Abstract

The Renvoi procedure is a legal mechanism that aims to protect the rights of creditors who face a refusal of payment by the receivership in the context of insolvency. This process provides a legal recourse for creditors who face rejection of bills by sending a letter of objection supporting the reasons for the rejection, complete with relevant evidence, to the Panel of Deciding Judges through the role of the Supervisory Judge. In this Renvoi Procedure case, PT JIEP as the Applicant and the Curator Team of PT Tobu Indonesia Steel as the Respondent made legal efforts because the Applicant submitted an objection to the bill to the Respondent. In this study, the author chose to apply a normative descriptive approach. The technique chosen involves a statute-based approach as well as a case-based approach to analyze and explore the issues discussed where this approach is used to examine cases that occur based on statutory provisions relating to all bankruptcy activities in PKPU. Based on the summary that has been submitted, the author develops a more in-depth research on Decision Number 28/Pdt.Sus-PKPU/2018/PN.Niaga.Jkt.Pst.

Abstract

Penelitian ini berfokus pada Desain Industri sebagai bagian dari Hak Atas Kekayaan Intelektual yang masih lemah dalam Perlindungan hukumnya di Indonesia.Metode penelitian ini adalah yuridis normatif / doktrinal dengan pendekatan konsep, teori dan perundang-undangan . Data yang digunakan adalah data sekunder berupa bahan hukum primer dan sekunder. Hasil penelitian menunjukkan bahwa perlunya perlindungan hukum atas Desain Industri yang didasarkan atas pemikiran bahwa lahirnya Desain Industri tidak terlepas dari kemampuan kreativitas cipta, rasa dan karsa yang dimiliki oleh manusia yang harus dilindungi. Namun terdapat beberapa faktor yang memperngaruhi lemahnya perlindungan hukum atas Desain Industri tersebut karena beberapa faktor yaitu faktor tuntutan pidana, sistem pendaftaran, pembebanan biaya pendaftaran hak desain industri dan pengetahuan masyarakat masih kurang tentang desain industri. Solusinya supaya merevisi Undang-Undang No.31 Tahun 2000 tentang Desain Industri sekaligus melakukan sosialisasi.

Abstract

The purpose of this work is to find out what are the regulations for the use of Sarmat missiles according to international treaties (1), what are the violations of the use of Sarmat missiles according to the Chemical Weapons Convention of 1997 (2), what is the form of responsibility for the use of Sarmat missiles according to the Weapons Convention of 1997. (3) what is the form of responsibility for the use of Sarmat missiles according to the 1997 Weapons Convention using normative legal research methods. concluded.: the efforts of countries to achieve world peace and mutual security of each country through the regulation and prohibition of chemical weapons are consistently implemented by countries, namely by establishing protocols prohibiting the use of gases that cause asphyxiation, poisonous gases / other gases in war and warfare. This method of using bacteria became known as the Geneva Protocol of 1925, the Chemical Weapons Convention of 1992, the Additional Protocol of 1977, and the Hague Convention of 1907. The existence of martial law has become a legal norm that the international community must abide by in wars and armed conflicts arising from sovereignty issues. The regulation of war and armed conflict in each UN member state is now a measure of the extent to which compliance with international humanitarian law treaties can be fairly enforced through the International Criminal Court.

Abstract

The importance of legal protection for each community is one of the reasons for the issuance of Law Number 13/2006 on Witness and Victim Protection which was enacted on 11 August 2006. This research aims to find out, how the regulations related to victim protection in Indonesia. Then, how is the process of applying for protection of victims' rights through LPSK and finally, how is the influence of the protection provided by LPSK on victims for law enforcement. This research uses a normative method. The procedure for providing protection to witnesses and victims as regulated in Article 28 to Article 32 of Law Number 13 Year 2006 is a process that includes various procedures and requirements that must be fulfilled by witnesses and victims to be able to get protection from LPSK which is sometimes difficult for witnesses and victims. The influence of the Witness and Victim Protection Agency (LPSK) in protecting witnesses and victims has not been maximised, due to the lack of socialisation in the community, especially in the regions, about the existence of the Witness and Victim Protection Agency as an institution tasked with protecting witnesses and victims.

Abstract

Legal disputes over land rights have become a fundamental and complex problem in the history of the development of agrarian law in force in Indonesia. The inequality that occurs in the pattern of distribution of control, ownership, use and utilization of land, which is also exacerbated by the condition of many land being abandoned by land rights holders, either due to intentional or unintentional factors, has triggered widespread cases of land disputes that have occurred until At the moment. The government itself has attempted to create policies and related regulations, in order to find solutions in resolving cases of ownership disputes over abandoned land. This includes Government Regulation Number 20 of 2021, concerning controlling abandoned areas and land. In this research the author raises two issues, namely, what is the urgency of eliminating ownership rights to abandoned land based on Government Regulation Number 20 of 2021, and what legal remedies can be taken by land rights owners and/third parties who suffer losses due to their abolition rights to abandoned land based on Government Regulation Number 20 of 2021. This research is a form of normative legal analysis (normative legal research), using a statutory approach and a conceptual approach. This research also has important implications in the context of land law, especially in terms of protecting the rights of land owners and encouraging the use of productive land uses. It is hoped that the results will serve as a guide for land ownership rights holders, the government and legal practitioners to better understand the relevant regulations and the impact of loss of ownership rights to land due to abandonment in accordance with the provisions contained in Government Regulation Number 20 of 2021.

Abstract

Penelitian ini membahas mengenai proses pengambilan keputusan di tengah masyarakat yang majemuk di wilayah Desa Ngadas, Kecamatan Poncokusumo, Kabupaten Malang, Provinsi Jawa Timur. Penelitian dilakukan guna mengetahui bagaimana proses pengambilan keputusan yang berlangsung di Desa Ngadas dan bagaimana proses tersebut mengakomodasi keberagaman masyarakat yang ada. Penelitian ini dirasa memiliki urgensi atau signifikansi yang cukup tinggi sebab pada umumnya masih sedikit penelitian yang membahas terkait aspek multikulturalisme dalam ranah politik daerah khususnya di desa, terutama yang dikaitkan dengan proses pengambilan keputusan. Penelitian dilakukan dengan menggunakan pendekatan kualitatif dan metode deskriptif dengan pengumpulan data primer dilakukan melalui wawancara. Hasil penelitian menunjukkan bahwa Desa Ngadas dengan keberagaman masyarakatnya, terutama pada agama yang dianut dalam melakukan pengambilan keputusan selalu melalui musyawarah bersama yang diwadahi oleh pemerintah desa dan Badan Permusyawaratan Desa (BPD). Keputusan yang diambil bisa jadi tidak mengakomodasi seluruh warga mengingat sifat peraturan pemerintah yang mengikat, tetapi pemerintah Desa Ngadas selalu menerapkan prinsip partisipatif, mencakup: gotong royong; musyawarah; peran adat.

Abstract

The existence of criminal law is part of the national law that organizes efforts to combat crime through the criminal justice system. Lapas plays a crucial role in the modern criminal justice system, with a focus on the rehabilitation of prisoners. The fact that Lapas is managed by the Indonesian state so far has never been rid of some problems such as overcapacity, inadequate facilities, and a lack of allocation of funds to operate prison facilities, which ultimately affects the quality of Lapas performance in Indonesia. This research using comparative legal methods to find out the similarities and differences among the elements of each legal system. The object of comparison is the State of the United States, which is administered in accordance with private parties. The results show that the Indonesian government has indeed issued a budget for the management of Lapas but has not been able to create an effective Lapas organization. Efforts that can be made by the government for future Lapas management can be achieved in cooperation with private companies in the framework of the development of Lapas infrastructure and funding sources, which are fundamental needs in order to efficiently manage Lapas.

Abstract

This discussion delves into the legal aspects of criminal prosecution concerning authentic deeds containing forged signatures, with a specific focus on the responsibilities of notaries in the creation of authentic deeds and the legal considerations by judges based on Supreme Court Decision Number 146K/PID/2015. The discourse encompasses the definition of forgery, the penalties that may be imposed on notaries, and the legal considerations regarding the authenticity of authentic deeds affected by forged signatures. Emphasis is placed on the evidence admissible in legal cases, the authority of officials creating authentic deeds, consistency with applicable laws, and potential legal consequences. Forgery within authentic deeds, including forged signatures, constitutes a serious criminal offense that can result in severe legal consequences for the perpetrators. The responsibility of notaries as officials responsible for creating authentic deeds is to ensure the validity and authenticity of such documents. Supreme Court Decision Number 146K/PID/2015 provides guidance on the considerations judges should take into account when assessing the authenticity of authentic deeds containing forged signatures, including handwriting expert opinions, the utilization of forensic technology, and an examination of the context surrounding the creation of the deed. The importance of consistency with applicable laws in the process of creating authentic deeds cannot be overstated, as it is a crucial factor in determining the validity of legal documents in court. Legal consequences that may arise from forged signatures within authentic deeds include the nullification of the deed, legal sanctions imposed on the perpetrators, and restitution for damages to the aggrieved parties.

Abstract

Konsekwensi logis dari dianutnya asas kebebasan berkontrak (freedom of contract, contractvrijheid) dan sistem terbuka yang ketentuannya bersifat hukum pelengkap (optional law, aanvullenrechts) dalam buku III KUHPerdata sebagaimana disimpulkan dari Pasal 1338 Ayat (1) memberi peluang kepada setiap orang untuk membuat perjanjian apa saja, baik yang sudah diatur dalam KUHPerdata maupun jenis perjanjian baru yang belum diatur dalam KUHPerdata yang muncul dalam praktek dengan berbagai nama, tanpa kecuali kontrak elektronik (e-contract) yang muncul dari transaksi elektronik (transaksi digital) yang dilakukan melalui dunia maya (cyber space) yang berakibat hukum pada dunia nyata. Permasalahan hukum yang muncul adalah bagaimana status kontrak elektronik (e-contract) dan bagaimana implikasinya terhadap ketentuan dalam buku III KUHPerdata. Penelitian ini bersifat deskriptif normatif. Data yang dibutuhan dalam penelitian normatif adalah data sekunder berupa bahan hukum primer, sekunder dan tertier untuk menjawab permasalahan dimaksud. Hasil penelitian menunjukkan bahwa status kontrak elektronik (e-contract) adalah kontrak tidak bernama (innominat contracten) yaitu varian kontrak baru yang memiliki sifat khusus atau sui generis dan berimlplikasi pada pemberlakuan ketentuan Buku III KUHPerdata sebagaimana diatur dalam ketentuan Pasal 1319 KUHPerdata, selain ketentuan yang diatur dalam UU ITE dan peraturan pelaksananya.

Abstract

The husband is required to give his wife nafkah iddah and mut'ah in a talak divorce; nafkah iddah is an allowance paid during the iddah period, and mut'ah is an allowance for the divorce term. The national laws that are in effect in the country govern efforts to settle court rulings. Settlements are typically reached through the family court system or the mediation process. The Religious Court Number 2429/Pdt.G/2023/PA.Mdn decided that although the panel of judges had required the applicant and respondent to use mediation, their attempts to reach an amicable agreement through mediation had failed. Subsequently, the case analysis proceeded by presenting the contents of the letter sent by the petitioner, which she kept on file. The spouses may pursue a just settlement in compliance with the relevant legal framework.
