Abstract

Penelitian ini bertujuan untuk menganalisa lebih dalam tentang dinamika pemikiran politik Islam di Tunisia yang di pelopori oleh Rached Ghannauchi sebagai pimpinan partai Ennahda, dimana perspektif politik yang ada saat itu lebih bersifat otoriter, sehingga membuat Rached Ghannauchi menawarkan sebuah inovasi baru tentang politik Islam yang lebih inklusif dan akomodatif, yang menjunjung tinggi demokrasi tanpa meninggalkan prinsip-prinsip keislaman dalam perpolitikan Islam. Penelitian ini menggunakan metode kualitatif yang berbentuk jenis penelitian keperpustakaan dengan pengumpulan data dari berbagai sumber buku, jurnal dan artikel ilmiah yang mempunyai relevansi dengan topik penelitian. Selanjutnya data-data temuan dianalisa secara deskriptif   yang mencakup analisis literatur tentang pemikiran politik Islam inklusif menurut Rached Ghannauchi sehingga dapat membantu pembaca untuk memahami bahwa politik Islam inklusif itu terintegrasi dengan prinsip-prinsip demokrasi modern. Hasil dari penelitian ini menjelaskan bahwa Islam dan modernisasi bukan suatu yang bertentangan melainkan dapat saling melengkapi untuk menciptakan politik yang inklusif. Ghannauchi menekatkan ijtihad dan juga menyoroti tentang bagaimana menghormati dan menyikapi dengan benar terhadap pluralitas yang terjadi pada masyarakat modern, untuk mencegah ekstremisme yang anti terhadap non islam, supaya terjadi stabilitas politik dan hamonisasi di masyarakat melalui politik Islam yang lebih akomodatif dan inklusif.Kata Kunci: Inklusif, Politik Islam, Rached Ghannauchi

Abstract

Islamic intelligence in Indonesia has experienced ups and downs, both politically and intellectually. The transformation of Indonesian Islamic Information Services, which were initially marginalized by intellectuals, politics, and bureaucracy in Indonesia, to a central position is one example of the long journey of Islamic Information Services in Indonesia. The emergence of Indonesian intellectuals at the end of the 19th century and the first two decades of the 20th century manifested in several names that continued to evolve, from the birth of figures to the emergence of Bangsawan Oesoel and Kaoem Muda. Kaoem, educated youth, or john. The emergence of the Secret Service was influenced by the ethical revolution in the Dutch East Indies due to the liberal economic crisis in the Dutch East Indies. Additionally, this period was marked by the entry of modernist Islamic reformism, which sought to balance the Western secularism trend. The 20th century witnessed various struggles for recognition and political authority. From the late 20th century to the early 21st century, many changes occurred in the economic and political systems, with successive government changes. This period was also marked by an economic crisis, signaling the beginning of the second economic era after the ethical reforms in the Dutch East Indies. Therefore, it can be said that active participation and power struggles took place among Indonesian Islamic intellectuals. Thus, the formation of Indonesia’s political and bureaucratic elite cannot always be separated from the development and changes in the map of Indonesia’s Islamic intelligence institutions. In fact, they have been at the core of Indonesia’s political elite, from the implementation of Dutch ethical policies to the post-reform regimes.

Abstract

This research examines the existence of Islamic Law and Customary Law in Indonesia's national legal system which reflects legal pluralism in a country with high cultural and religious diversity. The purpose of the research is to explore the role and integration of Islamic Law and Customary Law within the national legal framework, particularly in the context of the application of sharia principles and the recognition of customary law communities. This research utilizes a qualitative descriptive method with analysis of documents, legal literature, and relevant legislation, as well as a historical approach to understand theories of legal acceptance such as Receptie and Receptie in Complexu. The results of the analysis show that Islamic Law has gained significant legitimacy, especially through the Compilation of Islamic Law (KHI) which regulates family law and inheritance. Meanwhile, Customary Law is also recognized in Article 18B of the 1945 Constitution as an important part of the national legal system, although its implementation faces modernization challenges. This research finds that the interaction between these two legal systems produces not only challenges but also opportunities to build a national law that is adaptive and responsive to the needs of society. Thenovelty of this research lies in the comprehensive analysis of the dynamics of harmonization of Islamic Law and Customary Law amidst the social and political complexities in Indonesia. This research emphasizes the importance of an inclusive and contextual approach in building a just and sustainable legal system, which accommodates local religious and cultural values.

Abstract

This research aims to review the history of Islamic education in the 19th century in the fields of history, problems and contributions to civilization. To take positive values from the progress of Islamic education in the past and take ibrah/lessons from the factors that trigger the decline of Islamic education. Islamic education aims to form perfect humans, carry out religious teachings, create a generation that believes and is devoted to Allah SWT, does good deeds, has noble character, has knowledge and is able to compete with the progress of the times. This research uses a qualitative method, namely in-depth observation of the history of Islamic education in the 19th century, as well as revealing several figures who have succeeded in laying the foundations of Islamic civilization, in building the ummah, as well as the contributions that have been inherited in the world of education, such as: Muhammad Abdh, Rasyid Ridah, Jamaludin Al Afgani, Fathi al-Fawzan, as well as Indonesian national figures such as Syekh Ahmad Kahtib Al Minangkabawi, KH. Ahmad Dahlan, Hasyim al-'Asy'ari, Rahma El Yunusiyah and others. They were figures who contributed greatly to building Islamic civilization. Islamic education figures contributed to the development of Islam so that it was able to reach the peak of Islamic glory during the Abbasid dynasty as evidenced by the birth of famous Islamic figures such as Al Farabi, Ibnu Sina, Ibn Tufail and left a valuable legacy in science. The contribution of written works from Islamic figures becomes gold work and is very valuable as a reference in the world of education

Abstract

Islamic law is a legal system designed to meet the spiritual and social needs of Muslims. In this study, we will discuss the basis, sources, principles, scope and objectives of Islamic law which functions as a guide to Muslim life. This study aims to understand the role of Islamic law in creating a balance between the interests of individuals and society and achieving social justice. The basis of Islamic law relies on the Al-Qur'an and Hadith as the main sources, complemented by secondary sources such as ijma' (consensus of ulama) and qiyas (analogies) to answer various new problems that are not explicitly regulated in the sacred text. The principles of Islamic law, including the principles of justice, benefit, equality before the law, and individual responsibility, provide the ethical foundation for the just application of the law. The scope of Islamic law includes aspects of worship, muamalah, family law, criminal law, and international law, all of which aim to create a harmonious and just society. Meanwhile, the aim of Islamic law or maqashid al-syari'ah emphasizes the protection of religion, soul, mind, lineage and property, which reflects the primary interest in realizing the welfare of the people. Through a comprehensive understanding, this study hopes to provide in-depth insight into the importance of Islamic law in the context of contemporary life and its role in sustainable moral and social development.

Abstract

The transformation of Islamic justice in Indonesia reflects the dynamics between formal juridical norms and the socio-cultural realities of diverse societies. Religious Courts, as part of the national legal system, do not solely implement Islamic law in a normative form, but must also interact and negotiate with local values, social structures, and broader political and legal configurations. This research critically examines how the integration between Islamic legal norms and socio-cultural traditions occurs in judicial practice, as well as how these interactions affect the effectiveness and legitimacy of Islamic judicial institutions in Indonesia. The juridical-sociological approach is used to explore the relationship between legal norms and the context of society (living law), with an emphasis on aspects of social acceptance and substantive justice. The findings of the study show that although institutionally the Religious Courts have been strengthened, there is still tension between the spirit of codification of sharia law and the flexibility of local culture. In this context, the transformation of Islamic justice is not only a matter of legal reform, but also involves the repositioning of the role of religion, the state, and society in formulating and enforcing contextual justice. Thus, there is a need to strengthen an integrative paradigm in the reform of Islamic law that is able to bridge juridical norms with social reality, in order to strengthen the responsiveness and legitimacy of Islamic justice in the midst of the plurality of laws in Indonesia.

Abstract

This research aims to examine the work and thoughts of Tuan Guru Kyai Haji Muhammad Zainuddin Abdul Madjid in the context of Islamic education and his contribution to the nation's moral development through Nahdlatul Wathan. The method used is qualitative research with a library research model, where data is collected through literature searches on the Dimensions platform and Google Scholar. To analyse the themes and linkages in the previous discussion, the author used the VOSviewer application. The results show that, firstly, Tuan Guru is a functional elite figure in Islamic society who not only acts as a cleric, but also as a spiritual and social guide. Secondly, Nahdlatul Wathan educational institutions have characteristics as general education institutions based on Islamic values, with a focus on forming a generation of faith and piety, as reflected in the slogan ‘The main thing is NW, the main thing is NW Iman and Taqwa.’ Third, Tuan Guru's thoughts and struggles in establishing Nahdlatul Wathan reflect a great effort to form national cadres with Islamic character and national spirit, as stated in his monumental work Hizb Nahdlatul Wathan. Thus, the contribution of Tuan Guru KH. Muhammad Zainuddin Abdul Madjid through Nahdlatul Wathan is not only important in the field of education and religion, but also plays a major role in the moral and spiritual development of the Indonesian nation.

Abstract

Penelitian ini bertujuan untuk mengkaji secara mendalam Kompilasi Hukum Islam (KHI) sebagai produk kodifikasi hukum Islam yang berlaku di lingkungan Peradilan Agama di Indonesia. Dengan menggunakan pendekatan kualitatif deskriptif dan metode studi pustaka, penelitian ini memfokuskan pembahasan pada tiga indikator utama, yaitu: (1) makna dan sejarah lahirnya KHI, (2) landasan yuridis dan filosofis yang mendasarinya, serta (3) evaluasi kekuatan dan kelemahan KHI beserta implikasinya terhadap eksistensi lembaga peradilan Islam. Hasil penelitian menunjukkan bahwa KHI berperan penting dalam menyatukan berbagai pendapat fikih menjadi satu sistem hukum yang aplikatif, memberi kepastian hukum, serta menjadi rujukan resmi dalam penyelesaian perkara keagamaan seperti perkawinan, kewarisan, dan perwakafan. Namun demikian, KHI masih menghadapi tantangan serius, terutama terkait kedudukannya yang belum setara dengan undang-undang, keterbatasan ruang lingkup materi hukum, dominasi mazhab tertentu, serta belum optimal dalam menjawab dinamika sosial dan isu-isu hukum Islam kontemporer. Oleh karena itu, reformulasi KHI melalui jalur legislasi formal menjadi penting agar keberadaannya tidak hanya sebagai pedoman administratif, tetapi juga sebagai bagian integral dari sistem hukum nasional yang responsif, inklusif, dan berkeadilan.Kata Kunci: Kompilasi Hukum Islam, Peradilan Agama, Kodifikasi, Legislasi, Hukum Islam Kontemporer.
