Abstract

Justice in Islam is all-embracing, free from restriction, and universal. Islam governs private and public life, denies deviation from justice, non-discriminative, and holds that all humans are equal before the law and are accountable for their deeds. It is universal because it is applicable to all who accepts its authority. Islam memandang keadilan sebagai sistem yang utuh, bebas dari pembatasan, dan universal. Islam mengatur kehidupan pribadi dan umum, mengajarkan untuk tidak menyimpang dari keadilan, tidak diskriminatif, dan memandang manusia sama di hadapan hukum serta bertanggungjawab atas perbuatannya. Keadilan dalam Islam universal karena berlaku bagi semua manusia yang menundukkan diri padanya.

Abstract

Intisari Angkutan penerbangan pada saat ini sangat diminati oleh penumpang, mengingat biaya angkutan penerbangan domestik saat ini yang tidak terlalu mahal dan dapat dijangkau oleh masyarakat dan juga didukung oleh banyaknya jumlah maskapai penerbangan milik swasta yang beroperasi untuk melayani kebutuhan masyarakat melakukan angkutan penerbangan. Jumlah maskapai penerbangan yang semakin hari semakin bertambah menyebabkan bertambah pula dibukanya jalur-jalur atau rute penerbangan ke berbagai daerah di dalam negeri maupun luar negeri. Pembukaan dan pertambahan jalur-jalur baru penerbangan ini mengakibatkan lalu lintas udara juga semakin padat, sehingga diperlukan suatu pelayanan lalu lintas udara yang baik untuk terciptanya keamanan dan keselamatan angkutan penerbangan. Pelayanan lalu lintas penerbangan bertujuan untuk memperlancar dan menjaga keteraturan arus lalu lintas penerbangan, memberikan informasi yang berguna untuk keselamatan dan efisiensi penerbangan sehingga dapat mencegah terjadinya kecelakaan pada angkutan penerbangan.Kata Kunci : tanggung jawab, pelayanan, penerbangan.

Abstract

Divestment of PT NNT is located in the province of NTB, involving three Local Government ie Province, KSB, and Sumbawa regency, and have collaborated to form PT DMB is partnering with PT MC to acquire PT NNT. As a result of that happening is disagreement between the three regions in issuing policies on regional cooperation. To that end, the synchronization policy research cooperation between the three parties, including the central government needs to be done to avoid disharmony between regions that are not infrequently involve the community. Divestasi saham PT NNT yang berlokasi di NTB, melibatkan tiga Pemerintah Daerah yaitu Provinsi NTB, KSB, dan Kabupaten Sumbawa, dan telah bekerjasama membentuk PT DMB yang bermitra dengan PT MC untuk mengakuisisi saham PT NNT. Akibat yang terjadi adalah pertentangan antar ketiga daerah tersebut dalam mengeluarkan kebijakan menyangkut kerjasama daerah. Untuk itu, penelitian sinkronisasi kebijakan kerjasama antara ketiga pihak tersebut termasuk dengan Pemerintah Pusat perlu dilakukan untuk menghindari terjadinya disharmonisasi antara daerah yang tidak jarang melibatkan masyarakat.

Abstract

The government must accord special legal protection for pregnant and lactating female prisoners. Act Nr. 2/Pnps/1964 has been stipulated to the effect of regulating capital punishment to women. However, the Act does not yet reflect the sense of justice, humanity, and protection. Capital punishment for women must be reviewed. In a number of countries capital punishment for women has been abolished. In addition, several international legal instruments calling for abolishment of capital punishment for women are extant. In addition, the review of capital punishment for women stands upon the spirit that the implementation of capital punishment must not be applied too broadly in order to ensure that the objective of punishment would not go in a wrong way. Perlindungan hukum dan pengayoman terhadap perempuan pelaku tindak pidana khususnya yang sedang hamil dan menyusui, tidak dapat disamaratakan dengan laki-laki. Undang-Undang Nomor 2/ Pnps/1964, telah mengatur norma pelaksanaan pidana mati terhadap perempuan, akan tetapi aturan ini belum mencerminkan rasa keadilan, kemanusiaan, dan perlindungan. Kebijakan pidana mati terhadap perempuan di Indonesia sudah selayaknya ditinjau ulang. Di banyak negara ditemukan penerapan pidana mati secara terbatas dengan menghilangkan pidana mati khusus terhadap perempuan. Selain itu, berbagai ketentuan-ketentuan hukum internasional juga cenderung melarang pidana mati untuk perempuan. Peninjauan kebijakan pidana mati terhadap perempuan ini juga didasari semangat bahwa penerapan hukum pidana tidak boleh disamaratakan karena malah akan menjadi pengancam bagi tujuan hukum pidana itu sendiri.

Abstract

Building justice through judicature institution always contends with consequence which sacrifices the suspected as being object of investigation. There is a guarantee called “presumption of innocence”, but the guarantee is not representative enough, there must be still a guarantee that the position of the suspected is quiet strong, not only as object, but also, as possible as being subject, and law officers effort to find fair decisions. With the existing of prejudge, in hope, Criminal affairs will run well which is suitable with the current regulation. Arresting, jailing etc can not be accomplished at haphazard. The whole is to manifest law protection of human rights in order not to be violated. Besides it, the existence of prejudge in hope, is able to help and gives the protection of law to the basic rights of the accused as an effort to protect the one from forced trial by investigators and public prosecutors. Therefore, automatically the rights of the accused can also be protected. The execution of prejudge as managed within KUH Pidana is influenced by several factors such as: first, prejudge as the law protection of human rights. Second: prejudge as the instrument to control the investigator and prosecutor, Besides the factor as explained above, there are also barriers in the execution of prejudge. The hindering factor of prejudge execution consists, such as; First the prejudge practice is still rare. second, the basic difference of judge’s decision of sentence, third, limited time for inspection of prejudge affairs.

Abstract

AbstractThe mediation process in divorce cases is vulnerable to power relation imbalances and domestic violence. Domestic Violence Screening is a set of questions delivered by the mediator to the parties in Religious Court to examine whether domestic violence happens in the marriage. Domestic Violence Screening in mediation is not well known in Indonesia however it has been vastly used in many countries such as USA and Australia. This research tried to explained the benefit of Domestic Violence Screening in divorce mediation in Religious Court and identify whether it can be applied in Indonesia. Screening allows for: a) identification of power relation imbalance and domestic violence; b) domestic violence recording; and c) provide referral services for domestic violence victims. IntisariMediasi perkara perceraian rentan mengalami ketimpangan relasi kuasa dan kekerasan dalam rumah tangga/KDRT. Skrining KDRT (screening domestic violence) merupakan sejumlah daftar pertanyaan yang diajukan oleh mediator kepada para pihak yang berperkara di pengadilan agama untuk memeriksa apakah telah terjadi kekerasan selama ikatan pernikahan. Meskipun skrining KDRT belum dikenal di Indonesia namun telah digunakan secara luas dalam mediasi di berbagai negara. Penelitian ini bertujuan untuk memberikan gambaran sejauh mana manfaat skrining KDRT pada saat mediasi perkara perceraian dan apakah skrining tersebut dapat diterapkan di Indonesia. Keberadaan skrining memudahkan untuk: (a) mengidentifikasi terjadinya ketimpangan relasi kuasa dan kekerasan domestik sebagai faktor penyebab perceraian, (b) melakukan pendataan kasus KDRT, dan (c) memberikan layanan rujukan kepada korban KDRT.

Abstract

Conflict of interest between employee and employer has a complexity since its biopsychology and sosioeconomic in nature. As its implication, it is difficult to create a consensus between two different interest within a legal perspective. Justice theory by John Rawls has answered the respective problem by giving legal priority upon the group of people who have less capacity in sosial and economic. According to John Rawls, law shall give orientation toward marginalized group. In industrial relations, law shall take side upon the employee who are in subordinate position. Pertentangan kepentingan antara pekerja dan pengusaha memiliki kompleksitas karena bersifat biopsikologis dan sosio-ekonomi. Sebagai implikasinya, sulit mempertemukan dua kepentingan yang berbeda tersebut dalam satu rumusan hukum. Teori keadilan dari John Rawls telah menjawab persoalan tersebut dengan memberi prioritas hukum kepada orang-orang yang secara sosial ekonomi kurang beruntung. Hukum menurut John Rawls harus berorientasi kepada kelompok marjinal. Dalam hubungan industrial, hukum harus berpihak kepada pekerja yang berada dalam posisi subordinat.

Abstract

Act Number 5 of 1999 concerning Prohibition of Monopoly Practices and Unfair Competition has enacted in 2000. To supervise the enactment of the Act, the Commission of Business Competition (KPPU) was established. KPPU is an independent institution. The member of KPPU are appointed by President with approval of legislature. In performing its duties, KPPU is responsible to President. The Legal Status of the institution in performing both its duties and authority was clearly regulated in Article 35 and 36 of the Act. According to the Article 35 of the Act, the duties of the institution include performing the valuation of agreement resulting in monopoly practices and of whether or not there is dominant position abuse; providing government with recommendation and consideration in policies related to the monopoly practices and the unfair business competition; conducing investigation and/or inspection on the presumptive case of monopoly practices; inspecting the related proof instrument; deciding and stipulating whether or not there loss in one of the related business subject; informing the commission’s stipulation to the business subject that violated the stipulation of the Act.

Abstract

The Regional Autonomy Act 1999 started to give local government authority to regulate onhealth. This to be observed such as the implementation over local government’s authority toregulate over health’s issue and it’s positive implications as the result. This research shows thatimplementation of Yogyakarta City government’s  authority to regulate over health’s area have gone well since many healthcare’s policies had been produced in accordance to society’s needs and capabilities. Moreover, those regulations has significantly improved the healthcare’s quality becausethe numbers of licensed health facilities and paramedics increased. Undang-Undang Nomor 22 Tahun 1999 memberikan kewenangan mengatur tentang kesehatan kepadapemerintah daerah sehingga menimbulkan dua hal yang perlu diteliti, yakni tentang pelaksanaan kewenangan mengatur pemerintah di bidang kesehatan dan implikasi positif dari peraturan yang dikeluarkan tersebut khususnya di Kota Yogyakarta. Hasil penelitian menyatakan bahwa: Pertama,pelaksanaan wewenang mengatur Pemerintah Kota Yogyakarta telah berjalan baik dengan dibentuknya kebijakan-kebijakan di bidang pelayanan kesehatan sesuai kebutuhan dan kemampuan daerah. Kedua, pengaturan mengenai pelayanan kesehatan di Kota Yogyakarta memiliki dampak signifikan bagipeningkatan pelayanan kesehatan, yang ditunjukan dengan peningkatan jumlah sarana dan tenaga kesehatan berizin pasca dikeluarkannya Peraturan Daerah oleh Dinas Kesehatan Kota Yogyakarta.

Abstract

Yogyakarta municipality is committed to improve the quality of its procurement procedures by applying electronic procurement system, which finds its standing on Mayor Regulation Nr. 13 of /2009. Two issues are going to be addressed: first, whether the purpose of e-procurement has been served and second, what are the obstacles that occur in its implementation. Pemerintah kota Yogyakarta berkomitmen untuk meningkatkan kualitas pelaksanaan pengadaan barang dan jasa pemerintah dengan mengunakan sistem electronic procurement yang menggunakan Peraturan Walikota Yogyakarta No. 137 Tahun 2009 sebagai landasan hukum. Tulisan ini akan mengelaborasi pertanyaan apakah tujuan pelaksanaan e-procurement telah tercapai serta kendala apa sajakah yang menghambat pelaksanaan tersebut.
