Abstract

Penelitian ini bertujuan untuk mengetahui bentuk peralihan kewenangan pengawasan muatan lebih dari pemerintah Provinsi Sumatera Utara ke Kementerian Perhubungan, pelaksanaan kegiatan setelah peralihan kewenangan pengawasan muatan lebih dari pemerintah Provinsi Sumatera Utara ke Kementerian Perhubungan, serta akibat hukum pelaksanaan peralihan kewenangan pengawasan muatan lebih dari pemerintah Provinsi Sumatera Utara ke Kementerian Perhubungan. Jenis penelitian yang digunakan adalah yuridis empiris dengan sifat yang digunakan adalah deskriptif melalui wawancara dan dokumentasi yang diolah dengan menggunakan analisis kualitatif. Berdasarkan hasil penelitian dapat disimpulkan bahwa akibat hukum pelaksanaan peralihan kewenangan pengawasan muatan lebih dari pemerintah Provinsi Sumatera Utara ke Kementerian Perhubungan yaitu adanya peralihan personel UPPKB menjadi Pegawai Negeri Sipil (PNS) yang bertugas mengawasi kenderaan muatan lebih di bawah naungan pemerintah pusat, serta adanya tindakan terhadap pelanggaran muatan yang melebihi 5% sampai dengan 20% dari jumlah berat yang diizinkan dikenakan sanksi penilangan dan sanksi penundaan melanjutkan perjalanan dan jika pengemudi tidak bersedia baru dilakukan penurunan muatan lebihnya.

Abstract

Pelajar adalah harapan masa depan bangsa, sehingga sudah menjadi tanggung jawab kita bersama untuk memastikan mereka mendapatkan hak dan menjamin pendidikan yang layak untuk mereka. Namun, Kenakalan remaja dalam bentuk tawuran pelajar menjadi tantangan serius di lingkungan sekolah karena berpotensi menimbulkan dampak hukum dan sosial yang luas. Tawuran yang baru-baru terjadi di salah satu sekolah yang ada di Kabupaten Lombok Barat, Provinsi Nusa Tenggara Barat (NTB) menjadi salah satu fakta yang harus segera ditangangi secara prefentif agar tidak meberikan dampak negatif kepada pelajar lainnya. Kegiatan pengabdian ini bertujuan untuk meningkatkan kesadaran hukum siswa melalui edukasi mengenai bahaya tawuran dan konsekuensi hukumnya. Kegiatan dilaksanakan di SMPN 2 Batulayar, Lombok Barat, menggunakan metode ceramah interaktif yang dilanjutkan dengan sesi diskusi. Materi berfokus pada dasar hukum, faktor penyebab tawuran, serta strategi pencegahannya. Kondisi ini mendorong kami, para dosen dari Program Studi Ilmu Hukum, Fakultas Hukum, Ilmu Sosial, dan Ilmu Politik, untuk turut ambil bagian dalam upaya pencegahan melalui penyebaran informasi hukum kepada masyarakat. Kami merasa perlu hadir dan berkontribusi dengan memberikan edukasi hukum terkait edukasi hukum atas dampak dari tawuran. Hasil kegiatan menunjukkan adanya peningkatan pemahaman siswa terhadap pentingnya menjauhi kekerasan dan menjunjung nilai hukum dalam kehidupan sehari-hari. Edukasi hukum ini diharapkan menjadi langkah preventif dalam membentuk karakter siswa yang sadar hukum dan bertanggung jawab.

Abstract

This study examines the legal validity for Nazhir as a waqf asset manager in reclaiming waqf assets that are not used according to their intended use. The research method used is normative juridical. The results of the study indicate that the validity of Nazhir in the withdrawal of misused waqf assets is analyzed based on Decision No. 22/Pdt.G/2017/MS-Aceh which is in line with the provisions of Article 42 of Law of the Republic of Indonesia Number 41 of 2004 concerning Waqf, waqf assets that were initially loaned by Nazhir can be withdrawn if proven to be misused. The judge's consideration in granting the withdrawal of misused waqf assets in Decision No. 22/Pdt.G/2017/MS-Aceh is based on the fact that legally there is no legal reason for the Defendants/Appellees to illegally and unlawfully detain and control the disputed object as the legal property of YPI Bireuen.

Abstract

This research examines the position of married daughters in child adoption practices within the Ngada ethnic community through an analysis of Supreme Court Decision Number 407 K/Pdt/2019. Using normative legal research methods and a case approach, the study reveals that although the Ngada community adheres to a patrilineal system that traditionally prioritizes sons in child adoption, there exists an adaptive mechanism in the form of the concept "women can hold the machete" that enables the adoption of married daughters for the purpose of performing traditional rituals. The Supreme Court in its decision acknowledged this flexibility of customary law by rejecting the argument that adoption applies only to male children, while affirming that the practice of adopting married daughters does not contradict Ngada customary law as long as it is done to continue and perform traditional rituals. This research demonstrates that customary law is not a static system but rather dynamic and continuously evolving according to community needs, and highlights the important role of courts in harmonizing traditional values with principles of justice and equality within the context of legal pluralism in Indonesia.

Abstract

This research examines the application of the principle of appropriateness in determining post-divorce maintenance amounts for Civil Servants based on Supreme Court Circular Letter No. 3 of 2018 through a study of Supreme Court Decision Number 42 K/Ag/2024. The regulation of iddah maintenance, mut'ah, and child support in Indonesian positive law has been established in various legal instruments, but its implementation often faces challenges in determining appropriate and fair amounts. Through a normative juridical research method with a case approach, this research analyzes how the Supreme Court applies the principle of appropriateness by considering factors such as the husband's economic capacity as a civil servant, the duration of marriage, the basic needs of the former wife and children, and the principle of a year's living costs as a benchmark for iddah maintenance and mut'ah. This decision becomes an important jurisprudence that corrects lower court decisions by improving the amount of iddah maintenance from Rp7,500,000 to Rp12,000,000, mut'ah from Rp30,000,000 to Rp48,000,000, and child support from Rp2,000,000 to Rp5,000,000 per month with a 10% increase each year, reflecting a progressive approach in religious court practice that prioritizes substantive justice and protection of women's and children's rights after divorce.

Abstract

This study aims to determine the legal implications of the Constitutional Court Decision Number 46/PUU-VIII/2010 on the inheritance rights of illegitimate children. In the Indonesian legal system, referring to Law Number 1 of 1974 concerning Marriage, it states that illegitimate children only have a civil relationship with their mother, so they are not entitled to inheritance from their father. However, the Constitutional Court's decision changed this paradigm by recognizing the civil relationship of illegitimate children with their biological father if it can be proven scientifically and technologically, such as through DNA testing. This study uses a normative legal research method with primary and secondary legal materials. The results of the study indicate that the legal implications of the Constitutional Court's Decision provide fairer and more equal legal protection for illegitimate children in obtaining recognition of inheritance rights from their father which can be proven scientifically from the science and technology recognized by applicable law.

Abstract

Drug abuse in Indonesia has become a serious threat that has spread not only in urban areas, but also to remote villages and school environments. Law Number 35 of 2009 concerning Narcotics defines narcotics as substances that can affect consciousness and the central nervous system, and have the potential to cause dependence. Lack of legal understanding and information about the impact of narcotics on health, social, and economic causes increased vulnerability of the community, especially students, to abuse of this illegal substance. One case that emerged was the arrest of a junior high school student in Purwakarta who was involved as a drug dealer. The case illustrates the urgency of early prevention through legal education among students, including at SMP Negeri 3 Labuhan Haji, East Lombok Regency. Effective prevention efforts involve education, strengthening the role of the family, creating a positive environment, and support from the government and law enforcement officers. Education about the dangers and legal sanctions of narcotics is an important step to save the younger generation from the threat of drugs for a better future

Abstract

The transformation of government services from manual systems to digital platforms through e-government in Indonesia is a response to the advancement of information and communication technology (ICT) and the demand for bureaucratic efficiency. Presidential Instruction No. 3 of 2003 marked the initial milestone in e-government development, which has since evolved into various digital public services such as OSS, SatuSehat, and Satu Data Indonesia. This study employs a normative legal method using statutory, conceptual, and normative gap analysis approaches. The focus of the research is directed at two main aspects: the regulation of personal data protection within regional e-government systems and the normative weaknesses in ensuring the security and confidentiality of citizens’ data. The discussion reveals that despite the enactment of the Personal Data Protection Law (PDP Law), its implementation at the regional level faces significant challenges, including overlapping regulations, lack of technical standards, weak oversight, and ineffective sanctions. Regional governments often lack clear operational guidelines, resulting in disparities in data protection across regions. The study concludes that personal data protection must be an integral part of digital governance system design. Regulatory reform, institutional capacity building at the regional level, and the establishment of effective oversight mechanisms are strategic steps to ensure comprehensive protection of citizens’ privacy rights in the digital era.

Abstract

Divorce lawsuit against absent husband is a legal remedy for wives abandoned by their husbands without clear residence information. This research analyzes the legal mechanism of divorce lawsuits against absent husbands based on Law No. 1 of 1974 on Marriage and Islamic Law Compilation. The research method uses normative juridical approach with secondary data of descriptive nature. Results show that absent husband divorce procedures are regulated in Article 20 paragraph (2) of Government Regulation No. 9 of 1975 and Article 138 of Islamic Law Compilation, with summons through announcements on court bulletin boards and mass media. Implementation follows ordinary divorce lawsuit procedures with additional requirements including village certificate stating the unclear domicile of the defendant.

Abstract

Marriage constitutes a sacred bond between men and women governed by the Indonesian legal system. Law No. 16 of 2019 establishes a minimum marriage age of 19 years for both men and women, yet provides exceptions through marriage dispensation mechanisms for those who have not reached that age. This research examines the juridical aspects of granting marriage permits for children below the minimum age through normative juridical methods with qualitative analysis of statutory regulations and legal literature. Research findings indicate that marriage dispensation is regulated under Article 7 paragraph (2) of the Marriage Law and Supreme Court Regulation No. 5 of 2019, with contributing factors including economic aspects, low education levels, and cultural traditions. Underage marriage generates negative impacts including school dropout, reproductive health disorders, and sustained poverty. Strengthened regulations and comprehensive prevention efforts are required to protect the best interests of children.
