Abstract

This study examines the application of the shura principle, a concept of deliberation, as one of the key foundations in Islamic governance, within the context of Indonesia's national legislative system. Using a qualitative-descriptive approach, this study aims to analyze the extent to which shura values can be integrated into the process of forming democratic and just laws and regulations. Data were collected through literature studies of Islamic legal sources, legislative documents, and relevant previous research results. The study's results demonstrate that the principle of shura aligns significantly with the principles underlying the formation of national laws and regulations, including those of openness, public participation, and social justice. In addition, the integration of shura principles can strengthen moral and ethical legitimacy in the legislation process, so that it is expected to produce legal products that are more aspirational and in accordance with plural Indonesian values. These findings suggest the need to strengthen the deliberative mechanism at various stages of legislation, including formulation, discussion, and evaluation of laws and regulations, to achieve a more inclusive and interest-oriented legislative system.

Abstract

Abstract This article discusses the controversy surrounding the role of wali mujbir in cases of early marriage in Indonesia. Wali mujbir, as a guardian who has the authority to marry off girls without their consent, has become a topic of debate that links Islamic law with human rights, particularly children's rights. Despite having a strong foundation in classical fiqh texts, the application of wali mujbir in the modern era, especially in Indonesia, often comes into conflict with national laws that set marriage age limits. This article highlights how wali mujbir is often used to legitimize early marriage, especially in rural areas driven by social and economic factors, despite the negative impact this practice has on girls' physical, mental and social health. This research uses a qualitative method with a literature approach to analyze data from Islamic legal literature, academic studies, and reports related to the impact of early marriage. The findings show that the practice of wali mujbir in early marriage often leads to problems, including decreased access to education, increased risk of domestic violence, and reproductive health issues. In conclusion, although wali mujbir has a basis in Islamic law, its practice in the context of early marriage should be evaluated and adjusted to the principles of justice and protection of girls' rights, particularly through strengthening the role of the state and the judicial system in overseeing the granting of marriage dispensations. Keywords: Wali Mujbir, Early marriage, Islamic law, Children's rights Abstrak Artikel ini membahas kontroversi terkait peran wali mujbir dalam kasus pernikahan dini di Indonesia. Wali mujbir, sebagai wali yang memiliki otoritas menikahkan anak perempuan tanpa persetujuan mereka, menjadi topik perdebatan yang mengaitkan hukum Islam dengan hak asasi manusia, khususnya hak anak. Meskipun memiliki landasan kuat dalam teks-teks fikih klasik, penerapan wali mujbir di era modern, terutama di Indonesia, sering kali menimbulkan konflik dengan hukum nasional yang menetapkan batas usia pernikahan. Artikel ini menyoroti bagaimana wali mujbir kerap digunakan untuk melegitimasi pernikahan dini, terutama di wilayah pedesaan yang didorong oleh faktor sosial dan ekonomi, meski praktik ini memiliki dampak negatif terhadap kesehatan fisik, mental, dan sosial anak perempuan. Penelitian ini menggunakan metode kualitatif dengan pendekatan kepustakaan untuk menganalisis data dari literatur hukum Islam, studi-studi akademik, dan laporan terkait dampak pernikahan dini. Temuan menunjukkan bahwa praktik wali mujbir dalam pernikahan dini sering kali menimbulkan masalah, termasuk penurunan akses pendidikan, peningkatan risiko kekerasan dalam rumah tangga, dan permasalahan kesehatan reproduksi. Kesimpulannya, meskipun wali mujbir memiliki dasar hukum Islam, praktiknya dalam konteks pernikahan dini harus dievaluasi dan disesuaikan dengan prinsip keadilan dan perlindungan hak-hak anak perempuan, khususnya melalui penguatan peran negara dan sistem peradilan dalam mengawasi pemberian dispensasi pernikahan. Abstract

This research is motivated by the dynamics of the relationship between Islamic law and national law in the context of legal pluralism in Indonesia. The plurality of legal systems that include customary law, Islamic law, and positive law poses conceptual and practical challenges in realizing substantive justice. The politics of Islamic law is often perceived as merely an attempt to formalize sharia, even though historically and theoretically it has great potential to become an ethical and moral instrument in the formation of national law. Therefore, this study aims to reconstruct the political theory of Islamic law in order to be able to adapt to the reality of legal pluralism without losing the values of maqāṣid al-syarī'ah. The research method used is a juridical-normative approach with descriptive qualitative analysis of primary and secondary legal sources, including laws and regulations, fiqh siyasah literature, and modern legal political theory. The analysis is carried out through historical, philosophical, and conceptual approaches to trace the evolution of political ideas of Islamic law in the context of modern statehood. The results of the study show that the political theory of Islamic law needs to be reconstructed from a formalist paradigm to a substantive paradigm by emphasizing the principles of benefit, social justice, and the protection of citizens' rights. This reconstruction places Islamic law not as an exclusive system, but as a source of inclusive and dialogical value in the national legal system. Thus, Islamic legal politics in Indonesia can play an active role in strengthening the ethics of legislation and constitutional moral consistency in the midst of legal pluralism
