Abstract

Indonesia adalah negara yang memiliki kemampuan untuk menarik para pemilik usaha untuk memperdagangkan barang dan jasa milik pelaku usaha asing yang ada di Indonesia. Agar barang dan jasa terlindungi para pelaku usaha akan melakukan upaya perlindungan yang maksimal. Salah satu usaha perlindungan yang dilakukan adalah dengan mendaftarkan nama produk barang dan jasa, yang kita kenal dengan istilah merek, ke kantor merek yang berada dibawah naungan Direktorat Jenderal Kekayaan Intelektual Kementerian Hukum dan Hak Asasi Manusia. Pada proses pendaftaran merek inilah sering kali ditemukan kendala. Untuk mendaftarkan merek sesuai dengan UU Merek si pemohon harus memenuhi persyaratan pendaftarannya. Salah satu syarat sebuah merek dapat di daftarkan adalah merek yang akan didaftarkan tidak boleh ada persamaan bunyi, persamaan huruf, dan lainnya dengan merek yang sudah lebih dahulu didaftarkan di kantor Merek dan hal ini dikenal dengan istilah daya pembeda. Merek yang akan didaftarkan memiliki daya pembeda dengan merek yang sudah terdaftar lebih dulu. Tujuan penelitian adalah untuk menjelaskan istilah merek terkenal dan untuk menjelaskan sejauh mana penerapan kaidah-kaidah hukum yang berlaku pada Undang-Undang Merek terlaksana. Metode penelitian yang dipergunakan bersifat deskriptif, dengan tipe normatif. Data yang dipergunakan bersumber pada bahan hukum primer yaitu Undang-undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis Peraturan Menteri Kehakiman Nomor 67 Tahun 2017 tentang Pendaftaran Merek juga bahan hukum sekunder berupa buku-buku dan tulisan ilmiah para pakar hukum di bidang hukum HKI dan bahan hukum tertier dengan menggunakan kamus.

Abstract

Perubahan Undang-Undang Dasar 1945 yang terjadi di era reformasi didasari komitmen untuk mempertegas sistem Presidensial. Sebaliknya, sistem multi partai yang dikombinasikan dengan sistem pemerintahan Presidensial saat ini mendorong partai untuk membentuk koalisi yang justru memperlemah sistem presidensial itu sendiri. Praktik koalisi di Indonesia yang dibentuk sebelum pemilihan umum Presiden dan Wakil Presiden didominasi transaksi politik mengenai pembagian jabatan pemerintahan tanpa disertai perumusan platform bersama. Kenyataannya, koalisi yang dibentuk tidak menjamin bahwa partai-partai yang tergabung dalam koalisi yang memiliki wakil di badan legislatif akan selalu mendukung program-program pemerintah. Oleh karena itu, penelitian ini ditujukan untuk memahami penerapan sistem multi partai dalam sistem pemerintahan Presidensial di Indonesia pada era reformasi sekaligus merumuskan implikasi terhadap hubungan eksekutif dan legislatif serta penerapan yang idealnya. Jenis penelitian ini dapat dapat di golongkan dalam jenis penelitian yuridis normatif, karena menjadikan bahan kepustakaan sebagai tumpuan utama. Sumber data yang digunakan, bahan hukum primer, bahan hukum sekunder, dan bahan hukum tertier. Teknik pengumpulan data dalam penelitian ini dengan menggunakan metode kajian kepustakaan. Hasil penelitian menunjukkan bahwa penerapan sistem multi partai dalam sistem pemerintahan Presidensial justru memperlemah sistem Presidensial dan memiliki implikasi terhadap relasi eksekutif dan legislatif. Tiga hal yang menjadi implikasinya yaitu; Pertama, banyaknya kepentingan partai politik yang bertentangan dengan kebijakan pemerintah. Kedua, tidak adanya pengaturan koalisi tetap. Ketiga, lemahnya posisi Presiden. Idealnya penerapan sistem multi partai, agar terciptanya stabilitas sistem pemerintahan Presidensial di Indonesia, maka ada 3 (tiga) hal yang perlu dibenahi dalam sistem Presidensial kita, yaitu: Pertama, penyederhanaan partai politik, kedua, pengaturan koalisi tetap, dan ketiga, penguatan desain institusi kepresidenan. Penulis menyarankan diperlukan adanya koalisi partai politik yang sifatnya permanen yang ditetapkan melalui aturan-aturan, undang-undang yang lebih jelas sehingga akan menghasilkan pemerintahan yang kuat dan efisien dan diupayakan adanya penguatan institusi kepresidenan agar posisi Presiden tidak lemah terhadap Parlemen, dengan cara pemisahan institusi kepresidenan dari Dewan Perwakilan Rakyat (DPR) dan partai politik melalui aturan-aturan Undang-Undang yang jelas.

Abstract

Standard contract they exist for adhering to social conditions and economic large companies, the company spring, or the utility hold cooperation for their interests. Standard contract contents be standardized made in the form a format raw. Reviewed in a juridical manner, standard contract was not minimum undang-undang, according to community needs and their activities acceptable, raw deal strength binding based on habits. Standard contract is an agreement which are written, the contents of are predetermined in advance by the party that in general have a position that are more dominant, and standards the contract that was originally follow the development of trade and or business transaction, good at home or abroad. The contract needs this standard becomes very important, raw contract which in this case when the contracts signed with a signature means other parties agree . Abstract

Permasalahan pengangkatan anak jelas begitu kompleks dan rumit yang dapat membuat anak menjadi korbannya. Terlebih lagi di era modrenisasi negara-negara baik yang maju maupun Negara yang sedang berkembang telah membawa perubahan jalan pikiran tentang perkawinan dan keluarga dimana mereka rela mengeluarkan biaya yang sangat besar untuk dapat mengadopsi anak demi kebutuhan mereka. Dengan adanya hal ini yang menyebabkan terdapat pihak-pihak yang memanfaatkan untuk menarik banyak keuntungan yang tidak pada tempatnya. Abstract

Negara memiliki kewajiban dan tanggung jawab terhadap anak. Hal ini diaturdalam Pasal 22 UUD 1945 bahwa Negara wajib memberikan dukungansarana dan prasarana dalam penyelenggaraan perlindungan anak,memperhatikan hak dan kewajiban orang tua, wali, atau orang lain yangsecara hukum bertanggung jawab terhadap anak, serta mengawasipenyelenggaraan perlindungan anak (Pasal 23), dan menjamin anak untukmempergunakan haknya dalam menyampaikan pendapat sesuai dengan usiadan tingkat kecerdasan anak (Pasal 24). Metode penelitian yang penelitigunakan di dalam penelitian ini adalah: Penelitian ini merupakan penelitianhukum normatif, dengan menggunakan pendekatan perundang-undangan(statute approach) dan Pendekatan konseptual. Banyaknya lembaga yangdibentuk oleh pemerintah dalam melaksanakan perlindungn terhadap anakberhadapan dengan hukum masih belum efektif dikarenakan oleh anggaranyang tidak memadai sehingga keberadaan lembaga yang dibentuk Negarasemakin tidak punya fungsi yang jelas.Kata kunci: Eksistensi, Lembaga Perlindungan

Abstract

If today we are talking about a country called the Republic of Indonesia then we will not be much to talk about corruption, bribery, conflicts both internal conflict within the three highest institution in Indonesia as well as external conflict outside the institutions of the country, fighting between students as well as fighting between citizens in Indonesia itself, persecution, murder, rape and many others that we actually own has been embarrassed to talk about it because these things will not be there eventually. Especially if we are talking about the law in the era of globalization we are not going away talking about the law in Indonesia with the name of injustice,alignments, partiality, not autonomy and others. These things when we look back carefully, we will find something called "legal culture", because the legal culture is the determinant of where the legal system is placed in its rightful place with the values ​​in it that is of social value as a law made is intended for people in a country itself to regulate all behavior of the people in the country that issued the law. Legal culture in Indonesia itself has been displaced by a culture new law caused by many things for example the rapid advancement of technology as if we can cross the boundary between countries, the development of free trade in Indonesia, information increasingly and still many other causes. The causes are the leave a good impact on our country for example, just in the field of law, with the advancement of information technology we can determine how the application of the law in the countries of the other so that we can improve a system of law in our own country if rated less well then we can take the example of the application of the law in other countries. In addition to the positive impact made by many advances in the era of globalization, the negative impact also participated and coloring everything in our country. For example, just by the appearance of a culture of western thought we became western Similarly we can see the beginning of our country is a democratic state of the people and for the people all-round social and the social interest anyway so this time indirectly our country shifted to a liberal state that is society most have a spirit of individualism, the economy shifted that originally brag about a democratic economy in this country to be an economy of capitalism has been proven in our country in power at any point economic pulse is the capital high and that no capital is still the clans marginal in their own country without any change from year to year. Abstract

Penerimaan Calon Pegawai Negeri Sipil atau yang selanjutnya disingkat CPNS merupakan salah satu momentum yang paling diminati oleh masyarakat. Banyaknya minat masyarakat yang mengikuti seleksi CPNS yang diadakan oleh Kantor Wilayah Kementerian Hukum Dan Hak Asasi Manusia Kepulauan Riau dimana tahap awal peserta harus melaksanakan ujian CAT, pengecekan Fisik, dan Wawancara bagi pelamar S-1 dan D-3. Peserta jenjang SMA sedikit berbeda, setelah ujian CAT, mereka wajib mengikuti tes kesampataan, dan Test Pengamatan Fisik dan Keterampilan serta Wawancara. Berdasarkan latar belakang di atas, maka penulis mengangkat tujuan penelitian sebagai berikut: pertama, Sejauh mana transparansi seleksi Calon Pegawai Negeri Sipil di Lingkungan Kantor Wilayah Kementerian Hukum dan Hak Asasi Manusia Kepulauan Riau. Abstract

Advertising as one means of marketing and lighting facilities plays animportant role in development. In order for products offered by business actors have high selling value sometimes business actors justifies all means.One of them is through advertising that contains a grandiose promise aboutthe usefulness and benefits of products that suit the needs of consumers. Theneed for regulations that regulate consumer protection because of theweakness of consumer position compared to the position of business actors,because of the process until the production of goods or services that haveproduced consumer intervention at all. Regarding advertising there is nospecific regulatory regulation, but the advertising problem is contained inseveral articles in Law No. 8 of 1999 on Consumer Protection. The mainsource of this research is the data already available in the form of legalprovisions that have been written, which will then be studied according to theprovisions of applicable legislation, as the approach used is normativejuridical is done by reviewing and interpreting things theoretical nature ofprinciples, conceptions, doctrines and legal norms relating to consumerprotection and covenants. Data analysis in this research using qualitativeanalysis. Based on the results of the analysis, deductive conclusions aredrawn, namely the way of thinking based on general facts and then drawn aspecific conclusion.
