Abstract

This research aims to analyze the application of the principles of balance and good faith in the enforcement of mortgage rights, with a particular focus on ensuring proportional legal protection for debtors. Although the Mortgage Law provides legal certainty for creditors, execution practices frequently disadvantage debtors, especially regarding auction pricing, notification mechanisms, and creditor conduct in determining default. Using a normative juridical method with statutory and conceptual approaches, this study finds that debtor protection should not merely rely on formal declarations of default, but must also consider factual conditions, including force majeure circumstances and the debtor’s good faith. The implementation of procedural transparency, objective pre-execution mechanisms, and the principle of balance is essential to prevent abuse of rights by creditors and to ensure that execution serves as a last resort. Therefore, harmonizing legal certainty, justice, and utility is indispensable to create a fair legal relationship between creditors and debtors in the execution of mortgage rights.

Abstract

Technological advances open up opportunities for development for the creation of an object. In its development, Artificial Intelligence technology is able to create and produce a product so that protection of Intellectual Property Rights of it is needed. Law Number 28 of 2014 concerning Copyright has not been able to accommodate the protection of Intellectual Property Rights of product that produced by Artificial Intelligence due to the unclarity of the creator. For this reason, a protection mechanism is needed for product that produced by Artificial Intelligence. This study aims to identify and analyze the legal construction of intellectual property rights for product that produced by artificial intelligence in Indonesia and forms of copyright protection for product that produced by artificial intelligence. This research is a normative juridical research with analytical descriptive research specifications. This research uses a statutory approach, concept approach and comparison approach. The data used are secondary data that obtained from literature studies. The data are presented with normative texts and analyzed by qualitative normative methods. The results show that the legal construction of intellectual property rights for product that produced by artificial intelligence in Indonesia needs to be developed so that the creators can get copyrights to their products. The implementation of the legal construction of Artificial Intelligence also need ethical part to it.

Abstract

The increasing economic activity, particularly in the banking sector, has led to land being frequently used as the primary guarantee in credit agreements through mortgage rights (hak tanggungan). However, problems arise when the debtor passes away and the mortgaged land becomes part of the inheritance. Since mortgage rights are characterized by the droit de suite principle, the right remains attached to the land regardless of changes in proprietary rights. This legal characteristic often leads to conflicts between creditors and heirs, especially when the heirs were not involved in or unaware of the original credit agreement. Meanwhile, banking institutions require legal certainty over guarantee to exercise their execution rights effectively. This research aims to identify the legal convergence between inheritance rights and mortgage rights in order to uphold justice and legal certainty for all parties involved. The study adopts a normative juridical approach, using secondary data derived from statutory regulations and legal literature. The findings reveal that the lack of synchronization between inheritance law and security law creates legal uncertainty and practical problems, which can only be resolved through regulatory harmonization and procedural clarity in guarantee execution involving inherited land

Abstract

Perkembangan ekonomi digital telah mengubah cara konsumen berinteraksi dalam transaksi bisnis, dimana sekarang ini dapat menghadirkan peluang sekaligus tantangan baru dalam perlindungan konsumen. Penelitian ini bertujuan untuk menganalisis peran hukum dalam melindungi hak-hak konsumen di era ekonomi digital, tantangan hukum yang dihadapi, serta perbandingan perlindungan konsumen di Indonesia, China, dan Jepang. Metode penelitian yang digunakan adalah yuridis normatif dengan melakukan analisis terhadap peraturan perundang-undangan seperti UUPK, UU ITE, dan PP PSTE. Dari hasil penelitian menunjukkan bahwa regulasi di Indonesia belum sepenuhnya mengakomodasi karakteristik transaksi digital, seperti perlindungan terhadap data pribadi dan transaksi lintas negara. Tantangan utama meliputi celah hukum, kurangnya literasi konsumen, serta kelemahan penegakan hukum. Dibandingkan dengan China dan Jepang, Indonesia perlu memperkuat regulasi dan penegakan hukum serta meningkatkan literasi digital kepada masyarakat. Penelitian ini memberikan rekomendasi untuk memperkuat perlindungan konsumen melalui kebijakan adaptif, pengawasan berbasis teknologi, dan kolaborasi lintas sektor guna menciptakan ekosistem ekonomi digital yang aman dan berkelanjutan.Kata Kunci: Tantangan dan Peran Hukum; Perlindungan Konsumen; Ekonomi Digital.

Abstract

Vandalism on railway infrastructure is not merely understood as destructive behavior but also as a form of social expression that reflects the dynamic relationship between individuals and public space. This article examines vandalism as a socially structured phenomenon rooted in social interaction, environmental conditions, and power inequalities within public transportation spaces. The research method in this study is a theoretical study or systematic literature review with a Qualitative-Analytical approach. The data sources in this study are secondary, including sociology and criminology journals that discuss deviation, vandalism, graffiti, public space, and transportation infrastructure. The analysis employs various sociological perspectives, including Anomie Theory to describe collective frustration and weakened normative control; Social Learning Theory to understand peer group influence and the imitation of deviant behavior; Social Control Theory to explore the weakened social bonds that reduce conformity; Conflict Theory to observe vandalism as a symbolic form of resistance against inequality in public space governance; and Social Ecology Theory to highlight the role of environmental disorganization and lack of surveillance in enabling destructive acts. Based on this theoretical mapping, the article argues that vandalism is a multidimensional social phenomenon that requires a comprehensive approach, incorporating not only legal intervention but also strengthened social attachment, community empowerment, and more inclusive public space planning that is responsive to societal needs. It is hoped that this analysis can provide a more comprehensive understanding of the sociological roots of vandalism on railway assets and formulate practical implications for developing more holistic, community-based, and sustainable prevention strategies beyond merely repressive approaches.
