Abstract

Obstruction of justice is a criminal offense formulated in the Criminal Code to protect the judicial process so that it runs fairly and prevents manipulation. However, law enforcement against obstruction of justice in Indonesia is considered to be still weak due to several obstacles such as unclear article formulations, weak cooperation between related institutions, minimal internal supervision and lack of public understanding. Therefore, various comprehensive improvement efforts are needed both in terms of regulations, coordination between institutions, internal supervision, and public education so that enforcement of obstruction of justice laws can run effectively and optimally in Indonesia.

Abstract

Protection of cultural heritage in Indonesia is regulated in Law no. 11 of 2010 concerning Cultural Heritage. Violations in the form of destroying cultural heritage can be subject to serious criminal sanctions. One example of a protected cultural heritage is Fort Putri Hijau, with various protection efforts by the government such as restoration, monitoring and outreach, in order to preserve this historic site as the nation's cultural heritage.

Abstract

Legal proof in a criminal case is the process of convincing a judge of the truth of an event that is the basis of a claim or defence in a case. Legal proof has various aspects, methods, and systems that are governed by the rules of the law in force. Legal proof also relates to the concepts of justice, certainty, and validity of the law. The purpose of legal proof is to a fair, true, and in accordance with the facts and law. Law proof faces a variety of challenges and problems, such as the limitation of the means of proof, the difficulty of testing the validity and authenticity of evidence, and the influence of non-law factors on proof. Therefore, legal proof requires improved quality, professionalism, and integrity of the perpetrators, whether judges, prosecutors, lawyers, or witnesses. The methods used are the Legislative approach, the Case approach, and the Conceptual approach. By looking at whether the law of our events is still relevant to the existing case, then how to solve the problem with the emerging views and doctrines in criminal law. The legal proof in criminal cases is also very close to the emergence of judges' beliefs, so the judge is obliged to apply the theory relevant to the conditions that exist at the time of the decision of a case. Thus, theory used must follow the case and the development of the doctrine in the law of criminal cases.

Abstract

Marketplace legal liability in Indonesia regarding copyright infringement in the E-Commerce era faces increasing complexity and a rise in copyright infringement cases. The formulation of the problem in this research is the complexity of the problem of copyright infringement in the market, as well as obstacles in demanding market accountability, the role of the market, and what preventive measures need to be strengthened to overcome this problem. This research combines normative and empirical perspectives to understand the crucial aspects of market legal accountability. The research results show the need for revisions in the legal framework regarding market legal responsibility for copyright infringement in Indonesia. The inconsistency between Article 15 of the ITE Law and Article 10 of the Copyright Law creates obstacles in implementing the rules. Therefore, concrete measures are needed to harmonize regulations and improve copyright protection in the market.

Abstract

Indonesia is a unitary country consisting of thousands of large and small islands, and consisting of various tribes, cultures and religions, and has the motto Bhinneka Tunggal Ika. Interaction between tribes, races and religions is the initial door for people to know each other so that from this interaction there is who progress to the stage of marriage, there are even those who get married even though they are hampered by differences in religion. It is feared that this will gradually cause problems, if we refer to existing religious norms regarding certain boundaries regarding marriage. This resulted in a decision by the Pontianak District Court Number 12/Pdt.P/2022/PN.Ptk. who granted the request to carry out the registration of interfaith marriages. This determination certainly attracts attention if you remember the rules contained in Law No. 1 of 1974 that a marriage is valid if it is carried out according to the laws of each religious belief. Even though registration has been regulated in Article 35 Letter (a) of Law Number 23 of 2006 in conjunction with Law Number 24 of 2013 concerning Population Administration, the regulations regarding interfaith marriages in the Marriage Law still experience a legal vacuum. It is hoped that this article can provide insight to the public regarding the problems of implementing interfaith marriages in Indonesia.

Abstract

Dalam penyelesaian perkara pidana terdapat beberapa teori tujuan pemidanaan yang tentunya berimplikasi secara siginifikan terhadap nilai keadilan penyelesaian perkara. Teori tujuan pemidanaan klasik yang banyak dianut oleh banyak hukum pidana di seluruh dunia dahulu adalah teori pembalasan (retributive justice). Teori pembalasan dewasa ini dianggap sudah tidak sesuai dengan perekmbangan zaman, karena hanya menekankan pada titik jera pelaku dan tidak fokus memperhatikan kerugian korban. Sehingga muncul teori tujuan pemidaan baru yang lebih fokus terhadap penggantian kerugian terhadap korban. Teori penggantian kerugian yang disebut restorative justice ini mengedepankan pemulihan keadaan korban menjadi seperti semula daripada pembalasan terhadap pelaku tindak pidana. Tulisan ini menggunakan metode penelitian yuridis normatif dan kualitatif atas data terdahulu tentang peran advokat. Hasil dari penelitian ini menemukan bahwa advokat sangat berperan penting sebagai katalisator perdamaian antara korban dan pelaku tindak pidana. Advokat berperan sebagai mediator yang bersetujuan mencapai kesepakatan ganti kerugian kepada korban dan hukuman pidana yang pantas dituntutkan kepada pelaku. Hambatan dalam perwujudan restorative justive adalah kurangnya sumber daya manusia, sarana prasarana, hingga sulitnya mencapai kesepakatan antara para stakeholder yakni korban, pelaku dan aparat penegak hukum.

Abstract

Notary and PPAT Protocols whose whereabouts are unknown and whose whereabouts are not known so that the protocol is not handed over will result in losses for clients using Notary and PPAT services because various data and files belonging to clients are stored by the Notary/PPAT so this becomes a legal issue related to protection legal clients who experience events like this. The type of research or approach method used is the normative legal research method and the approach used is the statutory approach. Based on research, when something like this happens, clients who experience the incident can contact the relevant agencies such as the Police, BPN and follow all established procedures.

Abstract

This article aims to find out what are the problems and obstacles that are not well-implemented agrarian reform in Indonesia, and what recommendations that can be implemented so that agrarian reform runs properly. This research is a normative type of research conducted by examining library materials, also known as literature studies. Agrarian reform in Indonesia is faced with several problems that include inequality of land ownership, uncertainty of land ownership status, as well as conflict over land rights, and uncertainty of land ownership status and lack of law enforcement exacerbate the situation, causing uncertainty and conflict to the detriment of rural communities. Industrial expansion and development projects also place significant pressure on land resources and community land rights. The growth of the plantation, mining, and infrastructure sectors often has negative impacts on rural communities and the environment, complicating agrarian reform efforts. Resolving these issues requires a strong commitment from the government, collaboration between various parties, and progressive policy implementation to achieve inclusive and sustainable agrarian reform.

Abstract

This research aims to analyze: 1) The partial and simultaneous influence of organizational commitment, leadership and organizational culture on employee performance, 2) The most dominant variables that influence employee performance at BPKAD West Papua Province. The population of this study was 48 people. The sample was determined using a saturated sampling technique so that the entire population was sampled. Data collection uses questionnaires and documents, data analysis uses multiple linear regression. The research results show that: 1) Organizational Commitment, leadership and organizational culture have a partially positive and significant effect on employee performance, 2) Organizational commitment, leadership and organizational culture have a simultaneous positive and significant effect on employee performance, 3) Leadership is the most dominant variable influence on employee performance at BNPKAD West Papua Province. 4) The coefficient of determination results show a value of 89.8%, meaning that employee performance variables can be explained by the variables Organizational Commitment, Leadership and Organizational Culture, while the remaining 10.2% is explained by other variables outside the model.

Abstract

This research aims to analyze the influence of individual competence and organizational justice on job satisfaction and employee performance. Data collection is through distributing questionnaires. The research sample was 48 people, using a saturated sampling technique. Meanwhile, this research uses path analysis and descriptive analysis. The research results show that: 1) Individual competency and Organizational Justice have a positive and significant effect on job satisfaction; 2) Individual competency and Organizational Justice have a positive and significant effect on employee performance; 3) Job satisfaction has a positive and significant effect on employee performance. 4) Job satisfaction is able to mediate the influence of individual competence on employee performance. 5) Satisfaction is not able to mediate the influence of organizational justice on employee performance. The Head of BPKAD needs to improve individual competence and organizational justice so that it can create job satisfaction which has an impact on improving performance.
