Abstract

This article examines the formulation of criteria for the civil relationship of children born out of wedlock after Constitutional Court Decision Number 46/PUU-VIII/2010 from the perspective of legal certainty and the maslahah theory of Izzuddin ibn Abdissalam. The study is grounded in the ambiguity of the phrase “children born outside marriage” and the clause “civil relationship” in the Constitutional Court decision, which has led to diverse interpretations and disparities in judicial decisions. This research is a normative juridical study employing statutory and conceptual approaches. The legal materials consist of primary, secondary, and tertiary sources, including statutory regulations, Constitutional Court decisions, court decisions, Islamic legal doctrines, and relevant legal literature. The findings show that children born out of wedlock should not be treated as a single legal category. They need to be classified into three categories: children born from religiously valid but unregistered marriages, children born from defective marriages or relationships involving legal doubt, and children born from relationships without any marital bond. Each category produces different legal consequences, ranging from full, proportional, to limited civil relationships. This formulation aims to realize legal certainty, justice, utility, and maslahah while protecting children without undermining the legal order of lineage in Islamic family law.

Abstract

The determination of the beginning of Islamic months constitutes a crucial intersection between religious law, astronomical science, and state authority. In MABIMS Member Countries, variations in political configurations and state-religion relations have produced distinct legal policies governing the Islamic calendar, particularly regarding Ramadan, Shawwal, and Dhu al-Hijjah. This study aims to examine how legal politics shape state authority in determining the beginning of Islamic months and to analyse the legal consequences of these policies for legal certainty and public compliance among Muslim communities. This research employs a normative juridical method with conceptual and comparative approaches. Data were derived from an analysis of statutory regulations, official fatwas, state religious authority decisions, and regional coordination documents within the MABIMS framework, supported by scholarly perspectives in Islamic law, astronomy (ʿilm al-falak), and legal politics. The findings demonstrate that the determination of Islamic months is not primarily driven by the methodological choice between hisab (astronomical calculation) and rukyah (hilal observation), but rather by the political configuration and the degree of centralisation of state religious authority. Indonesia and Singapore, characterised by more pluralistic and participatory political systems, position the state as a coordinator and final legitimising authority while allowing limited pluralism in societal practice. In contrast, Malaysia and Brunei Darussalam adopt a highly centralised model of state religious authority, where the determination of Islamic months is a binding legal decision enforced through statutory sanctions. This study concludes that stronger state authority in religious governance correlates with higher levels of legal unification and compliance in the Islamic calendrical system. Accordingly, legal politics plays a decisive role in shaping the legal outcomes of determining the Islamic month in Southeast Asia, extending beyond doctrinal or jurisprudential debates alone. Abstract

Children’s involvement in the preservation of Bantengan art is part of the implementation of children’s rights to participate, but on the other hand, it can raise concerns that contradict other children’s rights such as the right to education, worship, and rest. Meanwhile, the Child Protection Law emphasizes the obligation to maintain the physical, psychological, and social well-being of children, but the Cultural Advancement Law does not explicitly integrate child protection principles into it. Studies on Bantengan mostly focus on cultural symbolism, community identity, or socio-economic aspects, thus leaving a normative gap regarding how cultural preservation policies can be aligned with the protection of children’s rights. Furthermore, the application of maqasid shari’ah as a normative framework for formulating operational regulations governing children’s participation in preserving Bantengan art is still under-explored in legal studies. This research is a socio-legal field study that uses a statute, conceptual, and disciplinary approach from legal anthropology and sociology of law. Data were collected through interviews, observations, and literature review. Then, it was analyzed using qualitative analysis, resulting in prescriptive legal recommendations. The findings of this study propose a procedural policy framework based on maqasid shari’ah especially the principle of al-daruriyyat al-khams that ensures the preservation of a child-friendly culture, including the protection of children from physical and psychological violence; age limits and children’s roles; the right to education and rest time; parental supervision; educational and inclusive cultural performances; and enhancing the capabilities of Bantengan community. This study contributes theoretically by integrating the sharia of maqasid shari’ah into the formulation of cultural policies and practically by offering a normative framework for local regulations that balance cultural preservation with child protection.

Abstract

Post-deradicalization radicalism remains a serious concern, particularly when former terrorism convicts return to their families and communities. This article analyzes the strengthening of family resilience as a counter-radicalization model for former terrorism convicts in Sampang Regency, Indonesia. This study employed an empirical qualitative approach with a case study design. Data were collected through observation, in-depth interviews, and documentation involving former terrorism convicts, family members, local government officials, security actors, religious leaders, and socio-religious organizations. The data were analyzed using Lawrence M. Friedman’s legal system theory and Jamaluddin Athiyah’s Maqashid al-Usrah perspective. The findings reveal that family resilience plays a strategic role in preventing the risk of re-radicalization through the strengthening of family communication, economic stability, moderate religious education, psychosocial support, and social acceptance. From Friedman’s perspective, the effectiveness of counter-radicalization depends on the synergy between legal structure, legal substance, and legal culture. Meanwhile, the Maqashid al-Usrah perspective affirms that family strengthening is aligned with the protection of religion, life, intellect, lineage, family institutions, and family economic stability. This article offers a family resilience-based counter-radicalization model that integrates the legal system approach and Maqashid al-Usrah as a conceptual contribution to the prevention of violent extremism in the post-deradicalization phase.

Abstract

Undang-Undang Nomor 22 Tahun 2022 tentang Pemasyarakatan mengatur narapidana perempuan dan anaknya (anak bawaan) harus dipisahkan paling lama usia anak 3 tahun, sehingga hak-hak anak rentan untuk tidak terpenuhi. Tujuan kajian ini untuk mengidentifikasi implementasi tanggung jawab negara dalam memenuhi hak-hak anak dari ibunya yang berstatus narapidana di Lembaga Pemasyarakatan Perempuan Kelas IIA Malang dan menganalisisnya menggunakan perspektif UU No. 35 Tahun 2014 tentang Perlindungan Anak. Jenis penelitian menggunakan yuridis empiris dengan pendekatan yuridis sosiologis. LPP Malang sudah mengimplementasikan Pasal 62 UU No. 22 Tahun 2022, Mandela Rules dan Bangkok Rules, hanya saja kurang signifikan dalam memenuhi hak-hak anak bawaan. Untuk mengatasi permasalahan tersebut, (1) perlu penegasan hak-hak anak bawaan dalam UU pemasyarakatan dan UU perlindungan anak, (2) pendanaan bagi anak bawaan untuk kebutuhan tumbuh kembang diadakan, (3) diadakan program pembinaan tentang pengasuhan anak dan pengawasan untuk menjamin terselenggaranya perlindungan anak bawaan yang dipisah dari ibunya untuk kepentingan terbaik anak di masa depan.

Abstract

Perlindungan konsumen merupakan upaya untuk menjamin terpenuhinya hak-hak konsumen atas barang dan jasa yang aman, layak, dan sesuai standar. Kasus adulterasi Bahan Bakar Minyak (BBM) yang mengakibatkan kerusakan kendaraan dan kerugian finansial menimbulkan kebutuhan akan advokasi yang efektif bagi konsumen. Penelitian ini bertujuan untuk mengetahui upaya Lembaga Perlindungan Konsumen Nasional Indonesia (LPKNI) dalam mengadvokasi kerugian konsumen akibat adulterasi BBM serta menelaah kesesuaiannya dengan prinsip maqashid syariah. Penelitian menggunakan metode hukum empiris dengan pendekatan kualitatif. Data primer diperoleh melalui wawancara dan observasi di LPKNI, sedangkan data sekunder diperoleh dari peraturan perundang-undangan, literatur ilmiah, dan dokumen pendukung. Data dianalisis secara deskriptif kualitatif untuk menggambarkan proses advokasi yang dilakukan. Hasil penelitian menunjukkan bahwa LPKNI melaksanakan advokasi melalui penerimaan pengaduan, verifikasi kasus, konsultasi hukum, pendampingan konsumen, mediasi, serta fasilitasi penyelesaian sengketa dengan pelaku usaha. Namun, pelaksanaan advokasi masih menghadapi kendala berupa keterbatasan sumber daya manusia dan rendahnya kesadaran masyarakat terhadap hak-hak konsumen. Dalam perspektif maqashid syariah, upaya tersebut sejalan dengan tujuan perlindungan harta (hifz al-mal) dan perlindungan jiwa (hifz al-nafs) karena berorientasi pada pencegahan kerugian dan pemenuhan hak konsumen.

Abstract

The increasing rate of divorce in Indonesia indicates that marital conflicts are no longer merely private matters but have evolved into broader social issues affecting community stability. In addition to litigation through religious courts, community-based alternative dispute resolution mechanisms emphasizing deliberation and local wisdom have developed, one of which is mediation conducted by village governments. This study aims to analyze the effectiveness of divorce dispute mediation carried out by the Village Government of Banra’as, Sumenep Regency, and to examine the practice from the perspectives of progressive legal theory and maqasid al-sharia as proposed by Jasser Auda. This research employs an empirical legal method with a qualitative approach. Data were collected through field observations, interviews with village officials and relevant stakeholders, as well as documentation studies, and were analyzed using descriptive-analytical techniques. The findings reveal that village mediation plays a significant role in reducing domestic conflicts and encouraging reconciliation between spouses before cases are brought to the religious court. From the perspective of progressive law, this practice reflects a humanistic, flexible, and substantively just legal approach. Meanwhile, from the perspective of maqasid al-sharia, village mediation represents an effort to preserve family welfare (hifz al-nasl), maintain social stability, and promote holistic societal well-being. Therefore, mediation conducted by village governments can be regarded as an effective and contextual dispute resolution model that aligns with both legal values and socio-religious norms.
