Abstract

Legal counselling is one of the effective methods to increase public legal awareness. Legal counselling through mass media, especially radio, is one of the strategic means to reach a wide audience. The legal education activity on corruption crimes held through Radio Maria Indonesia is part of a community service programme conducted by lecturers of the Law Study Programmes of Universitas Pelita Harapan (UPH) Medan Campus. This activity aims to provide a deep understanding to the public about the definition, form, and impact of corruption, as well as the steps to prevent it. Through a communicative approach and easy-to-understand language, this programme is expected to build collective awareness and encourage active participation of the community in supporting corruption eradication efforts. This study analyses the effectiveness of legal education through radio in shaping critical attitudes and more proactive public behaviour towards corruption issues. The results show that radio can be an efficient legal education tool, especially in areas with limited access to formal education or digital technology.

Abstract

Exploitation of natural resources has positive and negative impacts on human life, in this case this study aims to determine the legal responsibility for environmental pollution and damage due to the exploration of natural resources in Indonesia. The research method used is normative legal research, with an approach through laws and regulations that focus on legal products that regulate environmental pollution. The sources of legal materials to be used consist of primary legal materials, including the 1945 Constitution of the Republic of Indonesia; Law of the Republic of Indonesia Number 32 of 2009 concerning Environmental Protection and Management; Law Number. 6 of 2023 concerning Job Creation; Regulation of the Minister of Environment Number. 4 of 2021 concerning Environmental Impacts, and the Criminal Code (KUHP). While secondary legal materials come from literature studies, such as books relevant to the law and research results from legal experts and legal journals. The results achieved are that legal responsibility for environmental pollution and damage in Indonesia includes a comprehensive approach involving aspects of civil law, criminal law, and state administrative law. The government, through various regulations and law enforcement mechanisms, seeks to protect the environment by imposing sanctions and requiring polluters to undertake remediation.

Abstract

The purpose of this research is to find out and investigate the place and application of Pancasila in the life of society and the state in Indonesia. The formation of values, conventions, and legal systems that govern the life of the nation and state is highly dependent on Pancasila as the basis of the state. The research method used in scientific articles is a normative research method that uses a conceptual approach based on actual cases as well as an approach in norms as well as various legal regulations and real practices of people's lives. The diversity of ethnicities, religions, and customs form a diverse Indonesian society, which Pancasila wants to unite. The ideals of justice and unity, which uphold the principles of a just and civilized humanity, are the embodiment of Pancasila as the foundation of the state in daily life. However, there are various obstacles in the implementation of Pancasila in various fields, such as the social, political, and economic fields. Therefore, efforts are needed to remain sustainable in maintaining the relevance and implementation of Pancasila in the dynamics of the life of the nation and state of Indonesia.

Abstract

Abstract

Legal counselling is one of the effective methods to increase public legal awareness. Legal counselling through mass media, and community field counselling. The legal counselling activity on the Role of Suka Makmur Village Government in Preventing Drug Abuse was held through direct/face-to-face counselling to the people of Suka Makmur Village conducted by a team of lecturers from the Law Study Program of Universitas Pelita Harapan (UPH) Medan Campus. Drug abuse in Indonesia is a serious problem that threatens social stability and community welfare, especially in rural areas. The village government has an important role in preventing drug abuse through legal policies, local regulations, and collaboration with various parties through community-based programmes. This community counselling activity aims to find out the role of the Suka Makmur village government in preventing drug abuse and examine the legal basis that supports these efforts. Through a communicative approach and easy-to-understand language, this programme is expected to build collective awareness and encourage active community participation in supporting strict law enforcement efforts on drug crimes.

Abstract

People who work as wage earners from employers often face problems in employment relations due to differences in interpretation and implementation of employment agreements between employers and workers. The implementation of community service activities with the theme of companies and employment relations aims to provide education to workers regarding employment relations and the rights and obligations of workers on the one hand and employers on the other, and aims to ensure that workers know how to resolve employment disputes. The method used and implementing this community service activity is through counseling to the community (workers) using radio media with a 2 (two) way model, namely a resource person on the radio with listeners in another position, and the activity is carried out interactively directly. While the results obtained from this activity are the understanding of the community, especially workers, regarding the rights and obligations of workers on the one hand and the rights and obligations of employers on the other, as well as the steps and procedures for resolving employment disputes. In addition, the community also understands the role of the government and supervises employment relations.

Abstract

Tindak pidana terorisme merupakan ancaman serius terhadap kedaulatan negara, yang diperkuat oleh sistem pendanaan yang besar, terstruktur, dan sulit dilacak. Indonesia pernah mengalami dampak tragis aksi teror, seperti bom Bali 2002 dan 2005, saat regulasi terkait pendanaan terorisme belum memadai dan pengawasan masih lemah. Oleh karena itu, penguatan regulasi dan pengawasan terhadap aliran dana teror menjadi sangat penting untuk menjamin keamanan nasional. Penelitian ini menggunakan metode hukum normatif dengan kajian dokumen untuk menilai efektivitas regulasi dalam mencegah dan memberantas pendanaan terorisme serta kejahatan terorganisir.

Abstract

Perlindungan data pribadi merupakan aspek krusial dalam era digital yang ditandai oleh pesatnya pertukaran informasi melalui teknologi. Pemerintah indonesia telah mengesahkan regulasi yang mengatur perlindungan data pribadi, seperti undang-undang no. 27 tahun 2022, namun dalam implementasinya masih ditemukan berbagai kendala yang menghambat efektivitas perlindungan tersebut. Penelitian ini bertujuan untuk mengidentifikasi dan menganalisis kendala-kendala yang dihadapi dalam pelaksanaan perlindungan data pribadi, baik dari sisi regulasi, kelembagaan, teknis, maupun kesadaran masyarakat. Metode yang digunakan adalah pendekatan kualitatif dengan studi pustaka dan kajian liteartur sebagai teknik pengumpulan data. Hasil penelitian menunjukkan bahwa masih lemahnya infrastruktur pengawasan, ketidaksiapan pelaku usaha, serta minimnya literasi digital masyarakat menjadi hambatan utama dalam mewujudkan sistem perlindungan data pribadi yang efektif. Temuan ini diharapkan dapat menjadi masukan bagi para pemangku kebijakan, sektor swasta, dan masyarakat untuk meningkatkan komitmen dan koordinasi dalam penerapan perlindungan data pribadi. Diperlukan sinergi antara penegakan hukum, edukasi publik, dan penguatan kelembagaan agar pelaksanaan perlindungan data pribadi dapat berjalan optimal dan mampu menjamin hak privasi warga negara.

Abstract

Child exploitation within Child Social Welfare Institutions (Lembaga Kesejahteraan Sosial Anak or LKSA) remains a significant concern that undermines the fulfillment of children's fundamental rights, particularly in relation to access to education, health care, proper care, and protection. This study aims to examine the role of legal frameworks in preventing and addressing exploitative practices within LKSAs, focusing on the extent to which these institutions ensure the fulfillment of children's basic needs in accordance with national welfare standards. Employing a qualitative research design with a case study approach, the study was conducted in several LKSAs in Medan, North Sumatra. Data collection methods included in-depth interviews with key stakeholders, analysis of relevant legal and institutional documents, and direct field observations. The results show that there are still practices of child exploitation in several LKSA, including forced labor and misuse of foster child status for economic interests. Other important findings include weak supervision by government agencies, limited coordination between agencies, and a lack of understanding by LKSA managers of children's rights. On the other hand, the role of the police as law enforcers is considered reactive and not optimal in preventing and prosecuting cases of child exploitation in LKSA. The main obstacles faced by POLRI include limited resources, lack of specialized training, and the absence of strong synergy between the police and other child protection agencies. Hence, the research emphasizes that although the legal framework is in place through various laws and regulations, its implementation is still not effective.

Abstract

Access to justice is a basic right of every citizen as guaranteed in Article 28D paragraph (1) of the 1945 Constitution of the Republic of Indonesia. However, in practice, underprivileged community groups in rural areas still face various structural and cultural obstacles in obtaining legal aid services. Betimus Mbaru Village, located in Sibolangit District, Deli Serdang Regency, is one of the areas facing similar challenges, with a low level of legal literacy among the community and a minimal number of legal aid institutions operating actively in the area. This condition shows the importance of local-based initiatives to guarantee the constitutional rights of village residents, one of which is through the formation of Village Regulations (Perdes) on Legal Aid Services. This study aims to analyze the urgency, mechanisms, and impacts of the formation of Perdes that regulates legal aid services for underprivileged communities. The approach used in this study is a juridical-empirical approach, with qualitative methods. Data were obtained through literature studies, in-depth interviews with village officials, community leaders, and underprivileged residents, and participatory observation in the village deliberation process. The collected data were analyzed descriptively-analystically by referring to applicable legal principles, as well as the theory of social justice and community legal empowerment. This research is expected to provide practical contributions to village government in realizing inclusive governance and oriented towards human rights. In addition, this research can be an initial reference for other regions with similar social characteristics in developing local policies for legal aid services.
