Abstract

A rule-based system of World Trade Organization (WTO) should be supported by effective mechanism of disputes that ensure the Dispute Settlement Body (DSB) rulings toward the respondent could be enforced. The WTO DSM aims to provide predictability and security in international trade by providing strict time-frames, and was designed to be mutually agreed by the disputing members, flexible and binding. For the developing countries in the WTO, they need major effort in terms of training and institutional reform to meet the challenges of participation in the WTODSM. Indonesia has involved in the WTODSM. Sistem perdagangan WTO harus didukung oleh mekanisme penyelesaian sengketa yang efektif. Kepatuhan pada putusan Dispute Settlement Body (DSB) sangat penting agar manfaat perdagangan dapat dirasakan oleh seluruh anggota WTO, termasuk negara-negara berkembang. Dispute Settlement Understanding (DSU) WTO memberikan keamanan dan prediktabilitas atas proses sengketa di WTO yang dibutuhkanoleh seluruh anggota WTO sehingga memberikan kesempatan luas bagi negara-negara anggota WTO untuk berpartisipasi dalam mekanisme penyelesaian sengketa di WTO, termasuk Indonesia.

Abstract

This study aims at revealing two prime points (1) how is Indonesian Language utilized in legal practice in Indonesia and (2) which method is frequently used by legal practitioners in interpreting a certain word? This is a descriptive-qualitative study. The data of the research are sentences or phrases taken randomly from the criminal code (KUHPidana), civil code (KUHPerdata), trade code (KUHDagang), decrees, explanations of legislation (laws). The analysis employed is descriptive and prescriptive. It was figured out that the use of Indonesian language in legal aspect was manifested in seven processes: translation, abstraction, association, typology, meaning emphasis, simplicity, and legal choices. While the interpretive method used is interpretations and construction methods. Tulisan ini bertujuan menjawab dua persoalan, yaitu (1) bagaimana wujud penggunaan bahasa Indonesia dalam praktik hukum di Indonesia, dan (2) metode yang seringkali digunakan oleh praktisi hukum dalam menginterpretasikan suatu kata. Jenis penelitian yang digunakan adalah deskriptif kualitatif. Datanya adalah kalimat atau frasa yang diambil secara acak dari KUHPidana, KUHPerdata, KUHDagang, surat-surat keputusan, dan penjelasan undang-undang. Analisis datanya adalah analisis deskriptif dan preskriptif. Diketahui bahwa wujud penggunaan bahasa Indonesia dalam bidang hukum ada tujuh proses (penerjemahan, abstraksi, asosiasi, tipologi, penekanan makna, pemadatan, dan pilihan hukum). Sementara metode penginterpretasiannya adalah metode penafsiran dan metode konstruksi.

Abstract

This study analyses the problematic position of Presidential Instruction 1/1991 within Indonesian legislation system after the enactment of Act 10/2004. It also finds that religious court judges still base their decision on Compilation of Islamic Law. Apparently, CIH is regarded as a living law and as an Indonesian fiqh. Penelitian ini menganalisis kedudukan Inpres 1/1991 dalam sistem perundangundangan Indonesia pasca berlakunya UU 10/2004 dan menyelidiki faktorfaktor penyebab hakim peradilan agama menggunakan KHI sebagai salahsatu dasar hukum dalam memeriksa perkara. Hasil menunjukkan bahwa kedudukan Inpres 1/1991 problematik dan bahwa KHI dipandang sebagai hukum yang hidup dan sebagai fikih khas Indonesia.

Abstract

This article compares the provisions on moral rights in Indonesian Copyright Act, Copyright Bill, and The Berne Convention. The legality of parallel importation and the sui generis protection of traditional knowledge are also observed by referring to the Copyright Bill and Traditional Knowledge Bill. Tulisan ini membandingkan pengaturan mengenai hak moral menurut Undangundang Hak Cipta, RUU Hak Cipta dan Konvensi Berne. Selain itu, tulisan ini juga mengkaji legalitas impor paralel dan perlindungan sui generis terhadap pengetahuan tradisional dengan merujuk kepada RUU Hak Cipta dan RUU Pengetahuan Tradisional.

Abstract

There are several weaknesses of UU LLAJ. The first weakness is related to centralistic approach used in the UU. Second, the content of the UU has not yet been adjusted with several related new regulations. Third, it has not yet integrate land, marine and air transport. Forth, there are overlaps among related institutions on their rights and responsibilities. Fifth, it has not yet accommodated low-cost and efficient public services. RUU LLAJ, on the other hand, is drafted to elucidate the weaknesses of UU LLAJ. Some changes regulated on RUU LLAJ are regarding decentralization approach, new type of license and new authority on issuing license, and the integration of land, marine and air transport. Furthermore, the RUU LLAJ regulates public participation which has not yet regulated in UU LLAJ. Some of the changes are positive. However, the changes regarding the license system could increase public burden and could cause public confusion.

Abstract

AbstractInter-dynastic marriage today has been commonly held by Hindu community that has a vertically closed social stratification called dynasty. Couples who wants to perform inter-dynastic marriages before 1951 are required to conduct patiwangi ceremony in addition to the discharge penalty into areas outside Bali (Selong). Sanctions of patiwangi ceremony have been removed by some rules, but the community still conducts it. From this background, problems arise as follows: What is the meaning of patiwangi ceremony? Why are people still perform the patiwangi ceremony sanction?. The method used is the type of empirical legal research, using qualitative descriptive analysis. The meaning of patiwangi sanctions is to lower dignity and honor of a caste woman. People still perform the patiwangi because patiwangi is a legal culture that has penetrated into the soul of Hindu community in Bali.IntisariMakna sanksi upacara patiwangi adalah menurunkan derajat, kehormatan, keharuman wangsa dari perempuan yang memiliki wangsa brahmana, ksatria, dan weisya. Upacara patiwangi mengandung pelecehan baik dari segi sebutan istilah maupun pelaksaan upacara patiwangi. Oleh karena itu sudahsepantasnya upacara patiwangi dihapus, karena tidak sesuai dengan nilai-nilai kesetaraan, nilai-nilai kemanusiaan, nilai-nilai keadilan, dan nilai-nilai kearifan lokal. Berdasarkan hasil penelitian upacara patiwangi masih tetap dilakukan oleh masyarakat Hindu karena merasa yakin sanksi upacara patiwangi akan membawa keseimbangan dan kebaikan bagi pelaku perkawinan antar-wangsa. Upacara patiwangi sudah menjadi budaya hukum hukum bagi sebagian masyarakat Hindu di Bali.

Abstract

The Fault liability principle can not provide the maximum protection for passengers, meanwhile the passenger accident insurance as a form of carrier liability containing the potential uncertainty of the insurance compensation. The absolute liability principle should be enforce which accompanied by a ceiling system related the passenger accident insurance, and similarly the strict liability principle should be enforce too to fulfil the rights of victims in obtaining compensation for all losses suffered. The government should immediately established an insurance company for the passenger accident and revise Law No. 22 of 2000. Prinsip tanggung jawab pengangkut yang berdasarkan kesalahan, tidak dapat memberikan perlindungan hukum yang maksimal bagi penumpang (korban kecelakaan). Sedangkan keberadaan program asuransi kecelakaan penumpang sebagai wujud tanggung jawab pengangkut mengandung potensi ketidakpastian pembayaran asuransinya. Seharusnya diterapkan absolute liability principleyang disertai dengan sistem plafondterkait dengan program asuransinya, dan strict liability principleuntuk memenuhi hak korban dalam memperoleh ganti kerugian atas seluruh kerugian yang dideritanya. Pemerintah seharusnya segera membentuk perusahaan asuransi untuk kecelakaan penumpang dan merevisi UU Nomor 22 Tahun 2009.

Abstract

Law-making in Indonesia is generally based on formal-legal aspects and legislator’s political will, thus resulting in legislations that do not conform to society’s aspirations nor answer their needs. This paper discusses a responsive model legislation hence it could meet community needs, provide legal certainty, and ensure justice and welfare. Pembentukan peraturan perundang-undangan di Indonesia yang biasanya ditentukan oleh aturan hukum formil dan kemauan politik pembentuk undang-undang membuat produk perundang-undangan tidak sesuai dengan aspirasi masyarakat dan tidak menjawab kebutuhan mereka. Tulisan ini membahas model undang-undang yang responsif sehingga dapat memenuhi kebutuhan masyarakat, memberikan kepastian hukum, dan menjamin keadilan dan kesejahteraan.

Abstract

In developed countries, conflicts between environmental interests and agricultural emissions can not be avoided. Within the legal formal perspective, it is often assumed that all environmental conflicts are solved through the legal-formal system. In reality, however, the conflict between environmental concern and agricultural practices is complicated by wide variety of interests and mere legal formal approaches will not be adequate to solve them. This conflict as it relates to nitrate emissions will be referred to herein as the ‘nitrate conflict’. The role of civil society, in this case the Environmental Non-Governmental Organizations (ENGOs), are often neglected in the nitrate conflict management. This study will document and analyze nitrate con.ict management in the Netherlands and Flanders Belgium, on the roles of ENGOs regarding the issue. Moreover, the research will emphasize the important role of ENGOs in civic engagement in developing democratic and just environmental management.

Abstract

The infamous complexity of having a proper definition for crime of aggression began a long time ago.  A working definition has been discussed by experts and scholars from time to time. However, they have not reached into a common understanding, including the International Law Commission. The amendment to the Rome Statute, taking place on June 12, 2010, was expected to deal with the problemsof definition. In addition it will also be a guidance to categorize such a crime as a crime of aggression,particular in terms of elaboration of elements of crime of aggression. Kompleksitas pendefinisian kejahatan agresi telah terjadi sejak beberapa tahun yang lalu. Definisi kejahatan agresi telah diperdebatkan oleh para ahli termasuk didalamnya Komisi Hukum Internasional, namun hingga kini perdebatan terus terjadi. Hasil amandemen atas Statuta Roma yang ber-langsung di Kampala Uganda 12 Juni 2010 akan menjadi jalan keluar untuk mengatasi perdebatan dimaksud. Di samping itu, amandemen tersebut dapat menjadi rambu-rambu dalam menguraikan elemen kejahatan agresi, sehingga kejahatan yang diduga sebagai kejahatan agresi dapat diuraikan dengan takaran yang baku (standard) menurut hukum internasional.
