Abstract

A license to practice polygamy was granted by the Surakarta Religious Court in case number 366/Pdt.G/2023/PA.Ska. The respondent's postpartum depression and anxiety disorders were the cause of this decision. Nevertheless, these requirements are not fully explained by the laws regulating polygamy, such as Article 57 KHI and Article 4 paragraph (2) of the Marriage Law. The author of this paper examines the legal factors that judges at the Surakarta Religious Court took into account while making their decision in case number 366/Pdt.G/2023/PA.Ska. Prescriptive normative research methodology is employed in this study, which collects primary and secondary data. The primary focus of this research is secondary data gathered from a review of the literature. The findings demonstrated that the court based the facultative requirements in polygamy instances on Article 4 paragraph (2) of the Marriage Law. In addition, judges also use the principle of benefit to accept polygamy applications. In this case, the judge considered the benefits of polygamy rather than limiting the number of wives, unless the wife suffered from mental disorders after giving birth

Abstract

This article seeks to explore the institutional innovation practices of Islamic boarding schools carried out by Kyai Malik, namely from being just an institution for cadre cadre of ulama to an institution that also cadres entrepreneurs. Since its inception, Islamic boarding schools have had an innovative character. This institution is the result of innovation from religious educational institutions in the Hindu-Buddhist era. As time goes by, the kyai also make institutional innovations in the Islamic boarding schools they care for, namely by adopting schools at various levels. However, on the other hand, it turns out that schools are less able to carry out their duties as educational institutions that prepare their students to become people who are able to live independently. Responding to this situation, Kyai Malik carried out institutional entrepreneurship practices by innovating his Islamic boarding school, in the form of developing learning methods based on real reality. Real reality-based learning methods are educational methods that adapt entrepreneurial practices directly into the learning process.

Abstract

Religious tolerance education in elementary schools has become crucial in the current era of globalization and multiculturalism. SDN Pekuncen Kota Pasuruan plays a significant role in fostering students' tolerance towards religious diversity, with Islamic Religious Education (PAI) teachers as the key actors. This study aims to describe the role of PAI teachers as motivators and guides in cultivating religious tolerance at SDN Pekuncen Kota Pasuruan. This article employs a qualitative approach with a case study research design, collecting data through observations, interviews, and documentation from PAI teachers, students, and classroom teachers, and analyzed descriptively. The findings indicate that PAI teachers are effective in motivating students to accept religious differences and guiding them in developing attitudes of mutual respect, honoring others, and doing good.

Abstract

Darussalam Blokagung Islamic Boarding School is an Islamic educational institution that has certain characteristics, the most famous in Banyuwangi. Although when observed closely, the students at the Darussalam Putri Utara Islamic Boarding School have various backgrounds from their regions, but are able to understand the yellow book literature which only has one language, namely pegon Arabic.This research aims to: 1) describe the use of pegon language in understanding the Yellow Book, and 2) describe the factors that influence the use of pegon language in understanding the meaning of the Yellow Book. This research method is a qualitative type of phenomenology. Through this approach, the data sources used use primary data and secondary data where research is carried out directly through primary sources and document collection as the main media. Data collection techniques in this research used observation, data collection by interviews, and documentation. The results of this research show that the use of the Pegon language is an important component in learning the Yellow Book at the Darussalam Putri Utara Islamic Boarding School, Blokagung Banyuwangi, and plays an important role in facilitating students' understanding of the text. And there are potential factors that can influence students' understanding as follows: 1) Quality of teaching, 2) Availability of resources and references, 3) Peer support and discussion, 4) Cultural and linguistic background, 5) and the role of Indonesian as a unifier in learning yellow book.

Abstract

Penelitian ini mengkaji Program Literasi Darussalam dalam Membentuk Budaya Baca Santri PP. Darussalam Blokagung Banyuwangi. Penelitian ini menggunakan pendekatan studi kasus kualitatif, dengan metode pengumpulan data melalui observasi, wawancara, dan dokumentasi. Subjek penelitian adalah M. Nuruh Huda, selaku ketua Liteasi Darussalam. Hasil penelitian menunjukkan bahwa bahwa literasi Darussaalam telah berhasil mencapai beberapa indikator yang diinginkan dalam membentuk Budaya Baca Santri PP. Darussalam Blokagung Banyuwangi. Hal ini sejalan dengan visi yang ada dalam literasi Darussalam meskipun masih belum sempurna. Ada banyak faktor yang mendukung dalam pencapaiannya, diantaranya adalah dukungan dari sektor pengasuh pondok pesantren Darussalam dan semua elemen pendidikan kurikulum yang berada di pesantren tersebut.

Abstract

Penelitian ini bertujuan untuk menganalisis kepemimpinan Rahmah el-Yunusiyah dalam memajukan pendidikan perempuan di Minangkabau serta alasan Rahmah el-Yunusiyah mendapatkan gelar Syaikhoh. Rahmah el-Yunusiyah merupakan tokoh penting yang mendirikan Diniyah Puteri Padang Panjang, sekolah khusus perempuan pertama di Minangkabau. Penelitian ini menggunakan metode sejarah dengan pendekatan deskriptif kualitatif dan studi riset kepustakaan yaitu dengan cara menelusuri sumber-sumber data dari berbagai bacaan tanpa melibatkan penelitian lapangan. Data tersebut kemudian diolah dan dianalisis secara objektif dan sistematis sesuai prosedur yang ada. Hasil penelitian menunjukkan bahwa Rahmah el-Yunusiyah memiliki visi untuk memajukan pendidikan perempuan. Rahmah el-Yunusiyah dikenal sebagai pendidik yang menerapkan metode pengajaran inovatif hingga pada akhirnya mendapatkan gelar syaikhoh dari Universitas Al-Azhar pada tahun 1957. Kesimpulan dari penelitian ini menunjukkan bahwa kepemimpinan Syaikhoh Rahmah el-Yunusiyah tidak hanya memberikan kontribusi besar terhadap pendidikan perempuan di Minangkabau, tetapi juga memberikan inspirasi bagi perkembangan pendidikan perempuan di Indonesia. Gelar syaikhoh diberikan kepada Rahmah el-Yunusiyah sebagai pengakuan atas kepemimpinannya yang luar biasa dalam pendidikan perempuan dan kontribusi besarnya dalam mengembangkan pendidikan Islam di Indonesia. Gelar ini mencerminkan penghargaan terhadap dedikasinya dalam menciptakan sistem pendidikan yang komprehensif bagi perempuan, serta perannya sebagai teladan bagi generasi selanjutnya. Abstract

Abstract Pesantren (Islamic boarding schools) as traditional educational institutions have undergone a transformation in their role of providing entrepreneurial education to their students. However, many pesantren still view entrepreneurship education as less important compared to religious education. This study focuses on the implementation of Santri (student) Entrepreneurship Education through a Waste Bank at Pondok Pesantren Darussalam Blokagung Banyuwangi. The research employs a qualitative descriptive approach. The findings of this study show that the implementation of Santri entrepreneurship education through the Waste Bank at Pondok Pesantren Darussalam Blokagung Banyuwangi is a non-formal education based on community empowerment. The approach used in implementing the program is experiential learning, which emphasizes environmental awareness and creativity to foster an entrepreneurial mindset. Additionally, the implementation also incorporates leadership management and financial management theories. This research also observes positive changes in the Santri, encompassing five aspects: capability, self-confidence, connections, character, and care. Keywords: Education, Entrepreneurship, Santri.

Abstract

Hubungan interpersonal yang efektif adalah fondasi penting dalaml kehidupan, secara pribadil maupun lprofesional. Kemampuan untuk membangunl hubungan yangl baik denganl orang lainl dapat meningkatkanl kualitas hidupl. Penelitian inil bertujuan untukl menganalisis strategil komunikasi yangl efektif dalaml membangun hubunganl interpersonal. Metodel yang digunakan dalam penelitian ini adalah kualitatifl dengan teknik pengumpulanl data berupa studil literatur. Datal yang terkumpull kemudian dianalisisl melalui tiga ltahapan: reduksi ldata, penyajian ldata, dan penarikanl kesimpulan. Hasill penelitian menunjukkan bahwal strategi komunikasil yang efektifl dapat mendukung individul dalam membangunl hubungan interpersonall yang baik. Beberapal strategi komunikasil yang terbukti efektifl meliputi komunikasi yangl terbuka danl jujur, komunikasil empatik, komunikasil aktif, danl komunikasi lpositif.

Abstract

Fenomena childfree ini sesungguhnya sudah lama muncul di dunia Barat, orang-orang Barat juga termasuk orang yang sangat memprioritaskan terhadap pekerjaan, jadi sudah dipastikan hal ini tidak asing lagi, akan tetapi bagi masyarakat Indonesia, itu merupakan hal baru yang dapat menimbulkan pro-kontra. Hal tersebut dinilai tabu dan juga menyalahi norma budaya sekaligus norma agama. Penelitian ini merupakan penelitian pustaka (literature research). Adapun sumber utama yang digunakan adalah Undang-Undang Tentang Hak Asasi Manusia, jurnal ilmiah, serta buku-buku yang membahas mengenai hak asasi manusia dan sosial. Pendekatan yang penulis gunakan dalam penelitian ini merupakan pendekatan normatif dan sosiologis. Teknik analisis yang digunakan penulis adalah deskriptif kualitatif. Tantangan yang akan dihadapi oleh pasangan suami dan istri yang memilih untuk childfree diantaranya akan ada tekanan sosial, sikap diskriminasi dari orang-orang terdekat (teman maupun keluarga) serta masyarakat sekitar, bahkan ada juga yang berpikir takut kehilangan hartanya apabila memiliki keturunan, dan yang terakhir akan munculnya banyak stigma negatif terhadap perempuan. yang paling terpenting ialah dalam Undang-Undang No 39 Tahun 1999 tentang Hak Asasi Manusia tidak terdapat aturan khusus mengenai larangan childfree. Jadi bahwa keputusan para pasangan untuk memilih childfree merupakan suatu bentuk hak asasi manusia yang tidak dapat di invansi oleh siapapun, terlebih ketika seorang perempuan yang mengambil peran cukup besar dalam memiliki anak untuk melahirkan dan merawatnya.

Abstract

It cannot be denied that the contribution of Islam (Syariah) and Muslim thought is very large to the continuity and development of legal thought. The purpose of this paper is to find out how the origin of sharia exists, then what are the results of conventional ijtihad products and contemporary ijtihad and which reasons are more obligatory to obey between Fikih and Codification. The research uses a qualitative method. While the approach used in this research is a normative-historical approach. The findings produced in this study are that in Indonesia, one of the legal systems in force is Islamic law. In the Islamic legal system, there are types of Islamic legal thought products in Indonesia, which include: fiqh thought products, fatwas, tafsir, court decisions (Jurisprudence), and legal thought products (codification) and the results of the Supreme Court plenary meeting, should be enforced and enforced honestly and fairly. Then the products of Islamic legal thought that have been institutionalized and obeyed by the Indonesian people are Fiqh, Tafsir, Fatwa, Jurisprudence and Legislation. The process of the birth of these four things cannot be separated from the development of the dynamics of community life from time to time in collaboration with Indonesian conditions.
