Abstract

In traditional pawning in Tana Toraja, redemption of the pawned land is known as Ma'Sulang. Where the party who redeems the land has the right to get the land. However, in the context of Indonesian written law, this has not been accommodated in a written statutory regulation so that it could lead to different interpretations by the parties involved in the process of pawning the customary land, giving rise to legal uncertainty. The method in this research is empiricial that examinethe applicable legal provisions and what happens in reality in society. The results of the study confirm the difference between ma' sulang and the written legal provisions in Article 7 of Perpu No. 56 of 1960 concerning Determination of Agricultural Land Areas for redemption of pawns contains rules for a time limit of 7 years and the recipient of the pawn is obliged to return the pawned land to its owner with no right to demand a ransom payment, while the rules for redeeming traditional pawns (ma' sulang) do not recognize a time limit. but the obligation to return is binding. The lender is obliged to redeem his land if he wants the land back. The object of land from Ma' Sulang can also be applied for the issuance of a certificate of ownership of land rights while still adhering to the written legal provisions. making a letter of approval for the distribution of inheritancesigned by other heirs in the presence of witnesses and authorized officials.

Abstract

It is important to be careful when the directors assign the authority of substitution to someone else who will represent the company. The Directors shall set down in the Power of Attorney in specific and definite terms the scope of the legal activities authorized by the Power of Attorney. This does not, however, exclude the chance that the person who received the power of attorney might abuse that authority and cause damages for the agent of that power of attorney. In the Decision of the Supreme Court Number 4575 K/PDT/2022, the notary, who was the party who made the deed of power of attorney for the directors, bears responsibility for the legal ramifications of a forged directors' power of attorney on credit that has been disbursed. A normative-juridical research methodology with a case study approach was utilized to examine Supreme Court Decision Number 4575 K/PDT/2022. According to the study's findings, the credit agreement remained legally enforceable for the parties even though the power of attorney for directors was declared illegal because it failed to satisfy the subjective criteria for agreement validity. Therefore, even though the notary who created the forged power of attorney is not criminally liable, he is nonetheless held civilly liable for any losses brought on by the forged document.

Abstract

Youtube content as a creative economy work has been recognized as Intellectual Property that can be used as collateral. This, of course, can optimize the potential of creative economy actors to increase their business. However, this also still raises debate about the legal certainty of Youtube content as a guarantee for creative economy business actors from the perspective of guarantee law. This research is normative juridical research with an emphasis on secondary data. The research specification is descriptive-analytical, using a qualitative normative analysis method using a deductive approach to conclude. The results showed that the facilitation mechanism for intellectual property-based financing schemes begins with copyright registration of YouTube content, verification and assessment of collateral by a bank or non-bank financial institutions, financing or credit agreements followed by guarantee charging contract, and recording in the financing facilitation system for creative economy business actors. The legal certainty of YouTube content as a guarantee for creative economy actors from a legal perspective, guarantees do not protect creditors. This is because the value of intellectual property is uncertain which can change. The relevant ministries are expected to immediately issue technical regulations related to intellectual property-based financing so that they can serve as guidelines and provide legal certainty in implementing intellectual property-based financing for creative economy actors.

Abstract

This research aims to analyze the aggravation of members of the TNI who commit torture resulting in death.This research uses normative legal research with a statutory approach (statute approach) and a case approach (statute approach) with the following steps: (1) identifying legal facts and eliminating irrelevant matters; (2) collecting legal and non-legal materials; (3) conducting a review of legal issues; (4) drawing conclusions and providing prescriptions.The results of the research show that first, reviewing Decision No. 61-K/PM I-04/AD/VII/2020 and Decision No. 161-/PM.II-08/AD/VIII/2020 based on a) case of position, has described criminal events, criminal acts, and criminal acts, and b) mitigating and aggravating circumstances, has described differences. Second, the weighting of TNI members who commit abuse resulting in death can be determined through 1) the defendant being a member of the TNI, 2) Article 52 of the Criminal Code, 3) Article 131 of the Military Criminal Code, and 4) causing death.

Abstract

Kemajuan teknologi dan era globalisasi saat ini yang sudah semakin maju, dimana setiap orang dapat memanfaatkan teknologi dengan mudah untuk melakukan usaha guna memenuhi kebutuhan hidupnya. Tetapi kemajuan teknologi juga menyebabkan setiap orang dapat melakukan tindakan yang salah seperti melakukan pembajakan terhadap hasil karya orang lain. Hasil karya sebagai bagian dari hak kekayaan intelektual, yaitu berupa hak cipta yang diatur dalam hukum internasional dan hukum nasional. Dalam konsep hak cipta terkandung adanya hak moral dan hak ekonomi yang dimiliki oleh pencipta. Hak moral merupakan hak yang melekat pada pencipta untuk mencantumkan namanya dan melarang orang lain mengubah ciptaannya, sedangan hak ekonomi merupakan hak yang melekat secara ekonomi pada pencipta untuk mendapatkan keuntungan secara ekonomis. Liberalisasi perdagangan yang terjadi saat ini memberikan jaminan untuk melindungi terhadap hak ekonomi dan hak moral secara internasional dan nasional.

Abstract

The international cooperation is an important in interstate relation aspect. It is required an international agreement. The agreement in international law was established in Convention of Vienna 1969. The Convention 1969 is the regulation of internal law was agreed by the states including Indonesia. Even though have not ratifying yet the Convention of Vienna 1969, however, Indonesia persists oblige to the custom of international law. The national law of Indonesia is regulating how to implement the international agreement. It is described on Act No.24 of 2000 on International Agreement. Ironically, however, the regulation of international trading cooperation of the Act No.7 of 2014 contravene to the provision as was agreed by all the state, i.e. Convention of Vienna of 1969. One of article is No.85 the Act No.7 of 014. The national law of Indonesia has contravened the “pactasuntservanda”principle.Moreover, there is an inappropriate provision to the national law of Indonesia. There is must be a modification of international law in correlation of international trading.

Abstract

Homelessness and begging is a social phenomenon that must be taken seriously. This phenomenon is becoming more and more concerning. Although the government has always tried to reduce the population of vagrants and beggars through curbing operations, the number of vagrants and beggars never seems to decrease and even tends to increase. This study aims to describe the problems that occur in homeless people and beggars. This study is conducted research what is qualitative as well as descriptive that aims to describe the existing phenomena connected to the problem of homeless and Medan City's beggars. Documentation, observation, and interviews are the data gathering techniques used. The findings of this study indicate that the factors that lead to vagrant and beggar are limited employment opportunities, low levels of education, economic living conditions and mental factors, lack of parental attention, promiscuity, laziness to work, environmental influences, disability. As for the obstacles faced by the government in handling vagrants and beggars in Medan City, there are internal factors and external factors.

Abstract

Penelitian hukum terhadap tindakan promosi yang menyesatkan oleh produsen rokok ST dilakukan karena banyak dijumpai pelaku usaha yang memproduksi, menjual dan mengiklankan produknya tidak sesuai dengan manfaat yang dihasilkan dari penggunaan produk tersebut. Sedangkan di lain sisi, banyak konsumen rokok tersebut yang masih belum mawas diri mengenai promosi menyesatkan yang dilakukan oleh pelaku usaha. Meskipun tujuan pelaku usaha melakukan aktivitas usahanya adalah untuk mendapatkan keuntungan, namun harus tetap mempertimbangkan kepentingan konsumen secara umum. Selain itu, penulis ingin mengetahui seberapa jauh peran pemerintah (dalam hal ini Dinas Kesehatan) dalam melakukan pengawasan terhadap promosi yang menyesatkan, sehingga merugikan konsumen. Produsen rokok ST tetap meyakini jika produknya dapat memberikan dampak kesehatan bagi konsumen. Penjelasan mengenai berbagai fakta yang telah dijelaskan tersebut, secara langsung dapat diartikan sebagai kurangnya kemampuan konsumen untuk memahami suatu produk, khususnya produk olahan tembakau yaitu rokok sehingga mengakibatkan konsumen berada pada posisi yang rentan ataupun lemah. Ketertarikan konsumen untuk mengkonsumsi suatu produk, terkadang hanya didasarkan atas label produk atau promosi yang dilihatnya saja, tanpa berpikir hal - hal lain terkait produk tersebut. Di lain sisi, pelaku usaha sebagai produsen barang dan/atau jasa wajib bertanggung jawab terhadap validasi informasi mengenai produk yang diperdagangkan pada konsumen. Untuk menunjang harkat dan martabat konsumen, diperlukan kesadaran, pengetahuan, kepedulian, kemampuan dan kemandirian konsumen untuk melindungi dirinya serta menumbuhkembangkan sikap pelaku usaha yang bertanggung jawab. Esensi dari peraturan tersebut adalah memberikan perlindungan bagi konsumen sekaligus bagi pelaku usaha secara proporsional, yang bertujuan guna menciptakan keadilan baik bagi konsumen maupun pelaku usaha.

Abstract

Responsibility in space law is regulated in the 1967 Outer Space Treaty and the 1972 Liability Convention. These rules generally regulate the role and form of state responsibility in space activities that cause accidents. The current development of the legal space has begun to involve the private sector as the organizer of space activities, but so far regulations at the international and national levels have not regulated the roles and responsibilities of the private sector. To answer this problem, normative juridical research methods are used, namely legal research which bases the research results on secondary data, namely primary, secondary, and tertiary legal materials relating to personal responsibility in artificial space object accidents. From the research conducted, it can be concluded that the regulation of responsibility for space accidents that cause losses are borne by the state because the celestial bodies are registered in the name of the state, but in terms of payment of compensation incurred, it is borne by the state. space operator. The existing laws and regulations in Indonesia do not yet regulate the accountability mechanism for the private sector, because the Space Law only states that the private sector can play a role in space commercialization activities.

Abstract

Explores the concept of "fictitious positive" in the context of Indonesian administrative law, focusing on its application in public administration and licensing processes. The term refers to situations where public administration authorities fail to provide timely responses or services to citizen requests. The principle of positive fiction is enshrined in Article 53 of Law Number 30 of 2014, which sets time limits for government officials to make decisions and take actions. If the specified time limits are not met, the application is considered accepted. The State Administrative Court plays a role in adjudicating fictitious positive applications. However, recent regulatory changes introduced by the Job Creation Law have altered the process, shifting the authority to the executive branch. This abstract also examines the implementation of positive fictitious decisions in the context of the One Stop Integrated Service and the Electronic Integrated Business Licensing Service, aimed at simplifying licensing procedures and enhancing service quality. The abstract concludes by discussing the challenges and uncertainties associated with the application of positive fictitious principles in Indonesian administrative law and highlights the need for further regulations and clarity to ensure legal certainty and effective governance.
