Abstract

Penelitian ini bertujuan untuk mengkaji penentuan titik singgung antara hukum perdata dan hukum pidana dalam penggelapan dana investor dalam pelaksanaan perjanjian investasi dan tolok ukur penentuan penjatuhan putusan lepas dari segala tuntutan hukum oleh Hakim dalam putusan perkara pidana, serta menganalisis tolok Hakim ukur menjatuhkan hukuman lepas dari segala sesuatu tuntutan hukum dalam tindak pidana penggelapan dana investasi dalam hukuman Nomor 1073/Pid.B/2020/PN.Jkt.Tim. Artikel ini merupakan hasil penelitian hukum normatif, menggunakan pendekatan peraturan perundang-undangan, kasus dan konsep, menggunakan data sekunder, dengan analisis data kualitatif. Hasil penelitian penempatan pertama penentuan titik singgung antara hukum perdata dan hukum pidana dalam sistem hukum di Indonesia adalah ada atau tidaknya itikad baik dalam pelaksanaan hubungan hukum kontraktual tersebut, sehingga dapat dikecualikan antara tindak pidana penggelapan sebagai ranah hukum pidana dengan wanprestasi dengan itikad baik sebagai ranah hukum perdata, kedua tolok ukur penjatuhan putusan lepas dari segala tuntutan hukum oleh Hakim adalah perbuatan yang didakwakan terbukti, akan tetapi perbuatan tersebut bukan merupakan tindak pidana penggelapan, melainkan wanprestasi dalam pelaksanaan hubungan hukum kontraktual dengan itikad baik. Tolok ukur Ketiga Hakim menjatuhkan hukuman lepas dari segala tuntutan hukum dalam tindak pidana penggelapan dana investasi dalam hukuman Nomor 1073/Pid.B/2020/PN.Jkt.Tim adalah perbuatan yang didakwakan tidak merupakan tindak pidana penggelapan, melainkan wanprestasi, karena adanya itikad baik Terdakwa dalam pelaksanaan perjanjian tersebut dengan mengembalikan uang hasil investasi kepada korban.

Abstract

Society 5.0 was initiated by Japan, and inaugurated on January 21, 2019, made as a resolution to the Industrial Revolution 4.0, using modern-based science (Artificial Intelligence, Robots, Internet of Things) for human needs with the aim that humans can live comfortably, including in air transportation, initially focusing on human factors (pilots) began to shift the emphasis to the development of aviation technology. Therefore, it is interesting and necessary to examine how the readiness of laws and policies to build air transportation in the 5.0 era in Indonesia. This research is normative legal research using a statute approach, conceptual approach, and comparative approach and uses secondary data obtained from primary and secondary legal sources related to laws and policies to build air transportation in the 5.0 era in Indonesia. The results show that the existing laws and policies for building air transportation in the 5.0 era in Indonesia are not ready. It is necessary to harmonize and synchronize laws and regulations and policies to build air transportation in the 5.0 era in Indonesia with global regulations and policies in the form of international agreements related to air transportation development in the 5.0 era in the world.

Abstract

The transfer of land rights to purchase and sell land must be conducted under the supervision of an authorized official, commonly known as a Land Deed Official (PPAT) in this context. The authority to execute a legally binding land deed is vested in a Notary. Nevertheless, in this instance, notaries are prohibited from drafting deeds pertaining to land unless they have successfully completed the requisite examination to become a Land Deed Official (PPAT). Furthermore, deeds may be made by the subdistrict head, who acts as a temporary PPAT. The methodology employed by the author is normative legal research (doctrinal legal research). Normative legal research is a form of pure normative legal research, in which the problem under study is a legal scientific one, such as those pertaining to justice, order, and the agreement of will, among others. This research does not concern itself with the legal facts that exist in society. The findings of this research indicate that the role of a notary in the process of making a land sale and purchase deed is limited to the pre-sale of land or the making of an agreement between the seller and the buyer. It can be concluded that only a PPAT (land deed official) is authorized to prepare and execute a land sale and purchase deed.
