Abstract

This study examines the phenomenon of marriage without a guardian among former Indonesian migrant workers (TKI) from Aikmel District, East Lombok, in their respective countries. The research method used was qualitative with a sociological approach. Data were collected through in-depth interviews, focus group discussions (FGDs), and documentation studies with 20 respondents. The research results show that the practice of marriage without a guardian has various typologies, ranging from women marrying themselves, using taklik guardians, guardians of local judges (KUA), to guardians with unclear status. The reasons behind these marriages vary, such as seeking protection, avoiding adultery, gaining peace of mind and offspring, and—in some cases—because of a desire to avenge disappointment and freedom of action. Analysis from the perspective of Maqasid Syariah concludes that some reasons for marriage without a guardian, such as protecting the soul, offspring, and honor (hifzh an-nafs, an-nasl, al-'irdl), are in line with the objectives of sharia. However, reasons based on revenge and the desire for absolute freedom without consideration of sharia are considered outside the maqasid of marriage in Islam, even though they may be considered valid from a fiqh perspective by some schools of thought.

Abstract

This study aims to examine the impact of the Torang Muamalah 2025 Program on strengthening the sharia economy and empowering halal MSMEs in Sorong, West Papua. The method used was descriptive qualitative, with data collection techniques through interviews, observation, and documentation. The results indicate that the program has successfully built an inclusive economic ecosystem involving local governments, Islamic financial institutions, Islamic boarding schools (pesantren), and MSMEs. The program provides training, access to Islamic financing, and effective halal certification facilitation to increase the capacity and quality of MSME products. Furthermore, market expansion occurred through participation in the Islamic Economic Festival (FESyar). The program's socio-economic impact, in the form of improved community welfare and new job creation, is significant. In conclusion, Torang Muamalah 2025 is an effective and sustainable model of sharia economic empowerment and can serve as a model for development in other regions. This program not only increases microeconomic capacity but also strengthens the social and spiritual foundations that serve as the foundation for sustainable economic development in West Papua.

Abstract

This study analyzes the practice of Nganyareh Kabin a local term in Jukong Village, Labang District, Bangkalan Regency, for the renewal of a marriage contract, or Tajdid an-Nikah performed by married couples in a legally valid marriage. This study uses a qualitative approach with Alfred Schutz's Phenomenological theoretical framework to understand the subjective meaning of this social act from the perspective of the participants. In practice, Nganyareh Kabin is conducted very simply, privately, and secretly, without a wedding reception or crowd, attended only by the husband, wife, guardian, witnesses, and religious figures (kiai or modin). Despite its private nature, this process ensures the fulfillment of all the pillars and requirements of Islamic law, emphasizing the couple's careful attitude (ihtiyath) to ensure the legitimacy of their renewed bond. The main findings indicate that the participants' motivations are divided into two phenomenological dimensions: the "because motive" and the "in-order-to" motive. Motives stem from past experiences, such as fear of pronouncing divorce due to a major argument, lack of harmony, or financial hardship. Meanwhile, the motives stem from hopes for the future, namely to obtain blessings, recreate a family that is peaceful, loving, and compassionate, ensure a smooth flow of sustenance, and strive for offspring. From Schutz's Phenomenology perspective, Nganyareh Kabin is legitimized by a collective stock of knowledge and intersubjectively accepted within the lifeworld of the Jukong community. This practice serves as a social and spiritual adaptive mechanism that provides inner peace, is recognized by custom (‘urf sahih) and provides benefits (Maslahah Mursalah), despite being outside the framework of positive state law.

Abstract

Marriage serves as a means to establish a legitimate relationship, both religiously and legally, aiming to achieve domestic harmony and offspring. It also intends to preserve the purity of lineage, preventing adultery and its potential impact on descendants and their rights. Constitutional Court Decision No. 46/PUU-VIII/2010 stipulates that children born outside of a legal marriage possess the same rights as those born within one. However, according to the Imam Shafi'i school of thought, children born outside of a legal marriage do not receive the same rights as children born within a legal marriage. This research aims to examine and compare the positive legal policy of the Constitutional Court's decision with the policies proposed by the Imam Shafi'i school of thought. This study employs a normative legal research method, utilizing a library research approach to gather data from various primary and secondary sources. The data analysis method used is descriptive analysis with deductive conclusions. The findings of this research reveal data in the form of the verdict of Constitutional Court Decision No. 46/PUU-VIII/2010, the perspective of the Imam Shafi'i school of thought, findings regarding the recognition of a child's status, and findings concerning the protection of the rights of children born out of wedlock. The data analysis yields results in the form of the concept of child protection according to Constitutional Court Decision No. 46/PUU-VIII/2010 and the Imam Shafi'i school of thought. Furthermore, the research presents findings regarding the legal consequences of the discrepancy between the concept of protecting the rights of children born out of wedlock in Constitutional Court Decision No. 46/PUU-VIII/2010 and the viewpoint of the Imam Shafi'i school of thought.

Abstract

This study examines the role of women in combating corruption. Efforts that must be made by women to play a maximum role in combating corrupt behavior must be planned and systemic efforts, namely: First, it is necessary to build a shared awareness within the Muslim community, that women are complete human beings who are assets and have the potential to build the community. Women were also created to be Khalifah Fil-Ardh, namely as managers on earth together with men, who must be responsible for themselves, to other humans and most importantly to Allah SWT. Second, improve the quality of education both formal and non-formal, and be involved in the interests of all aspects of life. Third, it is necessary to emphasize a shared commitment to all elements of society, both men, women, rich and poor, officials and ordinary people that corruption is a crime against humanity and is a major sin, every element of society must have a part and take a clear role in efforts to eliminate corrupt behavior in their respective scopes.

Abstract

In the daily learning process, several major problems arise. Teachers find that some students have difficulty maintaining previously memorized material, are inconsistent in adding new memorization content, and have not yet fully mastered proper reading techniques before proceeding to the next stage. This study aims to describe the implementation of the Ahsanul Qira’ah, Murojaah, and Ziyadah (AHQMUZI) method and its impact on the achievement of the students’ tahfidz program at MDTA Al-Munawwarah Pamekasan. This research employs a qualitative approach through observation, interviews, and documentation. The results show that the AHQMUZI method is a memorization activity that begins with students reciting verses in a tartil and correct manner using the Ahsanul Qira’ah method. This approach helps improve the quality of students’ recitation before memorization and provides positive effects and strong motivation on students’ memorization. Overall, the AHQMUZI method is effective in supporting the success of tahfidz learning in non-formal basic educational institutions.

Abstract

Science that is currently progressing throughout the world, initially came from the embryo of Muslim scholars' thoughts. In its journey, a paradigm of dichotomy of science and religion emerged which caused a separation between religion and science, as well as religious people and scientists. However, it cannot be denied that science that is currently developing rapidly, in its historical center is Muslim scholars who took part in studying Science based on the first source of Islamic law, namely the Qur'an, one of whom was the 'ulama who lived during the Mamluk Dynasty Imam as-Suyuthi. There are many verses of the Qur'an that indicate knowledge, but other evidence is needed to strengthen it. Departing from this paradigm, the author then analyzes the process of how Imam as-Suyuthi carried out the process of classifying the sciences that originate from the Qur'an which we call istinbath. First, the author determines the verses of the Qur'an, or the opinions of other scholars that indicate or discuss a science. Then, he includes evidence in the form of verses, narrations that are interrelated in the process of istinbath as-Suyuthi until finally a science can be determined, and the branches of science from it.

Abstract

Learning concentration is one of the important factors that determine learning success. This study aims to examine the role of mindfulness in improving learning concentration in secondary education students. This research uses a qualitative approach with a case study method. The research subjects were 10 secondary education students who participated in an 8-week mindfulness program. Data were collected through in-depth interviews, observation, and documentation. The results show that mindfulness can improve students' learning concentration in two ways, namely: (1) Increasing awareness of thoughts and feelings. (2) Improve the ability to manage thoughts and feelings. Based on the results of this study, mindfulness is an important skill to be developed by students in a secondary education environment. The development of mindfulness skills can be done through various activities, such as meditation, yoga, and breathing exercises.

Abstract

This study aims to analyze the implementation of transparency principles in the financial management of Jelegong Village, Rancaekek District, Bandung Regency, and review it from the perspective of Siyasah Dusturiyah. Transparency in village financial management is based on the provisions of Law Number 6 of 2014 concerning Villages, Law Number 14 of 2008 concerning Public Information Disclosure, and Permendagri Number 20 of 2018 concerning Village Financial Management as a normative basis for realizing accountability and public information disclosure at the village level. This study uses an empirical juridical approach with a descriptive qualitative method. The results show that 1) the Jelegong Village government has implemented the principle of transparency through the dissemination of financial information in village deliberation forums and public information boards, but its implementation has not been fully optimal due to limitations in information updates, minimal use of digital media, and low levels of community participation; 2) the implementation of transparency in village financial management from the perspective of Siyasah Dusturiyah has, in principle, reflected the values of trust and maslahah, but has not fully realized justice and information disclosure equally for the entire village community.

Abstract

This article discusses the historical development of madrasas in Madura, where Islamic education has a long history that began during the time of the Prophet Muhammad (peace be upon him) with teaching methods in homes and mosques. Over time, Islamic education has undergone transformation, especially with the emergence of madrasas as formal institutions that integrate religious knowledge and general knowledge. In Madura, Islamic boarding schools are the oldest Islamic educational institutions and play a vital role in maintaining Islamic values, as well as being the beginning of the emergence of madrasas in Madura. With the influence of modernization, madrasas emerged as a form of renewal of Islamic education. This study discusses the rise of madrasas in Madura, their important role in shaping the character and religious identity of the community, as well as the challenges and opportunities faced. Madrasas in Madura have successfully combined traditional values with the demands of modernity, while also becoming agents of social change that maintain harmony between the two. Despite facing challenges such as limited facilities and teacher quality, madrasas in Madura continue to play a vital role in maintaining the balance between religious education and general knowledge, as well as in strengthening the cultural and religious identity of the Madurese community. This study uses a literature review method by examining articles related to this research.
