Abstract

According to executor attorney opinion, no time limit for application clemency, it wills be performing deep constraint on dead punishment execution. Execution of dead punishment also constraint by rule that allows criminal to propose the second clemency application. This constraint still is added by condition that second clemency application is two years of first clemency rejection. Meanwhile according to criminal lawyer reception, with no rule upon, constitute a advantage by criminal dead, since it can propose clemency without time limit for first clemency application and also second application, so execution could be delayed. At Yogyakarta court since year 2002 until now there is no criminal propose clemencies. It is caused, firstly, certain verdict type that could be requested for clemency, secondary by apply clemency cause dead sentence is no postpone except for dead verdict, thirdly most criminal on narcotic and drug abuse case was pleased with first grade verdict.

Abstract

This research is empirical law research. The collecting data were analyzed by qualitative and presented descriptively. The research can be concluded as follows: reasons for maintaining delict adat law are religious environment, maintaining norms politeness, adat executed as long as no conflict with the written law and the protection of women. Types of sanction are warning in a visit at night, asked to leave the house for interrogation, community sanctions; the reasons of sanction are near the mosque, maintaining delict adat law, neglection of verbal warning, anticipation pregnant before marriage and aruh-aruh culture must be maintained. Jenis penelitian ini adalah yuridis empiris. Data yang terkumpul dianalisis secara kualitatif dan disajikan deskriptif. Kesimpulan riset adalah: Pertama, alasan mempertahankan hukum delik adat karena lingkungan riligius, menjaga norma kesopanan, adat dijalankan asalkan tidak berbenturan dengan peraturan tertulis dan perlindungan perempuan. Kedua, proses penerapan sanksi masyarakat adalah peringatan dalam bertamu di malam hari, diminta keluar rumah untuk diinterogasi, diberi sanksi yang ditentukan musyawarah masyarakat. Ketiga, alasan penjatuhan sanksi pengusiran adalah lingkungan dekat masjid, mempertahankan hukum delik adat, tidak mengindahkan peringatan, pencegahan hamil di luar nikah, perlunya budaya aruharuh (tegur sapa) harus dipertahankan.

Abstract

Basic Agrarian Law Act (BAL) of 1960 which sets out the foundation for agrarian reform fails to solve Indonesia’s many land-related problems. In addition to the fact that its mandate has not been implemented, there are a cornucopia of inferior rules under the BAL that run afoul with the Pancasila and the 1945 Constitution. This normative research employs library research method. Library research was carried out by studying documented materials. We find that an agrarian reform which encapsulates the paradigm of Pancasila is yet to be realised given the many irregularities found in the implementation. We conclude that the affirmation and the revitalization of Pancasila values in the national agrarian politics is of utmost necessity. Undang-Undang Pokok Agraria (UUPA) 1960 sebagai induk reforma agraria belum mampu menjadi jawaban atas permasalahan agraria di Indonesia. Selain karena banyak amanatnya belum dilaksanakan, banyak juga aturan-aturan di bawahnya yang bertentangan dengan Pancasila, UUD 1945. Penelitian ini merupakan penelitian normatif, yaitu penelitian yang didasarkan pada penelitian kepustakaan. Penelitian kepustakaan dilakukan dengan merujuk pada bahan-bahan yang didokumentasikan dengan alat studi dokumentasi. Hasil penelitian menunjukkan reforma agraria berparadigma Pancasila belum mampu diwujudkan karena banyak ditemukan penyimpangan dalam pelaksanaannya. Oleh karena itu, sangat mendesak adanya penegasan dan revitalisasi nilai-nilai Pancasila di dalam politik agraria nasional.

Abstract

This writing is intended to disseminate the concept of copyright, related right, and industrial design to researchers and professors at universities. It also discusses the recent development on the protection of those rights according to international convention and Indonesian law, as well as explains the procedures to admit the rights.  Tulisan ini merupakan bahan dalam rangka sosialisasi hak cipta, hak terkait, dan desain industri kepada peneliti dan dosen di perguruan tinggi. Tulisan ini membahas perkembangan seputar perlindungan hak-hak tersebut berdasarkan konvensi internasional dan hukum Indonesia, serta menjelaskan prosedur dan persyaratan permohonan pendaftaran hak.

Abstract

AbstractThe PDAM of Tangerang City as a public service, it is inseparable from the risk of violation of consumer rights. This research used mixed method. Researcher concluded that the gap showed the PDAM of Tangerang City service quality not in accordance with customer expectation, that reflect the consumer rights have not been fulfilled. Based on the Law Number 8 year 1999 on Consumer Protection, the consumer rights to get education and claim compensation through class action. The cancellation of The Law Water Resources also provides consumer rights protection with create the six basic principles of water resources management restrictions.IntisariPDAM Kota Tangerang sebagai pelaku usaha pelayanan umum, maka tidak terlepas dari resiko pelanggaran terhadap hak-hak konsumen. Penelitian ini menggunakan metode penelitian kombinasi. Peneliti menyimpulkan bahwa adanya kesenjangan menunjukkan bahwa kualitas pelayanan yang diselenggarakan oleh PDAM Kota Tangerang belum sesuai dengan harapan para pelanggan, yang merefleksikan hak-hak konsumen belum terpenuhi. Berdasarkan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen, konsumen berhak untuk mendapatkan pembinaan dan pendidikan, dan hak menuntut ganti rugi melalui gugatan perwakilan. Pembatalan Undang-Undang Sumber daya Air juga memberikan perlindungan hak konsumen atas air dengan melahirkan enam prinsip dasar pembatasan pengelolaan sumber daya air.

Abstract

The transfer in the functions, duties, and authority for regulation and supervision as stipulated in Article 55 of the Act concerning the Financial Services Authority (OJK) does not include the transfer of authority in filing a petition for bankruptcy. The authority to file a bankrupty petition against a debtor in the financial services sector still refers to Article 2 paragraph (3) to (5) Act No. 37 of 2004 concerning Bankruptcy and Suspension of Payment. Peralihan fungsi, tugas dan kewenangan pengaturan dan pengawasan sebagaimana dimaksud dalam Pasal 55 Undang-undang tentang Otoritas Jasa Keuangan (OJK) tidak termasuk peralihan kewenangan pengajuan pailit. Kewenangan untuk mengajukan permohonan pailit terhadap debitor yang bergerak dibidang jasa keuangan tetap mengacu pada Pasal 2 ayat (3) sampai (5) Undang-Undang Nomor 37 Tahun 2004 tentang Kepailitan dan PKPU.

Abstract

Exclusive rights on trademark also cover the right to give permission to others to use the mark. Rights licensing is a licensing agreement. It takes two main principles of contract law, namely freedom of contract and good faith to enforce the contract. Strengthening the principles as the basis for the creation and implementation of a mark license agreement is required given the continuity of the implementation of a mark licensing agreement is highly dependent on the goodwill of the parties to implement the agreement. Strengthening of the principles can be achieved when the parties are honest and fully undertake to honour the agreement which they had agreed together. Hak eksklusif pada hak atas merek termasuk hak untuk memberi izin pada orang lain untuk menggunakan merek. Hak pemberian izin tersebut merupakan perjanjian lisensi. Diperlukan dua prinsip utama hukum kontrak, yakni prinsip kebebasan berkontrak dan prinsip itikad baik untuk menegakkan kontrak yang disepakati. Penguatan prinsip kebebasan berkontrak dan itikad baik sebagai dasar pembuatan dan pelaksanaan perjanjian lisensi merek diperlukan mengingat keberlangsungan pelaksanaan perjanjian lisensi merek sangat tergantung pada niat baik para pihak untuk melaksanakan isi perjanjian. Penguatan terhadap kedua prinsip itu dapat tercapai manakala para pihak secara jujur dan penuh tanggungjawab melaksanakan isi perjanjian yang telah mereka sepakati bersama.

Abstract

This research is aimed to know the contribution government and societies in Yogyakarta for maintaining the water pollution on Code River. Code River is a river in Yogyakarta which has crowded area on its river flow region. The research location is in Code’s river flow region, especially in Kelurahan Prawirodirjan Kecamatan Gondomanan dan Kelurahan Wirogunan Kecamatan Mergangsan Yogyakarta.Data in this research were obtained through field research and library research. The field research was carried out by using interview guidance and sample waste data testing from Balai Besar Teknik Lingkungan (BBTKL) Yogyakarta, whereas the library research was done by documentary study by collecting and analyzing selected laws and regulation which were relevant to the research.The result showed that the environmental data to maintain environment health and social condition in the field research has not been served. Beside that, the result of laboratory testing BBTKL showed that water condition on field research has contained pollutant. However, the government and societies just give less contribution to decrease the effect of water pollution on Code River. In this case, the contribution of laws and regulation has been needed to decrease the water pollution.

Abstract

Persetujuan pasien atau keluarga pasien sangat dibutuhkan dokter sebelum dilakukannya tindakan medis oleh dokter, namun sebelumnya pasien atau keluarga pasien membutuhkan informasi dari dokter atau disebut informed consent terkait tindakan medis tersebut. Transaksi terapeutik yang dilakukan dokter bisa terjadi setelah informed consent diterima oleh pasien. Hal ini menjadi bagian dalam hukum Perdata karena terjadinya transaksi terapeutik berdasarkan dari perjanjian yang akhirnya menimbulkan hak dan kewajiban pada dokter dan pasien sebagaimana diatur dalam Pasal 1330 KUHPerdata.Kata Kunci : Dokter, Pasien, Tindakan Medis.

Abstract

Communal land is the identity of indigenous communities whose existence is protected by the Constitution. Customary land is not only used for the purposes of indigenous peoples, but also exploited by the outsiders. This study examines how the pattern of the legal relationship between the indigenous people and to outsiders by using socio-legal research. This study was conducted in West Sumatera by limiting the study to the four natural resource sectors, namely plantations, water resources, mining and forestry. The results of this study indicate that the legal relationships that are not obvious to trigger disputes between indigenous people and outsiders. Tanah ulayat merupakan identitas masyarakat hukum adat yang diakui dan dilindungi keberadaannya oleh UUD 1945. Tanah ulayat tidak hanya digunakan untuk keperluan masyarakat hukum adat, namun juga dimanfaatkan oleh pihak luar. Penelitian ini mengkaji bagaimana pola hubungan hukum antara masyarakat hukum adat dengan pihak luar dalam pemanfaatan tanah ulayat dengan menggunakan pendekatan yuridis empiris. Penelitian ini dilakukan di Sumatera Barat dengan membatasi kajian pada 4 (empat) sektor sumberdaya alam, yaitu perkebunan, sumberdaya air, pertambangan dan kehutanan. Hasil penelitian ini menunjukkan bahwa ketidakjelasan hubungan hukum menjadi pemicu munculnya sengketa antara masyarakat hukum adat dengan pihak luar di dalam pemanfaatan tanah ulayat.
