Abstract

Opening a savings account, a common practice in modern society, is subject to specific bank requirements, including the criterion of adulthood regulated by Indonesian law. This juridical research navigates challenges such as legal disparities and regulatory changes related to the criteria for opening savings accounts. Ethical considerations and consumer protection play a pivotal role in determining adulthood criteria, contributing to a nuanced understanding of the legal aspects of banking transactions. The study provides insights for banks to adapt account opening policies to Indonesia's evolving legal landscape. Despite technological advancements in the banking sector, compliance with account opening requirements remains crucial. The study sheds light on legal aspects, particularly digital identification and identity verification in the context of savings account opening. Legal frameworks such as Law No. 19 of 2016 and Bank Indonesia's regulations underpin the review of savings account opening requirements, addressing consumer protection and banking transaction security. Relevant to the banking industry's current technological landscape, this research aids regulatory compliance and fosters consumer trust in digital banking services. The study offers insights into how technology shapes savings account opening requirements, providing a foundation for enhancing banking policies in the digital era.

Abstract

The culture of capture marriage in Central Sumba Regency has experienced a shift in cultural values that has resulted in violence against women, triggering debates between customary law and Indonesian positive law. This study aims to describe the essence of the culture of catch marriage for women in Central Sumba Regency and its compatibility with Positive Law and to elaborate on the shift in the culture of catch marriage for women in Central Sumba Regency in Legal Feminist thinking. The research method used is empirical legal research which obtains data from primary data or data obtained directly from the community and library legal sources. The results of the study show that the practice of catch marriage is no longer in line with the principles of the Indonesian State which ratified the Human Rights Law, because this practice indicates various oppression against women specifically in the process of arrest and detention. Using feminist legal theory, from the legal text analysis approach, it is found that the weaknesses of customary law in Central Sumba are patriarchal and communal, while the legal text of the Sexual Violence Crime Law has weaknesses in the unavailability of implementing regulations and there is a legal vacuum in the local government of Central Sumba Regency regarding arrest marriages. In the approach to legal application, cases of capture marriage are dominantly resolved by custom, due to family relations and the attachment of capture marriage to the culture of the indigenous people of Central Sumba. The novelty in this research is to describe the essence of culture and the reality of a shift in the culture of capture marriage in Central Sumba Regency, which is analyzed through a legal feminist theory approach to its handling. This research is only limited to the culture of capture marriage that occurs in Central Sumba Regency in a feminist legal approach.

Abstract

Talking about joint property in Indonesia and its relation to inheritance, it cannot be separated from reviewing the Compilation of Islamic Law, especially Article 96 paragraph (1) which emphasizes that in the event of a divorce, half of the joint property becomes the right of the spouse who lives longer. This study wants to know the views of the people of Pantai Labu District towards common property as heritage property which seems still not uniform when viewed from the perspective of the Compilation of Islamic Law. This research is an empirical legal research, using qualitative methods. Data collection techniques by observation and interviews with a number of informants from 5 (five) villages in Pantai Labu District. The results showed that the Compilation of Islamic Law, which had been formed in 1991, was still not fully implemented by the Muslim community in Pantai Labu, this can be seen by the difference in understanding in seeing the rules regarding joint property, half of which are the rights of the spouse left behind, in addition to the rights that have been determined in the inheritance law. There are two (2) people's understanding of common property, one understanding ignores the rules in Article 96 paragraph (1) of the Compilation of Islamic Law, on the other hand there is an understanding in accordance with these rules. In addition, it is also known the desire of some people who choose rules that benefit their position in heirs, and in terms of their control over inheritance.

Abstract

This research aims to analyze the Criminal Act of Severe Assault by PS towards M based on Law Number 13 of 2006 jo Law Number 31 of 2014 concerning the Protection of Witnesses and Victims. The research method used is a juridical normative legal research type with a statute and conceptual approach. The primary data source is primary legal materials such as the Criminal Code and the Law on the Protection of Witnesses and Victims. The results of the research indicate the urgency of protecting witnesses and victims of criminal acts in criminal law as an effort to uphold human rights. Protection for victims of severe assault crimes needs to be strengthened through clear and effective regulations to provide a sense of security and justice for the victims. In conclusion, the protection of witnesses and victims of criminal acts is an integral part of the criminal justice system aimed at providing justice, preventing threats, and ensuring the fulfillment of victims' rights. Further efforts are needed to strengthen the protection of victims of criminal acts, including severe assault crimes, in accordance with legal principles and human rights.

Abstract

Dalam perjanjian kredit modal kerja dapat menimbulkan sengketa berupa wanprestasi. Dalam kasus perjanjian kredit modal kerja antara PT Bank Perkreditan Rakyat Jateng selaku kreditur dengan Alm. Hasyim Mustofa selaku debitur terjadi wanprestasi karena debitur meninggal dunia dan ahli waris tidak ada itikad baik untuk menyelesaikan seluruh kewajiban yang ditinggalkan. Penelitian ini bertujuan untuk mengetahui kewajiban ahli waris terhadap hutang debitur (pewaris) dalam perjanjian kredit modal kerja dengan PT Bank Perkreditan Rakyat Jateng dan apabila ahli waris tidak bersedia membayar hutang debitur (pewaris) dalam perjanjian kredit modal kerja tersebut dapat dinyatakan wanprestasi atau tidak. Metode penelitian yang digunakan dalam penulisan hukum ini yaitu yuridis empiris. Berdasarkan hasil penelitian, ahli waris memiliki kewajiban untuk menyelesaikan seluruh hutang yang ditinggalkan oleh pewaris. Hal tersebut dikarenakan tidak adanya keterangan atas penolakan harta warisan dari ahli waris yang dapat dibuktikan dengan adanya putusan pengadilan agama yang berisi penetapan ahli waris. Dengan diterimanya warisan, maka seluruh hak dan kewajiban akan beralih kepada ahli waris. Dengan demikian, bagi ahli waris yang tidak memiliki itikad baik untuk membayar hutang dari pewaris dapat digugat wanprestasi oleh kreditur yang dalam hal ini adalah pihak PT Bank Perkreditan Rakyat Jateng.

Abstract

An economy that continues to develop in line with society's current needs. Loans using a pawn system are one of the alternatives chosen for distributing financing funds. However, in practice, there is still the practice of pawning credit systems with goods obtained from criminal acts, which is detrimental to PT Pegadaian (Persero) as the creditor of the pawnbroker. The method used in this research is Normative-Empirical with a qualitative descriptive approach. The results of the research show that, the position of PT Pegadaian (Persero) in this case as a creditor who gave the pawn, even though the collateral originates from a crime, namely, theft, does not necessarily make the company's position as a custodian. This is strengthened by the applicable laws and regulations and based on the considerations of the property judge. the guarantee is returned to PT Pegadaian (Persero). The anticipatory solution for PT Pegadaian (Persero) is that the company can reaffirm the regulations regarding the inclusion of collateral documents such as receipts for purchasing gold jewelry. Or it can be confirmed through a third party regarding ownership of the collateral. Next, the customer needs to make a statement as well as a power of attorney and approval for the goods to be guaranteed from the actual owner of the goods.

Abstract

This research discusses law enforcement for perpetrators of sexual relations between individuals who still have familial relationships based on consanguinity in the perspective of positive criminal law and Islamic criminal law. By using a comparative approach method, the researcher found differences between positive criminal law and Islamic criminal law in the process of consanguineous sexual relations, especially in the complaint process, and also in the withdrawal of reports. The researcher categorizes consanguineous sexual relations as adultery, which can be legally processed after a complaint from the victim based on Article 284 paragraph (2) of the Indonesian Criminal Code (KUHP), while in Islamic law, with just one of the three existing pieces of evidence, punishment can be imposed immediately without a complaint. Furthermore, in Article 284 paragraph (4) of the Indonesian Criminal Code (KUHP), it is also stated that the complainant is allowed to withdraw their report before a judge's decision. This is different from Islamic law, where once consensual sexual relations are known to have occurred, the punishment cannot be revoked. Since consensual sexual relations are categorized as adultery, punishment is already stipulated in Islamic law as the absolute right of Allah and has been determined in the Quran. Article 294 of the Indonesian Criminal Code should be amended promptly to prevent weakness and be more effective and precise in preventing and punishing perpetrators of consanguineous sexual relations. Furthermore, society should avoid this act, as it not only constitutes a major sin but also severely damages morals and mental well-being.

Abstract

Islam has established lofty and noble goals for marriage. Islam also establishes dowry as an exclusive right for women. The dowry is a financial right that is obligatory by the prospective husband to the prospective wife. Although the dowry is an obligation of the prospective husband to the prospective wife, Islam never burdens the dowry beyond the ability of the prospective husband himself. However, what happened in Malaysia, especially in the State of Selangor, the Sultanate of Selangor issued a regulation regarding the minimum limitation of the amount of dowry in the state of Selangor, where Islam itself never gave a minimum or maximum limit to the amount of dowry. Because of this, this research aims to find out how Islamic law views the determination of the minimum amount of dowry set by the Sultanate of Selangor. With the formulation of the problem of how the implications of the Selangor Islamic Religious Office's decision on the minimum amount, how Islam views the determination of the minimum amount of dowry set by the Sultanate of Selangor. This research uses qualitative research with a juridical sociological empirical legal approach where the author focuses on research on the implementation or operation of a rule of Islamic law in society, whether it is related to the effectiveness of implementation, to the impact of its implementation on Islamic law in the structure of society. The results of the research show that the fuqaha agree that there is no maximum limit in the amount of dowry, but in the minimum limit the fuqaha differ in their opinion regarding this matter.

Abstract

This research was conducted with the aim of finding out how to file a civil lawsuit, because the form and aspects of the lawsuit have the same characteristics. Aspects of the same form of lawsuit are cumulative lawsuits and group lawsuits. In this research method the author uses normative legal research, namely research carried out by analyzing applicable laws and regulations. Regarding the sources of legal materials used, they are divided into primary legal materials and secondary legal materials, where the primary legal materials are the main legal materials that are the basis for the study of this writing, namely statutory regulations. That there are differences in the forms of lawsuits even though they have some of the same characteristics, what makes them different is the accumulation of lawsuits / Combination of lawsuits regarding several legal issues that are both subjective and objective in nature, their use in civil courts which usually deal with issues of breach of contract, unlawful acts and divorce, etc. Meanwhile, group lawsuits are used for civil matters regarding consumer protection, the environment and forestry.

Abstract

This research analyzes the application of the Waqf Law Number 41 of 2004 to the role of nazhir in waqf administration, taking the case study of Case Decision Number 20/Pdt.G/2023/PN Msb as a basis. The focus is on evaluating the role and performance of the nazhir in the legal context, as well as its impact on the continuity of the waqf and the integrity of the nazhir. Through a normative legal approach, this research identifies the nazir's responsibilities and duties in maintaining and managing waqf assets following Sharia principles. Analysis of Decision Number 20/Pdt.G/2023/PN Msb reveals the judge's consideration of the nazir's role in managing waqf land, especially in the context of the conflict over ownership of land intended for the Baitul Makmur Mosque. This research explores the relationship between the nazhir's role and the implementation of the Waqf Law, as well as the impact of the judge's considerations on the decision in the case. As a result, protection of waqf ownership, especially in the context of waqf land, emerged as crucial. Emphasis is also placed on the important role of nazhir in safeguarding and managing religious assets for the public interest.
