Abstract

The principle of the rule of law (rechtsstaat) positions law as the primary safeguard of justice and democracy. In Indonesian constitutional practice, however, law often operates under political influence through legal politicization. This occurs when legal instruments are used to advance political interests in legislation, adjudication, and enforcement. Such practices undermine institutional independence, weaken enforcement quality, and erode public trust. This study examines the forms, mechanisms, and impacts of legal politicization on law and enforcement in post Reformasi Indonesia. It employs a normative juridical method with statutory and conceptual approaches, drawing on Critical Legal Studies (CLS) and analysis of statutes, court decisions, and relevant cases. The findings show that legal politicization in Indonesia is systemic and structural, reflected in agenda driven legislation, judicial intervention, the weakening of independent institutions, and selective enforcement. These patterns weaken the rechtsstaat and checks and balances while accelerating democratic decline through elite impunity and shrinking civic space. Legal politicization therefore poses a serious threat to constitutional democracy in Indonesia.

Abstract

This research examines the juridical position of government intervention through the golden share instrument (Series A Dwiwarna Shares) in State-Owned Enterprises (SOEs) listed on the stock exchange, analyzed from the perspective of Article 33 of the 1945 Constitution, Constitutional Law, and Criminal Law. The primary issue arises when the state's special veto rights conflict with the principle of shareholder equality (one share one vote) and the potential for abuse of power leading to corruption. The research method employed is normative legal research with statutory and conceptual approaches. The results indicate that the golden share is a constitutional instrument to safeguard economic sovereignty as long as its use is restricted to strategic policies concerning public welfare. However, this study finds a legal vacuum regarding the limits of managerial intervention, which often triggers maladministration and systemic losses for public investors. The proposed novelty is the concept of "Constitutional Proportionality," wherein the exercise of veto rights must be based on strict transparency protocols and independent oversight to prevent undue influence. In conclusion, regulatory reconstruction is necessary to align state control functions with good corporate governance principles to ensure legal certainty in the Indonesian capital market.

Abstract

Perkembangan ekonomi digital di Indonesia telah mengubah pola transaksi masyarakat sekaligus melahirkan berbagai risiko hukum, seperti penipuan daring, penyalahgunaan data pribadi, dan manipulasi informasi elektronik. Penelitian ini bertujuan untuk menganalisis kerangka hukum perlindungan konsumen digital dalam perspektif hukum ekonomi, hukum pidana, dan hukum tata negara; mengevaluasi efektivitas sanksi pidana terhadap pelanggaran hak konsumen; serta mengkaji kewenangan negara dalam pengawasan ekonomi digital. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan, konseptual, dan sistem melalui analisis regulasi serta doktrin hukum yang relevan. Hasil penelitian menunjukkan bahwa meskipun telah terdapat perangkat hukum seperti Undang-Undang Perlindungan Konsumen, Undang-Undang Informasi dan Transaksi Elektronik, Undang-Undang Perdagangan, dan Undang-Undang Perlindungan Data Pribadi, masih terdapat kekosongan norma, disharmoni pengaturan, serta kelemahan penegakan hukum. Sanksi pidana berfungsi sebagai ultimum remedium, namun menghadapi kendala pembuktian digital dan proporsionalitas efek jera. Selain itu, tumpang tindih kewenangan antarlembaga negara menghambat efektivitas pengawasan. Penelitian ini menyimpulkan perlunya reformasi hukum yang integratif melalui harmonisasi regulasi, penguatan sanksi yang proporsional, dan penataan desain kelembagaan guna menjamin perlindungan konsumen digital secara komprehensif
