Abstract

To administrative effort in the form of an objection, a maximum time of 21 working days is given. However, there are differences in the application of these administrative efforts between judex facti judges and judex juris judges. Judex facti judges through decisions number 21/G/2020/PTUN and 76/B/2021/PT.TUN JKT implementing administrative measures are mandatory, this decision was upheld by judges at the State Administrative High Court. However, the decision was annulled by the judge judex juris (Supreme Court level) through decision number 420 K/TUN/2021. The basis for the judex juris to cancel the judex facti decision is based on the phrase "can" as stated in Article 75 paragraph (1) of Law Number 30 of 2014 concerning Government Administration. So that administrative efforts through objections or administrative appeals are an option, not mandatory. Administrative efforts are efforts to realize the principles of Pancasila into the settlement of administrative problems, namely in the resolution of administrative problems so that they are first resolved through deliberation and consensus. If consensus deliberation cannot find a point of peace, it can be resolved through the State Administrative Court

Abstract

The implementation of parking at Samarinda City Mall is carried out using the parking model and parking space leases, with variations in standard clauses. Potential disputes between the parties in this legal relationship can occur due to damage or loss caused by the actions of third parties, which have an impact on consumer losses. Variations in the implementation of parking have an impact on legal uncertainty which results in non-optimal legal protection for consumers of parking services. The research method used is empirical juridical supported by factual data obtained from research at the Samarinda City Mall. The results of the study show that the management and arrangement of parking at the Samarinda Mall is constructed as a parking agreement, the manager is responsible for damage and loss of vehicles using parking services. The standard clause on parking tickets is an exoneration clause, while the standard clause on parking space leases is not an exoneration clause. Even though BPSK Kota Samarinda has supervisory authority for standard clauses, its implementation is less effective. Supervision can be carried out by the permit giver for effective guidance and administrative sanctions. The implementation of parking space leases at the Samarinda Mall must be disciplined, because it is an avoidance of the responsibility of business actors, as an effort to optimize consumer protection.

Abstract

The element of "obstructing or interfering with mining business activities" is the focus of this article, because the editorial has multiple interpretations. Its existence derives two problem formulations, namely (1) What are the problems with elements hindering or interfering with mining business activities?: (2) What is the reformulation that reflects democratic principles? The analytical knife used to examine existing problems through democratic principles. This study uses normative juridical research methods. There are several conclusions related to the problematic presence of elements hindering or interfering with mining business activities, including: first, elements hindering or interfering with mining activities can be directed to actions that can be interpreted differently. Second, these elements can be directed to certain interests. Third, these elements can be subjective. Fourth, it is counterproductive to provisions for environmental fighters who cannot be sued criminally or civilly. The reformulations that are expected to better reflect democratic principles include: first, providing a more detailed explanation regarding the redaction of elements hindering or disrupting mining activities. Second, changing the editorial elements hinders or disrupts mining business activities. Third, remove the redaction elements that hinder or interfere with this mining business activity.

Abstract

Indonesia telah digugat oleh Uni Eropa berkaitan dengan adanya pelarangan ekspor bijih nikel mulai 1 Januari 2020. Pelarangan ekspor itu dilakukan karena Indonesia akan melakukan hilirisasi nikel, dengan tidak mengekspor bijih nikel sebagai bahan mentah, namun menggolahnya menjadi baterai mobil listrik. Uni Eropa merasa dirugikan oleh kebijakan tersebut. Indonesia telah kalah pada tahapan pemeriksaan panel dan mengajukan banding ke Appellate Body WTO. WTO adalah organisasi perdagangan dunia yang sebenarnya dibuat untuk memuluskan kepentingan negara-negara maju, namun negara-negara berkembang anggota WTO juga melakukan berbagai upaya agar sistem WTO juga memberikan keadilan bagi negara berkembang sehingga terjadi tarik ulur antara negara maju dan negara berkembang di dalam WTO. Kasus Indonesia melawan Uni Eropa dalam sengketa pelarangan ekspor nikel adalah contoh konflik kepentingan antara negara maju melawan negara berkembang di dalam WTO. Menurut peraturan WTO jika hasil banding sudah diadopsi oleh Panel, maka harus ditaati, artinya apabila Indonesia kalah, maka Indonesia harus mengizinkan kembali ekspor bijih nikel sebagai bahan mentah. Masih terdapat peluang bagi Indonesia untuk memenangkan sengketa ini, namun untuk menghindari kekalahan, Indonesia dapat memilih cara lain yang ada di dalam mekanisme penyelesaian sengketa WTO. Cara-cara tersebut adalah Mutually agreed solutions, Good Offices, Conciliation, Mediation, serta Arbitration sesuai Pasal 25.1 DSU.

Abstract

click-wrap agreement is a form of agreement with a number of terms and conditions that include an agreement clause at the end of which there is a blank box with the sentence I Agree or I agree. The purpose of this study is to examine the validity and legal force of click-wrap agreements as electronic standard contracts. The approach method in this study is a normative juridical approach with the research specifications used namely descriptive-analytical with data collection techniques through legal materials in the form of secondary data, namely laws and regulations and literature. The data obtained was then processed and analyzed using qualitative methods. The results of the study show that currently there are several forms of electronic contracts, one of which is the click-wrap agreement. In a commercial transaction, before offering its product by displaying the terms and conditions, consumers are expected to read further beforehand. Then the consumer agrees to these terms and conditions by clicking on the box contained in the sentence "I Agree" or I agree. The validity of the click-wrap agreement basically refers to the Civil Code and UUPK regarding the transfer or limitation of responsibility.

Abstract

This paper examines regulations concerning climate change mitigation and adaptation efforts in the agricultural sector. A doctrinal method is applied to unpack the authority of the central and regional governments in realizing sustainable agriculture at the urban level, especially in the city of Blitar, where agriculture has been negatively affected due to the changes in weather. This research found that Indonesia already has Law Number 22 of 2019 concerning the Sustainable Agricultural Cultivation System, which contains 35 provisions mandating further regulations at the regional levels. Nevertheless, not all regions, including the Blitar City, have carried out this mandate.

Abstract

The national land law does not stipulate that the company's usufructuary rights can be cultivated on management rights land and customary law community land becomes management rights. This study aims to identify and analyze the process of ulayat land concession agreements by companies and the status of ulayat lands if the agreement between the company and customary law communities related to ulayat land concessions has ended and uses a normative juridical method, namely the data source used is secondary data, obtained from official documents, books and written reports. The results begin with a land use agreement, the status of communal land changes after the agreement expires with management rights to which the company's usufructuary rights apply for customary law communities.

Abstract

This paper takes issue with the regulation of the central government's financial balancing funds to regional governments in the context of regional autonomy which was just passed under Law 1/2022. The research method used is normative legal research, a method with the aim of dissecting all laws and regulations to find solutions to juridical problems. The results of the research show that Law 1/2022 has provided guidelines for local governments in managing regional finances. This regulation provides a basis for the Central Government to transfer funds to Regional Governments in the form of General Allocation Funds (DAU), Special Allocation Funds (DAK), Special Autonomy Funds, Privileges Funds, and Village Funds. There are still problems with the synergy of laws and regulations, especially with regard to the rigid percentages for calculating transfers of these funds to each regional government with special autonomy. However, on the other hand, the use of special autonomy funds and privilege funds is measurable because the management of these funds must refer to the national development plan and have performance targets. Keywords: State Finance, Fiscal Decentralization, Financial Relations Act Ringkasan Tulisan ini mengambil permasalahan tentang pengaturan dana perimbangan keuangan pemerintah pusat kepada pemerintah daerah dalam rangka otonomi daerah yang baru saja disahkan berdasarkan UU 1/2022. Metode penelitian yang digunakan yaitu penelitian hukum normatif suatu metode dengan tujuan membedah segala peraturan perundang-undang untuk menemukan solusi atas persoalan yuridis. Hasil penelitian menunjukan UU 1/2022 telah memberikan pedoman bagi pemerintah daerah dalam melakukan pengelolaan keuangan daerah. Peraturan ini memberikan dasar bagi Pemerintah Pusat untuk melakukan transfer dana kepada Pemerintah Daerah berupa Dana Alokasi Umum (DAU), Dana Alokasi Khusus (DAK), Dana Otonomi Khusus, Dana Keistimewaan, dan Dana Desa. Masih terdapat permasalahan sinergis peraturan perundang-undangan khususnya berkaitan dengan presentase rigid penghitungan transfer dana tersebut ke tiap pemerintahan daerah dengan otonomi khusus. Namun disisi lain penggunanaan dana otonomi khusus dan dana keistimewaan menjadi terukur oleh sebab pengelolaan dana-dana tersebut wajib mengacu pada rencana pembangunan nasional dan memiliki target kinerja. Abstract

The author uses a type of qualitative research with an empirical juridical approach that refers to field data as primary data and literature as secondary data. The results of the study, Parijoto syrup sold by CV. Alammu has met food standards (labeling) according to the provisions of Article 97 paragraph (3) of Law no. 18 of 2012 concerning food. In addition, it is also correlated with Law no. 8 of 1999 concerning Consumer Protection so that the products analyzed can provide consumer rights through the obligations of business actors. If the business actor violates the provisions that have been applied in Law no. 8 of 1999, administrative or criminal sanctions may be imposed.s. Keywords: Consumer Protection; Parijoto; Labeling Ringkasan Penulis menggunakan jenis penelitian kualitatif dengan pendekatan yuridis empiris yang mengacu pada data lapangan sebagai data primer dan literatur sebagai data sekunder. Hasil penelitian, sirup parijoto yang dijual CV. Alammu telah memenuhi standar pangan (labeling) sesuai ketentuan Pasal 97 ayat (3) UU No. 18 Tahun 2012 tentang pangan. Selain itu, juga berkorelasi dengan UU No. 8 Tahun 1999 tentang Perlindungan Konsumen agar produk yang dianalisis dapat memberikan hak konsumen melalui kewajiban pelaku usaha. Abstract

In carrying out the task of completing community reports, the Ombudsman of the Republic of Indonesia is not only known for providing recommendations but also the Ombudsman of the Republic of Indonesia has the final product of completing the report, namely the Final Report of the Examination Results. Therefore, this study aims to: explain the legal review of the Final Report of the Examination Results as part of the series of examinations of community reports that have a relationship with providing recommendations if corrective actions in the Final Report of the Examination Results are not implemented by the Public Service Provider in the findings of mal-administration. The method used in this study is the normative juridical method. The results showed that the Final Report of the Examination Results is a whole series of processes for receiving and verifying reports with formal and material requirements which will then be followed up in the examination process, the product of the Ombudsman's supervision service is the Final Report of the Examination Results. So the Ombudsman of the Republic of Indonesia does not just provide recommendations, because of the position of the Ombudsman of the Republic of Indonesia as a state institution that exerts influence in a persuasive approach in handling community reports related to mal-administration. One of the main concerns of this study is that the Final Report on the Results of the Examination has not been included in the Ombudsman Law of the Republic of Indonesia so that hierarchically the power of the Ombudsman of the Republic of Indonesia is in the recommendations. However, the existence of the Final Report of the Examination Results as an effort by the Ombudsman of the Republic of Indonesia to encourage the improvement and improvement of public services at the encouragement of independent public service providers
