Abstract

Law Number 20 of 2016 concerning Trademarks and Geographical Indications regulates the legal protection trademarks in Indonesia. Trademark disputes in Indonesia still often occur, especially regarding trademark similarities. The trademark registration system that generally known is the constitutive system (First To File). The purpose of this paper is to find out how the first to file principle is applied in trademark disputes and the legal consequences of decisions on trademark disputes. The method used in this study is normative juridical. Based on the results of the study, even though a trademark has been registered for the first time, if it is proven that the trademark has exceeded its legal protection period of 10 years, the legal consequences are that anyone can use the trademark.

Abstract

This study aims to examine the validity of smart contracts in business agreements in Indonesia as seen from the provisions of the agreement in the Civil Code and the provisions of contracts in other regulations applicable in Indonesia. The method used in this study is the normative method, which focuses on examining the rules in positive law. Based on this study, it is concluded that the use of smart contracts in Indonesia has been implemented properly and when viewed from the perspective of Civil Law in Indonesia, the use of smart contracts has fulfilled the elements of an agreement in Article 1320 of the Civil Code in general, although there are still shortcomings such as automatic execution as if made by only one party. In addition, in reality it is difficult to fulfill some of its elements, such as smart contracts creating special challenges because the transactions carried out in them are not bound by national borders, given the differences in legal systems between Indonesia and other countries. In all its limitations, smart contracts can still be carried out in Indonesia because of the principle of freedom of contract which has been regulated in Article 1338 of the Civil Code. In practice, the principle of freedom of contract must take into account Article 18 paragraph (1) and paragraph (2) of Law Number 8 of 1999 concerning Consumer Protection.

Abstract

Tujuan penelitian ini ialah untuk menggali ius constitutum terkait persidangan in absentia hingga eksekusi terhadap terpidana DPO dalam perkara tindak pidana korupsi dan menggali efektivitas eksekusi hukuman terhadap terpidana DPO dalam perwujudan pengembalian kerugian negara atas tindak pidana korupsi. Tipe penelitian yang digunakan adalah yuridis normatif. Pendekatan yang digunakan ialah terhadap peraturan perundang-undangan, konseptual hukum, dan kasus. Bahan hukum yang digunakan ialah bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Analisa bahan hukum yang digunakan ialah deskriptif analitis berdasarkan logika deduktif. Hasil penelitian didapati bahwa ius constitutum terkait persidangan in absentia hingga eksekusi terhadap terpidana DPO dalam perkara tindak pidana korupsi ialah menunjukkan kepastian hukumnya belum terwujud. Eksekusi hukuman terhadap terpidana DPO yang telah melalui persidangan in absentia pada perkara korupsi ialah tidak kemudian dapat memulihkan kerugian negara, yang menunjukkan bahwa efektivitas hukumnya belum terwujud. Perlu dilahirkannya undang-undang secara spesifik yang mengatur tentang sistem peradilan pidana in absentia pada korupsi dan eksekusi yang mengedepankan konsep follow the money daripada follow the suspect.

Abstract

Pada umumnya setiap negara memiliki undang-undang dan regulasi yang mengatur proses pemilu dengan mengedepankan prinsip netralitas. Undang-undang ini menetapkan standar yang harus diikuti oleh semua peserta pemilu, termasuk partai politik, kandidat, dan lembaga pemilihan. Dalam konteks penyelenggaraan pesta demokrasi. Netralitas merupakan sebuah dinamika masalah terpenting dalam melaksanakan Pemilihan Umum. Secara normatif, adanya perundang-undangan tentang pemilu memberi gambaran bahwa Indonesia telah berupaya mewujudkan pengisian jabatan Presiden dan wakil presiden, anggota Dewan Perwakilan Rakyat, anggota Dewan Perwakilan Daerah serta anggota Dewan Perwakilan Rakyat Daerah secara lebih demokratis melalui pemilihan umum secara langsung oleh rakyat. Di tengah antusiasme dan persaingan politik yang tinggi, netralitas pemimpin negara menjadi aspek kritis yang harus dijaga. Sifat netral pemimpin negara menjelang pemilu adalah esensi dari demokrasi yang bertanggung jawab, yang menjamin integritas proses demokratis serta memastikan keadilan dan keseimbangan dalam sistem politik. Tujuan dari penelitian ini adalah Tulisan ini bertujuan untuk membahas pentingnya sikap netral dari seorang presiden selama pemilu. Hal ini mencakup bagaimana presiden seharusnya tidak memihak pada salah satu kandidat atau partai politik, sehingga menjaga integritas demokrasi. Metode dalam penulisan ini menggunakan metode penelitian normative. Hasil dari penelitian ini menunjukan bahwa Salah satu etika politik yang harus dipegang oleh presiden sebagai kepala negara adalah sikap netral. Jika sikap ini tidak dipegang oleh kepala negara maka menimbulkan pro dan konta dalam masyarakat.

Abstract

Kedudukan peraturan lembaga dalam hierarki perundang-undangan di Indonesia, sebagaimana diatur dalam Pasal 8 Undang-Undang No. 12 Tahun 2011, masih belum memiliki kejelasan yang cukup, yang menyebabkan ketidakpastian hukum dalam praktik. Tujuan penelitian ini adalah untuk menganalisis kedudukan yuridis peraturan lembaga dalam hierarki perundang-undangan serta dampaknya terhadap pelaksanaan hukum di Indonesia. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan konseptual, serta pengumpulan data dilakukan melalui studi kepustakaan yang mencakup peraturan perundang-undangan, putusan pengadilan, dan literatur terkait. Hasil penelitian menunjukkan bahwa peraturan lembaga sering kali berpotensi bertentangan dengan peraturan yang lebih tinggi, seperti undang-undang atau peraturan pemerintah, karena ketiadaan harmonisasi yang jelas. Hal ini menimbulkan konflik normatif dan menurunkan kepastian hukum. Penelitian ini merekomendasikan perlunya revisi Undang-Undang No. 12 Tahun 2011 untuk memasukkan pedoman yang lebih rinci mengenai kedudukan peraturan lembaga serta mekanisme harmonisasi yang lebih jelas. Implikasi dari penelitian ini adalah pentingnya reformasi regulasi untuk meningkatkan kepastian dan konsistensi dalam pelaksanaan hukum di berbagai sektor di Indonesia.

Abstract

Pada mulanya kegiatan perekonomian masyarakat sekitar ditumpu oleh sektor pertanian, namun setelah adanya perusahaan pertambangan batubara di Jambi masyarakat mulai beralih pada sektor jasa yaitu menjadi tenaga kerja dan penyedia barang maupun jasa serta jasa untuk tenaga kerja dan perusahaan pertambangan batubara. Oleh karena itu, dalam penelitian ini peneliti akan mengkaji bagaimana dampak dari adanya pertambangan batubara terhadap kondisi sosial ekonomi masyarakat local di Jambi. Metode penelitian yang digunakan dalam penelitian ini adalah penelitian hukum normatif, maka yang diperlukan adalah bahan hukum primer yang bersumber pada sumber primer, yaitu perundang-undangan dan hasil wawancara yang berhubungan dengan perumusan masalah. Tidak dapat di pungkiri bahwa pemerintah mempunyai peran yang penting dalam mencari solusi terhadap dampak dan pengaruh pertambangan batu bara yang ada di indonesia. Pemerintah harus menyadari bahwa tugas mereka adalah memastikan masa depan yang dimotori oleh energi bersih dan terbarukan.

Abstract

A notary is a public official who has the authority to make authentic deeds regarding all acts, agreements and provisions required by statutory regulations and/or desired by interested parties. A deed made by a Notary can be used as strong evidence and the Notary needs to keep the contents of the deed he has made confidential. In carrying out their position, Notaries should be careful to avoid unlawful acts which can then be summoned by the judiciary. UUJN provides space for investigators to be able to examine Notarial deeds for investigative purposes as intended in Article 66 UUJN. The problem discussed is an examination of the minutes of Notarial deeds carried out by the Regional Notary Honorary Council for the purposes of investigations related to the principle of confidentiality and forms of protection for Notaries as public officials who are called upon to provide information. regarding the contents of the deed. The result obtained is that the Notary's obligation to keep the deed confidential as intended in Article 16 paragraph (1) letter f UUJN can be concluded as not violating the Principle of Notary Confidentiality. A Notary, in carrying out his official duties, is obliged to keep the contents of the deed and all information obtained by the Notary confidential in carrying out his official duties, unless statutory provisions order the Notary who is summoned as a witness to disclose this matter. keep the Notary's position confidential and fulfill his legal obligations as a witness in providing information regarding the contents of the deed as necessary. as evidence in court for law enforcement.

Abstract

Society 5.0 was initiated by Japan, and inaugurated on January 21, 2019, made as a resolution to the Industrial Revolution 4.0, using modern-based science (Artificial Intelligence, Robots, Internet of Things) for human needs with the aim that humans can live comfortably, including in air transportation, initially focusing on human factors (pilots) began to shift the emphasis to the development of aviation technology. Therefore, it is interesting and necessary to examine how the readiness of laws and policies to build air transportation in the 5.0 era in Indonesia. This research is normative legal research using a statute approach, conceptual approach, and comparative approach and uses secondary data obtained from primary and secondary legal sources related to laws and policies to build air transportation in the 5.0 era in Indonesia. The results show that the existing laws and policies for building air transportation in the 5.0 era in Indonesia are not ready. It is necessary to harmonize and synchronize laws and regulations and policies to build air transportation in the 5.0 era in Indonesia with global regulations and policies in the form of international agreements related to air transportation development in the 5.0 era in the world.

Abstract

A romance room is a special room or room provided by the state for inmates to channel their sexual desires. The provision of a romance room aims to provide a place for inmates to channel their sexual desires to their legal partners. In Indonesia, romance rooms are still limited and there are only three correctional institutions that have romance booths, namely Ciangir Class IIB Correctional Institution, Kendal Class IIB Open Correctional Institution, and Nusakambangan Class IIB Open Correctional Institution, while Parepare Class IIA Correctional Institution has not yet held a romance room. This study aims to find out the reality of inmates' sexual desire and the problems of procuring romance rooms in Class IIA Parepare Correctional Institution. This research is an empirical normative research that uses a statute appraoch, conceptual approach and social approach. The results of this study show that the reality of inmates' sexual desires in the Class IIA Parepare Correctional Institution requires a romance room as a legal mechanism to fulfill the inmates' sexual desires and to carry out the rights and obligations of the inmate's legal spouse in order to maintain marital harmony. Inmates of Class IIA Parepare Correctional Institution still have difficulty channeling their sexual desires because romance booths are not yet available, while CMK and extraordinary permits that are often used as a medium for channeling sexual desire require strict administrative requirements. The problems faced by the Parepare Class IIA Correctional Institution in the procurement of romance rooms are the absence of regulations that specifically regulate the requirements, implementation procedures, supervision, and technical matters related to the procurement of romance rooms. Another problem faced is the concern about the safety of the romance room and the impact caused if the inmate's wife or female inmate becomes pregnant and gives birth.

Abstract

This research project aims to examine the influence of civil law on the quality of life of people in big cities through a comprehensive literature review. The role of civil law in maintaining the equilibrium between the rights and obligations of individuals in a complex urban society is of great consequence. This research identifies the ways in which the application of civil law in the areas of property rights, contracts, family, and land affects various aspects of people's lives, including social stability, the economy, and individual welfare. From the literature review, it was found that legal certainty and effective access to civil justice contribute significantly to improving the quality of life of people in big cities. Conversely, ineffective civil law enforcement can lead to uncertainty, conflict, and inequality that negatively affect people's welfare.
