Abstract

Pembagian harta warisan sering menjadi sumber sengketa dalam keluarga, terutama karena ketidaktahuan mengenai ketentuan hukum yang berlaku. Di Indonesia, hukum yang mengatur pembagian warisan terdapat dalam Kitab Undang-Undang Hukum Perdata (KUHPerdata) Pasal 830-1130 dan Undang-Undang No. 3 Tahun 2006 yang mengatur pembagian warisan dalam konteks hukum waris Islam. Masalah hukum waris ini sering kali menimbulkan konflik berkelanjutan yang melibatkan berbagai pihak, mulai dari pejabat daerah, notaris, hingga pengadilan. Oleh karena itu, penting untuk memberikan pemahaman yang benar kepada masyarakat mengenai pembagian harta warisan yang sesuai dengan ketentuan hukum. Kegiatan penyuluhan hukum waris di Kelurahan Wonorejo ini bertujuan untuk meningkatkan pemahaman masyarakat tentang pembagian harta warisan yang sah, baik menurut KUHPerdata maupun hukum waris Islam. Dengan adanya sosialisasi ini, diharapkan masyarakat tidak lagi bingung atau buta hukum terkait pembagian warisan, serta dapat menyelesaikan sengketa warisan melalui musyawarah kekeluargaan sebelum melibatkan jalur hukum formal.

Abstract

The position of the Vice President in the Indonesian constitutional system is an important element in the presidential government. Although regulated in the 1945 Constitution, the role and function of the Vice President are often unclear, which can create ambiguity in the implementation of daily tasks. This study aims to analyze the functions and authorities of the Vice President, especially when the President is absent. As part of the executive, the Vice President is not only tasked with accompanying the President, but also has the responsibility in decision-making. However, although it has been regulated in the 1945 Constitution, the role and function of the Vice President are often unclear. So from this study there is one formulation of the problem, namely, what are the functions and authorities carried out by the vice president when the president is absent from carrying out his duties. This study uses a normative research method by seeking materials from various sources such as laws and regulations, books, and journals to examine the legal position of the Vice President and its implications in the implementation of the presidential system. So the results of this study indicate that the Vice President has a role in accompanying the President, coordinating policies between ministries, handling strategic issues, and representing the country in international forums.

Abstract

Domestic Workers (PRT) in Indonesia have a major contribution in supporting the sustainability of the economy and social life of the community. However, their existence is often ignored in legal regulations that should provide proper protection and recognition. The absence of specific laws governing the rights and obligations of domestic workers creates significant legal loopholes, so that many domestic workers face the risk of exploitation, discrimination, and even violence. This study aims to examine the urgency of legal regulations for domestic workers, with a focus on analyzing the weaknesses of current regulations and recommendations for the formation of more inclusive and fair policies. So that in this study there is a formulation of problem one, namely How is the legal regulation on Domestic Workers, and the formulation of problem two How is the legal protection for Domestic Workers. So to what extent are existing legal regulations able to protect domestic workers and what steps need to be taken to improve this protection. This study uses a normative legal method, with a legislative and conceptual approach. The data used includes primary legal materials, such as applicable laws, and secondary legal materials in the form of related literature, which are analyzed qualitatively to gain an in-depth understanding. The results of the study show that legal protection for domestic workers is very minimal. Domestic workers are not recognized as formal workers, so they do not receive basic rights such as minimum wages, decent working hours, and access to social security.

Abstract

Mass media in Indonesia plays a significant role in disseminating information and influencing society. Information can spread widely to various corners of the world and be accessed by millions of readers simultaneously. Journalists are prohibited from carrying out actions that harm other people, spreading false news or slander, or taking sides with the intention of inciting. Legal protection for victims of defamation is necessary to maintain a balance between press freedom and individual rights. The problem in this research is how is the legal protection for victims of defamation committed by journalists? This type of research is normative research with a statutory approach and a conceptual approach. The technique for collecting legal materials is carried out through searching and collecting legal materials, researching legal issues, as well as case studies from statutory regulations, legal journals, literature books, news and other materials relevant to the research topic. The results of this research show changes in the rules for defamation by journalists in the old and new Criminal Codes, reflecting a firmer response to the challenges of the digital era and the protection of individual rights. Article 310 of the old Criminal Code provides light sanctions while Article 433 of the 2022 RKUHP provides heavier sanctions and detailed regulations. The main focus is legal protection for victims in the era of social media with the Indonesian Journalist Code of Ethics (KEWI) as a guide. The importance of the Press Law as a lex specialis ensures a balance between press freedom and the protection of individuals who are disadvantaged.

Abstract

Inclusive education has become a fundamental principle within the Indonesian education system as an effort to ensure equal rights for all children, including those with special needs. However, the implementation of inclusive education policies at the regional level, particularly in Jombang Regency, reveals a gap between normative discourse and the reality of practice on the ground. The Jombang Regent Regulation No. 39 of 2014 serves as the legal basis for the implementation of inclusive education; however, its application does not fully reflect the principle of substantive justice for children with special needs. This study aims to critique the policy using philosophical and normative approaches to analyze the role of the state as the organizer of inclusive education. The methodology employed is a qualitative approach with textual analysis of legislation and observation of policy implementation in inclusive schools in Jombang. The research findings indicate that although inclusive education policies are legally and formally regulated, many deficiencies persist in practice, such as the lack of support teachers, unprepared curricula, and insufficient funding. These findings reflect the state's failure to uphold the principles of social justice and human rights for children with special needs. Inclusive education should be understood as an integral part of the state's obligation to achieve substantive justice, rather than merely an administrative requirement.

Abstract

Abstract: The presidential threshold is the nomination requirement employed by political parties to select the President and Vice President. In Indonesia, the regulation governing the presidential threshold is outlined in Article 222 of Law No. 7/2017 on General Elections. This article stipulates that candidate pairs must be proposed by political parties or a coalition of political parties participating in the elections, provided they meet the criteria of obtaining at least 20% of the total seats in the DPR (The House of Representatives of the Republic of Indonesia) or obtaining 25% of the national valid votes in the previous DPR elections Purpose: This study aims to determine the political dynamics of threshold presidential regulation law in Indonesia. Design/Methodology/Approach: The type used in this research is normative legal research, and uses several approaches, namely the statute approach, conceptual approach, and historical approach. Findings: In principle, the regulation of the presidential threshold is an open legal policy or open legal policy of the legislator, but its application in Indonesia, the presidential threshold has shortcomings because first, it makes legislative elections a prerequisite for the presidential election, and second, the legislative elections that are used as requirements have occurred in the previous election period, which in terms of political configuration is certainly different from the elections that will take place or are taking place. The application of the presidential threshold in Indonesia is also inappropriate because 1) it eliminates independent Presidential candidates; 2) it excludes the participation of non-parliamentary political parties to determine their own Presidential candidates; 3) it only benefits established/large political parties; 4) it is not suitable if applied in a presidential system, because the President in this system is not responsible to parliament; 5) the emergence of transaction politics; and 6) the limited number of choices of Presidential candidates offered. Originality/Value: There has not been much research on presidential threshold arrangements in their formation, especially based on the political dynamics of law that developed during the formation process

Abstract

 Road crossing services, also known as "Pak Ogah or Cepek Police" are people who regulate traffic unofficially in return for modest money who do not have a permanent job and consider it an opportunity that can be exploited and make money in exchange for traffic control services. Some people consider the actions of road users to cross the road, some feel very helpful. This study aims to analyze crossing services in the perspective of traffic law no. 22 of 2009 concerning road traffic and transportation. The type of research used is normative by using the statutory approach, the conceptual approach. The results of this study obtained that the existence of crossing services is not regulated in Law no. 22 of 2009 concerning Road Traffic and Transportation. Basically, any person or group of people who do not have the authority are prohibited from controlling traffic at crossroads, bends or roundabouts with the intention of getting compensation for services.[2] This traffic control activity is carried out by individuals or an organized group of people with the intention of obtaining monetary rewards. Positive law in Indonesia itself has regulated what victims are entitled to when a Traffic Accident occurs in general as stated in Article 240 of Law Number 22 of 2009 concerning Road Traffic and Transportation.

Abstract

The enactment of Law Number 6 of 2014 concerning Villages has had a significant influence, especially on the preparation of development funds and activities for villages from the government. So village heads and village officials are required to build a good system, from planning, implementation and supervision. The Village Consultative Body (BPD), which consists of several elements and village figures, is expected to be able to carry out its function as a carrier of community aspirations regarding the running of village government, monitoring development and empowering the community. This article is the result of a literature and empirical study of the role of BPD in Bareng District, Jombang Regency, in order to determine the role of BPD in carrying out its functions, along with the increasing transfer of funds from the central government to the regions which also influences the increase in funds received to villages. For this reason, BPD has a strategic position. As supervisor of the running of Village government including village development. The BPD and the Village Head must work together without having to argue. Therefore, this research focuses on how BPD carries out its role in supervising the running of government and village development, including the use of village finances. As well as the relationship between the BPD and the village head. Apart from that, it also explains what factors can support optimizing the role of BPD, including absorbing community aspirations. The synergy between the BPD and the Village Head as well as the BPD's ability to build aspirational communication with the community are important factors in the success of the BPD in carrying out its duties and functions

Abstract

Rangkap jabatan menteri menjadi isu penting dalam penyelenggaraan pemerintahan Indonesia, terutama setelah diberlakukannya Undang-Undang (UU) No. 39 Tahun 2008 terkait Kementerian Negara beserta perubahannya. Meskipun Pasal 23 UU tersebut telah mengatur larangan untuk menteri mendobel jabatan selaku pejabat negara lain, komisaris perusahaan, maupun pimpinan instansi yang memperoleh dana APBN atau APBD, ketentuan ini belum secara tegas mencakup jabatan di partai politik. Kondisi ini menimbulkan multitafsir dan membuka peluang terjadinya konflik kepentingan, penyalahgunaan wewenang, serta melemahnya prinsip tata kelola pemerintahan yang baik. Padahal, partai politik secara normatif juga menerima pendanaan negara, sehingga secara substansi memiliki keterkaitan dengan larangan rangkap jabatan. Situasi ini memperlihatkan adanya kekaburan norma yang perlu dikaji lebih jauh untuk menjamin kepastian hukum dan menjaga integritas penyelenggara negara. Metode yang dipergunakan ialah penelitian hukum normatif melalui pendekatan peraturan perundang-undangan, asas hukum, dan doktrin dengan menelaah UU No. 39 Tahun 2008, serta ketentuan pendanaan partai politik dalam UU No. 2 Tahun 2011. Hasil penelitian menunjukkan bahwasanya Pasal 23 UU No. 39 Tahun 2008 belum DENGAN tegas memberi larangan pada menteri dalam hal mendobel merangkap jabatan dalam partai politik meskipun partai politik memperoleh dukungan finansial negara, hingga menimbulkan kekaburan norma dan membuka ruang multitafsir. Kondisi ini berpotensi menimbulkan konflik kepentingan, penyalahgunaan kewenangan, serta melemahkan berbagai prinsip manajemen pemerintahan yang baik. Dengan begitu, diperlukan penguatan regulasi untuk memberikan kepastian hukum dan memastikan penerapan asas legalitas secara konsisten dalam penyelenggaraan pemerintahan

Abstract

Street photography is a form of artistic expression that captures social life spontaneously in public spaces. Behind its aesthetic and documentary value, this practice raises complex legal issues, particularly when it intersects with the boundary between the photographer’s freedom of expression and the individual privacy rights of the photographed subject. In the current legal framework, there are no specific regulations that clearly define the boundaries and legal responsibilities in the practice of street photography. Both photographers and the subjects they capture are placed in vulnerable positions: photographers risk criminalization on the grounds of privacy violations or defamation, while subjects who feel harmed lack a clear legal pathway to seek protection of their rights. This study examines the practice of street photography in Indonesia through a normative approach by analyzing the Criminal Code (KUHP), the Electronic Information and Transactions Law (UU ITE), and Law No. 27 of 2022 on Personal Data Protection (PDP Law), as well as connecting them to the principles of human rights as enshrined in the 1945 Constitution, the Universal Declaration of Human Rights (UDHR), and the International Covenant on Civil and Political Rights (ICCPR). The findings emphasize the need for the establishment of more specific regulations to create a balance between the rights of photographers and the rights of photographic subjects, thereby achieving legal certainty, justice, and the protection of human rights in the digital era.
