Abstract

In 2020, a hoax was disseminated through social media in Batam City, claiming that the captain of the Virginia Ship had contracted Covid-19. This hoax immediately caused significant concern among the residents of Batam City, as the ship was anchored in their city. This study aims to identify the strategies employed by the Regional Police of Riau Islands Province to combat hoaxes, specifically focusing on the case of the Virginia Ship. To achieve this objective, socio-legal research was conducted, which involved in-depth interviews with relevant stakeholders from the Regional Police of Riau Islands Province. Additionally, secondary data collected through library research was utilized. All data was qualitatively analyzed. The findings of the study indicate that the enforcement of laws against hoaxes on social media pertaining to COVID-19 news in Batam City has been effective. This success can be attributed to the establishment of a Cyber Crime Investigation Satellite Office situated at the Kepulauan Riau Regional Police headquarters.

Abstract

Hukum pidana di Indonesia erat kaitannya dengan asas legalitas yang terdapat di dalam Pasal 1 ayat (1) KUHP. Asas legalitas di bawah hegemoni paradigma positivisme, menekankan suatu perbuatan dapat dipidana apabila ada aturan hukum yang mengaturnya terlebih dahulu yakni aturan hukum pidana dalam bentuk undang-undang pidana. Jika hanya berorientasi pada undang-undang saja maka keadilan yang diwujudkan hanyalah keadilan formal. Paham critical legal studies menentang dan mengkritik pemahaman tersebut. Fokus sentral critical legal studies adalah untuk mendalami dan menganalisis keberadaan doktrin-doktrin hukum atau asas hukum, termasuk asas legalitas. Penelitian ini bertujuan untuk memberikan pemahaman bahwa paradigma critical legal studies memberikan pandangan yang berbeda terhadap asas legalitas. Metodologi penelitian ini menggunakan penelitian hukum normatif dengan pendekatan filosofi, perundang-undangan, dan hermeneutik. Berdasarkan hasil penelitian, bahwa paham critical legal studies telah masuk di dalam sistem hukum di Indonesia, baik melalui teori hukum maupun melalui undang-undang. Pasal 10 ayat (1) dan Pasal 5 ayat (1) Undang-Undang Nomor 48 Tahun 2009 tentang Kekuasaan Kehakiman merupakan refleksi dari pemahaman critical legal studies. Pasal tersebut memberikan arti yang berbeda mengenai asas legalitas dari apa yang dipahami selama ini serta mengisyaratkan peluang untuk mengisi kelemahan dari asas legalitas status quo.

Abstract

Kekayaan intelektual atau hak kekayaan intelektual berasal dari pemikiran seseorang yang kemudian disebut pencipta atau penemu dan karyanya kemudian mempunyai hak milik. Waralaba merupakan suatu cara bisnis yang sudah ada sebelumnya yangmerupakan hasil gagasan penciptanya. Untuk menjalankan usaha dengan metode waralaba, harus ada kesepakatan antara kedua pihak yang terlibat. dari Bagaimana Penyelesaian Sengketa Wanprestasi Perjanjian Waralaba Melalui Mediasi dan Bagaimana hambatan pertanggungjawaban para pihak terhadap wanprestasi perjanjian waralaba dari merk teh poci, Pihak yang memberi nama harus menjaga reputasi baik pihak lain dalam waralaba. Namun perjanjian ini seringkali dilanggar hingga terjadi pelanggaran kontrak sehingga merusak reputasi salah satu pihak.

Abstract

Kawin tangkap merupakan tradisi adat di Sumba yang keberadaannya masih diakui hingga saat ini, tradisi ini dilakukan dengan cara menangkap perempuan yang ingin dikawinkan dengan syarat yaitu telah memperoleh persetujuan baik dari pihak perempuan maupun dari pihak keluarga perempuan. Akan tetapi, aturan kawin tangkap berubah seiring waktu dimana pihak laki-laki menangkap perempuan yang ingin dijadikan sebagai istri tanpa diketahui oleh pihak perempuan dan keluarganya. Hal ini tentu saja merampas hak asasi perempuan dan tentu telah menjadi pelanggaran bahkan dapat menjadi tindak pidana yang dapat dijerat hukum.

Abstract

Penelitian ini bertujuan untuk mengetahui pertanggungjawaban pidana terhadap keluarga yang meminta untuk dilakukan euthanasia ditinjau dari perspektif KUHP dan untuk mengetahui euthanasia dipandang dalam perspektif hak asasi manusia. Penelitian ini bersifat deskriptif, yaitu menggambarkan hasil penelitian yang berhubungan dengan pertanggungjawaban pidana terhadap keluarga yang meminta untuk dilakukan euthanasia ditinjau dalam perspektif kuhp indonesia dan relevansinya terhadap hak asasi manusia, dengan menggunakan metode yuridis normatif dan data sekunder sebagai data utama. Adapun hasil penelitian ini yaitu pertanggungjawaban pidana terhadap keluarga yang meminta untuk dilakukan euthanasia dapat dikenakan Pasal 345 KUHP Indonesia dengan pidana penjara maksimal empat tahun. Pasal ini dianggap mendekati dengan euthanasia pasif dengan hukum pidana penjara maksimal 4 (empat) tahun. Kemudian eutanasia dari perspektif hak asasi manusia bertentangan dengan Pasal 28A, Pasal 28G ayat (2), dan Pasal 28I ayat (1). Selanjutnya Pasal 4, Pasal 9 ayat (1), dan Pasal 33 ayat (2) Undang-Undang Nomor 39 Tahun 1999 tentang Hak Asasi Manusia. Jadi, jika dipandang dalam perspektif hak asasi manusia, euthanasia sangat bertentangan dan melanggar Undang-Undang Dasar 1945 dan juga Undang-Undang Nomor 39 Tahun 1999 tentang Hak Asasi Manusia.

Abstract

Indonesia's location makes it vulnerable to border disputes and security threats. Indonesia needs to establish a universal Indonesian national defense system to defend its sovereignty and territorial integrity. One of them is in air defense. In order to identify foreign aircraft entering Indonesian airspace early and to provide security for the Indonesian Archipelagic Sea Lanes (ALKI), the establishment of ADIZ in the country's EEZ is a crucial and required subject. This has the potential to become a long-term prospect that can be maximized to meet Indonesia's air security needs. Even though establishing a new Indonesian ADIZ must still be halted because of the delegation of Natuna FIR under the Indonesia-Singapore FIR agreement 2022, the signing of this treaty has produced a new pattern in Indonesia's air defense strategy. Indonesia's air defense, which is still far from ideal, can actually develop after the signing of the FIR agreement. However, this also requires an evaluation of the long-term plan for air defense in Indonesia so that it can produce national sovereignty.

Abstract

Technology is getting more sophisticated and more and more people are able to access and use the technology, moreover, it is not uncommon for people to abuse the technology. As is the case with the use of social media in cyberspace which is often indecent, for example the distribution of pornographic photos/pictures or even videos. Twitter, Facebook, Instagram and so on are often misused, even though the Government has stipulated rules regarding strict sanctions for perpetrators of distribution and other matters related to pornographic elements. For this reason, the author in this case examines the process of investigating cyberporn perpetrators through the Instagram application and how effective the investigation process is and the result is that the investigation process is carried out in accordance with Article 6 of the Criminal Procedure Code and is carried out on the basis of prior reports, while the level of effectiveness is influenced by three factors namely structure, substance, and legal culture. This research was conducted using normative methods obtained from secondary data sources and laws and regulations.

Abstract

Waste management is something that is important and needs attention. The 1945 Constitution has guaranteed the basic rights of citizens to the environment as stipulated in Article 28H paragraph (1) of the 1945 Constitution which reads "Everyone has the right to live in physical and spiritual prosperity, to have a place to live, and to have a good and healthy environment and entitled to health services”. The Batam City Government has established Batam City Regional Regulation Number 11 of 2013 concerning Waste Management as the implementing regulation of Law no. 18 of 2008 in the city of Batam. However, in reality in the field, the management and handling of waste in the city of Batam can still be said to be not optimal. Based on the data, the waste transported to the TPA (direct and indirect is 57.36% or 1,523.20 m³/day, the waste is managed independently by the community is 0.033% or 0.95 m³/day, the 3R Processed waste (TPS3R/ TPST/Waste Bank) of 0.52% or 1.45 m³/day, and Unprocessed waste of 42.56% or 1,130.04 m³/day.This research is an empirical juridical study using a sociological approach.Primary data used in this study were field studies in the form of data and interview results with the Batam City Environment Service as well as the results of interviews with some communities around the Batam Kota sub-district, and coupled with data obtained from research questionnaires which were distributed to communities around the Batam sub-district area City using random sampling method.

Abstract

The zakat collection unit is tasked with collecting and distributing zakat funds to mustahiq zakat, but in its distribution in the Musthafawiyah Abituren Family Zakat Collection Unit distributes it to the construction of educational facilities, distribution outside the eight Asnaf is guided by MUI Fatwa No. 14 of 2011 concerning the Distribution of zakat assets in the form of managed assets. Zakat can only function when the collected zakat funds reach mustahiq, in the existing literacy mustahiq zakat consists of eight asnaf, all of which are understood by the majority of people, but in practice there are some zakat collectors who distribute the benefits of zakat to schools. Therefore, it is necessary to know what is the law of distributing zakat funds for the construction of school facilities. This research uses qualitative research with empirical juridical research type in which this research was conducted at the Musthafawiyah Abituren Family Zakat Collection Unit. From this research it is found that scholars have different views on the issue of distributing zakat to other than the eight asnaf, Wahbah Az-Zuhaili and the Jumhur scholars in the madhhabs agree that it is not permissible to distribute zakat to other than the asnaf determined by Sharia.

Abstract

This article aims to find out the perspective of the Compilation of Islamic Law (KHI) regarding gender partnerships in the concept of family resilience, and how it is implemented in Karo Muslim families in STM Hilir District. This research is empirical juridical research using a legal science and legal sociology approach (legal sociology approach), using primary and secondary data sources. Primary data sources were obtained from interviews with a number of informants who are members of the Karo Muslim community in STM Hilir District, while secondary data sources were obtained from primary legal materials such as Law No. 1 of 1974 concerning marriage, the Compilation of Islamic Law (KHI), and the book of fiqh. The data analysis method used is a qualitative method. The research results show that. Gender partnership is one of the variables in the concept of family resilience which has four indicators, namely aspects of togetherness in the family, husband-wife partnership, openness in financial management, and family decision making. From the perspective of the Compilation of Islamic Law (KHI), although the article does not specifically regulate gender partnerships, the indicators can be found in several articles in the KHI which support the realization of gender partnerships in family life. In its implementation, from 10 informants from the Karo Muslim community in STM Hilir District, it was discovered that indicators of openness in family financial management were implemented well, where husband and wife were directly involved in managing family finances together and transparently. Meanwhile, explaining other indicators still needs to be improved so that the values ​​of gender partnership as regulated in the KHI can be implemented well in Karo Muslim families, STM Hilir District.
