Abstract

This study aims to determine the legal protection given to cinema film copyright holders against uploading films through instastories without permission and to find out what efforts copyright holders can take regarding the uploading of cinema films without permission. The research method used is normative legal research method by using the method of statutory approach and conceptual approach. The results of this study indicate that preventive legal protection is carried out by fulfilling the rights of creators and copyright holders. Repressive legal protection in the Copyright Protection Act can be in the form of administrative sanctions, imprisonment and fines and additional criminal sanctions because the perpetrator commits the prohibition. Copyright legal protection is contained in the Copyright Law no. 28 of 2014, Law no. 11 of 2008 concerning ITE, and Law no. 33 of 2009 concerning Film. Then the efforts made by copyright holders regarding uploading without permission in the Copyright. The government protects copyrights and related rights in the world of information and communication technology (ICT). The government and judicial bodies carry out law enforcement. Copyright law enforcement is carried out by the government involving ministries. The legal remedies that copyright holders can take regarding uploading without permission have been regulated in the Copyright Act. Creators or copyright holders can take legal steps to obtain legal protection in the field of copyright, there are several legal steps that copyrights holders, including Mediation, criminal complaints, compensation lawsuits, content closure reports and Access Rights can take.

Abstract

The purpose of this research is to determine the legal protection for investors in digital investment activities in Indonesia, namely Law No. 8 of 1999 concerning Consumer Protection, Law No. 25 of 2007 concerning Capital Investment, Law No. 11 of 2008 concerning Information and Electronic Transactions (ITE), and BAPPETI Regulation No. 7 of 2022 concerning Determining the List of Crypto Assets That Can Be Traded. This research uses a type of empirical normative research. The study results and discussion of digital investment, such as cryptocurrency, create a legal relationship between investors and traders with rights and obligations regulated by CoFTRA regulations and the Currency Law. Investors have the right to clear information, benefits, and are obliged to understand risks and regulations. Traders are entitled to compensation and must provide information and protect investors' assets. The Investment Law and other rules protect investors, including the Consumer Protection Law and the Information and Electronic Transaction Law. This protection is essential to ensure investor safety from online investment risks, including illegal investments. The strategies to provide legal protection for investors are education, strengthening regulations and supervision, and implementing the precautionary principle. Law enforcement is also essential, including dispute resolution, criminal prosecution, and compensation. Firm and effective law enforcement can help prevent and eradicate illegal investment practices, protect, build trust and security, and encourage digital economic growth in Indonesia.

Abstract

Penelitian ini bertujuan untuk menganalisis bentuk tanggung jawab dari influencer bentuk tanggung jawab influencer terhadap endors produk palsu yang dilakukan serta perlindungan hukum bagi konsumen terhadap produk berbahaya yang dipromosikan oleh influencer. jenis penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan statute approach dan konseptual, sumber data dari data kepustakaan. Hasil penelitian yang didapatkan Seorang influencer atau endorser yang melakukan promosi dan membuat konten pengiklanan melalui social media, memiliki tanggung jawab berdasarkan UUPK, KUHPerdata, dan UU Kesehatan. Jika terjadi sengketa konsumen, maka konsumen bisa saja menggugat pihak-pihak yang terkait, dalam hal ini entah influencer ataupun pelaku usaha sebagai produsen produk. Jika influencer tersebut memang sudah menerapkan prinsip kehati-hatian (exercise due care) dalam mempromosikan suatu produk, maka dirinya tidak dapat dipersalahkan. sehingga tanggung jawab terkait substansi dan isi dari suatu produk jika menyalahi suatu peraturan merupakan tanggung jawab pihak Pengiklan selaku produsen produk dan/atau jasa tersebut. Bentuk perlindungan hukum terhadap konsumen di bagi menjadi dua yaitu secara Prenventif mencegah terjadinya pelanggaran) dan Reprensif (yang bersifat tahap akhir) Perlindungan hukum terhadap konsumen dalam jual beli online telah cukup memadai untuk memberikan jaminan terhadap para konsumen agar hak-haknya tidak dilanggar oleh pihak pelaku usaha.
