Abstract

This study compares the institutional frameworks of the Indonesian National Narcotics Agency (BNN) and the Philippine Drug Enforcement Agency (PDEA) using W. Richard Scott’s regulatory and normative pillars. Both agencies operate under presidential authority but adopt different operational styles. The Philippines applies a highly repressive approach through Duterte’s “war on drugs,” while Indonesia combines punitive and rehabilitative measures with legal protection for cooperative users. Using a qualitative-comparative method and legal document analysis, this study examines narcotics law enforcement, treatment of users and dealers, and rehabilitation strategies, focusing on methamphetamine. Findings reveal convergence in regulation and sanctions, but significant differences in implementation—repressive in the Philippines versus legal-rehabilitative in Indonesia. Convergence and securitization theories explain how domestic and global pressures shape narcotics law narratives.

Abstract

This study is driven by the rapid expansion of the global cosmetics trade, which necessitates the alignment of national regulations with international legal standards, particularly in relation to skincare product safety. The objective of this research is to examine Indonesia’s administrative regulations on skincare safety, compare them with those of selected East Asian countries, and evaluate their conformity with international legal frameworks. Employing a qualitative approach, this study utilizes descriptive-comparative analysis of national legal instruments, international standards, and relevant academic literature. The findings reveal that Indonesia has adopted the ASEAN Cosmetic Directive (ACD) harmonization framework; however, its implementation continues to encounter challenges in areas such as regulatory oversight, bureaucratic processes, and technical capacity. In comparison with Japan, South Korea, and China, Indonesia’s regulatory framework remains less integrated. The study concludes that strengthening institutional capacity and enhancing regulatory harmonization are essential to achieving greater alignment with the WTO’s Technical Barriers to Trade (TBT) principles and other international standards.

Abstract

The growing complexity of document forgery and money laundering cases involving notaries and Land Deed Officials (PPAT) has raised serious concerns regarding the boundaries of criminal liability for public officials. This study aims to identify and assess the criminal liability of notaries and PPATs and to analyze the alignment of criminal sanctions with the principles of justice, legal certainty, and the objectives of criminal punishment, as reflected in the West Jakarta District Court Decision No. 248/Pid.B/2022/PN.Jkt.Brt. The research employs a normative juridical approach, utilizing case-based, conceptual, and statutory analyses. The findings reveal that the criminal liability of notaries and PPATs remains uncertain, particularly in establishing elements of culpability and ensuring the proportionality of sanctions. In conclusion, while law enforcement in this case has achieved legal certainty, it has not yet fully realized substantive justice or the restorative justice objectives of punishment.

Abstract

This research addresses how social, economic, and educational factors contribute to contract breaches and explores the psychological impacts on patients and doctor-patient relationships, offering effective management strategies. Utilizing an empirical legal research approach, data will be gathered through observation and in-depth interviews. This study reveals how social, economic, and educational factors impact contract breaches at Mitra Masyarakat Timika Papua Hospital. Social conditions, culture, and environment shape patient-therapeutic interactions. Economic constraints and lack of insurance impede treatment payment, while limited education affects medical understanding and rights comprehension. Strategies like financial flexibility, assistance, and improved cost information manage risks. Breaches cause psychological impact and strained doctor-patient ties. Effective strategies encompass communication, support, re-evaluation, dispute resolution, education, and improved doctor communication. Holistic, empathetic approaches maintain care quality and trust

Abstract

In Indonesia, Indigenous Law Communities, exemplified by West Biak District, Papua, rely on customary law for conflict resolution in their territories. This research aims to address the resolution of ulayat land disputes and the optimization of the existence of customary law in the resolution of ulayat land disputes in West Biak District, Biak Numfor Regency. This qualitative study in West Biak District examines customary law’s role in cultural preservation and land dispute resolution. Primary data from interviews, secondary data from documents and literature, both analyzed for insights. The study reveals that customary land disputes in West Biak District result from unclear boundaries, unfair practices, the absence of historical witnesses, and increased land value. These are resolved via non-litigious mediation led by the traditional head, offering advantages over litigation

Abstract

Rekam medis elektronik dimanfaatkan untuk menghimpun, menyimpan, memproses, dan mengakses data rekam medis dengan cepat dan akurat, memanfaatkan kemajuan teknologi. Penelitian ini bertujuan untuk mengevaluasi penerapan Peraturan Menteri Kesehatan Nomor 24 Tahun 2022 mengenai rekam medis terhadap efektivitas pelayanan kesehatan. Metode penelitian yang digunakan adalah yuridis normatif, dengan pendekatan analisis deskriptif, melalui studi kepustakaan. Hasil penelitian menunjukkan bahwa adanya sanksi administratif, seperti teguran tertulis atau rekomendasi pencabutan status akreditasi, akan diberlakukan terhadap fasilitas pelayanan kesehatan yang tidak mematuhi atau melanggar ketentuan mengenai penerapan rekam medis elektronik sesuai dengan batas waktu yang telah ditetapkan dalam Peraturan Menteri Kesehatan Nomor 24 Tahun 2022. Selain itu, keterbatasan sarana dan prasarana, serta ketidakstabilan jaringan dan koneksi juga menjadi masalah yang dapat mengakibatkan gangguan atau kesalahan sistem pada beberapa titik waktu.

Abstract

This study aims to analyze the implementation of PPAT (Pejabat Pembuat Akta Tanah) guidance and supervision. It utilizes a normative and descriptive approach, gathering primary and secondary data through field investigations and relevant material collection. The analysis is qualitative, revealing that the PPAT Supervisory Council (PPAT) MPPD (Masyarakat Perlindungan Pejabat Dokumen) plays an active role in addressing non-compliance with office hours, in accordance with Article 47 of Permen ATR/Ka BPN No. 2 of 2018. Sanctions for such violations include written warnings and higher-level discussions with MPPW (Masyarakat Perlindungan Pejabat Wilayah). To improve guidance and supervision, efforts include disseminating land policies, defining PPAT duties, and regular office oversight. This study highlights the importance of effective supervision in ensuring PPAT compliance with regulations and duties, ultimately contributing to improved land management.

Abstract

The LPSK (Witness and Victim Protection Agency) is an institution tasked with safeguarding the rights of witnesses and victims within the framework of the Indonesian criminal justice system to ensure justice and security. However, the implementation of witness and victim protection faces challenges such as a lack of understanding among law enforcement officers, insufficient resources and facilities, and intimidation against witnesses and victims. Therefore, an analysis of the implementation of witness and victim protection becomes crucial to identify solutions and enhance the Indonesian criminal justice system. Through continuous collaboration and efforts, it is expected that the protection of witnesses and victims can be improved, thereby increasing public trust in the Indonesian criminal justice system.

Abstract

This paper will describe and analyze the potential of the use of natural resources in tourism development, areas that have beautiful natural resources and are still naturally one of the tourist destinations. The use of natural resources in the tourism industry has become a trend today. Thus, there needs to be governance that regulates how the utilization of natural resources as one in the tourism industry. In sustainable development there is a balance that must be done by the parties both the government, business actors and the community in building the tourism industry. The utilization of natural resources for the tourism industry is as wise as possible not to damage the environment but can contribute economically to the increasing economy of the local community. On the other hand, the local community still has a responsibility in maintaining its environment. So, there is a harmonious relationship between the environment (natural resources), local communities, and economic improvement.

Abstract

This study investigates the regulation of action sanctions through a restorative approach for children in conflict with the law (ABH) within the juvenile criminal justice system in Indonesia. The objective is to analyze the alignment of these regulations with the principles of child protection and restorative justice. Utilizing a normative juridical method that incorporates statutory and conceptual approaches, the findings indicate that Article 82 of the Juvenile Criminal Justice System Law (SPPA Law) embodies a restorative justice approach, striving to balance community protection with the rehabilitation of ABH. However, the implementation is suboptimal, and many ABH continue to receive prison sentences. This suggests that the principles of the best interests of the child, the right to development, and respect for children’s views have not been adequately upheld. There is a need for further refinement of action sanctions to better align with restorative justice and address the needs of ABH.
