Abstract

The rigidity of the takhrīj mażhabi methodology in pesantren fatwa traditions necessitates a new epistemological approach that is more responsive to contemporary realities. This study aims to explore ijtihād irsyādi as a methodological alternative that maintains continuity with classical tradition while enabling contextual creativity grounded in maqāṣid al-sharī’ah. Employing a qualitative-descriptive-analytical-exploratory approach and a case study method focused on the fatwas of the Lajnah Bahtsul Masail (LBM) Lirboyo from 2019 to 2024, the analysis reveals significant epistemological transformation in istinbath structures. Key findings demonstrate that ijtihād irsyadī prioritizes maslahat (public interest), referential flexibility, and social interpretation as legal foundations, replacing the deductive-formalistic patterns of madhhab-based takhrīj. This approach reinterprets classical authority through maqāṣid frameworks without negating its legitimacy, as evidenced in the 2023 BPJS Healthcare fatwa that teleologically reconstructs social insurance concepts via taḥrīr al-mafhūm (conceptual liberation), tanqīḥ al-manāṭ (ratio legis purification), and ta'līl maqāṣidī (teleological justification). The novelty lies in articulating an adaptive, integrative fatwa epistemology that proactively engages temporal dynamics, offering a reformative paradigm for Indonesian pesantren fatwa methodologies and a substantive contribution to renewing contemporary Islamic legal thought.

Abstract

Since the enactment of Law Number 16 of 2019, which amended Law Number 1 of 1974 on Marriage, the Religious Court of Malang Regency has experienced a significant surge in marriage dispensation applications compared to the period when the previous Marriage Law was still in effect. This research aims to construct the concept of maqāṣid asy-syarī’ah fī ḥifẓ al-awlād by analyzing judicial reasoning of judges in determining marriage dispensations at Malang Regency Religious Court. It specifically explores how judges’ interpretations of the best interests of the child can be formulated into a new derivative of maqāṣid theory. This research is a normative-empirical juridical research with a case approach. The data were collected through interviews with three male judges and two female judges from the Religious Court of Malang Regency. Informants were selected using purposive sampling, targeting judges with the most extensive experience in handling marriage dispensation cases. As data saturation had been reached, the number of informants was deemed qualitatively representative. Data were also obtained from official documentation of legally binding marriage dispensation rulings (inkracht van gewijsde). All data were analyzed using a descriptive-analytical approach, and conclusions were drawn through the application of an interactive cyclical method. The principle of the best interests of the child in determining marriage dispensations aims at providing protection for the child, both physically and psychologically. It includes the age of the prospective bride and groom, economic adequacy, reliable guidance and assistance from the family, and adequate religious safety and protection of children in the womb.

Abstract

Fenomena childfree di kalangan Muslim milenial muncul sebagai respons atas kompleksitas sosial kontemporer, termasuk tekanan ekonomi, krisis lingkungan, hasrat akan otonomi, serta kritik terhadap institusi keluarga. Penelitian ini bertujuan menganalisis dinamika tersebut melalui pendekatan sosiologi Islam dalam perspektif pemikiran Ibnu Khaldun. Metode yang digunakan bersifat kualitatif dengan studi pustaka dan pendekatan tokoh sebagai landasan analitis. Hasil penelitian menunjukkan bahwa pilihan childfree merepresentasikan pergeseran nilai dari pola relasional berbasis tanggung jawab kolektif menuju preferensi identitas individual yang lebih cair. Sakralitas keluarga dalam Islam, khususnya nilai hifz al-nasl dalam kerangka maqāsid al-syarī’ah, mengalami tekanan interpretatif akibat negosiasi nilai dalam budaya modern. Konsep ‘asabiyyah dari Ibnu Khaldun memberi pandangan kritis bahwa ketika solidaritas kolektif dalam keluarga melemah, kohesi sosial yang menopang peradaban ikut terancam. Fenomena childfree dapat dimaknai sebagai gejala awal dari disintegrasi nilai, yang dalam kerangka Ibnu Khaldun merupakan fase kemunduran sosial jika tidak dibarengi pembentukan solidaritas alternatif yang fungsional.

Abstract

The inauguration of Prabowo Subianto as the President of Indonesia marks a significant shift in the nation’s foreign and defense policy toward "Strategic Assertiveness." In an era defined as the "Age of Chaos," characterized by the erosion of multilateralism and intense US-China competition, Indonesia faces multifaceted threats ranging from maritime sovereignty to food and energy security. This report examines Prabowo’s leadership style through the lens of Maqashid al-Syariah, focusing on how his policies aim to protect the five essential elements of human well-being (al-maqasid al-khamsah). By employing a qualitative-descriptive methodology, the analysis reveals that Prabowo’s "firm, charismatic, and task-oriented" leadership embodies the Quranic principle of "I’dadul Quwwah" (preparation of strength) as mandated in Surah Al-Anfal 60. His focus on defense modernization and food self-sufficiency aligns with the preservation of life (Hifz an-Nafs) and wealth (Hifz al-Mal). However, the implementation of "polite democracy" and a military-dominant cabinet sparks debate regarding the balance between national stability and civil liberties. This research concludes that while Prabowo’s assertive stance is necessary for national survival in a multipolar world, it must be balanced with transparency and democratic accountability to ensure genuine public interest (maslahah).
