Abstract

The principle of freedom of contract can be interpreted as the freedom of the parties to make or not make an agreement, the freedom to choose or determine with whom the business partner will carry out the agreement, then the freedom to choose the content and form of the things you want to make an agreement with. However, the freedom granted in the principle of freedom of contract is not absolute or without restrictions at all. The existence of this principle must be given restrictions so that contracts made by business people do not harm one of the parties involved in the agreement. This study aims to find out how to limit the principle of freedom of contract in designing business contracts and to find out the structure of designing business contracts. The type of research used in this study uses a normative juridical approach, in obtaining several sources of law in this study derived from primary, secondary and tertiary legal sources. The data collection technique used was a literature review technique (study document). The results of this study found that the principle of freedom of contract contains restrictions that may not be violated in order to create justice and equality of the parties

Abstract

Challenge human resources management is creating various organizations' variety but demands efficient, effective, and also productive knowledge. This study discusses the creativity model in improving organizational performance at Hasanuddin University Hospital Makassar. This hospital has facilities and human resources consisting of medical and non-medical personnel to support all service activities. However, the application of the right model of creativity in work has not been fully implemented properly. there are still employees who do not have creativity at work, especially in solving problems when working. To be able to improve organizational performance at the Hasanuddin University Makassar Hospital, an appropriate creativity model is needed that can be applied in facing increasingly fierce competition in the Industrial Revolution era which features technological excellence. This study aims to determine the creativity model for improving organizational performance at Hasanuddin University Hospital Makassar. The type of research used is descriptive qualitative research where this research describes in depth by examining all the problems that occur related to the research focus with a phenomenological approach. Data collection techniques in the form of Observation, Interview, and Documentation. Data analysis techniques include examining all available data that has been obtained from various sources, presenting data, and verifying it. The results of the study show that the creativity model in improving organizational performance has been implemented quite well, where most employees have enough creativity at work. For organizational performance to get better, the Hasanuddin University Makassar Hospital should always develop an appropriate and appropriate model of creativity.

Abstract

Actor collaboration in the implementation of renewable policies is very important to do to deal with climate change and to realize new zero emissions. This study aims to analyze the collaboration of actors in realizing new zero emissions by 2060 through accelerating renewable energy in South Sulawesi Province. The research method uses a qualitative approach. Data sources include primary and secondary data. The informants of this research are the stakeholders involved in the implementation of renewable energy policies. Data collection methods include observation, in-depth interviews and documentation as well as data analysis techniques using interactive data analysis methods. Apart from that, there is also a sectoral ego that is happening in the South Sulawesi government and also BUMN PLN partners who delegate budget allocations for the distribution of electric vehicles as well as political intervention that requires the electric vehicle program to be carried out by the party the government wants, which is different from the wishes of the government. other partners. On the other hand, the findings of this study also found that the collaboration of government actors and the private sector did not provide clear certainty regarding the financial and non-financial benefits that could be obtained by investors and the community when the electric vehicle program was fulfilled for use by the people in South Sulawesi.

Abstract

Academic cheating is any dishonest act committed by students in order to gain achievement in the academic realm. independent variable (X) and academic fraud in online learning as the dependent variable (Y). This study analyzes the factors that encourage students to commit fraudulent behavior, especially in online learning. This study used observation data collection techniques, questionnaires and documentation by collecting sample data of 96 students. While the data analysis technique used is descriptive statistical analysis. The regression model feasibility test tool used is the classical assumption test. The hypothesis testing tools used are simple linear regression analysis, multiple linear regression analysis, T test, F test and R2 test. The results of this study prove that there is a positive and significant influence of each variable from pressure, opportunity, rationalization, ability and arrogance towards academic cheating in online learning partially and simultaneously.

Abstract

Order and architectural beauty are preconditions or the basis for the competitiveness of sustainable tourism destinations in many regions around the world. Appreciation of order and architectural beauty is an old approach that needs to be re-actualized in the context of developing an integrated tourism component based on local competencies. Qualitative research with a phenomenological approach explains the noumena (meaning) behind the phenomena (facts) regarding order and the beauty of natural and artificial socio-technical architecture in tourism destinations in Tana Toraja Indonesia. The results of the study found that there are works of natural architecture that are orderly (ordered) and beautiful and have symbolic meaning as a result of the creation of God Almighty so that they are used as preconditions or the basis for the competitiveness of tourism destinations in Tana Toraja. Appreciation and articulation of basic values and noumena value orientations behind natural and artificial architectural phenomena are reflected in the order and beauty of nature and the environment of the tourism destinations being studied. Order and the beauty of natural and artificial architecture are the results of the creation of God Almighty as a comparative advantage and the result of the creativity and innovation of local community members with added value as a precondition or basis for the competitiveness of sustainable tourism destinations.

Abstract

The Effectiveness of the Implementation of the One-Stop Integrated Service System at the Office of the Ministry of Religion of North Luwu Regency. The aim is to find out how effective the Implementation of the One Stop Integrated Service System is at the Office of the Ministry of Religion of North Luwu Regency. Data collection techniques used are observation, interviews, and documentation. The data analysis technique used is data condensation technique, data presentation, drawing conclusions or verification. The results of the study show that the implementation of the One Stop Service System at the Office of the Ministry of Religion of North Luwu Regency has been effective but not maximal in terms of three indicators. Achievement of goals is categorized as effective in terms of timeliness and ease of access to services. Adaptability is less effective in terms of the ability to manage good service situations and conditions and readiness to prepare a service environment that is less than optimal. Integration is categorized as effective in terms of good coordination and communication between all parties. related to service. This research can be used as a reference material in developing and improving the quality of services, especially one-stop integrated services to the community in order to support government programs in terms of bureaucratic reform in this case public services, especially in several offices that implement a one-stop integrated service system, this research uses the method qualitative research that focuses on the process and the meaning of the results.

Abstract

Digital banking services are electronic banking services that are developed through the use of customer data in order to provide services to customers quickly, easily, and in accordance with the wishes of customers, and can be carried out by customers themselves, taking into account aspects of security and confidentiality of customer data. This study aims to analyze the effect of digital banking services on profitability and risk profile and analyze the Covid-19 pandemic and capital moderating the effect of digital banking services on profitability and risk profile. This research is a type of causality research that uses secondary data from published reports of 59 conventional commercial banks with Indonesian legal entities over a 7-year period from 2015 to 2021. The sampling technique uses purposive sampling and data analysis in this study uses the Partial Least Square model through the product indicator approach analysis technique. Based on the results of the analysis, digital banking services have a positive and significant effect on profitability and risk profile, the Covid-19 pandemic has not moderated digital banking services on profitability and risk profile, and capital has moderated digital banking services on profitability and risk profile

Abstract

Tracing the tracks of transitional rural development collective policies, is a study of policies designed jointly, between the village government and the local community (read: village). This development departs from local initiatives, taking into account the cultural potential and human resources. This research was carried out in Kaili Village, West Suli District, Luwu, South Sulawesi. The research was carried out using a qualitative method, a sociohistorical approach. The research targets were all community groups (indigenous and immigrant communities) in Kaili Village, and the determination of the research sample was done by purposive sampling. The results of the study show that collective rural development policies are made possible by factors: the figure of the leader, needs and security, and cultural patterns of Siri Pacce. Based on these factors there are a number of collective policies, designed within the Kaili community, namely: social solidarity/solidarity and tolerance, accommodation and assimilation, and mutual cooperation/cooperation and competition. This collective policy enables Kaili's human development, in a harmonious and associative relationship, which is in favor of the interests of the local community and immigrants. A harmonious and humane relationship between the future group and the local community is a relationship that is far from conflict. Cooperation and adjustment in social relations occur in a mutually beneficial relationship, in accordance with village rules.

Abstract

Credit restructuring is an improvement effort made by the Bank in lending activities to debtors who are experiencing difficulties in fulfilling their obligations. This study aims to analyze the effect of implementing credit restructuring through Expected Credit Loss (ECL) on financial performance during the Covid-19 pandemic. This research is a type of causality research with a quantitative approach that uses secondary data obtained from the financial reports of 21 (twenty one) branch offices of PT Bank Negara Indonesia (Persero), Tbk during the period March 2020 to December 2021. The sampling technique uses a non-probability sampling technique with a saturated sampling technique and the data analysis tool in this study uses the SmartPLS application with an evaluation model that can be carried out by assessing the outer model and the inner model. The results of the analysis show that (1) credit restructuring during the Covid-19 pandemic had a positive effect on financial performance, (2) credit restructuring during the Covid-19 pandemic through expected credit loss as an intervening variable had a positive effect on financial performance. According to researchers, this is because the credit facility provided by the Covid restructuring scheme does not require additional reserves for impairment losses expected credit loss.

Abstract

The public organization of each local government in carrying out the implementation of regional autonomy requires human resources, namely local government officials who are able to realize the characteristics of good governance. This study aims to determine; how good is the application of the principles of good governance at the Makassar City DPRD Secretariat, how high is the level of effectiveness of employees at the Makassar City DPRD Secretariat, and how much influence does the application of good governance principles have on employee effectiveness at Makassar City DPRD Secretariat. This type of research is quantitative with using a descriptive and correlational approach. Data collection techniques were carried out through interviews, questionnaires and documentation. Data analysis technique used is data analysis used is descriptive statistical analysis and inferential statistical analysis using simple regression for hypothesis testing. The results of the study show that the level of application of the principles of good governance which focuses on one principle, namely the principle of transparency at the Makassar City DPRD Secretariat, is classified as good category, this is viewed from informativeness, openness, and disclosure). The level of employee effectiveness is in the good category, in terms of alertness, absenteeism, motivation, job satisfaction, workload, and time to complete tasks. There is a significant effect of the application of the principles of good governance on the effectiveness of the work of employees at the Makassar City DPRD Secretariat.
