Abstract

The dynamics of early divorce become a social problem that has an effect on the destruction of the family life level. This phenomenon requires empowerment from various elements, especially in the field of family counseling, so that married couples can live happily in building a sakinah mawah family. The purpose of this service is to build psychological resilience for young couples through ABS-SBK-based counseling. The approach uses participatory action research, with a research process that is carried out in a systematic, collaborative and sustainable manner for social transformation. The service background is in Lintau Buo, Tanah Datar Regency, with the target being young couples. The result of this dedication is the change in the perspective of young couples about the purpose and nature of marriage, the emergence of an increase in psychological resilience in responding to the problems of domestic life. It is recommended to the local government, especially in Tanah Datar, to oblige couples to attend premarital counseling before marriage.Dinamika perceraian dini menjadi persoalan social yang berefek pada rusaknya tataran kehidupan keluarga. Fenomena ini membutuhkan suatu pemberdayaan dari berbagai elemen khususnya bidang konseling keluarga, agar pasangan yang menikah dapat hidup bahagia dalam membangun keluarga sakinah mawah. Tujuan pengabdian ini, membangun ketahanan psikologis pasangan muda melalui konseling berbasis ABS-SBK. Pendekatan yang digunakan participatory action research, dengan proses riset dilaksanakan secara sistematis, kolaboratif, dan berkelanjutan untuk transformasi sosial. Adapun latar pengabdian di Lintau Buo Kabupaten Tanah Datar dengan target pengabdian adalah pasangan muda. Hasil pengabdian terjadinya perubahan cara pandang para pasangan muda tentang tujuan dan hakikat pernikahan, munculnya peningkatan ketahan psikologis dalam merespon persoalan kehidupan berumah tangga. Direkomendasikan kepada pemerintahan daerah khususnya di Tanah Datar untuk mewajibkan para pasangan mengikuti konseling pranikah sebelum dilakukan pernikahan.

Abstract

The research objective of this paper is to examine the impact of murabahah financing and entrepreneurial spirit on the income of Baitul Mal wa Tamwil El-Muhsin customers. This quantitative study comprises two independent variables and one dependent variable. There are 1,085 customers in the population. The Cochran formula was employed to implement stratified random sampling. A total of 196 customers were chosen as samples. The data collection technique employs a questionnaire, while the data analysis technique on the impact of financing and entrepreneurial spirit on customer income employs path analysis. The F test results indicated that the entrepreneurs of BMT el-Muhsin Hall have a substantial impact on their souls, with a F count of 17,664. Despite the fact that the coefficient of the financing route has a significant partial influence on the soul of entrepreneurs at BMT el-muhsin Hall (T count = 4,203), the hypothesis is acceptable. Structural analysis 2 demonstrated that the revenue of BMT el-Muhsin Hall customers was significantly impacted by the financing of mortgages and the spirit of entrepreneurship, with a value of 73.10%. Although the analysis of the murabahah financing route has a partial influence of 69.00% on the soul of entrepreneurs and the coefficient of the spirit of enterprises has a significant influence on the income of the entrepreneur of 11.30%, thus, the hypothesis is accepted.

Abstract

This paper aims to elaborate the concept of baliqh from the perspective of fiqh and Positive Law in Indonesia as the fuqaha's opinion about baligh and adult in Law no. 16 of 2019 concerning Amendments to Law No. 1 of 1974 concerning Marriage, Law No. 24 of 2013 concerning Population Administration and Law No. 35 of 2014 concerning Child Protection. The research method used is a literature study by tracking, comparing and analyzing doctrinal normative law through a qualitative approach in content analysis about baligh and adulthood. The results of the research revealed that baligh in fiqh with the rusyd benchmark when referring to the signs of puberty, namely ihtilam (wet dreams for men), menstruation (for women), hair growth around the pubic and age ranges from 15 to 19 years. Whereas, in the Indonesian Positive Law, adults are classified based on interests, namely adults for marriage age limit of 19 years for men and women, adults to have population administration (KTP), driver's license and have political rights at the age of 17 years. To determine the limit of children, notary position and citizenship age 18 years while income tax, free from guardianship and recognized as labor at the age of 21 years. The determination of the limits of puberty and adulthood is included in the category of mashlahah 'ammah, namely the general benefit that concerns the interests of many people.

Abstract

This article discusses the judge's decision in rejecting the application for marriage dispensation which had been submitted and registered at the Registrar's Office of the Painan Religious Court with Number: 68/Pdt.P/2021/PA.Pn, that the Petitioner intended to carry out the marriage of the Petitioner's 18-year-old biological child with a 46-year-old man. The researcher uses the Library Research (library) research method. The researcher describes a structured research procedure, namely the research approach. Because what is being studied is written text in the form of a corpus (data used as a source of research material). The research information that becomes primary data is the decision of the judge of the Painan religious court, while the secondary data is data obtained from written sources, library materials including statutory regulations, scientific literature, books and articles. , and journals. The results of the research can be concluded that the judge's decision can be correct because the judge adheres firmly to educational, and psychological aspects, as well as the potential for disputes in the household that will be fostered for children. In Islamic law, it is permitted by fiqh law and the values ​​aimed at implementing sharia.

Abstract

Legal certainty must be present in a law or regulation. Without legal certainty, the rights of legal subjects will be violated and neglected. Similarly, without legal certainty, legal subjects will feel anxious and insecure because they feel that the law does not protect them. Law Number 16 of 2019 concerning Amendments to Law Law No. 1 of 1974 is considered to lack legal certainty and clarity, as the determination of the marriage age limit in that law is based solely on Law No. 35 of 2014 on Amendments to Law No. 23 of 2002 on Child Protection. This type of research is library research. Library research is a series of activities related to the methods of collecting library data, reading and recording, and processing research materials. Law No. 16 of 2019 still allows Indonesian society to engage in child marriage under the legal age. This law must be considered from various legal perspectives and have clear legal consequences, so a comprehensive revision of this law is necessary. Even if possible, Law No. 1 of 1974 should be reviewed and adjusted to the legal issues that exist now and in the future. By applying the concept of public interest and rejecting harm in a law or regulation, the objectives of that law or regulation will be achieved and become effective.

Abstract

This research aims to analyze the law of providing family support from income from raising fighting cocks from Saddu Az-Zari'ah's perspective. This research uses a qualitative method with a descriptive approach and an empirical juridical legal approach. Data collection techniques include observation, interviews, and documentation. The results of the research can be concluded that the law regarding family support from income from raising fighting cocks in Saddu Az-Zari'ah's view is considered haram. Because, includes bad actions that lead people to immoral acts, as stated in the provisions of Saddu Az-Zari'ah to determine the legal means (means) that prohibit it. If the result of an action brings benefit as taught by the Shari'a, then this method is permissible, and conversely, if the result of an action is detrimental, even though the aim is for good (supporting the family) then it is considered haram.

Abstract

The increasing number of couples experiencing broken homes is caused by various factors, and researchers have observed numerous impacts, particularly on children. One of the most significant consequences of parental divorce is the child’s mental health, which often leads to psychological trauma and hinders personal development. This study focuses on how children's mental health in broken home families is viewed through the lens of Law No. 23 of 2002. Employing a qualitative descriptive method, the research was conducted in Kampung Sungai Liku Pelangai, West Sumatra, Indonesia. Data collection tools included observation, interviews, and documentation. Primary data sources were children who had experienced parental divorce, while secondary sources included community leaders, divorced couples, theses, journals, and books. The findings reveal that the disruption of children's mental health in broken home families in Kampung Sungai Liku Pelangai is caused by several factors: lack of openness between spouses, insufficient attention, domestic violence, infidelity, frequent exposure to inappropriate behavior during parental conflicts, and misalignment of visions and goals in the household. Furthermore, from the perspective of Law No. 23 of 2002, children's mental health issues resulting from broken homes are recognized as traumatic, affecting both psychological well-being and personal growth. To protect children in such cases, the law outlines parental responsibilities post-divorce and legal safeguards for children's mental health, as stated in Articles 13, 77, and 78 of Law No. 23 of 2002 on Child Protection.
