Abstract

Law Number 12 of 2022 concerning Crimes of Sexual Violence has become an important milestone in law enforcement efforts against sexual crimes, including electronic-based sexual violence. This research will discuss the legis ratio for regulating electronic-based sexual violence crimes and then discuss the harmonization of provisions for electronic-based sexual violence crimes after the enactment of Law Number 12 of 2022 concerning Sexual Violence Crimes. The research method used is normative, using a statutory approach, conceptual approach and case approach. The results of the research conclude, firstly, that the main basis for the provision of electronic-based sexual violence crimes is based on the 1945 Constitution which guarantees the protection of the rights of every citizen from all acts of violence. Second, before the legalization and enactment of Law Number 12 of 2022 concerning Criminal Acts of Sexual Violence (UU TPKS), the legal provisions regarding sexual violence were spread across various laws and regulations. However, there are no provisions that explicitly mention electronic-based sexual violence. So that it becomes dynamic in law enforcement.

Abstract

The reform of criminal law in Indonesia through Law Number 1 of 2023 concerning the National Criminal Code represents a significant transformation in the orientation of the national sentencing system. Historically, Indonesia’s criminal justice framework has largely been influenced by a retributive paradigm, where punishment is primarily viewed as retaliation for criminal acts committed by offenders. However, the development of modern criminal law thought has encouraged the adoption of a more comprehensive approach that emphasizes humanitarian values. In this context, the National Criminal Code introduces a new paradigm that incorporates humanistic and restorative principles, while emphasizing social recovery. This approach does not merely focus on imposing sanctions on offenders, but also seeks to repair the social relationships disrupted by crime, ensure adequate protection for victims, and support the rehabilitation and social reintegration of offenders. This study aims to examine the reorientation of sentencing objectives under the National Criminal Code and to analyze how a humanistic approach is integrated into Indonesia’s criminal law framework. The research employs a normative juridical method, utilizing statutory and conceptual approaches. The analysis is conducted through an examination of the provisions contained in the National Criminal Code as well as relevant criminal law literature. The findings indicate that the National Criminal Code establishes a new direction for the Indonesian sentencing system by emphasizing a balance between public protection, victim restoration, and offender rehabilitation. Consequently, punishment is no longer solely perceived as a mechanism of retaliation, but rather as a legal instrument aimed at achieving substantive justice, maintaining social order, and promoting a more humane and equitable criminal justice system.

Abstract

Dalam Undang-Undang Dasar Negara Republik Indonesia Tahun 1945, hak atas kesehatan adalah salah satu hak asasi manusia yang paling penting. Hak kesehatan setiap warga negara harus dipenuhi tanpa diskriminasi, menurut pengakuan tersebut. Pembentukan peraturan bukan satu-satunya cara untuk memenuhi hak-hak ini implementasi kebijakan publik yang berorientasi pada pemerataan akses, peningkatan kualitas layanan, serta keberlanjutan sistem kesehatan nasional. Tujuan dari penelitian ini adalah untuk memeriksa peran negara dalam melindungi hak atas kesehatan sebagai hak konstitusional warga negara, dengan memberikan penekanan khusus pada jenis tanggung jawab negara dan berbagai masalah yang muncul dalam menjalankan hak tersebut. Metode penelitian yang digunakan adalah yuridis normatif, menggunakan pendekatan perundang-undangan dan konseptual. Data dikumpulkan melalui penelitian kepustakaan yang mencakup bahan hukum primer, sekunder, dan tersier. Kemudian data dievaluasi secara kualitatif untuk memahami hubungan antara norma hukum dan praktik pelaksanaannya. Hasil penelitian menunjukkan bahwa Indonesia memiliki kerangka hukum yang cukup secara normative komprehensif dalam menjamin hak atas kesehatan. Namun, dalam praktiknya masih terdapat berbagai hambatan, seperti ketimpangan distribusi fasilitas kesehatan, keterbatasan tenaga medis, serta persoalan pembiayaan dalam sistem jaminan kesehatan nasional. Dengan demikian, diperlukan penguatan peran negara melalui kebijakan yang lebih responsif, peningkatan alokasi anggaran, serta pengawasan yang efektif guna memastikan terpenuhinya hak kesehatan yang merata dan adil bagi semua orang

Abstract

The social assistance program (Bansos) has become the main instrument in the government's performance to alleviate poverty and ensure community welfare. However, the phenomenon of misuse of social assistance for political purposes, especially in the context of general election campaigns (Pemilu), is an issue that raises serious concerns in realizing the principles of justice, transparency, and accountability in realizing elections that are "Luber Jurdil" (Direct, Public, Secret, Honest, and Fair). The purpose of this paper is to identify and examine carefully and thoroughly the normative problems related to the misuse of social assistance programs for campaign purposes during the general election. This research uses a normative analysis method by referring to various legal sources, regulations, and related literature. To deal with this issue, this article adress several policy recommendations, including strengthening legislative material regarding supervision and accountability, increasing the capacity of related institutions, as well as increasing awareness of law and political ethics among the public and political actors. So the misuse of social assistance programs for campaign purposes during general elections is a complex problem and requires comprehensive and sustainable action from various related parties to build transparent, clean, and accountable public governance.

Abstract

Penyebaran hoaks dan ujaran kebencian di dunia maya telah menjadi masalah sosial yang mengancam stabilitas sosial dan politik, serta melanggar hak-hak individu. Meskipun Indonesia telah memiliki berbagai peraturan hukum seperti UU ITE dan KUHP untuk menangani masalah ini, penerapannya masih menghadapi berbagai tantangan, termasuk ambiguitas regulasi, kesulitan dalam penegakan hukum, serta keterbatasan dalam mengidentifikasi pelaku yang anonim. Selain itu, meskipun media sosial dapat berperan dalam mencegah penyebaran hoaks dan ujaran kebencian melalui kebijakan moderasi konten dan peningkatan literasi digital, peran platform digital dalam mencegah konten berbahaya sering kali dirasa kurang maksimal. Penelitian ini mengemukakan bahwa untuk mengatasi permasalahan ini diperlukan pendekatan yang holistik, yang mencakup penguatan regulasi, penegakan hukum yang lebih konsisten, serta kerjasama yang lebih erat antara pemerintah, platform media sosial, dan masyarakat. Dalam rangka menciptakan ruang digital yang lebih aman, regulasi yang jelas dan literasi digital yang lebih baik harus menjadi bagian dari solusi jangka panjang untuk menanggulangi hoaks dan ujaran kebencian di media sosial.

Abstract

Kepemilikan tanah absentee (tanah yang dimiliki oleh individu namun tidak dikelola atau dihuni) menjadi masalah yang signifikan dalam pengelolaan sumber daya alam, terutama tanah di Indonesia. Meskipun tanah memiliki peran penting dalam pembangunan ekonomi dan sosial, kepemilikan tanah absentee sering kali menimbulkan masalah sosial, ekonomi, dan hukum. Artikel ini membahas perspektif hukum pidana terhadap kepemilikan tanah absentee serta perlindungan hukum yang diberikan oleh negara untuk mengurangi ketimpangan sosial dan ekonomi. Negara, melalui kebijakan dan regulasi yang ada, berperan dalam melindungi hak atas tanah bagi masyarakat dan memastikan pemanfaatan tanah dilakukan secara produktif demi kepentingan bersama.

Abstract

This article examines the legal implications that healthcare professionals may encounter when they overstep their authorized scope in delivering medical services. Such occurrences are relatively common in Indonesia’s healthcare system, where doctors, nurses, and other medical personnel often act beyond their prescribed authority. Various factors, including lack of awareness, insufficient training, and the pressure to complete tasks quickly, may contribute to these actions. The purpose of this paper is to analyze the legal repercussions for healthcare professionals who exceed their authority and to provide a deeper understanding of the regulations governing the professional authority of healthcare providers in Indonesia. It is hoped that this article will offer valuable insights and enhance healthcare professionals’ understanding of the importance of adhering to legal guidelines in medical practice.

Abstract

Corruption within the corporate sector, particularly in state-owned enterprises, has emerged as a significant concern in the Indonesian legal system. A notable example of this is the corruption scandal at PT. Timah, a state-owned entity in the tin mining industry. This case uncovered instances of authority misuse and budget manipulation by individuals within the company, resulting in harm to both the state and the public. The Law on Corruption Crimes serves as the primary legal framework to address such criminal activities. This article seeks to explore the implementation of this law in the case of PT. Timah and provide insights into the challenges that law enforcement may face in tackling similar cases in the future.

Abstract

The misuse of authority by law enforcement officers in handling public demonstrations remains a recurring issue within Indonesia’s legal enforcement practices. Such incidents are frequently manifested through arbitrary arrests, excessive use of force, and the criminalization of peaceful protesters. In fact, the right to express opinions publicly is explicitly guaranteed under the 1945 Constitution and Law No. 9 of 1998. Repressive actions of this nature not only constitute legal violations but also erode public trust in the police institution. From a criminal law perspective, officers who exceed their authority may be held accountable under provisions of the Indonesian Penal Code, such as Article 170 or 351 on acts of violence, as well as through internal disciplinary sanctions. This study employs both normative and empirical approaches, examining recent cases including the May Day 2025 demonstrations and the Kanjuruhan tragedy to highlight weaknesses in oversight mechanisms, both internal and external. Findings indicate that a culture of impunity persists, allowing officers to often escape criminal liability despite evidence of misconduct. Therefore, comprehensive reforms are urgently needed, including strengthening oversight systems, ensuring consistent law enforcement, and fostering cultural transformation within the police force to ensure accountability and justice are genuinely upheld.
