Abstract

 Indonesia and Malaysia are two countries with two different laws where Indonesia is a country that applies Civil Law and malaysia with Common Law. The difference between this two systems lays with how they run the judicial systems that also includes what task and leverage of the supreme court of Indonesia and Malaysia. The problem statement in this journal will inquire about the duty and leverage of the Supreme Court of Indonesia. The research method that is going to be use in these journal will use normative method where the author going to analyze on the norms that applied in the country. The research method that is going to be use in this journal include issues, rules, application, and conclusion or (IRAC). Writer conclude that the Supreme Court holds major influence in the judicial system in Indonesia and Malaysia.

Abstract

Criminal Code (KUHP) is a legacy of the Dutch colonial era. Its substance and principles are still influenced by individualistic and colonialist views that are not in line with the ideological values of the Indonesian nation. With the enactment of Law Number 1 of 2023 concerning the Criminal Code, Indonesia seeks to reform its criminal law system to be more in line with social, cultural values, and current and future societal conditions. This study aims to analyze the differences or disparities in criminal sanctions between the old Criminal Code and Law Number 1 of 2023 concerning the Criminal Code. The method used is normative legal research, namely by examining the provisions of sanctions in both regulations in depth and systematically. The results of the study indicate that criminal sanctions and actions in the National Criminal Code for their imposition on perpetrators must pay attention to the provisions of 1) the purpose of punishment (Article 51-Article 52); 2) guidelines for punishment (Article 53-Article 56); 3) guidelines for the application of imprisonment with a single formulation and alternative formulation (Article 57); 4) aggravation of the sentence (Article 58-Article 59); 5) other provisions regarding sentencing (Article 60-Article 63). This is quite different from the use of types of criminal sanctions in the Criminal Code, which does not recognize these five important things to pay attention to because they are not regulated in the Criminal Code. The purpose of sentencing is one important aspect that forms the basis for analyzing the provisions of the main criminal sanctions in both regulations.

Abstract

 The purpose of this study is to analyze various regulations of foreign citizens in obtaining limited stay permits and law enforcement on the abuse of limited stay permits by foreign investors in Indonesia. The type of research in this writing is doctrinal research with a legislative and conceptual approach that focuses on laws and regulations and literature as sources of legal material. After the legal materials are collected by conducting literature research, the next step is to analyze descriptively and argumentatively. Based on the results of the study, it shows that the procedure for owning an investor KITAS in Indonesia has provided legal certainty and made it easier for foreign citizens to invest in Indonesia as one of the main factors that attract investors to invest. Foreign nationals who will invest must meet several document requirements and establish a PT PMA with capital provisions in accordance with applicable regulations. Administrative action against the misuse of investor KITAS by foreign nationals is carried out by Immigration Officials as a form of law enforcement which is an attributive authority granted by law. The administrative action that can be taken by Immigration Officials for the misuse of investor KITAS is deportation from Indonesian territory. Abstract

Carok is a cultural tradition in Madura, involving a fight or duel using a cerulit knife to restore one's pride and honor that has been trampled on by others. This tradition involves abuse and murder, and the perpetrators are not punished because there is a customary agreement. This is not in accordance with Islamic law and positive law. In Islamic Criminal Law, carok is categorized as a qishash-diyat crime. Meanwhile, according to Indonesian positive law, carok is a criminal act of murder as regulated in Articles 338-340 of the Criminal Code. This study aims to analyze the tradition of carok from the perspective of positive law and Islamic criminal law, including examining the sanctions for perpetrators of carok, the elements and stages of carok, and the customary agreements involved. This study uses a descriptive analysis method with a normative juridical approach. The type of data used in this research is qualitative, using secondary data sources with library research data collection techniques and deductive data analysis techniques. The results of this study show that the tradition of carok violates Positive Law and Islamic Criminal Law. In Islamic Criminal Law, perpetrators are subject to qishash-diyat, and in Positive Law, carok is a criminal act and violates the law. Therefore, carok as a tradition needs to be re-examined.

Abstract

 The use of force majeure clauses as grounds for termination of employment (PHK) is increasingly common in employment practices, particularly in crisis situations that impact a company's operational capabilities. However, the use of force majeure as a reason for termination of employment often raises legal issues because it is often misinterpreted, over-extended, or used without meeting the normative requirements stipulated in the Manpower Law and its implementing regulations. This study aims to analyze the validity of using force majeure as a basis for termination of employment, identify its legal limitations, and examine the considerations of judges in several Industrial Relations Court and Supreme Court decisions related to this issue. The research method used is normative legal research with a statutory approach, a case approach, and a conceptual approach. The results indicate that force majeure can only be used as a basis for termination of employment if the event is beyond the company's control, unpredictable, and truly prevents the company from maintaining its employment relationship. Furthermore, judges tend to reject terminations based on force majeure if the company is still able to operate or if other alternatives exist, such as bipartite negotiations, rearranged working hours, or wage deferrals. Therefore, regulatory certainty and clarity are needed to prevent employers from misusing force majeure.Keywords: force majeure, Termination of Employment (PHK), Employment Law, Judge's Consideration

Abstract

This study aims to examine the impact of stock suspension policies on the protection of public investors in the Indonesian capital market. This study uses a normative juridical approach by examining laws and regulations related to the capital market sector. A comparative approach is also used by reviewing regulatory practices in Malaysia to identify normative and procedural gaps in the suspension mechanism in Indonesia. The results of the study show that stock suspension serves as an instrument to maintain market integrity, but in practice it can limit investors' rights to liquidity and information disclosure if it lasts too long without clear reasons and time limits. Compared to Malaysia, Indonesia does not yet have a definite deadline, creating legal uncertainty for public investors. This article provides solutions to the stock suspension mechanism within the framework of Indonesia's capital market law by emphasizing clearer coordination between supervisory agencies and strengthening information disclosure obligations.

Abstract

Jayawijaya Regency, a region rich in natural resources, faces significant challenges in plastic waste management. The use of Noken bags as an environmentally friendly alternative to plastic bags is a strategic step that requires analysis from a legal policy perspective. The purpose of this paper is to analyze legal policies related to reducing plastic bag waste, assess the effectiveness of Noken bags as an alternative to plastic bags, and analyze the challenges and obstacles in implementing plastic waste reduction policies. This paper utilizes a qualitative research method, focusing on legal policy analysis, combined with a survey method to obtain public perceptions of Noken bags as an alternative to plastic bags. The study concludes that the plastic waste problem in Jayawijaya is urgent due to the ever-increasing volume and minimal management infrastructure, resulting in serious impacts on the environment and health. Although Noken bags have the potential to be an environmentally friendly alternative, limited production and price are obstacles. Therefore, a comprehensive strategy is needed, encompassing waste management facilities, an effective 3R program, education, economic support, and strong regulations to make Noken a sustainable solution.
