Abstract

To administrative effort in the form of an objection, a maximum time of 21 working days is given. However, there are differences in the application of these administrative efforts between judex facti judges and judex juris judges. Judex facti judges through decisions number 21/G/2020/PTUN and 76/B/2021/PT.TUN JKT implementing administrative measures are mandatory, this decision was upheld by judges at the State Administrative High Court. However, the decision was annulled by the judge judex juris (Supreme Court level) through decision number 420 K/TUN/2021. The basis for the judex juris to cancel the judex facti decision is based on the phrase "can" as stated in Article 75 paragraph (1) of Law Number 30 of 2014 concerning Government Administration. So that administrative efforts through objections or administrative appeals are an option, not mandatory. Administrative efforts are efforts to realize the principles of Pancasila into the settlement of administrative problems, namely in the resolution of administrative problems so that they are first resolved through deliberation and consensus. If consensus deliberation cannot find a point of peace, it can be resolved through the State Administrative Court

Abstract

Ringkasan Artikel ini bertujuan untuk menemukan perspektif hukum administrasi negara terkait penetapan Matarumah Parentah di Negeri Rumahtiga Kota Ambon. Seperti diketahui Saniri Negeri Rumahtiga sampai saat ini belum melanjutkan proses pembentukan Peraturan Negeri dalam rangka Penetapan Matarumah Parentah, padahal tahapan penetapan sudah dilalui sesuai dengan aturan yang berlaku. Melalui penelitian yuridis normatif didapatkan hasil bahwa sikap Saniri Negeri Rumahtiga merupakan tindakan administrasi pemerintah yang dapat diuji keabsahannya dan dapat dikategorikan sebagai sikap diam Pemerintah serta sebagai tindakan pemerintah berupa keputusan yang mencakup tindakan faktual sebagaimana dimaksud dalam Undang-Undang Administrasi Pemerintahan. Kata Kunci: Penetapan, Matarumah Parentah, Hukum Administrasi Negara.

Abstract

Law Number 23 of 2004 concerning the Elimination of Domestic Violence and the 2001 Uud Danum Dayak Customary Law Book have provided protection for wives who are victims of domestic violence by their husbands. The protection provided by Law Number 23 of 2004 concerning the Elimination of Domestic Violence is provided from the time the victim makes a police report, when he is questioned and arrives at a court decision. Legal protection provided by Tomakung to wives who are victims of violence (hotuhui) by husbands by paying fines and implementing siro sahkik to restore conditions damaged by violence (hotuhui) between husband and wife. Factors that cause domestic violence by husbands are caused by internal and external factors. Internal factors are caused by wives who cheat, wasteful with money, lazy to cook. Internal factors in husbands are due to being lazy to work, not having a job, having an affair, gambling and being an alcoholic drink addict. The government should provide jobs for all levels of education that are evenly distributed from villages to cities. The government should, in helping the poor, not provide social assistance in the form of direct cash assistance because a small nominal amount of money is only enough to buy alcohol and play gambling. The increase in domestic violence is not solely the fault of the citizens but due to a lack of community awareness raising by the central and regional governments that is right on target because today the Government is building more infrastructure than building the mental and spiritual Indonesian people themselves.

Abstract

Stages of administrative dispute resolution as regulated in Law No. 30 of 2014 concerning Government Administration, article 58 paragraph (6) bring about changes in the state administrative justice system in Indonesia, which are related to administrative efforts. This study aims to analyze administrative efforts that should be in line with what is stated in Supreme Court Regulation No. 6 of 2018 which discusses guidelines for resolving government administrative disputes after taking administrative measures with Law No. 51 of 2009 Second Amendment to Law no. 5 of 1986. In practice, there are several problems related between object of dispute and administrative efforts, first: whether administrative measures must be taken first before filing a claim for a state administrative dispute to the State Administrative Court, second, whether there are legal consequences if no administrative efforts are carried out by the plaintiff, third, whether If a difference is made in the deadline for filing a lawsuit, administrative efforts can increase the effectiveness of the ongoing legal process. Systematically this research uses a normative juridical approach. This research will obtain formulations of norms that can provide effective legal protection for the parties concerned in matters of state administrative disputes and analyze the effectiveness of applying different time limits in administrative efforts.

Abstract

The element of "obstructing or interfering with mining business activities" is the focus of this article, because the editorial has multiple interpretations. Its existence derives two problem formulations, namely (1) What are the problems with elements hindering or interfering with mining business activities?: (2) What is the reformulation that reflects democratic principles? The analytical knife used to examine existing problems through democratic principles. This study uses normative juridical research methods. There are several conclusions related to the problematic presence of elements hindering or interfering with mining business activities, including: first, elements hindering or interfering with mining activities can be directed to actions that can be interpreted differently. Second, these elements can be directed to certain interests. Third, these elements can be subjective. Fourth, it is counterproductive to provisions for environmental fighters who cannot be sued criminally or civilly. The reformulations that are expected to better reflect democratic principles include: first, providing a more detailed explanation regarding the redaction of elements hindering or disrupting mining activities. Second, changing the editorial elements hinders or disrupts mining business activities. Third, remove the redaction elements that hinder or interfere with this mining business activity.

Abstract

The stagnation of discussions to accommodate independent presidential and vice-presidential candidates may be because an appropriate pattern of implementation has not been found. Therefore, it is important to learn from best practices in other countries. From this comparison, it is hoped that this will be the basis for the idea of implementing it in Indonesia. To discuss this, this paper uses a combination of statute approach, conceptual approach, and comparative approach. The results show, first, that the United States and Egypt are more flexible in managing the nominations for President and Vice President by implementing a multi-track system. Second, there are two implementation models that can be adopted, namely public support and nominations by state institutions. In the Indonesian context, both can be applied with some adjustments because in principle they have been practiced.

Abstract

This research is addressed to theoretically examine authority and position of deputy head of region in local government system in the post-reform time, in particular by using Philipus M Hadjon's authoritative theory as an analytical tool. We apply normative juridical approach through analysis of theory, concepts, legal principles as well as law and regulation which have correlation with this research. Our result shows that the authority of the deputy head can be achieved in three different ways: first, direct or explicit power governed by the law, second and third through delegation and mandate from higher authority (e.g. regional head), respectively. Interestingly, we notice that most of the tasks are unfortunately mostly in assisting mode, while we argue that this can be also carried out by local secretary. This power overlapping could actually create ambiguity and further have implication in the urgency of deputy head position in the regional government system.

Abstract

The status of fish evidence resulting from the crime of illegal fishing in the last three years At the Tanjungpinang District Court, it was destroyed during the investigation stage. The purpose of this research is to find out the obstacles and legal settlement of fish resulting from the criminal act of Illegal Fishing in a review of the principle of benefit. The research method to be carried out is empirical juridical research. Juridical settlement of fish resulting from the criminal act of Illegal Fishing in the review of the principle of benefit at the Tanjungpinang Fisheries Court can actually be carried out through auctions and grants. Barriers to the use of fish resulting from the criminal act of Illegal Fishing at the Tanjungpinang Fisheries Court, namely the caught fish are mostly rotten before the legal case is completed or a court order is issued, The next problem is if the fish are auctioned, most of the fish are not sold, Another obstacle PSDKP Batam does not have a place frozen freezer storage for the fish. Another way to store the caught fish is to rent a place to the private sector, but the price associated with the rental will be of high value and will be detrimental to the State.

Abstract

Abstract Justice collaborators are very much needed by law enforcement in uncovering certain criminal acts. The fact is that in the formulation of the justice collaborator arrangement in the law, especially the problem of determining the main actor, there are still many juridical problems that have an impact on its application and implementation. This research is classified into normative legal research (normative juridical), using primary legal materials and secondary legal materials. The approach used is a statutory approach to review all relevant rules and regulations. In this study, we will discuss the problem of legal arrangements related to the provisions for determining the provision of a justice collaborator for a particular crime, and the juridical problem of determining the main actor in the provision of a justice collaborator for a particular crime. The findings in this study indicate that there is no juridical definition of the main actors who cause legal problems at the level of norms and practice. The next finding is the difference in perception and the unclear determination of authority to determine the main actors between law enforcers which results in legal uncertainty. Abstract

In principle, only Indonesian citizens can own land in Indonesia. With the government's program to improve development and the Indonesian economy by promoting investment by bringing in foreign investors, the government issued a policy to regulate property ownership for foreign citizens who wish to own a residence in Indonesia. Property that can be owned by foreign nationals can only be owned with the status of Right to Use and Right to Rent for a certain period of time. The purpose of this limitation of the period of property ownership for foreign nationals is to protect land owned by Indonesian citizens from various exploitation and covert foreign domination. Ownership of property by foreign nationals is regulated in various laws and regulations and their implementing regulations. With the issuance of these various regulations, it is hoped that there will be harmonization between property ownership arrangements for foreign citizens and residential ownership for Indonesian citizens.
