Abstract

Penelitian mengenai penerapan alternatif penyelesaian sengketa terhadap tindak pidana pencurian bernilai ringan bertujuan untuk mengetahui perkembangan alternatif penyelesaian sengketa dalam masyarakat Indonesia dan untuk mengetahui penerapan alternatif penyelesaian sengketaterhadap tindak pidana pencurian bernilai ringan. Penelitian yang digunakan adalah yuridis normatif disertai atau penelitian doktrinal ditambah dengan wawancara. Hasil penelitian yang diperoleh yaitu sistem alternatif penyelesaian sengketasudah mulai berkembang sejak dulu dengan nama musyawarah adat desa dan semakin berkembang dengan dibentuknya Badan Arbitrase Nasional Indonesia (BANI) dan Pusat Mediasi Nasional (PMN). Selain itu, penerapan alternatif penyelesaian sengketaterhadap tindak pidana pencurian bernilai ringansudah diterapkan berdasarkan Surat Kapolri No.Pol/3022/XII/SDEOPS/2009 tentang Penanganan Kasus Melalui Alternative Dispute Resolution (ADR) dan PERMA Nomor 02 Tahun 2012 tentang Penyesuaian Batas Tindak Pidana Ringan dan Jumlah Denda dalam KUHP dengan cara memediasikan para pihak tanpa harus melimpahkan berkas ke tingkat pengadilan negeri.

Abstract

The hospital is where the health services are operated and maintained with the utmost regard for the building and environmental hygiene aspect both physically, waste, liquid waste, clean water and insect/pest animals.Akantetapi to create the hygiene in hospitals is an attempt which is quite difficult and complex nature of the dealing with various aspects of, among others, culture/society behaviors, habits, environmental conditions, social and technological. Hospital waste is any waste generated by the activities of the hospital and other supporting activities.Hospital waste, in particular the infectious medical waste that has not been in the manage well will be catastrophic for the environment.Many hospitals have yet to manage infectious wastes according procedural should be.Not rare cases medical and non medical waste mixed giving rise to the problem of medical waste. Hospital waste processing can be done in various ways, by giving priority to sterilization, namely in the form of a reduction in volume, the use of sterilization must return with the first, recycling and processing.The most important thing in the processing of waste is the separation of waste, waste storage, handling of waste and waste disposal must be in accordance with the provisions of the regulations.So as not to give a negative impact to the environment.

Abstract

This study uses empirical juridical method where research with a view to legal provisions in practice. This study concerns the basic factors underlying the onset of any breach of the principle of utmost good faith in the insurance agreement as well as how the settlement and legal consequences of the breach of the principle of utmost good faith in the contract of insurance. The author uses the qualitative data analysis to make an assessment of data that authors get on the field with the help of literatures related research. Based on the research that earned the author the P.T. Asuransi Jiwasraya (Persero) Padang Branch that the factors underlying the violation of the principle of utmost good faith can be caused by internal factors (the insurer) is an insurance agent and risk selectors (underwriter) and external factors i.e. insured parties. Violation of the dishonest agents caused the insurer gives a description of the products offered to the prospective insured because only the pursuit of targets and commissions, vice versa the insured provides false information when responding to a question from the insurer. Completion of the offence principle of utmost good faith this is done first by deliberation, if agreement was not reached will proceed through court proceedings. As a result of legal violations of principle of utmost good faith is the insurance agreement void or in other words the insurer has no duty to indemnify if the claims of the insured object.

Abstract

Jual beli adalah suatu perjanjian bertimbal-balik dalam mana pihak yang satu (si penjual) berjanji untuk menyerahkan hak milik atas suatu barang, sedang pihak yang lainnya (si pembeli) berjanji untuk membayar harga yang terdiri atas sejumlah uang sebagai imbalan dari perolehan hak milik tersebut.Pemberian kredit yang dilakukan oleh pihak bank kepada nasabah untuk membayar pembelian apartemen atas dasar kepercayaan dan keyakinan bahwa nasabah yang akan menerima kredit itu mampu dan mau mengembalikan kredit yang telah diterimanya. Dari faktor kemampuan dan kemauan tersebut, tersimpul unsur kemanan dan sekaligus juga unsur keuntungan dari suatu kredit. Kedua unsur tersebut saling berkaitan. Suatu pinjaman yang diberikan secara khusus untuk membiayai transaksi, misalnya memperoleh barang, jasa, atau tanah disebut dalam undang-undang sebagai debitor creditor supplier agreement. Itikad baik dalam pra perjanjian dan penyusunan perjanjian mewajibkan para pihak untuk memberitahukan atau menjelaskan fakta material kepada pihak yang lain mengenai pokok yang di negoisasikan itu. PT Multi Artha Griya selaku produsen berkewajiban untuk memberitahukan kepada konsumennya bahwa persyaratan aturan untuk pengikatan perjanjian jual beli (PPJB) dikarenakan suami dari Konsumen ternyata adalah Warga Negara Asing, maka ada syarat mutlak yang harus dipenuhi yaitu adanya perjanjian Pra-nikah antara si suami dan isteri sebelum melakukan Down Payment, sehingga konsumen akan mempertibangkan untuk membeli Apartemen tersebut atau tidak. Tidak adanya itikad baik dari produsen mengenai hal tersebut mengakibatkan produsen telah melakukan perbuatan melawan hukum yakni bertentangan dengan Pasal 4 angka 7, Pasal 7 angka 1 Undang-undang Perlindungan konsumen dan Pasal 1338 ayat 3 Kitab Undang-undang Hukum Perdata.

Abstract

The formation of a regulation aims to be able to regulate and also be able to organize the existence of life in a country where in the life of a society that is also regulated by the law to be able to obtain certainty, as well as benefits and also justice in life in the state. It also includes regulations concerning criminal justice for children in conflict with the law or commonly referred to as children as perpetrators of criminal acts, where children, even as perpetrators, must pay attention to their human rights while in the Special Child Development Institution (LPKA) and the law implies there are criminal sanctions that contain the main and additional punishments that will be imposed on children, but in the birth of the SPPA law it has not explained which criminal acts are in the form of violations and crimes, regardless of the age limit of the child, at least the classification between violations and crimes should be included in the law on the juvenile justice system because it is related to child protection because basically punishment is the last resort imposed on children when the settlement of diversion does not reach an agreement between the perpetrator and the victim, what is the legal ratio in the formation of the law on the juvenile justice system without including any classification of violations and crimes committed by children.

Abstract

The continual advancement of technology and the expanding array of human needs have fuelled significant growth within the trade sector, particularly in intellectual property (IP) domains. This growth is evidenced by a marked increase in intellectual property registrations, which play a pivotal role in the trade sector. The surge in registrations, including trademark, copyright, patent, and industrial design sectors, has correspondingly led to a rise in intellectual property disputes. While these disputes traditionally find resolution within Commercial Courts, alternative mechanisms such as mediation and arbitration have gained prominence. The World Intellectual Property Organization (WIPO) oversees a specialized institution for mediation and arbitration, namely the WIPO Mediation and Arbitration Centre. Indonesia similarly hosts its own institution dedicated to resolving intellectual property disputes, the Intellectual Property Arbitration and Mediation Agency (BAM HKI), established in 2011. Arbitration mechanisms prioritize privacy, efficiency, and expediency in resolving intellectual property disputes compared to Commercial Courts. Consequently, the presence of arbitration institution offers a viable alternative dispute resolution mechanism favoured by involved parties.

Abstract

Necrophilia in Indonesia has not been specifically regulated in the law. This causes a legal vacuum to punish the perpetrators of necrophilia in Indonesia. this research focuses on examining maqashid sharia in the criminalization of necrophilia in Indonesia. The research method used is normative research method. the results show that in Islamic teachings, necrophilia is considered a serious violation of the honor of the corpse which is highly respected, equivalent to respect for the living. This act not only violates the honor of the corpse but also the principle of keeping private parts and sight, which is emphasized in Islam. Criminalizing necrophilia protects individuals from heinous crimes and preserves the moral and ethical values of society in accordance with maqasid al-shariah, which aims to protect human honor and posterity. In the Qur'an, Allah SWT strictly prohibits zina, including all forms of sexual relations outside the bonds of legal marriage, as in Surah Al-Isra' verse 32. Necrophilia, as a sexual perversion, is a grave violation of Islamic teachings that emphasize respect for the human body. This prohibition emphasizes the importance of private parts and morality in the context of marriage and Islamic moral values. Necrophilia tarnishes human dignity, disrupts social order, and violates sharia law and Islamic ethics. Maqāṣid al-syarī'ah includes five main principles: the preservation of religion, soul, mind, offspring, and property, all of which emphasize the importance of prohibiting and punishing practices that insult human dignity such as necrophilia. Criminalizing necrophilia is an important effort to preserve religious integrity, morality, and social justice, as well as protect human dignity and the stability of society.

Abstract

The issue of preventing child marriage and marriage dispensation to provide child protection remains a crucial legal problem. This research aims to examine the legal reasoning in the rulings of Religious Court judges regarding marriage dispensation applications and to what extent these rulings provide child protection from the perspective of Maqāshid Al-Shari’ah. This study employs normative legal research methods and analyzes legal issues from the perspective of Maqāshid Al-Shari’ah. Data collection was conducted through a literature review. The findings indicate that the legal reasoning in the rulings of Religious Court judges has not fully aligned with the spirit of the Marriage Law, the Child Protection Law, and the Supreme Court Regulation on Marriage Dispensation, which aim to prevent child marriage. There is a dilemma among judges between efforts to prevent child marriage and the legal reality where the child applying for marriage dispensation has met urgent reasons and supporting evidence. Most of the rulings by Religious Court judges on marriage dispensation cases align with the main objectives of Islamic law (Maqāshid Al-Shari’ah), which are the protection of religion (hifz al-din), the protection of life (hifz al-nafs), the protection of lineage (hifz al-nasl), the protection of intellect (hifz al-aql), and the protection of property (hifz al-māl).

Abstract

This research analyzes the extent to which the concept of the Ultimum Remedium Principle becomes the principle basis for judges to keep children out of prison. This principle encourages problem-solving efforts involving perpetrators, victims and other parties. The provisions of Law No. 11/2012 are a form of certainty in providing clear guidelines for judges in making decisions that are optimal for the interests of children, in accordance with the principle of the Ultimum Remedium Principle. Nonetheless, some judges still tend to take action based on the theory of retaliation when determining responsibility for the wrongdoing committed by the child. This study aims to determine the extent to which this country has a legal umbrella in protecting children and to determine the optimization of the application of the ultimum remedium principle to crimes committed by children. This research is a normative juridical study. The results showed that the settlement of cases of children in conflict with the law according to Law No. 11/2012 is to prioritize alternative out-of-court settlements which are the basic principles in the legal system governing child protection. This approach is in line with the principles of human rights and the best interests of the child.

Abstract

The practice of pawning in Indonesia, especially in the context of customary law, namely selling pawns, is often still used by the community today, but this practice is considered irrelevant along with the development of pawn practices in Indonesia. New regulations from PT Pegadaian (Persero) through pawning with pawn objects in the form of land in Sharia Pawnshops with the aim of providing financing for the community and to micro, small and medium enterprises and farmers who use productive land. The development of pawn practices in Indonesia is also marked by the existence of an online pawn mechanism that is rampant among the public today. On the other hand, online pawning is also considered to provide convenience for the pawn giver because it can be done anytime and anywhere and the pawn giver can also estimate for himself how much the value of the pawn object is, but of course on the other hand this online pawn also has several weaknesses. This research uses normative juridical research methods to describe problems and solutions in the context of the development of pawn practices in Indonesia and uses qualitative research methods and is balanced by conducting interviews with the Padasuka branch of Sharia Pawnshops, Bandung City.
