Abstract

Penelitian bertujuan untuk mendeskripsikan ketentuan hukum pidana Indonesia mengenai penahanan terhadap tersangka serta untuk menganalisis perlindungan hukum terhadap tersangka pada saat dilakukan penahanan ditinjau dari hukum pidana Indonesia. Penelitian ini merupakan penelitian hukum normatif, yang mengkaji peraturan perundang-undangan dalam suatu tata hukum yang koheren serta nilai-nilai hukum yang terkait dengan penahanan tersangka dalam kajian hukum pidana Indonesia. Hasil penelitian menunjukkan bahwa ketentuan penahanan terhadap tersangka diatur dalam KUHAP Pasal 1 butir 21, Penahanan merupakan penempatan tersangka atau terdakwa di suatu tempat tertentu oleh penyidik atau penuntut umum atau hakim dengan penetapannya dalam hal serta menurut cara yang diatur dalam undang-undang. Selama dalam penahanan, tersangka dapat menggunakan hak-haknya sesuai dengan pasal 50 sampai dengan pasal 68 Kitab Undang-Undang Hukum Acara Pidana (KUHAP). Perlindungan hukum selalu dikaitkan dengan konsep rechtstaat atau konsep Rule of Law karena lahirnya konsep-konsep tersebut tidak lepas dari keinginan memberikan pengakuan dan perlindungan terhadap hak asasi manusia. Tersangka mempunyai hak pada saat dilakukan penahanan yang dijamin oleh hukum seperti hak menerima dan membaca Surat Perintah Penahanan atau Penetapan Hakim yang mencantumkan identitas tersangka atau terdakwa dan menyebutkan alasan penahanan serta uraian singkat perkara kejahatan yang dipersangkakan atau didakwakan serta tempat ia ditahan sesuai dengan Pasal 21 ayat (2) KUHAP

Abstract

This article reviews the implementation of the marriage traditions of the Dayak Tobag traditional community in Tayan Hilir District, Sanggau Regency from a socio-anthropological perspective which is still maintained today. The aim is to identify, describe and explain marriages in the Tobag Dayak sub-tribe from a socio- anthropological perspective in Tebang Benua Village, Tayan Hilir District using empirical legal research methods to see the types of traditional marriages carried out by the Tobag Dayak indigenous community. Indigenous peoples often have deep reasons for maintaining traditional marriages and rituals. Indigenous peoples tend to highly value their traditions and cultural heritage. Weddings and traditional rituals are an integral part of their cultural identity that has been passed down from generation to generation. Maintaining traditions is considered a way to honor ancestors and maintain the integrity of their culture. From the results of this research it can be revealed that there are 4 types of Tobag Dayak traditional marriage ceremonies, namely: hanging marriage customs, simple marriage customs, ordinary marriage customs, and large wedding customs

Abstract

This study aims to analyze the legality of applying taxes to cryptocurrency In Indonesia and to analyze the mechanism of tax collection against cryptocurrency In Indonesia. This type of research is normative research that discusses the legality of applying taxes to cryptocurrency In Indonesia, by examining library materials or secondary data consisting of primary legal materials, even secondary law and tertiary legal materials.The results of the research show that: 1) The legality of applying taxes to cryptocurrency In Indonesia is Minister of Finance Regulation (PMK) Number 68/PMK.03/2022 concerning Income Tax and Value Added Tax on Crypto Asset Transactions. This crypto tax rule applies starting May 1, 2022, for all types of crypto asset transactions such as trading crypto assets for fiat currency, swapping crypto assets for other crypto, or exchanging crypto assets for goods. other than crypto assets and/or services. 2) Mechanism of tax collection against cryptocurrency In Indonesia is that the Government appoints a third party as a collector of VAT on trading crypto assets and Income Tax Article 22 on crypto asset transactions. The intended VAT and crypto PPh collectors are Trade Operators Through Electronic Systems (PPMSE) who are taxpayers who have been confirmed as Taxable Entrepreneurs (PKP), both domestically and abroad.

Abstract

This research aims to analyze the regulation of the use of the customary land of the Bunggu Tribe Customary Law Community in Pakawa Village, Pasangkayu Regency, West Sulawesi Province and to analyze the role of the Regional Government of Pasangkayu Regency in terms of recognizing and protecting the customary land of the Bunggu Tribe Customary Law Community. This research is an empirical type of research, the location of this research was carried out in Pakawa Village, Pasangkayu Regency, West Sulawesi Province. The results of the research show that the regulation of the use of the customary land of the Bunggu Tribe Customary Law Community in Pakawa Village, Pasangkayu Regency, West Sulawesi Province, is still being regulated using customary mechanisms, meaning that every person who owns or will manage land must have the knowledge of the traditional stakeholders. And the role of the Regional Government of Pasangkayu Regency in terms of recognizing and protecting the customary land of the Bunggu Tribe Traditional Law Community in Pakawa Village, Pasangkayu Regency, West Sulawesi Province, is only limited to recognizing the existence of the Bunggu Tribe culturally and customarily, not yet providing legal or regulatory recognition through Regional Regulations ( Regional Regulation).

Abstract

Legal compliance in the community is always an interesting issue to discuss. The research question in this study is how the compliance of the members of the Tadulako University academic community in response to the Decree of the Minister of Health of the Republic of Indonesia Number: HK.01.07/MENKES/413/2020 concerning Guidelines for the Prevention and Control of COVID-19 through the implementation of Tracing, Testing, and Treatment (3T Program)? To answer the research objectives, empirical legal research (socio-legal research) was conducted to support the depth of analysis. The analysis materials include data on the conditions and levels of health risks experienced by the academic community based on the available COVID-19 link records, data on the number and distribution of academic community members who have been infected with COVID-19, and data on the implementation of the 3T program sourced from Tadulako Hospital. Starting from the interpretation of the research data analysis, the findings revealed: (a) there are some members of the academic community who do not respond to filling in data regarding the condition and level of health risk on the available COVID-19 link; (b) members of the academic community who have had a history of contact with COVID-19 sufferers have not all complied with the rules for preventing and handling COVID-19 through the implementation of 3T; (c) members of the academic community who are declared positive for COVID-19 infection have relatively high legal compliance in supporting the implementation of treatment. Their legal compliance is categorized as identification according to Herbert C. Kelman’s theory.

Abstract

The purpose of this research is to determine the form of unclear norms in the preparation of academic texts, and to determine the involvement of universities through academic texts in the formation of regional regulations. The method used in this research uses normative legal research methods which raise the theme of legal systematics or the systematics of statutory regulations with vertical and horizontal levels of synchronization, with legal, conceptual, historical, theoretical and interpretive approaches. The results of this research show that explanatory words or adverbs, and/or academic texts have very different positions so that their diction cannot be in harmony because each position is very different. Apart from that, there are inconsistencies in norms which cause laws and regulations to be out of sync with each other, so that there is no normative harmonization from a vertical and/or horizontal perspective. Meanwhile, higher education institutions' involvement in academic texts is still situationally involuntary, namely a temporary situation within the limits of academic paper preparation activities and there is no aspect of continuity of this involvement. Thus, the position of academic texts is very respectable, however, in terms of legal norms governing academic texts, they are still not clear, so there is no legal certainty.

Abstract

Investasi  merupakan suatu  kegiatan  berupa  penanaman  modal  yang memiliki  periode  waktu  yang  panjang  serta  dimaksud untuk  mendapatkan  sebuah keuntungan   di   masa   mendatang. Kota Batam diidentikkan dengan iklim berinvestasi, karena lokasinya yang strategis Kota Batam menjadi tempat berkumpulnya para investor dari manca negara untuk menanamkan modalnya. Kepastian hukum yang jelas mengenai investasi juga menjadi salah satu faktor investor mau berinvestasi di Indonesia. Oleh karena itu, pemerintah membuat beberapa perubahan mengenai investasi dengan dikeluarkannya Undang-Undang No. 11 Tahun 2020 tentang Cipta Kerja pada tahun 2020 silam. Namun, pemerintah menggantinya dengan Undang-Undang No. 6 Tahun 2023 tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 2 Tahun 2022 tentang Cipta Kerja. Dengan adanya Undang-Undang Cipta Kerja ini diharapkan ada kepastian hukum dan tidak  terjadi tumpang tindih peraturan  baik dalam proses  perizinan  maupun pasca  perizinan (saat beroperasi). Dengan dikeluarkannya peraturan yang memuat aturan mengenai investasi, tentu terdapat berbagai perubahan yang dirasakan dan  menimbulkan pertanyaan, terkhusus bagaimana pemerintah Kota Batam menyikapi akan perubahan tersebut. Penelitian ini dilakukan dengan tujuan untuk menemukan jawaban atas pertanyaan-pertanyaan tersebut. Penelitian ini dilakukan dengan menggunakan metode pendekatan yuridis empiris, yaitu pendekatan yang melihat dan mengkaji peraturan perundang-undangan terkait permasalahan kemudian menghubungkannya dengan kenyataan yang ada di lapangan. Hasil penelitian menunjukkan bahwa pemerintah Kota Batam sudah menerapkan berbagai kemudahan kepada investor melalui regulasi UU Cipta Kerja, dimana output dari UU Cipta Kerja tersebut, pemerintah Kota Batam membuat Peraturan Daerah Provinsi Kepulauan Riau tentang Pemberian Insentif dan Kemudahan Investasi. Guna membuat kepastian hukum mengenai insentif investasi di Kota Batam semakin jelas.

Abstract

Climate change is a threat to current and future generations. The main cause of climate change is the use of fossil fuels such as coal, oil and gas. Amidst the international community's concerns about climate change, the use of fossil fuels has increased, including in Indonesia. This research aims to analyse Indonesia's compliance with the 2015 Paris Agreement. Indonesia as a country that binds itself to the Paris Agreement has a commitment to reduce emissions in an effort to mitigate climate change. This research analysed using regime compliance theory. The research method used is juridical-normative. The results showed that Indonesia complies with the Paris Agreement regime because it fulfils three indicators in the regime compliance theory, namely output, outcome, and impact.

Abstract

Traffic accidents are a disturbing problem for road users, can cause material and immaterial losses, and are one of the criminal cases that can be resolved through mediation. Penal mediation is a way of handling criminal case disputes involving victims and perpetrators, as well as third parties, namely mediators, without eliminating the principles of restorative justice. The research objective in this article is to examine how mediators are classified based on their role in post-accident criminal mediation mechanisms and examine the juridical basis for implementing criminal mediation in handling traffic disputes. This article uses a juridical-normative research method with a statutory and conceptual approach. The results of this study are, first, that the principle of restorative justice contained in penal mediation has been carried out by the police using the right of discretion contained in the Letter of the Chief of Police Number Pol: B/3022/XII/2009/SDEOPS dated 12/14/2009 concerning handling cases through alternative dispute resolution (ADR). Second, there is no explicit regulation governing penal mediation, but implicitly it has been regulated in Article 1, Number 7, of Law No. 11 of 2012 concerning Juvenile Justice, which is better known as diversion.

Abstract

This study aims to analyze the PPAT's responsibility for the land sale and purchase deed he made in the event that the parties do not convey the actual land price and analyze the validity and consequences that will arise if the land sale and purchase deed does not include the actual land price. This research is normative research, where in this research the subject matter of the study is in the form of the application of normative law in action to any particular legal event that occurs in society. The results of the study show that if the PPAT knows that the price entered by the parties is included in the sale and purchase agreement, the PPAT must refuse to make the sale and purchase deed. In addition, it is mandatory for PPAT as an extension of the government to play an active role in providing counseling or guidance to prospective buyers and sellers not to reduce the actual price of the land sale and purchase price between them. Then regarding the validity and consequences that will arise in the future if the land sale and purchase deed does not include the actual price of the land and without the PPAT knowing as the maker, it can result in the land sale and purchase deed (authentic deed) degrading its evidentiary power to a private deed because it has been made with ways that deviate or are not in accordance with procedures both materially and formally. And it is possible that in the future it will be discovered that the price stated in the land sale and purchase deed is incorrect, so there is a possibility that the parties (seller and buyer) may be entangled in Article 266 paragraph (1) of the Criminal Code.
