Abstract

People strongly urge for a civil society as the reflection of democracy in which their great participation determines the success of the government programs. The Constitutions No 2-1 1992 and No. 22 1999 show that people have the right to take a part in determining the programs. However, it is clearly seen that this civil right is not well accommodated As the result, the developmental programs are not designed to meet their needs and, even, create critical gaps. This social legal research is done to find out the effectiveness of application of the two above rules by paying more attention to the causes of the low participation given by the informal workers (PKL) and ways how the local government applies two rules. It turns out the government is not consistent in having law enforcement toward these people. This was caused by the fact that government considers these informal workers only have a temporal job. In addition, the government doesn’t have a definite policy as result of reform euphoria of Ulul Albab.

Abstract

Abstract:Agricultural land is a vital object in fulfilling food in Indonesia. However, economic interests have reduced agricultural land. This article aims to describe the role of the Malang City Land Agency in controlling the conversion of agricultural land in order to create sustainable food land. This article is based on doctrinal legal research with a sociological approach. The results of this study indicate that the monitoring of agricultural land conversion has not been running optimally. The unavailability of data on agricultural land in Malang City is because most of them do not have clear ownership status. The reasons for unclear ownership status are due to administrative costs and the lengthy process for obtaining land title certificates.Keywords: agrarian law; agricultural land; food security.Abstrak:Lahan pertanian merupakan objek vital dalam pemenuhan pangan di Indonesia. Namun, kepentingan ekonomi menjadikan lahan pertanian semakin berkurang. Artikel ini bertujuan mendeskripsikan peran Badan Pertanahan Kota Malang dalam mengendakinah alih fungsi lahan pertanian dalam rangka mewujudkan lahan pangan berkelanjutan. Artikel ini bedasarkan penelitian hukum doctrinal dengan pendekatan sosiologis. Hasil penelitian ini menunjukkan bahwa pengawasan terhadap konversi lahan pertanian belum berjalan secara maksimal. Tidak tersedianya data lahan pertanian yang berada di wilayah Kota Malang disebabkan karena sebagian besar belum memiliki status kepemilikan yang jelas. Alasan tidak jelasnya status kepemilikan karena biaya administrasi dan lama proses pengurusan sertifikat hak milik atas tanah.Kata Kunci: hukum agrarian; lahan pertanian; ketahanan pangan.

Abstract

The purpose of this research is to find out and analyze the rationale of local government in conducting land management and management and to know and analyze the authority of the Regional Government in structuring and managing the perspective of Maslahah's theory. The rationale for the authority of the regional government to arrange and manage land comes from Article 12 paragraph (2) letter d of Law No. 23 of 2014 concerning Regional Government, because the essence of regional autonomy is to bring services closer to the community. The authority of the regional government in structuring and managing the land of the perspective of the maslahah theory includes the Hajjiyah maslahah, the benefit needed by the community to perfect the basic benefit or something needed by humans, but has not yet reached the level of dharuri.

Abstract

The effectiveness of the complete systematic land registration program to increase the ownership of land rights certificates at the Malang Regency land office has not been effective. The Covid-19 pandemic had an impact on the target of issuing a Complete Systematic Land Registration certificate in Malang Regency. Impact of Covid 19, In 2020, the target is only 4,675 plots of land by pre-antecedent, only 50 percent of land in Malang Regency has a certificate. Farmers who do not have a field certificate are 651 fields. Still less than 650 thousand. The inhibiting factors for the complete systematic land registration program to increase the ownership of land rights certificates by the Malang Regency land office include (1) the level of community education (2) PTSL applicants are difficult to attend during measurement activities (3) Completeness of administrative requirements (4) Still lacking Coordination (5) Lack of Community Interest and Discipline of Malang Regency and (6) Geographical Condition of Malang Regency. Efforts made by the land office of Malang Regency in streamlining the complete systematic land registration program towards increasing ownership of land rights certificates are (1) Coordinating the Land Office with the village/kelurahan government (2) Increasing Outreach To Attract Enthusiastic Citizens and (3) Increasing Quality of Facilities and Infrastructure.

Abstract

To this present day, violence against women and children remains prevalent and shows an upward trend over the years. This phenomenon is attributed to a multitude of variables, encompassing both domestic and societal influences. The primary objective of this study is to determine the necessity of legal and religious education inside the family. In addition, it aims to investigate the consequences and potential remedies for the absence of such education in familial settings. This study employs an empirical legal methodology that combines an approach to legislation with the Islamic law. The data was collected through interviews conducted in the city of Malang, East Java and reviews of literature. The study highlights the crucial need for legal and religious education within families due to the persistently high levels of crime. The protection of women in the Islamic law extends from their pre-marital stage through marriage and even after divorce from their spouses. These rights encompass the entitlement to inherit from their parents, access to education, the right to receive love and care when they start a family, provision of bodily and spiritual nourishment, clothing, and a home or place of abode provided by their husbands. Upon divorce, a woman is entitled to receive sustenance, iddah, pastau, mut'ah, and acceptable clothing from her former spouse. Child protection in the Islamic law can be ensured by the provision of nasab (self-identity), radha` (breastfeeding), hadhanah (care and maintenance), walayah (guardianship), and nafaqah (supply of sustenance). The protection of women and children is implemented by proactive measures, such as pre-marital advising and family counseling. Repressive measures, such as issuing threats to abusers, and providing guidance and counseling to victims of violence, are also employed. Proper implementation of women's and children's rights will occur when legal and religious education is conducted within the home environment.

Abstract

Technological advances on a transnational scale have had a considerable impact on all levels of Indonesian society. One of the technological advances is the existence of gadgets. Not only positive effects, but they also bring negative impacts. Furthermore, the existence of gadgets continues to grow with more transactions being carried out. Unfortunately, this can be a dispute. The purpose of this research is to propose the problems of Indonesian International Civil Law which have not regulated and provided guarantees to protect transnational e-Commerce interests and their solutions. The method used in this research is normative with a statutory and conceptual approach. The results of this study are the existence of Consumer Protection Law (UUPK), Electronic Information and Transactions Law (ITE Law), Money Supply Law (UUUP), and International Civil Law (HPI) of Indonesia have not provided a clear guarantee of protection related to the choice of law in transnational scale e-commerce contracts. Besides, they also have not been able to accommodate the interests of consumers. One of the solutions offered is concretizing the principle of the recipient country. It is a rule that allows end-users to apply the Consumer Protection Law of their country. This principle is excluded from consumer transactions. This also does not apply .e-commerce contracts. This principle is taken from the Rome and Brussels Convention which is incorporated into the Directive, namely the Law for the EEC community (Europe Union). To provide legal guarantees for consumers, thus the interests’s of consumers can be protected.

Abstract

Pengadilan Agama Surabaya beserta Kantor Pertanahan Kota Surabaya 1 melakukan kerjasama yang tercantum pada Memorandum of Understanding Nomor W13-A1/1909/HM.00/3/2021 dalam rangka pelayanan terpadu percepatan penyelesaian penetapan ahli waris sebagai kelengkapan pendaftaran tanah pertama kali. Tujuan penelitian ini adalah sejauh mana kedua pihak dalam mengimplementasikan kerjasama pelayanan terpadu percepatan penyelesaian penetapan ahli waris berdasarkan MoU yang telah dibuat dengan kesepakatan antara keduanya, serta kerjasama pelayanan terpadu ini ditinjau dari asas peradilan sederhana, cepat dan biaya ringan (contante justitie). Penelitian ini menggunakan jenis penelitian hukum empiris dengan pendekatan yuridis sosiologis. Data penelitian yang diperoleh dalam penelitian ini yaitu wawancara sebagai data primer dan pustaka serta dokumentasi lainnya sebagai data sekunder. Pengolahan data yang digunakan yaitu edit, klasifikasi, verifikasi, analisis dan kesimpulan. Hasil penelitian yang didapat dari wawancara bersama informan yaitu pertama, implementasi kerjasama pelayanan terpadu antara Pengadilan Agama Surabaya dengan Kantor Pertanahan Kota Surabaya 1 telah terlaksana sebagaimana semestinya yang tertera dalam Memorandum of Understanding, adapun tujuan diadakannya kerjasama ini adalah mempercepat penyelesaian penetapan ahli waris berdasarkan hukum Islam sebagai kelengkapan permohonan pendaftaran sertifikat tanah pertama kali. Kedua, implementasi yang dilaksanakan oleh keduanya merupakan salah satu upaya dalam penerapan asas peradilan sederhana, cepat, dan biaya ringan sehingga kerjasama ini telah dilaksanakan sebagaimana asas tersebut. Kata Kunci: pelayanan terpadu; penetapan ahli waris; asas sederhana, cepat dan biaya ringan.

Abstract

In accordance with National Land Agency Regulation No. 1 of 2021, this study investigates the adoption of electronic land certificates. The need to enhance land services in Indonesia, especially in the fight against the land mafia and the settlement of intricate agrarian disputes, is what makes this research so urgent. Creating an electronic certificate system is essential to updating public services in light of the rise in fraud and land ownership disputes. Significant obstacles stand in the way of digital transformation in land management, nevertheless, such as the requirement for a strong legal framework and prepared infrastructure. The novel aspect of the study is its evaluation of infrastructure preparedness for electronic certificates, a topic that has received little attention in earlier studies. The responsive law theory of Philippe Nonet and Philip Selznick is used in this analysis to emphasize how crucial adaptable legal frameworks are for addressing societal shifts. The results indicate that increasing digital infrastructure and raising public understanding of land technology are essential to the success of electronic land certificates. This invention has the potential to improve confidence in the National Land Agency and expedite the settlement of land disputes. According to Indonesian law, both paper and electronic documents are legitimate; nevertheless, for long-term use, rules pertaining to data security, technology, and public education need to be strengthened. The digital revolution of land administration requires cross-sector cooperation.

Abstract

The implementation of UIN Serving activities in Tunjngsekar Subdistrict, Lowokwaru District of Malang concerning the Establishment of the "Pojok Sakinah" Village Community Care Forum is the first step towards Tunjungsekar Urban District as a legal awareness sub-district. The presence of the "sakinah corner" is expected to be able to educate the community members, provide motivation and as a learning tool, as a place for vent and will eventually lead to people who are obedient and aware of the law. Obstacles in the Establishment of the "Pojok Sakinah" Village Community Care Forum in Tunjungsekar Sub-District, Lowokwaru Sub-District of Malang, among others, the lack of activeness of the Tunjungsekar village government apparatus, lack of coordination with the government officials of Tunjugsekar, Karang Taruna, and the lack of community awareness of the importance of the presence of this Sakinah Corner.

Abstract

Indonesia, as an archipelagic country, possesses a vast geographical area and an extensive coastline. Its coastal areas hold abundant natural resource potential, such as tourism assets, fisheries, seaweed, and coral reefs, all of which offer economic value and contribute to the welfare of local communities. This study employed an empirical juridical method and analyzed the issues of sea fence and public policy on the welfare of fishermen families in Tangerang, Indonesia, through the lens of public policy theory. Data were collected by means of interviews, document analysis, and a review of laws and regulations. Findings reveal that a lack of environmental impact assessments, community involvement, and transparency have rendered the sea fence construction policy ineffective. Additionally, sea fences have a direct impact on the well-being of fishing families, including reduced incomes, health problems, restricted access to fishing areas, higher operating expenses, and detrimental effects on marine biodiversity and seawater quality. Hence, efforts must be made to address the issues surrounding sea fences to enhance the welfare of fishermen and their families. Government policies on sea fences should include increasing the capacity of fisherman’s families through training and education, establishing supporting infrastructure, and boosting fishermen and local community organizations. Policy review, more dialogic communication, and the implementation of fairer and more sustainable fisheries welfare measures are among the recommendations.
