Abstract

The Muslim community in Jayapura faces significant challenges in implementing Sharia-based economics, chiefly due to persistent social stigma surrounding halal products and limited public understanding of Islamic economic principles. This study explores how Fiqh al-Aqalliyyat a flexible jurisprudential framework can address these challenges within a multicultural society. Adopting a qualitative case study methodology, the research draws on interviews with 14 key local stakeholders, including government officials, religious leaders, and business owners. Data were gathered through purposive sampling and analyzed thematically to identify key barriers and viable solutions. The findings indicate that social stigma and inadequate infrastructure impede halal product promotion. Nevertheless, significant opportunities exist, including a growing demand for halal goods, government support for Sharia-compliant capital markets, and the active engagement of religious institutions. Abstract

This research aims to analyze the judge's considerations in granting dispensation for child marriage in the Religious Courts Class I.B Blora (the case number 153/Pdt.P/2019/PA.Bla). This research is qualitative using a normative approach. Data were obtained through a review of several case examination documents, books, articles, journals, and regulations related to the research topic. According to the prevailing regulation, the age limit for marriage for both men and women is 19 years. If the man and woman have not reached the specified age, the family is allowed to apply for a marriage dispensation to the Court. This study found that the judge's considerations in deciding the case were based on the concept of sadd al-zari'ah (closing the path of evil). This is because in the case submitted there is two conflicting badness. First, the badness of early marriage relates to the health condition of the prospective bride and groom, which includes the health of reproductive organs, pregnancy, the expected child, and the possibility of a break in the household. Second, the bad impact that arises if the dispensation application was rejected, the two prospective brides continue to be involved in adultery. Of the two bad impacts, adultery is far worse. Based on the sadd al-dzarî'ah, the judge, therefore, granted the dispensation request.

Abstract

Kemaslahatan sebagai inti dari Maqâshid al-Syarî‘ah, memiliki peranan penting dalam penentuan hukum Islam. Sebab hukum Islam diturunkan mempunyai tujuan untuk mewujudkan kemaslahatan umat baik di dunia maupun di akhirat. Dengan demikian sesungguhnya Maqashid al-Syarî‘ah memiliki hubungan yang sangat erat dengan metode istinbath hukum, dengan kata lain bahwa setiap metode istinbath hukum berdasar pada kemaslahatan. Adapun cara yang digunakan oleh para ulama dalam menggali kemaslahatan tersebut ada dua macam yakni; Pertama metode Ta’liîlî (metode analisis substantif) yang meliputi Qiyas dan Istihsân. Kedua metode Istishlâhî (Metode Analisis Kemaslahatan) yang meliputi Al-Mashahah al-Mursalah danal-Dharî’ah baik kategori sadd al-Dzarî’ah maupun fathal-Dzarî’ah.

Abstract

The implementation of the Regional Regulation with sharia nuances in the city of Tasikmalaya often causes polemics related to the relationship between religious norms and the principle of the state of law that upholds diversity. This study aims to analyze the form, motive, and impact of the Sharia Nuanced Regional Regulation in Tasikmalaya City in the framework of the contestation between Islamic law and the state. The method used is qualitative with a socio-legal approach, through field studies and document analysis, as well as interviews with key legislative actors and religious organizations. The results of the study show that the Regional Regulation reflects more transactional political strategies between local elites and religious groups, rather than purely the normative aspirations of the community. Its application tends to be symbolic and does not have a significant impact on improving the quality of life of the community at large. The implications of these findings underscore the importance of evaluating local legislation to be in line with the principles of non-discrimination, substantive democracy, and the protection of the civil rights of all citizens without exception.

Abstract

Interfaith marriages are a classic example of a legal question that has yet to be resolved. There are several points of contention in it, ranging from how to define the term scribes to their legal standing. The purpose of this paper is to describe how the fatwas of NU, MUI, and Muhammadiyyah reinterpret mixed marriages. A descriptive-analytical method with a qualitative approach is used in this investigation. The research data is collated and described for further analysis using existing ideas, after which conclusions are drawn. This analysis demonstrates that NU's qaulī technique, MUI's maṣlaha mursala method, and Muhammadiyyah's sadd al-żarī'a method all strongly establish that interfaith marriage is prohibited, regardless of its form.Perkawinan beda agama, merupakan persoalan klasik yang hingga saat ini belum disepakati status hukumnya. Di dalamnya terdapat perbedaan pendapat, mulai dari memaknai istilah ahli kitab hingga status hukumnya. Tulisan ini bertujuan untuk mendiskripsikan reinterpretasi tentang perkawinan beda agama yang termuat dalam fatwa-fatwa NU, MUI dan Muhammadiyyah. Penelitian ini menggunakan metode deskriptif-analitis dengan pendekatan kualitatif. Data yang diperoleh dari penelitian disusun serta dijelaskan untuk selanjutnya dianalisa berdasarkan teori yang ada kemudian ditarik kesimpulan. Penelitian ini menunjukan bahwa NU melalui metode qauli, MUI melalui maṣlahah mursalah dan Muhammadiyyah melalui metode sadd al-żari’ah dengan tegas menfatwakan bahwa apapun jenisnya, perkawinan beda agama dilarang oleh.

Abstract

This article aims to describe the views and arguments of NU scholars in responding to the concept of istibdâl waqf through the fatwas issued by Lajnah Bahtsul Masail (LBM-NU), and their relevance to Islamic law reform. The concept of istibdâl is basically one way that can be used by policy makers in managing waqf land so that it remains productive. However, the concept of istibdâl has not been fully accepted by scholars. In general, the responses of scholars regarding the concept of istibdâl can be grouped into two. The first group strictly prohibits istibdâl, and the second group allows istibdâl but with strict conditions. The difference is more due to the tendency of the principle that is the weight, namely the principle of eternity (ta’bid al-ashl) and the principle of expediency (tasbîl al-manfa’ah). This research is a normative legal research because it examines the legal provisions, arguments and arguments used. The approach used is a conceptual approach. Primary data sources are fatwa texts issued by NU scholars, while secondary data sources are scientific books, articles, journals, laws related to this research. This study shows that NU scholars allow the practice of istibdâl with agreed terms, namely the existence of disadvantages contained in the waqf object so that the waqf property is in an emergency condition that must be saved. The argument is that the concept of benefit is the spirit of maqâshid syari’ah (the purpose of syari’a), where the value of benefit in istibdâl practice is far greater than its harm. The concept of benefit which is the argument in the fatwa is in accordance with the spirit of reforming Islamic law.

Abstract

Perkawinan dibentuk untuk menciptakan keluarga yang bernuansa harmonis, bahagia dan sejahtera (sakînah mawaddah wa rahmah). Keluarga harmonis, bahagia dan sejahtera merupakan perkawinan yang mencerminkan terwujudnya al-ushûl al-khamsah atau maqâshid al-syarî‘ah. Sedangkan perkawinan beda agama (antar Muslim dengan non-Muslim yang mencakup Musyrik dan Ahl al-Kitâb), merupakan salah satu faktor munculnya berbagai konfik yang akan mengancam keharmonisan, kebahagiaan dan kesejahteraan rumah tangga. Di samping itu, perkawinan beda agama juga disinyalir akan mengancam praktek keagamaan (murtad) bagi salah satu kedua mempelai. Berdasarkan hal tersebut, Bahts al-Masâ’il memutuskan keharaman praktek perkawinan beda agama apapun bentuknya.

Abstract

Menjama’ Shalat Tanpa Halangan:Analisis Kualitas dan Kuantitas Sanad Hadits. Shalat merupakan bentuk ibadah badaniyah yang pelaksanaannya memiliki waktu yang sudah ditentukan. Meskipun demikian, tidak semua umat Muslim bisa melaksanakan sesuai dengan waktu yang telah ditentukan. Jamak merupakan solusi akan hal demikian. Jamak merupakan bentuk rukhshah (keringan) yang pelaksanaannya harus berdasarkan udzur yang diperbolehkan oleh syara’. Hadits riwayat Abu Daud No. 1025 dan juga Hadits-Hadits pendukung lainnya, kalau dipahami secara tekstual akan didapatkan kesimpulan kebolehan jamak shalat tanpa ada udzur syar’i, yang demikian akan bertentangan dengan QS. Al-Nisâ’ [3]: 103 yang menyatakan bahwa shalat merupakan bentuk kewajiban yang ditetapkan bagi orang-orang yang beriman yang waktunya telah ditentukan. Sehingga solusi yang paling tepat adalah Hadits yang secara tekstual bertentangan dengan ayat Al-Qur’an tersebut bisa dikompromikan (al-jam‘u wa al-tawfîq) dengan cara mentakwil Hadits tersebut kepada makna yang lebih sesuai atau sejalan dengan makna ayat Al-Qur’an (haml al-dzâhir ‘ala al-muhtamal al-marjûh).

Al-Quran and Hadith are sources and arguments in Islamic law whose existence has been agreed upon by the ulama. Abstract

Forms of domestic happiness have the value of materialism and idealism. Materialism can be interpreted as attached to products, wealth, and worldly objects. Meanwhile, the value of idealism emphasizes the importance of the superiority of the mind, soul or spirit rather than things that are material or material. The data of this study were collected through a literature study that outlined data based on the formulation of the problem How is happiness according to the concept of mathematicalism of Karl Marx and the sufistic al-Ghazali and its application of the Household? The result of the research is that Happiness according to Karl Marx is essentially created because of the material, namely in the form of property and economic establishment and social conditions, while according to al-Ghazali, namely by knowing oneself, then you will know Allah Almighty by having knowledge and charity, being sure, purifying the soul and, perfecting the soul. The implementation of Karl Max's concept of materialism towards household happiness, namely economic stability, is what can bring a happy household in other words, material is the source of happiness in the form of property. Meanwhile, according to al-Ghazali, happiness will be created in the household, when the household becomes a field of worship to be close to Allah.
