Abstract

The debate on the transmission of hadith by meaning is not something new. The root of this issue arose due to statements from the Prophet Muhammad that prohibited it, while in other narrations, the Prophet permitted it. The permissibility of transmitting by meaning is feared to lead to a change in the meaning of the hadith as a consequence of textual changes. Muslim scholars, including Muhammad Amin Al-Syinqithiy, have set conditions and limitations regarding the transmission by meaning and who is allowed to do it. He established these conditions and limitations so that narrators who had difficulty transmitting verbally could narrate so by meaning as a form of facilitation. These conditions and limitations also ensure to prevent narrators who transmit by meaning from being reckless, ensuring the authenticity and originality of the hadith, protecting it from distortion and fabrication. By adopting the title of this research, the researchers aim to understand the legal status of transmitting by meaning and what conditions and limitations apply when doing so. This research uses a qualitative literature-based approach, and based on the findings, the researchers employ a descriptive research method. The result of this research is that the transmission of hadiths by meaning is permissible according to Al-Shinqiti, but there are strict conditions and obligatory limitations that must be fulfilled when transmitting them.

Abstract

ndonesia is currently in a state of emergency for adultery. The National Commission on Human Rights of the Republic of Indonesia, on its official website (2019), informs that the number of commercial sex workers (PSK) in Indonesia reaches around 230,000 people. This condition should be of concern to the government as a regulator. This research aims to analyze and compare the polygamy regulations in the Law of the Republic of Indonesia Number 1 of 1974 and the Egyptian Family Law Number 100 of 1985 from the perspective of Islamic law and maqashid sharia. This research is library research. The data analysis technique in this research is content analysis and comparison. This research concludes that first, in the polygamy regulations in Indonesia, there are requirements that are very difficult to fulfill by most husbands who want to be polygamous, namely that the court only grants permission to be polygamous if the first wife or wives are in an incurable disability or illness, cannot bear offspring, and must be with the consent of the first wife or wives. Meanwhile, the polygamy regulations in Egypt include requirements that can generally be fulfilled by husbands who want to practice polygamy, namely that they only have to explain their marital status in the marriage certificate, make a statement letter including the names of their wives and their places of residence, and the notary must notify the first wife about the new marriage. Then, polygamy can be carried out officially without permission from the court. Second, the polygamy regulations in Indonesia and Egypt are basically both built on maslahah considerations, but what distinguishes the two is that in the polygamy regulations in Indonesia there are provisions, as mentioned above, are not relevant to Islamic law because the potential harm that will arise is greater than the maslahah that will be achieved. The polygamy regulations in Egypt are all relevant to Islamic law. Third, the polygamy regulations in Indonesia and Egypt are basically both able to facilitate the realization of maqashid sharia, but what distinguishes the two is that in the polygamy regulations in Indonesia there are provisions, as mentioned above, that can hinder the process of realizing two maqashid sharia, namely protecting religion and offspring. The provisions of polygamy in Egypt are all relevant to maqashid sharia, especially in terms of protecting religion and protecting offspring. The theory found in this research is kullu tanzhimin mabniyyin 'ala al-masya'ir wahdaha, fa-inna mafsadatahu takunu a'zham min al-mashlahah al-murad tahqiquha (every regulation that is built on the consideration of feelings alone, then the mafsadah will be greater than the maslahah to be achieved). This theory is strengthened by the finding that 73.01% of polygamy requests in Indonesia were rejected, even though 34.8% of them were approved by the old wives.

Abstract

Waqf is a form of worship which in the Qur'an is referred to as al-habs, a synonym for the word al-waqaf, namely someone's property that is given to the public so that it can be used as long as the item is still there. Along with the large need for funds for the benefit and locations spread outside the area for the wakif, the idea of ​​cash waqf emerged. With the convenience of cash waqf, people can easily spend their wealth as waqf in religious ways. This research aims to understand the law of cash waqf in the study of fiqh, by looking at several views of fiqh scholars regarding cash waqf and its benefits from a maqasid sharia perspective. This research uses a qualitative-descriptive approach with content analysis techniques in library research and problem analysis using maqasid asy-syariah theory. The results of the research show that the jurists have different opinions in determining the law on cash waqf. Some scholars believe that cash waqf is permissible. Others view the law as makruh. There are even scholars who prohibit it. The results of the study show that cash waqf is in accordance with the principles of maqasid sharia, namely to improve the economy and obtain benefits in this world and the hereafter.

Abstract

Disputes between husband and wife sometimes lead to divorce. Some cases of divorce are caused by husbands, such as domestic violence, not providing support, cheating and so on. Sharia provides a way for wives to file for divorce. This lawsuit is of course based on justifiable reasons. This research examines the sentiments of students majoring in Family Law (HKI) at STDIIS semester 3 classes A, B, D regarding Decree Number: 1622/Pdt.G/2023/PA.JB regarding divorce cases, division of joint assets, and hadanah. A quantitative approach is used to better understand students' perspectives on certain legal decisions. Data was collected through a structured questionnaire given to a sample of HKI STDIIS students in semester 3 classes A, B, D. The Naive Bayes method using the Rstudio application and Orange software, it was concluded that the method and software used were effectively able to produce reliable analysis results. The accuracy of the Naive Bayes method in classifying user sentiment is reflected in the high level of accuracy, namely 72.3%. With the help of Orange software, the sentiment analysis process becomes more efficient and reliable, as evidenced by the achievement of Precision: 76.4% Recall: 72.3% F1 Score: 73.4%. This combination of methods and software proves its ability to carry out in-depth and reliable sentiment analysis of STDIIS IPR Students' reviews of Decision Number 1622/Pdt.G/2023/PA.JB regarding divorce cases, division of joint assets, and hadanah.

Abstract

This study aims to explore the differences in perspectives between Malthusianism and Islam regarding reproductive issues. The research method employed is a qualitative literature review. The findings reveal that Islam holds a distinct viewpoint from Malthusianism concerning reproduction and population growth. While Malthusianism advocates for reproductive restrictions and population control, Islam encourages having children without limitations, emphasizing the importance of upbringing to raise righteous individuals, as well as efforts to meet their daily needs and recognition of women’s reproductive rights. This perspective is reflected in numerous religious texts urging Muslims to have many offspring. However, Islam does not advocate for increasing the number of children except with careful consideration within the framework of Allah's Sharia. Therefore, the theory proposed by Thomas Robert Malthus is not suitable for implementation by devout Muslims. The significance of this research lies in guiding Muslims to adhere to their religious teachings in managing reproductive issues and population growth.

Abstract

The family has an important position in Islam as the first and main place of education in the growth and development of a Muslim. Maintaining the integrity of the family is highly recommended in Islam. One of the factors that triggers the breakdown of family resilience is the difficulty of meeting economic needs which leads to shortcuts by gambling online and online loans with usury. Islam offers various solutions such as zakat, sadaqah and cash waqf. This research seeks to answer how the role of cash waqf in strengthening the resilience of Muslim families. This research uses a qualitative method with a type of library research. Primary data sources are Islamic jurists’ opinions, MUI fatwas and statutory regulations; secondary data are books, journals, documents and related research. Data collection uses data documentation and analysis by collecting, reducing, presenting, and concluding the results. The results of the research show that cash waqf can play a role in strengthening Muslim families with the qardhul hasan method, nazir cooperation with Muslim families in cash waqf, and investment of cash waqf to distribute its profits to Muslim families.

Abstract

Basically, polygamy in Islam is permissible. In fact, according to some scholars, the original law for marriage is polygamy, except for those who are afraid of not being fair, then they are permitted to marry one woman. However, some people in Indonesia have different views on polygamy, some consider it normal and some consider it inappropriate for someone who is good and has authority in society. The government neither agrees nor absolutely rejects people's views on polygamy, but they provide difficult conditions for anyone who wants to practice polygamy. If one pays attention to these conditions it is difficult to fulfill, making it almost impossible for a husband to legally practice polygamy according to the law. One of the conditions that is very difficult for a husband who wants to be legally polygamous is to obtain written permission from his wife. In fact, in Islamic law, a husband who wants to practice polygamy is not required to ask permission from his wife. On the other hand, the presence of Islamic sharia actually has a specific purpose. These goals have been compiled by the scholars with the term maqashid sharia. The principles of maqashid sharia are reflected in various matters in Islamic law, including the law on monogamous and polygamous marriages. With the difficulty of procedures and requirements for polygamy in Indonesia, it is feared that it will become an obstacle to achieving maqashid sharia through this polygamy sharia. The researchers are interested in conducting deeper research related to the suitability of polygamy procedures and requirements in Indonesia with the principles of maqashid sharia.

Abstract

تناول هذا البحث عن أنواع الاشتقاق الواردة في مؤلفات ابن تيمية وتم احتجاجها في المسائل العقدية. الاشتقاق هو أحد الطرائق لكشف معاني الألفاظ بالرجوع إلى جذور الكلمات لنيل معانيها الدقيقة. يستنتج هذا البحث أهمية اللغة العربية لحفظ الدين ولا سيما في المسائل العقدية إذ إنها أصل الأصول. ونوع منهج البحث الذي تم استخدامه هو المنهج الوصفي التحليلي، ويكتشف به أنواع الاشتقاق الثلاثة وهي الأكبر والأوسط والأصغر لدى ابن تيمية مع المسائل العقدية المتعلقة بها. وهذه الاشتقاقات أيضا سبق تناولها عند القدامى من الحاة واللغويين.

Abstract

The niqab or veil, as a manifestation of religious identity, has been a subject of societal discussion, with perspectives often centered on issues of autonomy, cultural diversity, and perception. This study aims to reveal the Islamic creed perspectives of wearing-niqab students in an academic environment and examine the understanding of wearing-niqab students’ attitudes toward themselves, their experiences wearing the niqab, interactions with the campus environment, and their perceptions of how other members of the academic community perceive them. The researchers surveyed a sample of 177 female students from 2 colleges affiliated with the Salafi Manhaj in East Java Province, namely STDI Imam Syafi'i Jember and STAI Ali bin Abi Thalib Surabaya. The survey used Likert-type items. The findings of this research are: 1) 65% of wearing-niqab students choose to wear the niqab based on their Islamic creed and the majority (84.2%) of respondents believe that the law of wearing niqab is sunnah, and it’s believed as a form of worship and obedience to Allah and His Messenger. 2) the majority of the respondents (94.9%) felt very confident, while only a small proportion of respondents (5.1%) felt very insecure, and all of the respondents see themselves as part of Indonesian society. 3) most of the respondents (82.5%) have been wearing the niqab consistently since they were teenagers, all respondents never get bullied while on campus and just a small proportion of them (10.8%) often get bullying off campus and the majority of them are open minded people and wants to interact with society.

Abstract

This article explores aspects of gender equality in the context of divorce, with a study focus on the hadith that discuss divorce actions taken by women. This study aims to explore a deeper understanding of the Islamic view of divorce initiated by women and its impact on gender equality in society. By detailing the various relevant hadiths, the study analyzes the context, law, and wisdom behind the ruling. The results of this study show that women can terminate their marriage by filing a khul' (sue for divorce) before a religious court. With this, it is hoped that every married couple has the awareness to carry out their duties and treat their spouses well, so that the harmony and integrity of the household can be maintained.
