Abstract

This research endeavors to analyze the safeguarding of the traditional cultural expression of the “perang ketupat” as a communal intellectual property in Tempilang District, West Bangka, as well as to explore the perception of the Air Lintang community in Tempilang District towards efforts to protect the “perang ketupat” tradition as communal intellectual property. This study employs a socio-legal approach through combining qualitative analysis and a simple quantitative survey. Qualitative analysis is carried out to understand the social context, cultural values, and community perspectives in managing communal intellectual rights. The quantitative survey involved 110 respondents from 11 neighborhood units in Air Lintang village to measure community perceptions about legal protection of the “perang ketupat” tradition. The results show that although the Tempilang community consistently preserves the “perang ketupat” tradition, their grasp of intellectual property rights and the corresponding legal safeguards remains underdeveloped. Most respondents acknowledge the significance of safeguarding traditional cultural expressions using legal instruments, However, most respondents have an incomplete understanding the implications of registering the “perang ketupat” as communal intellectual property. This research encourages strengthening community legal awareness through legal literacy programs involving collaboration between the government, local governments, and universities.

Abstract

This research is addressed to theoretically examine authority and position of deputy head of region in local government system in the post-reform time, in particular by using Philipus M Hadjon's authoritative theory as an analytical tool. We apply normative juridical approach through analysis of theory, concepts, legal principles as well as law and regulation which have correlation with this research. Our result shows that the authority of the deputy head can be achieved in three different ways: first, direct or explicit power governed by the law, second and third through delegation and mandate from higher authority (e.g. regional head), respectively. Interestingly, we notice that most of the tasks are unfortunately mostly in assisting mode, while we argue that this can be also carried out by local secretary. This power overlapping could actually create ambiguity and further have implication in the urgency of deputy head position in the regional government system.

Abstract

Studi ini menganalisis formulasi hukum pidana dan perlindungan hukum terhadap tindak pidana perdagangan orang melalui dunia maya (TPPO) yang berdampak pada buruh migran Indonesia nonprosedural di Myanmar. Terjadinya TPPO dunia maya menimbulkan ancaman yang signifikan bagi buruh migran Indonesia, khususnya mereka yang melakukan perjalanan melalui rute nonprosedural ke Myanmar. Modus operandi pelaku TIP telah berkembang dengan menggunakan teknologi informasi dan komunikasi untuk perekrutan, pemindahan, dan eksploitasi korban. Penelitian ini menggunakan metodologi hukum normatif yang memanfaatkan pendekatan perundang-undangan dan yurisprudensi. Temuan studi ini mengungkapkan bahwa hukum pidana Indonesia yang berkaitan dengan TPPO dunia maya menunjukkan kekurangan dalam pengaturan lintas batas, khususnya dalam menangani kejahatan terorganisasi transnasional. Perlindungan hukum terhadap korban TPPO siber pada pekerja migran non prosedural menghadapi tantangan signifikan dalam hal yurisdiksi, pembuktian, dan kerja sama internasional. Penelitian ini merekomendasikan penguatan instrumen hukum pidana, optimalisasi diplomasi hukum, dan peningkatan kerja sama internasional untuk menanggulangi TPPO siber serta memberikan perlindungan yang efektif bagi pekerja migran Indonesia.

Abstract

Dunia modern saat ini telah banyak berkembang dalam kehidupan manusia baik di bidang ekonomi juga teknologi. Dalam ekonomi yang dapat dilihat dari perkembangannya salah satunya ialah bentuk investasi. Investasi pada masa kini bisa dilakukan dengan menggunakan teknologi. Teknologi memungkinkan investor untuk membeli dan menjual saham, obligasi, atau instrumen keuangan lainnya melalui platform trading yang berbasis aplikasi atau website. Masyarakat banyak tertarik berinvestasi karena dimudahkannya dengan penggunaan perangkat lunak. Untuk memastikan keamanan dan keandalan robot trading, otoritas pasar modal perlu mengawasi penyedia layanan ini dan mewajibkan memiliki sertifikasi atau izin yang menunjukkan bahwa robot mereka memenuhi standar operasional dan transparansi yang ditetapkan. Penelitian ini memiliki tujuan untuk menganalisis aspek yuridis terkait penggunaan robot trading dalam konteks aspek hukum perlindungan konsumen di Indonesia. Metode penelitian yang digunakan adalah metode kualitatif dengan pendekatan normatif empiris yaitu bagaimana regulasi yang ada diterapkan dalam praktik dan dampak terhadap aspek hukum perlindungan konsumen, serta studi kasus pada beberapa platform robot trading yang umumnya diawasi oleh lembaga seperti Otoritas Jasa Keuangan (OJK) dan Badan Pengawas Perdagangan Berjangka Komoditi (BAPPEBTI). Hasil dari penelitian ini menunjukkan bahwa dapat menciptakan lingkungan yang aman dan transparan bagi konsumen yang menggunakan layanan robot trading serta menurunkan risiko kerugian akibat penyalahgunaan atau kegagalan sistem yang tidak sesuai dengan regulasi, meskipun terdapat regulasi yang mengatur aktivitas perdagangan dan perlindungan konsumen, banyak konsumen yang belum sepenuhnya memahami risiko yang terlibat.

Abstract

The transfer of State-Owned Assets (BMN) in the form of land is a legal process that must comply with administrative and land law regulations. The issue of an authentic deed by a Land Deed Official (PPAT) is an essential instrument in the transfer of land rights. This study seeks to analyze the legal ramifications of conducting the process without a PPAT deed and to assess the importance of PPAT in validating property rights transfers, including BMN. The applied research methodology is normative juridical, utilizing a statutory and case study approach. The results demonstrate that the conveyance of land rights does not comply with the legal stipulations set forth by national land laws in the absence of a deed executed by a PPAT, which may lead to disputes and financial losses for the state. This report promotes the strengthening of regulations mandating PPAT involvement in all BMN land transfers to ensure legal certainty and protect state interest.

Abstract

The national criminal law transformation towards the effective enforcement of Law Number 1 of 2023 and Law Number 20 of 2025 demands a reorientation of law enforcement practices from a retributive to a restorative paradigm. However, the current implementation of restorative justice in ordinary theft cases at the police resort level still operates within an internal regulatory framework prone to a relevance crisis due to normative gaps with the new statutory standards. This study aims to evaluate the objectivity of existing practices, analyze the clash of norms approaching the transition period, and formulate institutional policy harmonization strategies. Employing a mixed-methods legal research approach, this study integrates a doctrinal review of Police Regulation Number 8 of 2021 with empirical data from the Pangkalpinang Police Resort, triangulating in-depth interviews with investigators, victims, and offenders. The results indicate that although existing practices have met administrative compliance requirements and provided tangible recovery benefits for victims, implementation experienced statistical stagnation in certain periods due to workload and investigators’ administrative concerns. Substantively, a fundamental incompatibility was found between the rigidity of internal police rules regarding the absolute ban on recidivists and nominal loss parameters, on the one hand, and the sentencing flexibility principles in Law Number 1 of 2023, on the other hand, as well as the misalignment of internal case exposition mechanisms with the judicial scrutiny standards mandated by Law Number 20 of 2025. This study concludes that there is an urgent need for harmonization through the establishment of a specialized supervisory unit to simulate material validity testing equivalent to that of the Preliminary Examining Judge, and the integration of customary figures’ roles in penal mediation to guarantee accountability for police discretion in the new criminal justice era.

Abstract

Hak Asasi Manusia akan selalu berkaitan dengan upaya perlindungan hukum. Upaya ini khususnya berkaitan dengan hak-hak tersangka yang relevan dengan KUHAP. Namun faktanya masih belum terlaksana dengan optimal, karna masih kurangnya pemahaman tentang hukum. Maka perlu ditinjau lagi tentang hak tersangka yang ada dalam UU No 8 Tahun 1981 KUHAP suaya bisa diperhatikan secara bijak oleh penegak hukum, terutama di fase penyidikan. Tujuan studi ini yaitu menganalisis upaya perlindungan hukum tersangka berdasarkan UU No.8 Tahun 1981 tentang KUHP di POLRESTA Pangkal Pinang. Studi ini ingin mengamati serta memahmi hak-hak tersangka dengan didasarkan KUHAP serta upaya untuk melindungi hak tersangka. Studi ini bermetode hukum normatif secara berpendekatan analisa, undang-undang, serta konsep. Hasil studi ini mengindikasikan jika tersangka pidana bisa dilindungi oleh hukum serta mempunyai hak yang tercantum dalam KUHAP seperti perlindungan dari instansi, penasehat, penyidik, serta polisi juga perlindungan rohani jasmani tersangka. Upaya perlindungan hukum sesuai KUHAP yaitu dengan praperadilan yang di inginkan kasus pidana bisa terselenggara lancar selaras hukum yang ada.

Abstract

The digital transformation of state governance has engendered a novel form of algorithmic authority that exerts a direct influence on human rights. In Indonesia, administrative determinations derived from digital systems, such as the Computer Assisted Test for civil service recruitment, the Integrated Social Welfare Database, digital identity applications, and inter-agency data integration facilitated by the One Data Indonesia initiative, are frequently executed without transparency, correction mechanisms, or accessible legal recourse. This scenario engenders a substantial disparity between the constitutional tenet of due process and the actualities of automated public decision-making. This scholarly inquiry endeavors to articulate the notion of algorithmic due process as a unique constitutional safeguard that transcends procedural fairness, administrative due process, and digital due process. Employing normative legal methodologies in conjunction with a socio-legal perspective, this research scrutinizes the Indonesian legal framework's responsiveness to the challenges engendered by algorithmic authority. The results indicate that Indonesia is deficient in adequate normative foundations to govern algorithmic justice and safeguard fundamental rights. Consequently, the study advocates for a model of algorithmic due process predicated on the rights to explanation, correction, and legal challenge, situated within the overarching theoretical paradigm of Rule of Law 5.0. The study underscores an imperative for constitutional reform to establish definitive standards for algorithmic governance in the realm of public services.

Abstract

The legal principle of actio pauliana is the right given to creditors to request the cancellation of all acts of transfer of rights carried out by the debtor. The curator is the only party who can cancel legal actions carried out by the bankruptcy debtor based on the legal principle of actio pauliana through the Court, so that the deed of transfer of rights made by PPAT can be canceled using the legal principle of actio pauliana through a court decision. The aim of this research is to analyze the concept of the actio pauliana principle in the legal system in Indonesia and find out the legal position of the deed of transfer of rights made before the PPAT which is submitted for actio pauliana legal action in bankruptcy in Indonesia. The method used in research is normative juridical. Based on the research results, it is concluded that the concept of the actio pauliana principle in the legal system in Indonesia has been regulated in Article 1341 of the Civil Code and Articles 41 to Article 49 of Law Number 37 of 2004 concerning Bankruptcy and Postponement of Debt Payment Obligations with the aim of protecting interests of creditors from bad actions carried out by debtors. This must go through a process by filing a lawsuit with the Commercial Court to obtain a decision to cancel the transfer of property or assets to a third party. A lawsuit for the transfer of property or assets can only be directed against a party who within 1 year before the bankruptcy occurred transferred their assets. The legal status of the deed of transfer of rights made before the PPAT which is submitted for actio pauliana legal action in bankruptcy in Indonesia is binding for both parties when the transfer of rights is carried out in good faith in accordance with the provisions required in the Law.

Abstract

This research examines legal protection against child sexual exploitation through Augmented Reality (AR) and Virtual Reality (VR) technologies, which are increasingly developing in the digital era. AR combines virtual elements with the real world, while VR creates a fully immersive environment. Both offer positive opportunities and serious risks, including new crime modes such as the creation of avatars or virtual models of children for sexual purposes, grooming in virtual spaces, and the distribution of immersive child pornography. Anonymity, the difficulty of age verification, the lack of digital literacy, and the forensic challenges of 3D content are significant obstacles to law enforcement. Existing regulations, including Law No. 17 of 2016 concerning Child Protection, Law No. 1 of 2024 concerning the Second Amendment to the ITE Law, and Law No. 12 of 2022 concerning the TPKS, have provided a strong legal basis, but do not specifically regulate AR/VR technology. A normative juridical research method with a statutory and conceptual approach is used to analyze existing norms, regulatory gaps, and their relevance to international standards such as the Budapest Convention and the Lanzarote Convention. The research findings emphasize the urgency of adaptive regulatory updates to technological developments, the implementation of cybersecurity standards, mandatory age verification, and strengthening the capacity of law enforcement officers in digital investigations and AR/VR forensics. Cross-border and cross-sector collaboration is needed to expedite notice and takedown mechanisms and close legal loopholes exploited by perpetrators. These efforts are expected to create a safe digital environment for children and increase the effectiveness of legal protection in the realm of immersive technology.
