Abstract

Allah Subhanahu wa Ta’ala makes a woman something beautiful in the eyes of men. One of Satan's temptations for men is a woman's problem. Allah Subhanahu wa Ta'ala also ordered the Muslim women to wear hijab by wearing a veil that could cover their heads and chests. Tegal Besar is a sub-district in the Kaliwates sub-district of Jember, East Java. The formulation of the problem in this study is about: (1) the driving factors and stages that are passed by Muslim women in wearing the veil, (2) the challenges faced and pleasures felt by Muslim women after wearing the veil, (3) hadith and atsar which make Muslim women to use veils. The approach in this study is to use a qualitative approach, with this research model is the study of living hadith. The results of this study indicate that: (1) There are 7 driving factors for Muslim women to veil and there are 6 stages that are passed by Muslim women until they succeed in wearing the veil. (2) There are two challenges faced by Muslim women after wearing the veil, namely: accused of following cults and being criticized by people, but they also feel their own pleasure after they continually wear the veil. (3) There are texts on theorem that make Muslim women use veils, both from the traditions of the Prophet Shallalahu aih alaihi wa Sallam and from atsar from Sahabat and Tabi’in.

Abstract

There are two sides of view that need to be compromised, groups that carry radical, extremist and secular, liberal and nationalist groups. Each of them mutually clasps the one-sided truth, as if the religious and nationalist circles are two angles of a triangle that would not be possible to find. Nationalists view that the application of sharia regulations is an effort to place Muslims as an exclusive and special community in this country and place other people as second-class citizens. On the other hand radicals consider that the current system of government is in contradiction with the Islamic range absolutely, total and radical changes must be made.So this research tries to open the discourse of moderate thinking in addressing this problem, not extreme left and not right extreme. The main subject of this study will be based on three issues, sharia regulations in constitutional review, historical facts about the application of Shari'ah on Nusantra and sharia law in the review of Islamic Aqeedah. This study was conducted in the form of literary literature studies using the induction approach using qualitative analysis.The conclusion of this study, that the application of sharia regulations is part of actualizing constitutional orders into real life. Part of sharia law is valid in the unitary State of the Republic of Indonesia. Doing radical methods such as coups and for example in attempting to adopt sharia law is contrary to sharia law itself.

Abstract

مما قد علم بالنصوص الشرعية أن البدعة في الشرع كلها ضلالة، وليس منها شيء حسن، وأن العمل إذا تبين كونه بدعة فهو باطل ومردود على صاحبه، إلا أن أصحاب البدعة لهم شبه وحجج يتشبثوا بها في تحسين البدع وتبريرها وترويجها بين الناس. وقد ذكر أهل العلم من جميع المذاهب قواعد وأصولا يمكن من خلالها معرفة بطلان البدعة وردها ودحض شبهات أهلها. فهذا البحث المتواضع مشاركة في بيان هذا الأمر وذلك من خلال أقوال علماء الشافعية رحمهم الله. وقسمته إلى مقدمة تشتمل على خلفية البحث وتحديد المسألة ومنهج البحث، ثم موضوع البحث ويشتمل على تعريف البدعة لغة واصطلاحا، وتعريف القاعدة وأهمية معرفتها، وقواعد في رد البدعة في نظر علماء الشافعية، ثم الخاتمة وفيها ذكر نتائج البحث. وهذا البحث يُعدُّ من البحوث المكتبية التي تعتمد على المنهج الكمي (Kuantitatif) الذي يقوم بجمع أقوال علماء الشافعية من بطون مؤلفاتهم المتعلقة بهذه المسألة، وأما ما يتعلق بعرض البيانان وتقريب المعلومات للوصول إلى نتائج البحث فيستخدم المنهج الوصفي (Deskriptif) والاستقرائي (Dedukatif) وتحليل المحتوى (Analisa isi). ومن خلال دراسة أقوال هؤلاء العلماء واستقرائها وتحليلها يمكن تلخيص القواعد لرد البدعة في الأمور التالية: 1) الأصل في العبادة المنع أو التحريم، ويندرج تحت هذه القاعدة: أن العبادة لا تبنى على القياس، وأن الثواب على العمل مبني على التوقيف أيضا، 2) كل بدعة ضلالة، 3) درء المفسدة مقدم على جلب المصلحة، 4)النية الحسنة غير كافية في قبول العبادة،5) الاحتياط في موافقة السنة والاقتداء بسلف الأمة 6) الكثرة ليست دليلا على الحق، وإنما الحق موافقة الكتاب والسنة.

Abstract

الأمر الذي دفعني إلى اختيار هذا الموضوع قول الإمام الحاكم رحمه الله في تعريف الشاذ اصطلاحا حيث إنه عرَّفه بتفرد الثقة. بينما الآخرون من العلماء كالإمام الشافعي و ابن الصلاح وابن حجر وغيرهم رحمهم الله عرفوا الشاذ بأمرين هما : تفرد الثقة مع وجود المخالفة لمن هو أولى منه. واعتبروا أن الشاذ من أقسام الحديث الضعيف, وأما مجرد تفرد الثقة بحديث فلا يحكم عليه بالشذوذ. و أشكل علينا تعريف الإمام الحاكم بالنظر إلى غرائب الصحيحين, كيف يحكم عليها بالشذوذ مع أنها صحيحة؟ وما المراد بالشذوذ عنده هل هو مردود أم مقبول؟ وإذا كان المراد بالشذوذ تفرد الثقة كما ذكره في معرفة علوم الحديث فهل التزم الإمام الحاكم بتعريفه بعد تطبيقه في الأحاديث المحكوم عليها بالصحة والشذوذ معا في مستدركه ؟ فأقوم بتخريج الأحاديث التي حكم عليها الإمام الحاكم بــالصحة والشذوذ معا في مستدركه مع دراسة أسانيدها بعد جمع طرقها لمعرفة درجتها ومعرفة مدى التزامه بتعريف الشذوذ الذي هو تفرد ثقة عنده بعد تطبيقه في تلك الأحاديث. والنتيجة التي توصلت إليها: أن الأحاديث التي حكم عليها الحاكم بالشذوذ والصحة معا في مستدركه ثلاثة أحاديث فقط. ودرجة تلك الأحاديث كما يلي: الحديث الأول أنه صحيح، تفرد به إبراهيم بن زياد وهو ثقة. والحديث الثاني: حسن لغيره، تفرد به جعفر بن برقان وهو ثقة. والحديث الثالث: حسن لذاته، تفرد به الهيثم بن حميد وهو ثقة. وقد التزم الحاكم بتعريف الشاذ الذي هو تفرد ثقة عنده. والله أعلم.

Abstract

Every Muslim is certainly afraid to commit immorality to Allah subhanahu wa ta'ala, because he is aware that all forms of disobedience to Him are sin. However, sometimes the act done by someone is unwittingly has the potential to give birth to immorality. On the one hand, maybe the person is not aware of this potential; because basically there is no intention of him at all to act. But on the other hand, those who witnessed this saw that disobedience was the result of that action, so they were motivated to do the same thing, especially those who indeed wanted the immorality from the beginning. This paper examines thoroughly the laws relating to cases that have the potential to become immoral immorality.

Abstract

Husband has been settled as a leader in the household according to the guidance of the shariah. One of the main tasks of a husband is to protect his wife and children from things that can harm them, both in this world and the hereafter. One of the things that can harm them is the utterance of hatred which has lately been used very much among the people, especially in various existing information technologies. Technological advances have made human life easier, and usually every increase in speed is followed by heavier risks. Through this research, the writer wants to reveal the tips of the Prophet (Peace be Upon Him) in educating and fortifying his family from bad speech such as utterances which spread hatred in the community. It can cause the background of the occurrence of widow status in women. By knowing these tips, it is hoped that the community can emulate them.

Abstract

Seeing the development of increasingly advanced technology and influencing children's development, it is necessary to have a concept for parents in maintaining the nature of their children, therefore the concept of Maqashid Al-Sharia in safeguarding the child's nature, is expected to be a solution for educators, especially parents. The method used in this study is a qualitative non-interactive analytical concept method, which is a study that explains the meaning of a concept, by describing the general or important meaning, different meanings, and usage according to the concept. Researchers also explained the nature of the Al-shariah maqashid, namely to realize the benefit in the world and the hereafter. While the benefits based on the level of needs are divided into three categories, namely; dharuriyyat (primary benefit), hajiyyat (secondary benefit) and tahsiniyyat (tertiary benefit). The primary types of children are classified into eight types, eight of them are the nature of the faith, the nature of learning and reasoning, the nature of talent and leadership, the nature of development, the nature of sexuality and love, the nature of aesthetics and language, the nature of individuality and sociality, the nature of physical (physical and sensory). In this study, it will be linked between maqashid Al-sharia with the nature of children. Then the researchers form the concepts created in the form of tables and charts, which will be known estuaries from the concept, which all lead to parents.

Abstract

The word “sarapan” (breakfast) comes from the word “sarap” which is added a suffix “an.” The word “sarap” is a verb which means eating something in the morning. Breakfast is food that is eaten in the morning before doing activities and it is eaten approximately one third of the food in a day. Breakfast gives a lot of benefits for the health of our body. It will be more enjoyable if it is done together. Bangah is a village located in the Gedangan district in Sidoarjo, East Java. The formulations of the problem in this research are about: (1) the concept of procuring breakfast together after Sunday morning recitation, (2) the benefits of having brakfast togehter after Sunday morning recitation, (3) the hadiths that recommend to feed others and eat together. The research in this study uses qualitative research with the study of living hadith as its research model.The results of this study indicate that: (1) the concept of procuring breakfast together after Sunday morning recitation starts from the desire to apply knowledge about the virtues and a great reward for those who feed the prosecutors of knowledge.The source for funding the activities are from the donations of the worshipers and the donors of the mosque, (2) the activity of having breakfast together after Sunday morning recitation brings a lot of positive benefits personally and socially, (3) there are hadits that recommend to feed other people and eat together.

Abstract

Everyone wants success. To achieve it, there are many supporting factors. Some can run well, but some can become obstacles. The success of the hadith scholars also do not escape from those obstacles. The economic factor is an example of their obstacles. However, they do not make it as a problem in thier study. From those different economic factors which make them success, it then creates some questions. How are their condition in their studies? Is economic condition a problem? What are the evidences, so they are said to be successful? And what are the factors that make them success? In this study, the author tries to find the authentic sources in tracing their lifes in trusted books, so the authors find that the economy is not an obstacle for them. Their success was also obtained from several factors including the recognition of the scholars, the book they wrote, the success factors in the Diwan Al Imam Al-Shafi'i, the piety and the support from their closest people.

Abstract

Extracurricular activities are student activities that include reasoning and science, interests and hobbies, efforts to improve student welfare and social service for the community. In this regard, STDI Imam Syafi'i Jember participated in developing the interests and talents and potential of students to be able to compete in the era of globalization. One of the student activity units formed was the Research Rijal Student Activity Unit. Research on this UKM is needed. The reason is because the making of scientific papers that are the product of this unit is a hard thing for students in general.This study aims to explain the cause of students lack of interest in making scientific papers, factors driving students to join Research Rijal UKM, and the contribution of these UKM in improving scientific writing. This research uses a qualitative approach with the type of case study. Data is described descriptively. The analysis used is inductive analysis. Based on its scope, this study takes one site. Data was collected from several documents, observations, and interviews with 17 informants. The main informants in this study were 13 students of the Hadith Sciences Study Program. Then supplemented with additional informants from 3 Ahwal Syakhsiyah Study Program students and P3M supervisors.This research produces several conclusions. First, that the cause of students' lack of interest in making scientific papers is because: (a) students are less interested in writing, (b) lack of ideas and ideas, and (c) the rules for writing scientific papers that are relatively complicated. Second, the factors driving the students of the Hadith Science Study Program to join Research Rijal UKM include: (a) they want to learn the methodology of writing scientific papers, (b) foster interest in reading, (c) practice critical habits of scientific papers, and (d ) develop general writing skills. Third, the contribution of UKM Rijal Research includes (a) giving special lectures to UKM members on how to make good scientific journals and (b) providing further guidance in the completion of scientific papers.
