El-Faqih, Jurnal Pemikiran dan Hukum Islam, ISSN, 2503-314X ( Online) and 2443-3950 (Print) is a peer-reviewed journal published by the Faculty of Sharia, IAI Faqih Asyari Kediri. This scholarly periodical specializes in the study of Islamic law and seeks to present the various results of the latest research, both conceptual-doctrinal and empirical, in the field. The editors welcome contributions in the form of articles to be published after undergoing a manuscript selection mechanism, peer-review, and editing process. The journal is published twice a year in April and October. It is now a fully online journal, and it only accepts manuscript submissions written in Indonesia, English, and Arabic.

Abstract

Kehamilan dalam budaya Jawa bukan sekadar proses biologis, tetapi juga memiliki makna sosial dan spiritual yang mendalam. Berbagai tradisi, seperti mitoni atau tingkeban, dilakukan sebagai bentuk doa dan harapan agar ibu serta bayi selamat. Penelitian ini bertujuan untuk menganalisis praktik adat Jawa dalam kehamilan dan mengkaji kesesuaiannya dengan prinsip Maqashid Syariah dalam hukum Islam. Dengan menggunakan metode kualitatif deskriptif-analitis, penelitian ini menggali keterkaitan antara adat Jawa dan prinsip perlindungan dalam Islam, seperti hifz al-din (agama), hifz al-nafs (jiwa), hifz al-aql (akal), hifz al-nasl (keturunan), hifz al-mal (harta), dan hifz al-‘irdh (kehormatan). Hasil penelitian menunjukkan bahwa adat Jawa dalam kehamilan memiliki keselarasan dengan Maqashid Syariah, terutama dalam menjaga kesejahteraan ibu dan bayi, mempererat hubungan keluarga, serta menjaga keseimbangan sosial dan spiritual. Namun, beberapa praktik adat perlu disesuaikan agar tetap sesuai dengan prinsip Islam dan tidak bertentangan dengan ajaran syariah. Dengan pendekatan Maqashid Syariah, tradisi kehamilan dalam budaya Jawa dapat terus dilestarikan tanpa kehilangan esensi Islam, sehingga membentuk harmoni antara nilai budaya dan hukum Islam.

Abstract

This research is motivated by the rampant practice of online gambling in Indonesia, which has had various negative impacts, both socially, economically, and morally, and the lack of comprehensive regulations regarding criminal liability for online gambling organizers. The purpose of this research is to determine how criminal liability for online gambling organizers is regulated under Indonesian positive law and to formulate ideal regulations for more effective law enforcement. The research method used is normative legal research, with a statutory and conceptual approach. Data was obtained through a library study of relevant laws and regulations, legal literature, and previous research findings. The results indicate that the criminal liability for online gambling organizers is regulated in the Criminal Code (KUHP), specifically Article 303 paragraph (1), Article 303 bis paragraph (1), and Article 303 paragraph (3). Furthermore, provisions regarding online gambling are also contained in Article 27 paragraph (2) in conjunction with Article 45 paragraph (2) of Law Number 11 of 2008 concerning Electronic Information and Transactions (ITE), as amended by Law Number 19 of 2016. However, these regulations are deemed inadequate to address the development of information technology-based crimes. Therefore, this study recommends the creation of special regulations regarding cybercrime that explicitly regulate online gambling crimes, including the forms of criminal liability for organizers, perpetrators, and participating parties. With these special regulations, it is hoped that law enforcement against online gambling crimes will be more effective and provide legal certainty.

Abstract

Islam prohibits all types of crimes, including all forms of fraud. Fraud is an evil act committed by someone by deceives others. When viewed from the perspective of the actions and elements of fraud, it appears that there are similarities between fraud and crimes regulated in Islamic law, such as ghulul, treason, and lying. The research approach used is Normative Juridical legal research. The purpose of this study is to determine the regulation of the Criminal Act of Fraud in the Criminal Code and Fiqh Jinayah. And how is the process of resolving the Criminal Act of Fraud in case NO 6 / Pid.B / 2024 / PN Bkt, with the following conclusions: In Islamic criminal law, perpetrators of fraud will receive ta'zir punishment. This is because ta'zir is a type of punishment whose final decision is in the hands of the government, especially the judge who gives the verdict. The judge has the freedom to choose the type of punishment based on their assessment. This also applies to cases of fraud that have been regulated in Article 378 of the Criminal Code.

Abstract

Women have long been frequent targets of sexual violence. In society, This study examines the legal protection for women who experience sexual violence in power relations, with a focus on the normative development of Indonesian law. Sexual violence in power relations occurs when perpetrators exploit structural, social, or institutional authority to dominate victims, particularly in educational and professional settings. Using a normative juridical method, this research analyzes statutory regulations, legal theories, and scholarly opinions—primarily the Indonesian Law No. 12 of 2022 on Sexual Violence Crimes (TPKS) and Permendikbud No. 30 of 2021. The findings show that Indonesian legal reform has shifted from a limited KUHP-based definition toward a victim-centered and restorative justice approach. However, implementation challenges remain, especially regarding enforcement, institutional accountability, and protection against retaliation. This study emphasizes the necessity of strengthening survivor-centered mechanisms and legal awareness to prevent repeated abuse of power within academic and institutional environments.

Abstract

Indonesia, as a country with a Muslim-majority population, applies a legal system that integrates both religious and state law, including in matters of marriage. However, the practice of nikah sirri, a marriage that is religiously valid but not officially registered by the state, remains widespread and raises various legal and social issues, particularly affecting women and children. This study aims to analyze the validity of nikah sirri through Abdullah Saeed’s hermeneutical approach from the perspective of maqāshid syarī‘ah. The method employed is a library research approach by examining Qur’anic and Hadith texts related to marriage and reviewing Abdullah Saeed’s contextual interpretation. The findings reveal that marriage registration is not merely an administrative formality but a legal protection mechanism aligned with the Islamic principle of public welfare (maslahah). By applying Saeed’s five levels of value hierarchy, obligatory, fundamental, protective, implementational, and instructional, it can be understood that marriage registration is an essential effort to safeguard human rights and prevent social and legal harm. Abdullah Saeed’s contextual approach emphasizes that Islamic law is dynamic and adaptive to the changing times; therefore, marriage registration can be viewed as an actualization of maqāshid syarī‘ah values in the context of modern Indonesia.

Abstract

Social and economic changes in the modern era have led to shifts in household roles, including the phenomenon of wives becoming the primary breadwinners. This issue raises legal and social questions from an Islamic perspective, particularly under the Compilation of Islamic Law (KHI) and the concept of maslahah mursalah. This study aims to analyze the legal status of wives as primary breadwinners based on KHI provisions and the maslahah mursalah principle. The research employs a qualitative approach with normative analysis of Islamic legal regulations and concepts. The findings indicate that, under KHI, the husband is primarily responsible for providing for the family. However, under certain circumstances, the wife may assume this role while maintaining balance in the household. From the perspective of maslahah mursalah, this phenomenon is permissible as long as it brings benefits to the family and does not cause harm. Therefore, Islam provides flexibility in the division of financial responsibilities, ensuring justice and family welfare remain upheld.

Abstract

This phenomenon raises questions regarding the legal status of financial support (nafkah), the obligations of husbands and wives, and the legal implications when viewed through the lens of Shafi’i jurisprudence. The research employs a normative-juridical method with a library research approach, drawing on classical Shafi’i fiqh literature as well as secondary sources such as books, journals, and relevant articles. Data were analyzed descriptively and analytically by outlining normative provisions in Shafi’i jurisprudence and linking them to contemporary social realities. The findings reveal that, according to the Shafi’i school, the husband’s obligation to provide financial support does not lapse even if the wife works or assumes the role of the main breadwinner, as this obligation is a consequence of the marriage contract. Meanwhile, wives are permitted to work as long as they obtain their husband’s permission, adhere to Islamic legal guidelines, and do not neglect household responsibilities. Thus, the phenomenon of wives as primary breadwinners is permissible insofar as it is carried out within the framework of Islamic law as understood in the Shafi’i school.

Abstract

This study examines the role of convert husbands in forming a peaceful family in Islam. The background of this study is related to the increasing number of individuals who embrace Islam, often because of the need to fulfill marriage requirements. The main objective of this study is to analyze how converted husbands adapt to Islamic values ​​in building a peaceful family, with a focus on the role of husbands as leaders, protectors, and educators in creating a harmonious family environment. This study was conducted through the Mualaf Center institution in Yogyakarta with a qualitative approach through interviews with three couples of convert families. The findings of the study indicate that despite facing challenges in adjusting to a new religious identity, the role of convert husbands in forming a family full of peace, love, and spirituality is very important. Husbands play an important role in educating children, maintaining household harmony, and strengthening the spiritual foundation of the family. This study provides valuable insights into the dynamics of convert families in Muslim society and the important role of convert husbands in forming a peaceful family.

Abstract

Early marriage remains a prevalent phenomenon in Indonesia, with a profound impact on the quality of individuals’ lives. From the perspective of Maqāṣid al-Syarī‘ah, marriage is considered a completion of worship aimed at achieving human welfare. Law Number 16 of 2019 concerning Amendments to Law Number 1 of 1974 on Marriage stipulates the minimum age for marriage for both men and women as 19 years old. This provision aims to prevent and minimize various negative consequences arising from the practice of early marriage. This study aims to analyze the essence of early marriage from the perspective of Law Number 16 of 2019 and Maqāṣid al-Syarī‘ah, identify the factors contributing to the high prevalence of early marriage, and examine its impacts on individuals’ quality of life.This research employs a qualitative method with a library research approach, enabling the researcher to gain an in-depth understanding of early marriage from the perspectives of Maqāṣid al-Syarī‘ah and the Compilation of Islamic Law, as well as its implications for individuals’ lives. The findings reveal that early marriage has negative impacts on various aspects of life, including family economic instability, low income levels, increased risks of poverty, divorce, and even neglect. Limited financial resources also lead to difficulties in accessing healthcare services, which consequently affects the overall quality of family health.

Abstract

This study examines the legal status of blood transactions used for blood transfusions from the perspective of Islamic law, with emphasis on the concepts of akad tabarru’ and akad ijarah. The research analyzes the mechanisms of blood collection, management, and distribution at the Blood Donation Unit of PMI Banyuwangi, deepening understanding of the legal status of blood transactions. Employing a qualitative method with a narrative approach involving interviews and literature review, the findings indicate that blood transfusion falls under akad tabarru’, a contract without compensation aimed at mutual help based on the principle of cooperation (ta’awun). The novelty of this research lies in its specific analysis of the blood processing fee (BPPD), which is categorized as akad ijarah, where the fee is a payment for blood management services, not the result of selling the blood itself. This study provides a theoretical contribution to contemporary fiqh by clearly distinguishing between the human aspect (blood donation) and operational costs. The research emphasizes that blood transactions in a medical context must be based on humanitarian values, solidarity, and adhere to the principles of Sharia in both akad tabarru’ and akad ijarah.
