Abstract

This research discusses the legal status of buying and selling motorbikes resulting from the withdrawal of leasing collectors from consumers who failed to pay from the perspective of Yusuf al-Qardawi, a case study of Tanjung Gunung Village, Buntu Pane District, even though it is equally known that the basis of buying and selling is as an effort by the human being to maintain and meet their living needs. Furthermore, Islam does not limit a person's desire to seek wealth, as long as it is carried out according to the general principles that apply, namely halal and good by means of mutual cooperation and helping each other. Based on these problems, further research was carried out regarding the practice and law of buying and selling motorbikes resulting from leasing collectors from consumers who failed to pay, Yusuf Qardawi. The writing of this thesis uses qualitative methods, namely in the form of field research. This research is also descriptive analytical in nature, namely the author systematically describes the object being researched and then analyzed. So we can conclude the law based on the perspective of Yusuf Qardhawi's opinion that buying and selling motorbikes resulting from the withdrawal of the leasing collector from consumers who fail to pay is prohibited (haram). The main trading point of buying and selling motorbikes resulting from the withdrawal of the leasing collector will result in mutual assistance between the seller and the buyer in terms of elements of disobedience and injustice, namely committing fraud.

Abstract

Abstrak: Penelitian ini mengeksplorasi masyarakat jawa dalam penyelenggaraan pernikahan dengan mempertimbangkan perspektif hukum Islam. Tujuan dari penelitian ini adalah bertujuan untuk menjelaskan kaidah Al-‘Adah Muhakkamah dan untuk mengevaluasi sejauh mana tradisi adat jawa dapat diselaraskan dengan prinsip-prinsip hukum Islam dalam konteks pernikahan. Pendekatan kualitatif digunakan dalam penelitian ini. Dengan menggunakan metode penelitian yang diuraikan di atas, dapat disimpulkan bahwa berdasarkan prinsip-prinsip tersebut, tradisi pernikahan masyarakat jawa dianggap sah dalam Islam, bahkan dapat menjadi landasan hukum dengan ketentuan bahwa: tradisi tersebut telah berlangsung lama dan dikenal luas oleh masyarakat, diterima secara universal sebagai tradisi yang bermoral, dan tidak bertentangan dengan ajaran yang terdapat dalam Al-Qur'an dan Hadis Nabi. Harapannya, penelitian ini dapat memberikan pemahaman yang lebih dalam tentang bagaimana prinsip-prinsip hukum Islam, terutama Qawaid Fiqhiyyah Al-‘Adah Muhakkamah, diterapkan dalam konteks tradisi pernikahan masyarakat jawa.

Abstract

This research was conducted at the Multidimensi Islamic boarding school of Al-Fakhriyah Makassar. This pesantren is a modern pesantren but does not leave the culture of Salafi style, which has diverse students from various tribes, races, ethnicities, social classes, different skin colors, and regional origins. As a result of this diversity, this pesantren must have good management. The purpose of this study is to explore and analyze the form of multicultural Islamic religious education management in the Multidimensi Islamic boarding school of Al-Fakhriyah Makassar. Researchers use qualitative research methods with a case study approach, data collection using participatory observation, structured and unstructured interviews, and documentation, and then the data is processed by analyzing it through an interactive model proposed by Miles and Huberman. The result of this study is that the management of multicultural Islamic religious education in the Multidimensi Islamic boarding school of Al-Fakhriyah Makassar runs quite effectively and efficiently; all activities are carried out well, and multicultural values have been seen, although there are still a handful of perpetrators of discrimination. According to researchers, this problem can be overcome by adding more supervision and attention and updating the management related to the organizing system. Abstract

Settlement of disputes in al-ijarah contract transactions between service providers (mu'jir) and service recipients (musta'jir) in Medan City, is sometimes carried out not in accordance with the instructions contained in Supreme Court Regulation Number 02 of 2008 concerning the Compilation of Sharia Economic Law (KHES). This can be seen, when a musta'jir in the city of Medan demands compensation from the mu'jir with an amount that is very burdensome for the mu'jir, even though the actual condition of the mu'jir is not breaking a promise, but because of a compelling or emergency condition caused by losing your laptop, burning your hard disk, or video and photo files being infected by a virus so that the data is lost and it is difficult to restore the data to how it was originally. Mu'jir has broken his promise if seen at a glance as stated in Article 36 starting from letter "a" to letter "d", but does not necessarily have to bear all the risks from the loss of videos and photos of the wedding reception. There are conditions that are not fulfilled in accordance with those contained in Article 39 of Supreme Court Regulation Number 02 of 2008 concerning the Compilation of Sharia Economic Law (KHES) in declaring a mu'jir breaking his promise, the first condition is that the mu'jir never makes the same mistake twice, and secondly mu'jir in conditions of necessity or emergency that cannot be avoided.

Abstract

The implications of multicultural education are important for changing education and culture throughout society. One of them is through local wisdom as a set of values that are practiced in a society, which are believed to be true both explicitly and implicitly and are used as a guide to behavior in everyday life in a society. Local wisdom is valued as a source of educational innovation based on local community culture. Like the government in providing education. This research aims to determine and analyze the form of implementation of multicultural education based on local wisdom in Gending Seblang Olehsari Banyuwangi. Researchers use qualitative research methods with a type of realist ethnographic research with a cultural studies perspective, namely research that can be said to be able to dig up detailed information from many sources related to a community's culture. The data collection techniques used were observation, field notes, interviews, and documentation studies. The importance of maintaining the inclusive school paradigm is that every student with a different cultural background also gets the right to an education that meets the student's needs. Instilling humanist attitudes and values between ethnic groups with different cultures is built in solidarity and prevents conflict between ethnic groups.

Abstract

This research aims to determine the extent to which teachers and students in the field need integrated mathematics modules in the Madrasah Science Competition and the effectiveness of using these modules. This research is quantitative research. Data analysis used used N-Gain to test the effectiveness of the integrated mathematics module. The results of this research show that 82.39% of students stated that they really needed this integrated mathematics module due to the lack of references related to integrated mathematics, especially questions in Arabic. The results of the analysis of the needs of mathematics teachers from 6 madrasahs were 100% and also stated that integrated mathematics modules were really needed in guiding students preparing for the Madrasah Science Competition. The integrated mathematics module developed by researchers also has a high effectiveness value of 0.7675 so that the module can be disseminated to madrasas and the community.

Abstract

This study examines Kyai's leadership in shaping Santri civilization in Nurul Jadid Paiton Probolinggo's Residence. The research uses a qualitative case study approach, with data collection methods through observations, interviews, and documentation. The subject of the study is Kh. Moh. Zuhri Zaini, BA, as the nurses of the current nursing house. The results of the research show that Kyai Zuhri's leadership style has successfully achieved some of the desired indicators in shaping a central civilization. It is in line with the vision of the founder and first guardian, Kh. Zaini Mun'im, which was later continued by his son, Kh. Moh. Hasyim Zaini, and was perfected by the third guardian Kh. Abdul Wahid Zaini who formulated the Trilogy and Panca Consciousness Santri based on the book Bidayatul Hidayah by Imam Al-Ghazali. Kyai Zuhri's charismatic leadership and integrity have enabled the ministry and society to implement the good manners as well as the charitable manners presented by Kyai.

Abstract

English is an agreed language as a world/international language, so this subject is a course or lesson that must be taken by all students and college students in Indonesia from elementary level to college as a compulsory course in the English Language Teaching (ELT) series. IAI Darussalam Blokagung Banyuwangi is a pesantren-based college campus, so the purpose of this research is to find out to what extent the educators integrate ELT with Islamic Studies in accordance with their study programs. The research method used is Descriptive Qualitative which determines the subjects of this study are several lecturers and students with data collection techniques prioritized from interviews and supported by observation and documentation. From the process in the field, it is found that the implementation of ELT which is integrated with Islamic Studies has been implemented even though it is still not totally, and this provides insight to students so that they can communicate about Islamic studies using English.

Abstract

The aim of this research is to find out the law of carrying out istimna’ bi yadin nafsi (masturbating with one’s own hands) for long distance marriage couples according to Islamic law, and to find out how to maintain harmony in LDM couples according to Islamic law. This research is a qualitative research type of empirical juridical research, using two primary and secondary data sources. The primary data source comes from interviews with functionaries of the Indonesian Ulema Council (MUI) Medan City, and secondary data comes from books and literature related to research topic. The results of this research show that the law of carrying out istimna’ bi yadin nafsi for long distance marriage (LDM) couples in Islam is a complex issue among ulama. In the rules of fiqh, the principle “a real benefit must take precedence over mafsadah that is not yet real” is applied. Some Ulama in the city of Medan allow istimna’ yadin nafsi (masturbating with one’s own hands) for couples undergoing long distance marriages, with conditions and approval from both, and some other Ulama do not allow this practice because they hold the view that it is better to maintain chastity. And avoiding actions that could have a negative impact on the relationship.

Abstract

Abstract The issue of polygamy has always been a social problem that causes polarization between the groups that support and reject it. This discussion should no longer revolve around whether polygamy is allowed. Furthermore, the discussion on polygamy should lead to the issue of how polygamy can be placed proportionally as something logical and just. This article seeks to situate the issue of polygamy by reviewing various perspectives. The focus of this study is as follows. 1) What is the background to the legality of polygamy in Islam? 2) Does Islam advocate polygamy or monogamy, the model of marriage expected by Islam? This study used a library research method. The approaches used were the normative approach (fiqh), the social conditions of society when the polygamy verse was revealed (socio-historical), and the cultural approach of pre-Islamic society. The results show that 1) polygamy was legalized at that time because it aimed to avoid the Arab habit of marrying female orphans and engaging in injustice. Instead, Islam legalized the polygamy that had become a tradition of the Arabs before as an emergency measure. 2) Islam came to reduce the practice of polygamy, which was done far from justice. Instead, monogamy became the principle of marriage expected by Islam to achieve the goal of marriage: sakinah, mawaddah, and rahmah. Keywords: Polygamy, Monogamy, Islam
