Supervision and control of utilization of water resources for irrigation in Sleman regency is vital in realizing fair use of water resources. This descriptive-qualitative study finds that preventive-internal supervision has been consistent with those set forth in the working procedures and that repressiveinternal supervision is present in the form of sanctions. The locals enjoy preventive and repressive eksternal supervisionary role, which is manifested in local gatherings and public reporting system. We also find that the government exerts control by licensing, reprimands, advocacy, direction, and conflict resolution mechanisms. Practical problems include the absence of provincial irrigation commission and specific agencies that supervise the enforcement of mediation. Pengawasan dan pengendalian pemanfaatan sumber daya air untuk irigasi di Kabupaten Sleman sangat penting dalam mewujudkan penggunaan sumber daya air yang adil. Hasil penelitian menunjukkan bahwa pengawasan internal-preventif telah sesuai dengan yang dimandatkan oleh tugas pokok dan fungsi dan bahwa pengawasan internal-represif telah dilaksanakan dalam bentuk sanksi. Masyarakat melakukan pengawasan preventif dan represif dalam bentuk sarasehan/musyawarah dan sistem pelaporan. Penelitian ini juga menunjukkan bahwa pemerintah mengendalikan penggunaan sumber daya air dengan menyelenggarakan sistem perizinan, teguran, pembinaan, dan penyelesaian sengketa. Beberapa masalah yang ditemukan di lapangan antara lain adalah tidak adanya komisi irigasi provinsi dan lembaga pengawas khusus yang mengawasi pelaksanaan putusan mediasi.

This research has two purposes. First, to argue the effectiveness of control by the National Agency of Drug and Food Control concerning distribution of imported processed food products in establishing consumer protection. Second, to analyze the obstacles faced by the National Agency of Drug and Food Control in the distribution control of imported processed food products in Indonesia. The research result shows that, first: the control by the National Agency of Drug and Food Control concerning distribution of imported processed food products in establishing consumer protection in Indonesia is ineffective yet. The proof is that there are imported processed food products which are illegal and still distributed in Indonesia without permission, also unsafe to be consumed. Moreover, there are imported processed food products which contain dangerous materials and danger to be consumed even though they have license to be distributed in Indonesia. Second, the obstacles faced by the National Agency of Drug and Food Control in controlling the imported processing food products in Indonesia include two categories, the internal and external aspects.

AbstractHazardous and Toxic Waste (B3 in Indonesian abbreviation) have specific types and characteristics which could harm the environment itself and/or human health and other living being if thrown away to the environmental medium without proper treatment. On this basis, integrated hazardous waste treatment is needed to be regulated in a regulatory framework. Indonesian environmental law regime under Law no 32/2009 (EPMA) has given an integrated regulatory framework which intertwined every knot of hazardous and toxic waste treatment, including: containment, collecting, transporting, treatment, reuse, and dumping by Government Regulation No 101 year 2014. This article briefly explains the hazardous and toxic waste integrated treatment in Indonesia, both from the regulatory framework perspective and from environmental law aspect analysis.IntisariLimbah Bahan Berbahaya dan Beracun atau limbah B3 memiliki sifat dan karakteristik tersendiri yang dapat menimbulkan bahaya terhadap lingkungan hidup itu sendiri maupun kesehatan manusia serta makhluk hidup lainnya apabila dibuang langsung ke dalam media lingkungan hidup. Atas pertimbangan itulah, pengelolaan limbah B3 menjadi suatu kewajiban untuk diatur di dalam kerangka perundang-undangan. Rejim hukum lingkungan berdasarkan UU 32/2009 (UUPPLH) memberikan pengaturan secara terpadu yang menghubungkan keterkaitan setiap simpul Pengelolaan Limbah B3 yaitu kegiatan penyimpanan, pengumpulan, pengangkutan, pengolahan, pemanfaatan, dan penimbunan limbah B3 melalui PP Nomor 101 Tahun 2014. Artikel ini memaparkan secara ringkas konsep pengelolaan limbah B3 baik dalam kerangka pengaturan yang ada serta dengan analisis dari aspek hukum lingkungan yang terkait di dalam pengelolaan limbah B3 secara terpadu.

This study was aimed to investigate the Implementation of Energy Law of Hybrid Power Station for Social Welfare in Pantai Baru. The problem formulations are the management and utilization of hybrid power station in Pantai Baru and implementation of energy law of hybrid power station for social welfare in the fields of economy and information in Pantai Baru. Based on data analysis it is concluded that the management of hybrid power station in Pantai Baru is performed collaboratively between government and the society. The existence of hybrid power station in pantai baru has positive impacts in economy and information. Penelitian ini meneliti Pelaksanaan Hukum Energi Pembangkit Listrik Tenaga Hibrid untuk Kesejahteraan Rakyat di Bidang Ekonomi dan Informasi di Pantai Baru. Masalah yang diteliti adalah bentuk pengelolaan dan pemanfaatan pembangkit listrik tenaga hibrid di Pantai Baru dan pelaksanaan hukum energi pembangkit listrik tenaga hibrid untuk kesejahteraan rakyat di bidang ekonomi dan informasi di Pantai Baru. Berdasarkan analisis data dapat disimpulkan bahwa pengelolaan pembangkit listrik tenaga hibrid yang ada di pantai baru dilakukan secara kolaboratif, antara pemerintah dengan masyarakat. Kehadiran pembangkit listrik tenaga hibrid yang ada di pantai baru telah memberikan dampak positif di bidang ekonomi dan informasi.

This article aims at exploring the dynamics of women’s property right in southern US culture, which is interwoven with and embroided by loss and victories, as well as accomodation and resistance. This study demonstrates that women’s property right is greatly influenced by the masculinity and patriarchial power of southernmen. Tulisan ini bertujuan menelaah dinamika perkembangan hak wanita atas properti di AS bagian selatan yang dihiasi sulaman kemenangan dan kekalahan serta akomodasi dan resistensi. Tulisan ini menunjukkan bahwa hak wanita atas properti sangat dipengaruhi oleh maskulinitas dan kekuasaan patriarkal suami-suami di daerah Selatan.

Developing countries believe that the TRIPS Agreement gives more benefits to pharmaceutical companies of developed countries and prevents access to cheaper and affordable drugs. A reduction of drug prices has occurred when developing countries applied safeguards, such as parallel imports and compulsory license. The effort to enact safeguard legislation has resulted in US legal action, such as the dispute between the US government and the Brazilian government when Brazil considered the adoption of compulsory license. Another example was a dispute between big pharmaceutical companies and the South African government in its plans for adoption of parallel imports and compulsory license. These disputes demonstrate that the TRIPS safeguard articles are weak and meaningless because the interpretation of those articles has favored the developed countries’ perspectives.

Certain provisions of Presidential Regulation No. 36 of 2010 concerning Negative Investment List are not clearly stipulated. In relation to the restrictions of foreign investment in certain business sectors asspecified in the Negative Investment List Article 33 para. (1) and (2) of the 2007 Investment Law expressly prohibits investors from entering into any nominee shareholding documentation. Notwithstanding, manynominee shareholding practices are still employed in Indonesia, aiming to circumvent such restrictions.This paper addresses certain issues on Presidential Regulation No. 36 of 2010 and nominee shareholding practices in Indonesia. Beberapa ketentuan dalam peraturan Presiden No. 36 Tahun 2010 yang mengandung ketentuan Daftar Negatif Investasi tidak dirumuskan secara jelas. Sehubungan dengan pembatasan kepemilikan modal asing di beberapa sektor usaha, Pasal 33 ayat (1) dan (2) Undang-Undang Penanaman Modal No. 25 Tahun 2007 secara tegas melarang penanam modal membuat dokumen-dokumen yang terkait dengankepemilikan saham secara nominee. Namun demikian, praktik kepemilikan saham secara nominee masih sering dilakukan di Indonesia untuk menghindari pembatasan tersebut. Tulisan ini akan membahasbeberapa permasalahan yang berhubungan dengan Peraturan Presiden No. 36 Tahun 2010 dan praktek kepemilikan saham secara nominee di Indonesia.

Judges may write a dissenting opinion in court judgments. However, this practice seems to be rarely observed in both civil and criminal cases at Yogyakarta District Court and Sleman District Court. From 2004- 2010, only 4 out of 6.634 court judgments are rendered with dissenting opinions appended. Hakim dapat menulis pendapat yang berbeda dalam putusan pengadilan. Namun praktik penulisan perbedaan pendapat ini belum banyak diikuti di Pengadilan Negeri Yogyakarta dan Pengadilan Negeri Sleman. Perbedaan pendapat hanya terdapat dalam 4 putusan dari 6.634 putusan pengadilan selama tahun 2004 sampai 2010.

The compatibility between Islamic law and international law has been a long lasting source of both academic discussion and social friction. This includes the Islamic laws on conduct of war (IsHL), especially in context of the Middle East conflicts. This article explores how there are two extreme opinions: ‘Islamophobes’ and apologists –both of them being dishonest. It will be shown that there are multi-level possibilities of relations between IsHL and International Humanitarian Law including possible incompatibilities, and that an ijma is a good room for reconciliation. Kompatibilitas hukum Islam dan hukum internasional telah lama menjadi sumber debat akademis dan friksi social. Termasuk diantaranya adalah hukum Islam terkait pelaksanaan perang, terutama di tengah konflik Timur Tengah seperti sekarang. Artikel ini mengamati dua pendapat ekstrim: ‘Islamofobik’ dan ‘apologist’ –keduanya tidak jujur. Akan ditunjukan ada berbagai tingkat kemunginan hubungan antara hukum perang Islam dan Hukum Humaniter Internasional, termasuk diantaranya adalah kemungkinan pertentangan, lalu bagaimana dibutuhkan sebuah ijma untuk menyelesaikan masalah tersebut.

This juridical-normative research was conducted on the basis of secondary data as its primary source. We analysed the data using qualitative method and present our findings in a descriptive discussion. This research studies the balance of rights and obligations of workers and employers by analyzing Act Number 13 of 2004 on Manpower. In the same regulation, it was found that there was no balance in the rights of workers and employers in situation of a labour strike. The provisions in the regulation hinders strikes to be legally initiated, this is seen from the inbalance in strike and lock out provisions where procedures to initiate a strike is made to be more difficult. Penelitian ini bersifat yuridis normatif, mendasarkan pada data sekunder sebagai sumber data utama. Data yang diperoleh dari penelitian dianalisis secara kualitatif. Hasil analisis selanjutnya disajikan dalam bentuk uraian yang bersifat deskriptif.Penelitian ini dilakukan untuk menjawab pertanyaan bagaimanakah perimbangan hak dan kewajiban pekerja dan pengusaha dari segi teks Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan. Kesimpulan yang didapatkan bahwa memang ada ketidakseimbangan hak pekerja dan pengusaha dalam ketentuan mogok kerja yang diatur dalam Undang-Undang Ketenagakerjaan. Terdapat ketentuan yang dapat menyulitkan mogok berlangsung secara sah, ketidakseimbangan juga terlihat jika ketentuan mogok kerja dibandingkan dengan ketentuan lock out yang merupakan hak dasar pengusaha.
