Abstract

This study aims to analyze the normative responsibilities of the West Bangka Regency Government in fulfilling the health and safety rights of traditional fishermen. As a maritime entity, the fishing profession in this region carries high risks that are often overlooked due to regulatory complexity and economic interests. The research method used is a normative method with a legislative approach and the theory of state responsibility. The results of the discussion indicate that despite the mandate through Law No. 7 of 2016 and the free BPJS program, there are still regulatory gaps related to Occupational Safety and Health standards and protection for informal workers. Implementation in the field is still hampered by limited maritime medical infrastructure at coastal health centers and a lack of supervision of safety standards on traditional vessels. In conclusion, the West Bangka Regency Government needs to immediately codify the protection of fishermen into an inclusive Regional Regulation, strengthen the community-based social security system, and increase maritime medical capacity to guarantee the constitutional rights of fishermen in a sustainable manner.

Abstract

Ringkasan Aktivitas pertambangan tidak bisa dipisahkan dengan kelestarian lingkungan hidup. Di Indonesia, sektor pertambangan harus mendapat perhatian penuh, dikarenakan dampak kerusakannya. Kegiatan ekstraktif ini tidak hanya mengakibatkan rusaknya hutan, hadirnya banjir dan longsor, tercemarnya air, terjadinya konflik dengan masyarakat sekitar, tetapi juga menghilangkan nyawa akibat lubang tambang yang tidak direklamasi. Menggunakan pendekatan Analisis Wacana Kritis (AWK) Norman Fairclough, penelitian ini menganalisis berita kerusakan lingkungan akibat pertambangan di Mongabay Indonesia periode Januari hingga Desember 2024. Dalam penelitian diketahui bahwa banjir dan longsor merupakan bencana yang paling sering dijelaskan sebagai dampak buruk pertambangan. Sementara, pelanggaran aturan pertambangan yang dilakukan perusahaan, tidak hanya mengakibatkan terjadinya kerusakan lingkungan tetapi juga membuat warga yang berada di sekitar area pertambangan paling menderita. Keterkaitan antara kerusakan lingkungan dan tata ruang menunjukkan terjadinya bencana ekologis, terlihat dari  lemahnya pengawasan kegiatan pertambangan. Undang-undang Republik Indonesia Nomor 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup harus ditaati dan dijalankan agar pengelolaan lingkungan hidup Indonesia berjalan baik, dikarenakan lingkungan hidup yang baik dan sehat merupakan hak setiap warga negara Indonesia. Kata kunci: lingkungan hidup, pertambangan, analisis wacana kritis, mongabay indonesia, undang-undang perlindungan dan pengelolaan lingkungan hidup.

Abstract

Penelitian ini mengkaji disharmoni dalam perumusan sanksi pidana terhadap praktik Illegal, Unreported, and Unregulated (IUU) Fishing dalam hukum perikanan Indonesia dari perspektif Sustainable Development Goal (SDG) Target 14.4. Penelitian ini menggunakan metode penelitian hukum normatif dengan orientasi empiris melalui analisis terhadap peraturan perundang-undangan, dokumen kebijakan, dan doktrin hukum. Hasil penelitian menunjukkan bahwa sanksi pidana yang berlaku masih didominasi pendekatan pemidanaan konvensional, belum mengintegrasikan mekanisme pemulihan ekologi, lemah dalam pengaturan pertanggungjawaban pidana korporasi, serta tidak terintegrasi secara memadai dengan rezim hukum lingkungan. Akibatnya, hukum pidana perikanan belum berfungsi sebagai instrumen tata kelola ekologi yang efektif.

Abstract

The rapid development of information and communication technology has led to an increased use of electronic systems for managing personal data across various sectors, both public and private. Alongside this progress, the risk of personal data breaches has also risen, potentially causing material and immaterial losses and threatening individuals’ privacy rights. This study aims to analyze the regulation of criminal liability for personal data breaches by electronic system providers and to examine the application of such liability within the framework of Law Number 27 of 2022 concerning Personal Data Protection. This research employs a normative juridical method by analyzing legal norms contained in legislation, legal doctrines, and relevant scientific literature related to personal data protection and criminal law. The results indicate that the Personal Data Protection Law provides a comprehensive legal framework governing the rights of data subjects, the obligations of data controllers, and criminal sanctions for unlawful acts such as obtaining, disclosing, or using personal data without authorization. Criminal liability may arise if the elements of unlawful conduct and fault whether intentional or negligent are established. Furthermore, criminal liability for personal data breaches can be imposed on both individuals and corporations. Individual liability applies to parties who directly commit unlawful acts, while corporate liability may arise when breaches occur due to weak internal policies, inadequate security systems, or negligence in the management of personal data. However, the enforcement of criminal liability still faces several challenges, including difficulties in proving fault and causation, technological complexity, limited law enforcement capacity in digital forensics, jurisdictional issues in cross-border cases, and the lack of standardized technical security measures. In conclusion, although the legal framework governing criminal liability for personal data protection in Indonesia is relatively adequate, its effectiveness depends on stronger implementation, clearer technical regulations, and improved compliance among electronic system providers.

Abstract

This study analyses local government institutions and regulatory frameworks in mainstreaming family media literacy in Indonesia. Digital transformation poses challenges for families, including exposure to misinformation, harmful content, and weak information verification skills. Local governments are in a strategic position through their authority over education, public communication, child protection, and community literacy. However, the results of the study show that there is no clear institutional structure and no regional regulations that explicitly regulate family media literacy. This study uses a normative-juridical method through a statute and conceptual approach to map legal gaps, overlapping authorities, and inconsistencies between national and regional regulations. The main findings indicate institutional fragmentation, institutional void, and obscurity of norms as obstacles to the implementation of family media literacy. A comparison with international standards (UNESCO MIL, UK Online Media Literacy Strategy, and Japan's Family ICT Framework) shows that Indonesia lags behind in providing a local regulatory architecture. This study offers an ideal regulatory model based on four pillars: regulation, inter-agency coordination, programme standardisation, and family-based indicator evaluation. The results of this study contribute theoretically to strengthening the study of local government law and practically to the drafting of a Regional Regulation on Family Media Literacy.
