El-Faqih, Jurnal Pemikiran dan Hukum Islam, ISSN, 2503-314X ( Online) and 2443-3950 (Print) is a peer-reviewed journal published by the Faculty of Sharia, IAI Faqih Asyari Kediri. This scholarly periodical specializes in the study of Islamic law and seeks to present the various results of the latest research, both conceptual-doctrinal and empirical, in the field. The editors welcome contributions in the form of articles to be published after undergoing a manuscript selection mechanism, peer-review, and editing process. The journal is published twice a year in April and October. It is now a fully online journal, and it only accepts manuscript submissions written in Indonesia, English, and Arabic.

Abstract

Artikel "Pembaruan Islam dalam Bidang Hukum Keluarga" membahas perubahan aturan hukum keluarga dari era pra Islam hingga era kodifikasi. Sebelum kedatangan Islam, perempuan sering kali tidak diperlakukan secara manusiawi dalam hukum keluarga. Namun, dengan datangnya Islam, terjadi pembaruan yang signifikan dalam perlakuan terhadap perempuan. Islam memberikan hak-hak yang setara antara laki-laki dan perempuan dalam hal perceraian, pewarisan harta, dan pernikahan. Jenis penelitian ini merupakan penelitian kepustakaan atau library research. Penelitian pustaka adalah penelitian yang mengandalkan berbagai literatur untuk mendapatkan data penelitian. Data diperoleh dari berbagai sumber tertulis atau bahan bacaan baik berupa buku, artikel, undang-undang, serta catatan lainnya yang berkaitan dengan permasalahan yang di kaji Penelitian ini menyoroti pentingnya pembaruan hukum Islam dalam menciptakan keadilan dan kesetaraan di dalam masyarakat. Dengan adanya pembaruan ini, perempuan menjadi lebih berdaya dan memiliki kedudukan yang lebih baik dalam masyarakat. Melalui analisis dari era tradisi Arab, era setelah datangnya Islam, dan era kodifikasi, jurnal ini menunjukkan bagaimana Islam membawa perubahan positif dalam kehidupan keluarga untuk menciptakan keluarga yang sakinah, mawaddah, warahmah.

Abstract

This article aims to expose and examine the Ahmadiyah Qadiyani breakaway group in Indonesia through the lenses of sociology and Islamic law. Social contact and religious teachings, which are a rich source of Islamic theological thinking and include Ahmadiyah, are factors in the rise of Islamic sects. The presence of Qadiyani Ahmadiyya in Indonesia has become an interesting subject for sociological and Islamic legal studies. This research aims to analyze this phenomenon using a sociological and Islamic legal approach. Through a literature review, this study reveals the social dynamics that emerged with the existence of Ahmadiyah Qadiyani in Indonesian society, as well as the response of Islamic law to this sect. By considering the historical and social context, this analysis highlights Muslims' various pros and cons towards Ahmadiyah Qadiyani and its impact on relations between believers in Indonesia. This research also explores the implications of Islamic law for treating Ahmadiyah Qadiyani, including fatwas and legal regulations governing their existence. Thus, this study provides in-depth insight into the social and legal complexities associated with such splinter flows in Indonesia.

Abstract

This research aims to find out more deeply about the emergence of Salafi and its legal thinking, analyze how the istinbath method was used and how the views according to the scholars of fiqh 4 madzhab Researchers use descriptive qualitative research methods is a type of research that aims to gain an in-depth understanding of a particular phenomenon or topic. This research uses a library research model with reference sources through journal articles and books that explain the research theme. The results of this study indicate that there are factors that caused Salafi Islamic law to be revived, one of which is Muhammad bin Abdul Wahhab thought that Muslims were misguided in religion and did not return to the Qur'an and As-Sunnah. Still, his thinking was wrong, and also this movement has very radical (hard) thoughts in religion and easily disbelieves someone when they have different thoughts from them. The method of istinbath carried out by Salafis is different from the scholars of the 4 madhhabs, salafis only focus on the Qur'an, sunnah, and the opinions of scholars from their circles, while the scholars of the 4 madhhabs have other istinbath besides the Qur'an and Hadith. The impact of the implementation of Salafi Islamic Law thinking is different from the legal thinking of the 4 madhhabs, namely salafis require a woman from their circle to cover the whole body including the face. In comparison, the scholars of the 4 madhhabs only require covering the whole body except the face and palms.

Abstract

New issues and phenomena that require legal certainty also develop along with the development of the times and the social context. The Qur'an and Sunnah, which only contain legal issues implicitly, require mujtahids to dig up the law with several methods, one of which is maslahah mursalah or istislah. This research tries to explore matters related to istislahi reasoning, starting from the concept, and limitations, to its implementation in the application of Islamic family law in Indonesia. This research uses a descriptive method with a critical review. The research results show that maslahah mursalah is basically based on preserving the purpose of syariah by taking benefits and rejecting harm (mafsadah). The limitations of this maslahah are: it is not merely conjectural so that it must produce benefits and reject harm (mafsadah), it is general, and it does not conflict with the principal rules of syara'. Thus, the application of the istislahi method in the formation of law is very necessary to face new problems and phenomena that require legal certainty.

Abstract

Child abuse is a serious issue with lasting impacts. While positive law provides legal protections for children, its implementation faces challenges. In Islamic tradition, fiqh from the four major schools of thought—Maliki, Shafi'i, Hanbali, and Hanafi—also offers guidelines for child protection. This study explores the integration between positive law and fiqh to enhance child protection. Using a qualitative, library research method, the research examines whether Indonesian legislation aligns with the views of these schools. The findings reveal both alignments and differences. Positive law offers a clear legal framework, while fiqh provides a moral and religious foundation that supports the social and ethical dimensions of child protection. Integrating these perspectives can lead to a more holistic approach, combining legal rigor with religious principles to safeguard children's rights. This collaboration may strengthen child protection strategies by being more adaptive to socio-cultural contexts, offering a comprehensive solution to combat child abuse and ensure children's rights are effectively protected.

Abstract

The growth of information technology has introduced challenges like cyberbullying, especially on platforms like TikTok. The real-time nature of TikTok and insufficient moderation exacerbate the psychological harm caused to victims. In Indonesia, cyberbullying is a criminal offense under Law Number 19 of 2016 (ITE Law) as it violates human rights. From an Islamic perspective, it is seen as a serious sin, contradicting Islamic moral values. The four major Islamic schools of thought—Hanafi, Maliki, Shafi'i, and Hanbali—guide punishing offenders, ranging from fixed (hudud) to discretionary (ta'zir) penalties depending on the severity of the offense. This study uses a doctrinal legal approach and library research to examine cyberbullying on TikTok from the perspectives of both criminal law and Islamic jurisprudence. The findings highlight that integrating the principles of positive law with Islamic jurisprudence could create a more holistic and effective framework for addressing cyberbullying. A combined approach can strengthen anti-cyberbullying policies, fostering a safer digital environment. Additionally, promoting education that emphasizes Islamic values such as respect can help prevent cyberbullying. The study recommends increasing public awareness, integrating Islamic and positive legal principles into policies, and improving law enforcement’s capacity to address cyberbullying more effectively.

Abstract

after the equal marriage age was established through Law No. 16 of 2019. In Islam, there is no specific regulation regarding the age limit for marriage. This research explores Alie Yafie's thoughts on Indonesia's marriage age limit. The study is qualitative, using a library research approach. Primary data comes from Alie Yafie’s book Initiating Social Fiqh, while secondary data is derived from journals discussing marriage age limits and maslahah in Yafie’s thought, along with other supporting literature. Data collection was done through document analysis related to the marriage age limit and the concept of maslahah. The data was analyzed using content analysis. The findings reveal that Indonesia's high rate of child marriage is a significant issue, with marriages below 19 years being prone to divorce due to psychological and economic unpreparedness. Alie Yafie supports the government's decision to set the marriage age limit at 19 years, rooted in the maslahah concept to enhance family welfare.

Abstract

The discourse on the political role of women in Islam is one of the most complex and debated issues in the context of gender equality and religious interpretation. The idea that women have a subordinate position is deeply embedded not only in the minds of men but also in women themselves. This is due to the strong and pervasive patriarchal construction, which emphasizes male superiority and is supported by various institutions such as the state, religion, and culture. This study aims to examine the arguments in the discourse on the political role of women in Islam, trace the roots of marginalization, and efforts to recognize the role of women in politics. This study uses a descriptive qualitative research method with a type of library research, namely reference sources from journal articles, books, and other literature that are relevant to the research theme. The results of the study show that conservative interpretations of religious texts are often used to marginalize the political role of women, associate political leadership with the male realm and emphasize women's domestic roles. This approach is supported by patriarchal cultural and social norms, which have long dominated many Muslim societies.

Abstract

This study aims to further understand how the “marhaban” tradition is carried out in Semurup, Kerinci Regency. The focus is to what extent the “marhaban” tradition meets or may conflict with the principles of maqashid sharia. This study is an empirical study with a descriptive qualitative approach. Through this field research, the author will try to explore primary data sourced from the relevant place, namely in Semurup, Kerinci Regency. Data collection techniques are carried out by interview and observation. The data analysis techniques used include data reduction and classification, data presentation, and conclusion. The results of the study show that the “marhaban” tradition is carried out by completing the Qur'an first, dhikr, and prayers, strengthening family relationships, and maintaining cultural identity by involving community members and there is no waste or unnecessary expenditure in its implementation to maintain balance and justice in the management of the property. Parents also get inner peace because they feel they have started their children's lives with the blessings and protection of Allah.

Abstract

This research aims to find out and understand the validity of transactions without pronunciation, namely bai‘ al-mu‘āṭāh in reviewing the rules of fiqh. The type of research used is descriptive qualitative in the form of library research using a sociological approach to understand Islamic law, especially bai‘ al-mu‘āṭāh from a social perspective or community conditions. The results of this research show that bai‘ al-mu‘āṭāh is buying and selling carried out with certain movements or actions that show the agreement of both parties to the transaction. The validity of bai‘ al-mu‘āṭāh depends on the region and community conditions. In areas where transactions are commonly conducted through gestures without verbal expression, such as in almost all supermarkets in Indonesia where customers simply select items independently and pay at the cashier without any verbal exchange, bai‘ al-mu‘āṭāh is considered valid. However, in regions where transactions without verbal expression are uncommon, bai‘ al-mu‘āṭāh is not considered valid.
