Abstract

The international community has come to an agreement on the importance of gender issues to solve such problems as the gender inequality, the gap between men and women. Gender issues have become a part of the national direction and strategy in carrying out national development. Therefore, addressing these issues has to be integrated in various national policies. The central government has granted authorities to each region in Indonesia to make gender-responsive regional policies, hoping that the concept of justice and gender equality in Indonesia be realized properly. This study uses a normative legal method by examining secondary data normatively such as laws and regulations, research papers on policy gender-responsive regional development. This article was originally a research focusing on the Government of Banyumas Regency in creating a gender-responsive regional policy. Through Banyumas Regent Regulation Number 35 of 2018 concerning Guidelines for Implementation of Gender Mainstreaming, the Banyumas Regency Government has supported gender responsive regional policies.

Abstract

The organizational structure of the MPR based on the amendments to the 1945 Constitution consists of members of the DPR and members of the DPD. Membership of the MPR is similar to the membership of Congress in the United States, which consists of the House of Representatives (lower house) and the Senate (high house). The authority of the MPR after the amendment of Article 3 of the Constitution of the MPR is no longer the highest state institution, but is a state institution whose position is equal to other state institutions. The purpose of this paper is to examine the changes in the organizational structure and authority of the People's Consultative Assembly after the amendment to the 1945 Constitution and what are the implications for changes in the organizational structure and authority of the MPR after the amendment. This research uses a statue approach. Data sourced from primary and secondary legal materials were analyzed using qualitative normative analysis methods. The results of the study found that after the amendment to the 1945 Constitution, the concept of the MPR as the holder of people's sovereignty was abolished. The MPR no longer holds the highest power in the state administration system in Indonesia. The implications of changes after the amendment to the Constitution, the role of the MPR is only limited to carrying out the task of socializing the results of the amendments to the 1945 Constitution and inaugurating the President and Vice President.Keywords:  Organizational structure, Authority, MPR

Abstract

Isu krusial yang melatar belakangi dilakukannya penelitian ini adalah adanyaDosen Unsoed dan sejumlah Mahasiswa yang terprofokasi oleh fahamradikalisme dan akhirnya bergabung dengan gerakan ISIS dan jaringan NII.Tujuan khusus dalam penelitian ini adalah: Kesatu menemukan pola-polapenyebaran paham radikalisme di kalangan mahasiswa dan civitas akademikasehingga dapat diantisipasi dan dilakukan pencegahan.Kedua merumuskanstrategi pencegahan dan penanggulangan timbulnya faham radikalismedikalangan mahasiswa dan civitas akademika. Ketiga merumuskan peranstrategis perguruan tinggi dalam upaya pencegahan dan penanggulanganpaham radikalisme di kalangan mahasiswa dan civitas akademika. Adapuntujuan jangka panjangnya adalahterbentuknya nuansa dan iklim AkademikKampus di Kabupaten Banyumasyang sejuk, demokratis, dapat menghargaikeberagaman, pluralitas, dan tumbuhnya sikap toleransi sesuai dengansemboyan Bhinneka Tunggal Ika. Metode Penelitian yang digunakan adalahpenelitian kualitatif, dengan spesifikasi penelitian deskriptif dan analisissecara Content Analysis Method.

Abstract

The Covid-19 pandemic has had a broad impact on people worldwide, including Pasir Kidul Village, Purwokerto District, Banyumas. Community Service is conducted in two main activities: social service and community education. Social service activities are implemented by providing essential food subsidies to insufficient people affected by Covid-19, distributing masks, and spraying disinfectant liquid in the mosque area, public space, and the homes of residents of Pasir Kidul Village. Community education activities were held in four sessions with the following materials: Islamic understanding of Covid-19; Understanding of praying law in congregation during the Covid-19 pandemic; Understanding of health protocols related to the implementation of worship during the Covid-19 pandemic; and Materials regarding the burial of Covid-19 corpses. The activity results show that residents feel supported and have a good understanding of the practice of worship during the pandemic. Community service is a solution to real problems in the community who want to carry out various activities and worship activities without worrying about contracting the coronavirus.

Abstract

AbstractDuring the COVID-19 pandemic in almost all countries of the world, human activities were physically completely paralyzed and replaced by new ways through the help of technology and digitalization. Starting from work, school, and other communication needs to be carried out online, the delivery of opinions and aspirations related to the government is also carried out through online methods. Through the digital world, especially on social media platforms, discussions about a policy or new hope for government can be carried out by anyone and at any time, of course, this is an ease in realizing democracy. But unfortunately, behind this convenience, there are several problems that arise due to too easy communication through the digital world. These problems include the misuse of social media as an opinion-raising tool for certain parties, widespread fake news with invalid sources, rampant use of inappropriate language in digital communication, and other forms of unlimited freedom that no one can contain when communicating digitally. The inadequacy of internet users creates a lack of ethics in the use of communication technology. Through this article, the author will examine the phenomenon of digital democracy in terms of morality. The research was conducted using the literature review method, and it is expected that the results of this research will have an impact on internet users, especially for policy making.Keywords:  digitalization, democracy, morality

Abstract

Penerapan Asas Freies Ermessen Dalam Pengambilan Kebijakan Oleh Administrasi Negara Berdasarkan Hukum Administrasi Negara  Merupakan  suatu kebebasan yang diberikan kepada tata usaha negara dalam melakukan penyelenggaraan pemerintahan. Sehingga Freies Ermessen merupakan kemerdekaan bertindak atas inisiatif dan kebijakan sendiri dari administrasi negara. Keberadaanya  yang lain karena adanya suatu peningkatan akan  tuntutan pelayanan publik yang harus di berikan tata usaha negara terhadap kehidupan sosial ekonomi pada warga memiliki keberagaman, dan untuk menyelesaikan persoalan-persoalan yang mendesak yang belum ada aturannya  dan harus dapat dipertanggungjawabkan secara hukum dan moral.

Abstract

Penetapan pandemi Covid-19 oleh WHO membuat Indonesia menetapkan keadaan ini sebagai keadaan darurat melalui Keppres No.11 Tahun 2020 tentang Penetapan Kedaruratan Kesehatan Masyarakat Covid-19. Penetapan tersebut mengharuskan dilakukannya Pembatasan Sosial Berskala Besar (PSBB) yang kemudian digantikan dengan Pemberlakuan Pembatasan Kegiatan Masyarakat (PPKM). PPKM saat penelitian ini dilakukan ditetapkan melalui Instruksi Mendagri No.39 Tahun 2021 yang selain mengatur PPKM, juga mengatur kewajiban menggunakan aplikasi PeduliLindungi sebagai syarat masuk fasilitas umum bagi masyarakat. Pada sisi lainnya, data Badan Pusat Statistik (BPS) tahun 2020 menggambarkan jika sepertiga masyarakat Indonesia tidak memiliki ponsel dan terancam tidak dapat menggunakan PeduliLindungi. Kebijakan PeduliLindungi sebagai syarat masuk fasilitas umum tersebut menjadi inspirasi dimana dalam penelitian ini hendak dicari tahu implikasi kebijakan PeduliLindungi terhadap HAM, khususnya mengenai hak masyarakat non pemilik ponsel untuk bebas bergerak dan tidak mendapat diskriminasi. Metode yang digunakan dalam penelitian yuridis normatif ini adalah metode kualitatif dengan pendekatan perundang-undangan. Dari penelitian ini diperoleh kesimpulan jika kewajiban menggunakan PeduliLindungi berpotensi melanggar hak bebas dan dapat menyebabkan diskriminasi terkhusus kepada warga yang tidak memiliki ponsel.Kata Kunci: Covid-19, PPKM, PeduliLindungi, Hak Asasi Manusia

Abstract

Village Council (BPD) plays an important role in the formation of village regulation (Perdes). Strengthening the role of BPD in legislation is an effort to improve the quality of village regulation products. This is outlined in Article 61 Village Law, BPD is an institution that embodies democracy in the administration of village governance that functions to accommodate and channel community aspirations, carry out the task of supervising the performance of the Village Head, and together with the Village Head, discuss and agree on the draft village regulation in Dawuhan Kulon Village during 2020-2023 was 24 Perdes’s. One person was purely an initiative for BPD. This research shows that the Dawuhan Kulon BPD, in its role in the initiative to create village regulations, has not been optimal, as seen from the number of Perdes produced. BPD's position in carrying out aspirations is carried out through community activities. BPD places itself as an extension of the village community. Activities are carried out to socialize information on village development, accommodate community aspirations for village regulations, and agree with the Village Head. Recommendations from this research are formulated such that the community is aware that village regulation is a legal product for the benefit of the community; therefore, the community also needs to be involved. The BPD should socialize with its citizens through Rukun Tetangga meetings if there will be discussions and the creation of Perdes.

Abstract

Research has been conducted on community interactions that can produce tolerance to create harmony in diversity in Banyumas Regency. The specific objectives of this study are: first to find patterns of interaction that occur in the heterogeneous Banyumas community. The second objective is to explore the concept of community views on diversity. Third, it reveals the involvement of organizations and or communities that intersect with issues of tolerance in creating a conducive religious atmosphere in Banyumas Regency. This research was conducted by gathering information and analyzing the harmony of the community in Banyumas Regency. This research is qualitative and analytic descriptive. This method is carried out to solve actual problems by collecting data, compiling or classifying, analyzing and interpreting it using multicultural education theory and then drawing conclusions. This research focuses on the embodiment of the harmony pattern of Banyumas community diversity through FKUB, SMLI and FORSA. These three organizations have a real contribution in the formation of a harmony society in diversity in Banyumas Regency. The results of this study show that the harmony of religions in Banyumas regency has been successfully carried out because there is no mutual suspicion of interfaith leaders and have the same understanding of "never being different in harmony" which forms the basis of religious and social life. In addition, the community togetherness is based on the sincerity of the characters causing religious harmony in Banyumas Regency.

Abstract

Such conception of human rights is in line with international human rights law, in particular with adopting a comprehensive women's rights instrument, namely the Convention on the Elimination of All Forms Discrimination Against Women, hereinafter referred to as the CEDAW Convention, which was ratified by the State of Indonesia with Law No. 7 of 1984 on Ratification of the CEDAW Convention. Women, especially in Indonesia are still left behind both in public life and politics. This raises the issue of gender equality, which means a condition of "inequality" experienced by women. The current trend in society is that women tend to participate in the national level such as general elections or participation in the DPR or MPR. Currently, there is yet any law that comprehensively regulates the protection of women's rights. Indonesia still rely on legal instruments regarding gender equality with various conventions such as the CEDAW Convention, the ICESCR Convention, and the ICCPR Convention. Women face discrimination, not only in the domestic sector but also in the public sector. Therefore, it is important to learn and develop the multifunctional dynamic character of women. This development has appeared in various Constitutional Court's decisions on judicial review of laws.Keywords: genderequality;judicial reviews;general election
