Abstract

Penelitian ini mengkaji peran Peraturan Mahkamah Agung (Perma) Nomor 1 Tahun 2022 dalam pemenuhan hak restitusi bagi korban trading binary option. Trading binary option merupakan bentuk investasi baru yang sedang populer di kalangan masyarakat Indonesia. Namun, investasi ini memiliki risiko tinggi dan sering kali terkait dengan praktik-praktik yang meragukan. Dalam penelitian ini, peneliti ingin mengidentifikasi bagaimana pelaksanaan pengembalian kerugian korban sebelum dan sesudah diterbitkannya Perma Nomor 1 Tahun 2022, serta peran Perma tersebut sebagai upaya pemenuhan hak restitusi bagi korban trading binary option. Metode penelitian yang digunakan adalah penelitian hukum normatif yuridis dengan pendekatan perundang-undangan. Hasil penelitian ini diharapkan dapat memberikan pemahaman yang komprehensif mengenai isu ini dan kontribusi dalam perlindungan hak-hak korban trading binary option.

Abstract

There are several factors that influence the removal of the right to prosecute, one of which is due to expiration. The complainant or victim believes that the act of abolishing prosecution, especially due to expiration, means releasing the suspect from criminal responsibility, the abolition of prosecution, especially due to expiration, may not provide justice for them. This writing uses normative or doctrinal legal research because it uses information sources of norms with prescriptive research specifications. This research method includes document review or literature review, and the writing approach used is the statutory approach and the case approach. Public perception and trust in the current legal system can be harmed by the elimination of expired prosecutions. As in the Constitutional Court Decision Number 118/PUU-XX/2022, this is because the Criminal Code, especially Article 79 Paragraph (1), does not provide legal certainty to victims of criminal acts if the calculation begins after the counterfeit goods are used.

Abstract

This study aims to determine the responsibility of the manager of the online buying and selling application (Shopee) for the sale of counterfeit products of well-known brands and legal protection for owners of well-known brands in selling counterfeit products through online buying and selling applications (shopee). The type of research used is normative legal research. The object of study in this research is the Civil Code, Law Number 20 of 2016 concerning Marks and Geographical Indications, Law Number 19 of 2016 concerning Information and Electronic Transactions, law books and legal journals from various media related to this research. The results of this study indicate that the responsibility of the manager of the Shopee buying and selling application is to sell famous brand counterfeit products. In the form of action if there is a report from the owner of IPR or in the sense of the owner of a well-known mark. The legal protection of well-known brand owners is contained in Law Number 20 of 2016 concerning Marks and Geographical Indications where in the event of a trademark violation in the Shopee online buying and selling application, it is repressive protection in the form of being able to file a lawsuit against article 83 paragraph (1) and also article 1365 of the Civil Code. This proves that saving legal loopholes when infringement of well-known marks is an initiative of the brand owner, and the absence of preventive protection in the form of prudence and responsibility to protect well-known brand owners, thereby harming brand owners when their brand products are imitated and traded without rights in buying and selling applications. online shopee.

Abstract

This study focuses on efforts to determine the practice of solving criminal cases through the Restorative Justice approach at the House of Restorative Justice in Bojonegoro Regency. This research uses qualitative methods and field research to explore the concept of restorative justice and its application to the House of Restorative Justice in Bojonegoro Regency. The results of this study state that Restorative Justice is a powerful alternative paradigm for solving minor criminal cases in the community. The Bojonegoro Regency Government, together with the District Attorney's Office, collaborate in humane law enforcement through the establishment of 5 (five) House of Restorative Justices in Bojonegoro Regency located in Kauman Village and Pacul Village in Bojonegoro District, Jipo Village, Kepohbaru District, Dolokgede Village, Tambakrejo District, and Pilanggede Village, Balen District. The application of the concept of restorative Justice at the House of Restorative Justice in Bojonegoro has generally been carried out well as a form of the sense of crisis towards social problems of the community in a humane law enforcement effort. It involves the active role of village heads and local community leaders.

Abstract

Because there is still a lot of land that has not been registered, legal certainty regarding community rights to land is important in land dispute situations. The Minister of Agrarian Affairs issued Regulation Number 6 of 2018 concerning Complete Systematic Land Registration. This is research that aims to find mass certification procedures for government land, as well as factors that support and hinder Complete Systematic Land Registration (PTSL) efforts in Dairi Regency. Legal frameworks are used first in field research, then social and behavioral data. Minister of Agrarian and Spatial Planning Regulation Number 6 of 2018 states that certificates obtained in Dairi Regency through Complete Systematic Land Registration (PTSL) fulfill the land registration requirements. Program implementation still faces challenges related to location distance. Due to a lack of public awareness of the program, PTSL was only partially implemented, with a small number of surveyors and little public enthusiasm. The National Land Agency needs to involve the community more and carry out further inspections to reduce obstacles.

Abstract

Penelitian kali ini menjawab permasalahan mengenai keterbukaan informasi publik yang menjadi salah satu bentuk dari pemenuhan hak asasi manusia. Hak asasi manusia di Indonesia termaktub di Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Pendekatan yang digunakan dalam penelitian kali ini bersifat deskriptif yang berarti dimaksudkan untuk memberikan data yang seteliti mungkin tentang manusia, keadaan atau gejala-gejala lainnya. Undang-Undang Nomor 14 Tahun 2008 tentang keterbukaan informasi publik sebagai pelaksana dari pasal 28 F UUD NRI 1945 dan adanya komisi informasi dan Pejabat Pengelola Informasi dan Dokumentasi sebagai penyelenggara dari UU KIP. Ada beberapa kendala yang dihadapi oleh KI dan PPID dalam menjalankan UU KIP bukan hanya dari internal penyelanggara UU KIP juga dari eksternal seperti masyarakat yang kurang memahami UU KIP. Semenjak 2009 KI telah banyak menyelesaiakan sengketa informasi publik, akan tetapi masyarakat juga mengkritisi pasal yang terdapat UU KIP yang ditandai dengan pengajuan judicial review kepada Mahkamah konstitusi mengenai pasal di UU KIP yang menandakan bahwa banyaknya jumlah permohonan juga berkaitan dengan pasal-pasal yang mengatur informasi publik tersebut.

Abstract

In Indonesia, a rule-of-law state, the relationship between the government and citizens is governed by Administrative Law, ensuring the effectiveness, legitimacy, and legality of state administration. The National Land Agency, established to supervise and nurture land administration, plays a crucial role in implementing the Basic Agrarian Law and managing land registration in accordance with prevailing regulations. Literature studies reveal that the National Land Agency is responsible for providing legal certainty and protecting rights, particularly regarding land ownership. This responsibility includes data management, dispute resolution, and ensuring compliance with legal provisions in court proceedings. The conclusion underscores the importance of the National Land Agency's role in upholding law and safeguarding landholder rights.

Abstract

Soil is a source of life not only for humans but for every living creature on earth such as animals and plants. In the Civil Code, land is categorized as immovable objects in accordance with Article 506 of the Civil Code. The transfer of land rights in the form of a grant is often a problem in people's lives. The definition of a gift is regulated in Article 1666 of the Civil Code, namely: "A gift is an agreement whereby the donor, during his or her lifetime, freely and irrevocably hands over an object for the needs of the recipient of the gift who receives the gift. That. The law does not recognize other gifts other than gifts between living people." The research method used is normative legal research. Normative juridical method writing is a writing method that is carried out by researching library material. The nature of the research used is analytical descriptive where the writing team tries to describe the transfer of grants that are not registered with PPAT or known as verbal grants according to the applicable laws and regulations. The transfer of land rights must be proven by an authentic deed issued by the PPAT or Land Office in the area where the dispute occurs. Giving a gift orally without a PPAT deed is considered invalid even though it meets the legitimacy of the portie, but the transition is still used verbally without any authentic evidence. Legal certainty for grant recipients is regulated in Article 37 of Government Regulation 40 of 1997 concerning Land Registration which states that the transfer of land rights and ownership rights to apartment units is through sale and purchase, exchange, grant, entry into a company and other legal acts of transfer of rights. In proving the validity of a Grant Deed, it must have external, formal and material evidential strength, and the process of making a Grant Deed fulfills the specified elements. Settlement of gift disputes is a deliberation between the heirs. Every grantor in providing a grant must openly state it in the PPAT deed so that it can be proven if a dispute occurs.

Abstract

This research is motivated by the development of shrimp farming businesses, which are always growing in Batang Anai District, Padang Pariaman Regency. However, most of the shrimp ponds were built without complying with environmental legal instruments. The research method used is qualitative descriptive analysis with an empirical juridical approach in addition to a normative approach, as well as data collection techniques such as interviews, observation, literature study, and documentation. Analyzed using four components of analysis, namely data collection, data reduction, data presentation, and conclusion drawing. The results of the research obtained by the author are: Firstly, most of the shrimp farming businesses in Batang Anai sub-district are not environmentally friendly due to the difficulties of entrepreneurs in processing Amdal documents. Second, the government has made efforts to regulate shrimp farming businesses that are not yet environmentally friendly in Batang Anai District, but the efforts made by the government have not been effective. It would be better for the Regional Government of Padang Pariaman Regency to form a regional Amdal to make it easier for entrepreneurs to process business permits.
