Abstract

Article 176 paragraphs (1) and (2) of Law No. 10/2016 regulates the mechanism for filling vacancies of deputy governors, deputy regents, and deputy mayors, but in practice there are many delays in filling vacancies of deputy regional head positions. In fact, in some regions there are vacancies until the term of office of the deputy head of the region expires. This research aims to: (1). Analyze the mechanism for filling vacancies of deputy regional heads, (2). Analyze why there is a delay in filling the vacancy of the position of deputy regional head, (3) Offer a legal solution to anticipate the delay in the process of replacing the deputy regional head. Based on how to process data, this research is included in qualitative research. This research is not to find how many vacant deputy regional heads there are in Indonesia. This research also does not use statistical data processing to draw a conclusion. This research is a library research. The type of data in this research is secondary data consisting of primary legal materials and secondary legal materials. The mechanism for filling the vacancy of the regional head by election by the provincial DPRD or regency/city DPRD is based on a proposal from the supporting political party or a coalition of political parties. In practice, it is difficult for the supporting parties to agree to appoint a replacement, and each political party has an interest in making a candidate from the party or candidate they support as deputy regional head. The solution is the need for additional articles in Law No. 10/2016 aimed at anticipating if a political party or coalition of political parties fails to propose two replacement candidates.Keywords: filling positions, deputy regional head.

Abstract

AbstractRecruitment of candidates for legislative members is carried out by Political Parties based on the Articles of Association (AD) and Bylaws (ART), and must pay attention to educational background, abilities and knowledge of politics, government and state administration, not just paying attention to candidates who have large capital, so they are immediately accepted as candidates. This is a habit that must be corrected and changed by the political parties participating in the election, so that the elected candidates can truly carry out the people's mandate and not disappoint the people. In addition, the quality and professionalism of elected legislative members is largely determined by the mechanisms and recruitment carried out by political parties, as well as the implementation of elections in accordance with their principles, namely direct, general, free, secret, honest and fair, as well as with the principles of proper implementation. independent, open, proportional, professional, effective and efficient. If this is done as well as possible and in accordance with applicable regulations, it is hoped that it will produce legislative members of quality and professionalism, but if on the contrary, the elected legislative candidate will not produce performance in accordance with their main duties and expectations of the people who elect them, so that the contribution of the selected candidate does not have a significant impact on the progress of society, nation and state, and overall will experience losses for five years.Keywords: Recruitment of Candidates for Legislative Members, Political Parties, General Election AbstrakRekrutmen calon anggota legislatif yang dilakukan oleh Partai Politik berdasarkan Anggaran Dasar (AD) dan Anggaran Rumah Tangga (ART), dan harus  memperhatikan latar belakang pendidikan, kemampuan, dan pengetahuan tentang politik, pemerintahan, dan ketatanegaraan, tidak semata-mata hanya memperhatikan calon yang mempunyai modal besar, sehingga langsung saja diterima sebagai calon. Hal ini merupakan kebiasaan yang harus diperbaiki dan dirubah oleh partai politik peserta pemilu, agar calon yang terpilih memang benar-benar dapat mengemban amanah rakyat dan tidak mengecewakan rakyat. Di samping itu, kualitas dan profesionalitas anggota legislatif yang terpilih sangat ditentukan oleh mekanisme dan rekrutmen yang dilakukan oleh partai politik, serta penyelenggaraan pemilu yang sesuai dengan asasnya, yakni langsung, umum, bebas, rahasia, jujur, dan adil, serta dengan prinsip penyelenggaraan yang mandiri, terbuka, proporsional, professional, efektif dan efisien. Apabila hal ini dilakukan dengan sebaik-baiknya dan sesuai dengan ketentuan yang berlaku, maka diharapkan akan menghasilkan anggota legislatif yang berkualitas dan profesionalitas, tetapi apabila sebaliknya maka calon anggota legislatif yang terpilih tidak akan menghasilkan kinerja yang sesuai dengan tupoksinya dan harapan masyarakat yang memilihnya, sehingga kontribusi dari calon terpilih tidak membawa dampak yang signifikan bagi kemajuan masyarakat, bangsa dan negara, dan secara keseluruhan akan mengalami kerugian selama lima tahun.Kata Kunci: Rekrutmen Calon Anggota Legislatif, Partai Politik, Pemilihan Umum

Abstract

This research aims to analyze the implementation of the obligation to own a permit and analyze the factors that hinder it as well as efforts to overcome the obstacles in Rokan Hulu Regency. This type of research is sociological/empirical legal research. The approaches used are the statutory approach, case approach and historical approach with qualitative analysis methods. The results of the research show that firstly, the implementation of permit ownership obligations has not gone well. Second, inhibiting factors: legal factors, local government officials, facilities/facilities and the community. Third, efforts to overcome obstacles: legal factors, namely that it is best to simplify the permit requirements and procedures in regulations. regional government apparatus factors, namely that the government should be able to prioritize the use of appropriate budgeting; the government should carry out frequent outreach; It would be better if there was an appropriate division of tasks for the implementation of order and law enforcement, it would be better to increase supervision and guidance so that everyone has permits. the facilities/facilities factor is that it is better to increase the budget. Abstract

This research aims to analyze the application of diversion to children who commit criminal acts of abuse in the jurisdiction of Pekanbaru City and analyze the obstacles and efforts to overcome these obstacles. The type of research used is sociological legal research with a legal effectiveness approach. The data source used is primary data which is analyzed qualitatively. The results of the research show that the implementation of diversion against children who have committed criminal acts of abuse in the jurisdiction of Pekanbaru City has not been implemented well in 2021 to 2023, where there is still failure to diversion against children who have committed serious criminal acts of abuse. Some of the obstacles behind this failure include: First, legal factors, namely legal provisions that require an agreement between the perpetrator and the victim for diversion, whereas there is no agreement on compensation. Second, the factor of law enforcement officers, namely: the lack of involvement of the Pekanbaru City Social Service in the diversion process. Third, community factors, namely: The desire of the community that the perpetrator must be punished.Keywords: Diversion, Children, Criminal Abuse

Abstract

This research aims to analyze the income position of working wives in Islamic family law in Indonesia. In classical jurisprudence, the husband has the obligation to pay his wife's maintenance, based on the rules of separation of assets in marriage. Meanwhile in Indonesia, maintenance is determined by the husband, with the implementation of joint property. This proof was carried out by examining books related to this study. Qualitative descriptive analysis was carried out after complete data was obtained. The results of this research explain that there is no text that expressly prohibits wives from working and there is no text that explicitly states that wives must work with their husband's permission. In classical jurisprudence, a wife's income from work is the husband's obligation, as is the case in Indonesia. However, it is not in line with the implementation of joint property, so it brings ambiguous legal treatment. The implementation of joint property in marriage has an impact on the implementation of all obligations in the household being carried out jointly, including the obligation to fulfill maintenance.

Abstract

Peraturan Pemerintah (PP) Nomor 24 Tahun 2022 tentang Pelaksanaan UU Ekraf menyebutkan bahwa terdapat skema pembiayaan yang diberikan kepada para pelaku ekonomi kreatif berbasiskan kekayaan intelektual (KI) termasuk didalamnyamelalui pemanfaatan Hak Cipta yang bernilai ekonomi. Skema pembiayaan dalam konteksekonomi kreatif dapat mencakup berbagaipendekatan seperti pembiayaan modal ventura, pembiayaan kredit usaha rakyat, pembiayaanmikro, pembiayaan berbasis risiko (PembiayaanModal Kerja dan Investasi). Sebuah ciptaanmemiliki cerminan dari penciptanya (alter ego) dan hal ini tidak dapat dialihkan karna termasuk sebagai hak moral yang melekat mutlak pada penciptanya. Jika skema pembiayaan menjadikankarya dari pencipta sebagai objek jaminan, makaperlu untuk diteliti apakah dalam terjadinyawanprestasi, objek tersebut akan sepenuhnyaberpindah tangan kepada kreditur ataukah hanyasebatas sampai kreditur memenuhi kewajibannya. Proses labour yang membuat hak kekayaan intelektual pada pencipta atau penemu hingga menciptakan suatu karya. Maka sejauh mana asas alter ego, teori reward dan teori labour dapat diimplementasikan dalam skema pembiayaan pada ekonomi kreatif. Metode penelitian yang digunakan oleh penulis dalam riset ini adalah yuridis normatif. Dari penelitian ini didapatkan kesimpulan pertama, tiap hak cipta dapat memiliki nilai yang sangat berbeda karena faktor alter ego. maka semestinyadiberi keleluasaan bagi pencipta untuk dapat bebasmemilih dalam mendapatkan fasilitaspembiayaan,bukan hanya dalam sistem kreditdimana objek ciptaan dapat terancam dialihkan jika pencipta berpotensi gagal bayar. Kedua, Pemenuhan teori reward dalam konteks ekonomiuntuk hak cipta belum sepenuhnya terlaksana. Salah satunya karena pilihan terbatas pendanaanyang dapat diberikan kepada pencipta hanyadalam bentuk kredit. Pemberian reward kepadapencipta masih hanya sebatas konsep teoritis dan tertulis dalam peraturan, namun belum dapatdilaksanakan secara menyeluruh dengan benar-benar menghargai pencipta.

Abstract

There is a legal vacuum related to the non-regulation of sanctions for companies that do not implement CSR/implement it but do not comply with legal provisions. Both in Law Number 40 of 2007 concerning Limited Liability Companies and regulations at the regional level. Such conditions mean that the realization of people's welfare as the goal of providing CSR cannot be fulfilled. The aim of this research is to analyze the concept of regulating legal certainty in providing CSR for the welfare of the people; To formulate the ideal concept of regulating legal certainty for providing CSR. This type of research is normative legal research. The approach used is a statutory, concept and case approach with qualitative analysis methods. The results of the research show that Firstly, the concept of regulating legal certainty for providing CSR for welfare based on Law Number 40 of 2007 concerning Limited Liability Companies does not provide legal certainty, as do the derivative regulations at the regional level, especially in Berau Regency, Kampar Regency, Semarang City, Kota Pematang Siantar and the Special Region of Yogyakarta, which have not yet explicitly regulated sanctions for companies that have not implemented CSR for the community or these companies have implemented CSR for the community but the implementation has not complied with the legal provisions governing CSR itself. The impact is that the provision of CSR by the company to the community around the company has not provided welfare for the community. Second, the ideal concept of regulating legal certainty in providing CSR for the welfare of the people based on Law Number 40 of 2007 concerning Limited Liability Companies, is the concept of regulating derivative regulations at the regional level, namely regulations as in Aceh Besar Regency Qanun Number 9 of 2019 concerning Social Responsibility and Company environment; as well as Siak Regency Regional Regulation Number 1 of 2013 concerning Corporate Social and Environmental Responsibility which regulates legal sanctions against companies that have not implemented CSR for the community or the company has implemented CSR for the community but the implementation has not complied with the legal provisions governing CSR itself. This ideal concept has demonstrated the success of implementing CSR for the community around the company so that people's welfare can be achieved through the CSR program..Keywords: CSR, People, Limited Liability Company.

Abstract

The legal relationship of Land Sale and Purchase in relation to land acquisition for public purposes, and the role and responsibilities undertaken by a Notary Public or Public Official, become highly significant. This is because the Notary Public bears the responsibility to ensure that the land being bought and sold is transferred in accordance with the prevailing legal regulations. This study aims to determine the Accountability of the Notary Public or Public Official regarding the implementation of Land Sale and Purchase that has a designated Land Acquisition location, and the Legal Certainty Aspect of Authentic Deeds from Land Sale and Purchase Created by the Notary Public or Public Official in relation to Land Sale and Purchase that has a designated Land Acquisition location. The research method employed is normative juridical, focusing on literature review, particularly analyzing the applicable legal provisions. The research is descriptive-analytical in nature, aiming to comprehensively depict the state of an object in a systematic manner. The research is carried out in two stages: Field Research and Library Research, with the goal of obtaining primary, secondary, and tertiary legal sources. The research findings indicate that the sale and purchase of land rights by a Public Official, who oversees the transfer process of an object designated as land for development for public purposes, results in the improper receipt of compensation costs by the wrong party. In this regard, the Notary Public or Public Official, in carrying out their duties, must adhere to legal regulations, exercise prudence, and avoid favoring any party in order to prevent any party from being disadvantaged in the process of transferring land rights that they have executed

Abstract

 ABSTRACTCorruption in Indonesia is an extraordinary crime with systemic impacts on governance and public welfare. This normative legal study analyzes the differences in focus and legislative frameworks of anti-corruption policy across the administrations of Presidents Joko Widodo and Prabowo Subianto. Under President Joko Widodo, anti-corruption efforts faced significant setbacks. The 2019 revision of Law No. 19 on the KPK was widely criticized for weakening the institution's independence. Further legislation, including the Omnibus Law on Job Creation and the 2023 Criminal Code (KUHP), introduced new corruption risks and created legal disharmony. These developments contributed to a decline in Indonesia's Corruption Perceptions Index (CPI), marking the Jokowi era with institutional weakening and controversial reforms. In contrast, the Prabowo Subianto administration presents an evolving orientation. Early policy narratives prioritize asset recovery through restorative justice and strengthening the roles of the Attorney General’s Office and the Police. However, concrete legislative reforms remain limited. While this approach suggests a potential for stronger deterrence, it also raises concerns that political compromise could lead to implicit decriminalization. Overall, Indonesia’s anti-corruption legal politics reflect a complex dynamic shaped by fluctuating political will and competing interests. The Jokowi era was defined by institutional erosion, while the Prabowo era confronts the dilemma of balancing asset recovery, institutional strengthening, and political stability. The study concludes that the effectiveness of future anti-corruption efforts will depend on consistent political will to establish strong, transparent, and public-oriented regulations.Keyword: Corruption, Legal Politics, Criminalization and Decriminalization, Corruption Eradication Commission (KPK), Anti-Corruption LegislationABSTRAKKorupsi di Indonesia digolongkan sebagai kejahatan luar biasa yang berdampak sistemik pada tata kelola pemerintahan dan kesejahteraan publik. Studi hukum normatif ini menganalisis perbedaan fokus dan kerangka legislatif antikorupsi antara masa pemerintahan Presiden Joko Widodo dan Presiden Prabowo Subianto. Di bawah Joko Widodo, upaya antikorupsi mengalami pelemahan signifikan. Revisi UU KPK No. 19 Tahun 2019 dikritik karena melemahkan independensi institusi. Selain itu, legislasi seperti Omnibus Law Cipta Kerja dan KUHP 2023 dianggap menciptakan risiko korupsi baru dan ketidakharmonisan hukum. Perkembangan ini berkontribusi pada penurunan Indeks Persepsi Korupsi (CPI) Indonesia. Era Jokowi ditandai oleh pelemahan institusional dan reformasi yang kontroversial. Sebaliknya, administrasi Prabowo Subianto menampilkan orientasi yang berbeda. Narasi kebijakan awal menitikberatkan pada pemulihan aset melalui keadilan restoratif serta penguatan Kejaksaan Agung dan Kepolisian. Meskipun reformasi legislatif konkret masih terbatas, pendekatan ini menyiratkan potensi deterensi yang lebih kuat. Namun, hal ini juga menimbulkan kekhawatiran bahwa kompromi politik dapat mengarah pada dekriminalisasi implisit. Secara keseluruhan, politik hukum antikorupsi Indonesia mencerminkan dinamika yang kompleks, dibentuk oleh kemauan politik yang tidak stabil. Era Jokowi diwarnai erosi institusional, sementara era Prabowo menghadapi dilema untuk menyeimbangkan pemulihan aset, penguatan kelembagaan, dan stabilitas politik. Efektivitas upaya antikorupsi di masa depan sangat bergantung pada konsistensi kemauan politik untuk menciptakan regulasi yang kuat, transparan, dan berorientasi publik.Kata Kunci: Korupsi, Politik Hukum, Kriminalisasi dan Dekriminalisasi, Komisi Pemberantasan Korupsi (KPK), Legislasi Antikorupsi.

Abstract

Land plays a strategic role not only as a place to live but also as a source of economic and social status. However, legal issues such as document forgery, duplicate certificates, and land grabbing still frequently occur. This study uses a normative juridical method to examine the cancellation of land certificates due to unlawful acts (PMH) based on Article 53 of the State Administrative Law and Regulation of the Minister of Agrarian Affairs and Spatial Planning/National Land Agency No. 11 of 2016. The principle of legal certainty in Article 19 of the UUPA is an important basis for resolving land disputes. The case study of the Karawang District Court Decision No. 58/Pdt.G/2020/PN.Kwg, which was upheld by the Bandung High Court No. 207/PDT/2021/PT.BDG, emphasizes the importance of caution by land officials and the application of the principle of ius curia novit and the social function of land as regulated in Article 6 of the UUPA.
