Abstract

This research is entitled Implementation of Child Protection Law No. 35 of 2014 Against Underage Marriage in Malay Cultural Society. This research takes the formulation of the problem: Has Law No. 35 of 2014 been implemented on the Marriage of Minors in Malay Indigenous Peoples? What are the obstacles to the implementation of Law No. 35 of 2014 on the Marriage of Minors in Malay Indigenous Peoples? What is the effect of underage marriage according to Malay custom? This type of research is a combination of normative (doctrinal) research and empirical research. This research was conducted in Tanah Merah District, South Binjai, Grand Marcapada Indah Complex Block F3 Kotamadaya Bijai. The approach method in this paper is using the normative juridical method because the target of this research is laws and rules. Based on the research found cases of child marriage according to Law No. 35 of 2014 by using Malay cultural customs. Abstract

Customary inheritance is the process by which tangible and intangible property is inherited and passed on from generation to generation. The customary law of inheritance contains provisions on the transfer of property and intangible property from generation to generation to their descendants. An heir is a person who dies, whether male or female, leaving behind a portion of the property acquired and the rights and obligations that must be exercised during his lifetime, whether by will or not. The legal basis for the crown prince to bequeath part of the crown prince's property according to BW inheritance law. Many or at least the share that the heirs receive from the applicable law. Therefore, all heirs have the same inheritance. Meanwhile, batak customary punishment is based on the provisions of the law and ordinary presidential orders on the division of inheritance.

Abstract

Pasal 1 dikatakan bahwa perkawinan adalah ikatan lahir bahtin antara seorang pria dengan seorang wanita sebagai suami dan isteri, dengan tujuan membentuk keluarga (Rumah Tangga) yang bahagia dan kekal berdasarkan Ketuhanan Yang Maha Esa. Perceraian ialah penghapusan perkawinan dengan putusan hakim, atau tuntutan salah satu pihak dalam perkawinan. Undang – undang tidak dibolehkan perceraian dengan pemufakatan saja antara suami dan isteri. Pernikahan dini adalah pernikahan yang dilakukan sebelum mempelai berusia 18 tahun. Selain memunculkan risiko kesehatan bagi perempuan, pernikahan dini juga berpotensi memicu munculnya kekeraasan seksual dan pelanggaran hak asasi manusia.

Abstract

Keadaaan ekonomi yang semakin sulit di masa pandemi, menjadi salah satu alasan kuat terjadinya konflik yang terjadi di dalam hubungan suami istri. Berdasarkan Pasal 114 Kompilasi Hukum Islam, putusnya ikatan perkawinan karena perceraian dapat diakibatkan karena adanya talak dari suami atau adanya gugatan dari istri. Perceraian diperbolehkan atas dasar manfaatnya lebih banyak dari pada sisi mudhorot. Namun, perceraian merupakan suatu perbuatan halal yang Allah benci sehingga sebaiknya perceraian tersebut dapat dihindari dengan berbagai upaya pencegahan sebagaimana ditekankan dalam perundang- undangan di Indonesia. Hubungan perceraian suami isteri dengan masalah ekonomi cukup dominan pada masa pandemi Covid 19 di Pengadilan Agama Kelas I A Medan. Beberapa kasus perceraian diakibatkan dampak Covid-19 yang akibat dilakuan PHK dari pekerjaannya, sehingga tidak dapat memenuhi ekonomi keluarga.

Abstract

The purpose of this research is to determine and analyze the legal protection of the impact of using refill perfume on consumers based on Law Number 8 of 1999 concerning Consumer Protection, obstacles to the impact of using refill perfume on consumers based on Law Number 8 of 1999 concerning Consumer Protection and solutions to the impact of using refill perfume on consumers based on law number 8 of 1999 concerning consumer protection. This research is The field research method, which involves conducting research in an actual field setting, is a common methodology employed in legal research. Prior to conducting any research project, the researcher should determine the most appropriate method for the study at hand. The results of the research are the continued disadvantage of consumer rights by business actors in terms of refill perfume. The responsibility of business actors for losses suffered by consumers who use cosmetic products, in this case refill perfumes, is contingent upon the clarity of the product label. The responsibility of business actors is also referenced in Article 1365 of the Civil Code concerning Consumer Protection, consumers who have been harmed as a result of using dangerous refillable perfume oil may pursue legal remedies through out-of-court dispute resolution.

Abstract

The objective of this study is to determine the role of the government with regards to honorary workers in compliance with Law No. 5 of 2014 concerning the State Civil Apparatus. Furthermore, it seeks to identify the efforts and policies of the Serdang Bedagai Regency government in organizing personnel administration of honorary workers. Furthermore, this study will examine whether there has been an impact on the Government of Serdang Bedagai Regency in accordance with Law Number 5 of 2014, as well as the impact of Law Number 5 of 2014 on honorary workers in the region. The empirical juridical method was employed in this study. Data were collected through interviews and documentation. Upon completion of the data processing stage, it is evident that the Serdang Bedagai Regency Government has consistently implemented its policy of administering honorary staff and similar personnel through the establishment of formal legality, as evidenced by the issuance of a decree (SK) of honorary staff, which was originally initiated by the Regent or Regional Official. This practice has continued, with no changes being made, for the 2019 and subsequent years. Furthermore, the decree has been transferred to each OPD, where it will be administered by both the head of the agency and the head of the service within the agency. In addition, it should be noted that, in order for the Serdang Bedagai Regency Government to function effectively and efficiently, it still requires honorary staff, such as operators, security personnel, and cleaning personnel, whose roles are essential to the smooth running of operations.

Abstract

Data released by the World Bank shows that from 1985-1997 Indonesia has lost about 1.5 million hectares of forest each year and it is estimated that about 20 million production forests remain. Illegal logging is related to the increasing demand for timber in the international market, the large installed capacity of the domestic timber industry, local consumption, weak law enforcement, and timber bleaching that occurs outside the logging area. Based on the results of the FWI and GFW analysis over a period of 50 years, Indonesia's forest cover has decreased by around 40% of the total forest cover throughout Indonesia. And mostly, forest destruction (deforestation) in Indonesia is the result of a political and economic system that considers forest resources as a source of income and can be exploited for political interests and personal gain. The problem is with how Legal Protection of the environment to reduce Illegal Logging in Medan City. The method used is empirical juridical research method, which is a legal research conducted by examining directly and coupled with reviewing the literature to obtain further explanation. In terms of sociological legal research using laws and regulations related to the title. The result of the research is that it must play a more active role in protecting the environment so that plants in the city of Medan are well maintained. Abstract

The principle of utmost good faith is the most important principle in a life insurance agreement. The application of this principle in the practice of life insurance, among others, occurs when the insured completes the insurance request form. This research uses a descriptive method through a normative approach (legal research), namely an approach to problems, carried out by examining various legal aspects in terms of applicable regulations. The results of the study show that the form of legal protection provided to consumers in the life insurance business in Indonesia is the principle of utmost good faith adhered to in the life insurance business, which is an act of accurately informing all information that is requested or not requested by the insurance company regarding something. to be insured or the insured object/interest. Forms of bad faith from life insurance companies on life insurance policies related to their obligations in running a life insurance business are that the insurer often does not want to make payments on life insurance claims. As for the form of legal action taken in resolving consumer disputes over life insurance policies in Indonesia through (three) stages of dispute resolution and in this case there is no appeal against the decision of the district court which decided objections to the decision of the Consumer Dispute Settlement Agency, but was immediately appealed to the Court great .  Keywords: Legal Protection, Bad Faith, Life Insurance.

Abstract

The working time provisions above also only regulate the working time limit for 7 or 8 days and 40 hours a week and do not regulate when working time or hours begin and end. Arrangements for the start and end of working time or hours every day and during the week, must be clearly regulated as needed by the parties in the Work Agreement, Company Regulation (PP) or Collective Labor Agreement (PKB). The problem raised in this research journal is how the obstacles faced by Law No. 13 of 2003 concerning Decisions on Employment Relations. This research approach method uses a normative juridical approach. The normative approach method is used to analyze laws and regulations relating to Termination of Employment Relations. The results of this research journal are not synchronized between legislation and termination of employment in the field. Abstract
