Abstract

The objective of this study is to analyze the concepts of social philosophy in al-Qur 'an, especially the theory of conflict. By making use a Thematically  Approach, and of a Historical and Socio-Anthropological interpretation and analysis, it finds some concepts of Islamic social philosophy which has differences in confronting with a modern (Western) concept of conflict. It also finds the impact of these concepts in Islamic tradition of social transformation by the Muhammad saw era.

Abstract

The presence of SEMA Number 3 of 2018, which prohibits polygamy marriage, hurts women. This is because women do not have legal power over their marriages and cannot access the legal umbrella through the only way, namely the isbat of marriage. The logical consequence of this is that when their husbands neglect siri polygamous women, women undoubtedly have difficulty demanding their rights and difficulties in giving up their status. This study seeks to dissect the interests of polygamous siri women by considering aspects of their benefit. The study's focus is to answer how the position of polygamous marriage when juxtaposed with women's interests is still prohibited or allowed. The study carried out was a normative study with the maslahah mursalah Al-Shatiby as the analysis tool. The final hypothesis illustrates that it is precisely the prohibition of marriage to have an impact on women. This is because the maslahah of prohibiting marriage is assumptive, while the negativity of a woman whom her husband ignores is factual. Therefore, the prohibition of SEMA number 3 of 2018 must be re-read and studied more deeply in the interests of polygamous women in siri.   Abstrak: Hadirnya SEMA Nomor 3 tahun 2018 yang melarang isbat nikah poligami berdampak mudlarat atas perempuan. Pasalnya perempuan tidak memiliki kekuatan hukum atas pernikahannya dan tidak bisa mengakses payung hukum melalui satu-satunya jalan yakni isbat nikah. Konsekuensi logis dari hal tersebut adalah ketika perempuan poligami siri diabaikan oleh suaminya, niscaya perempuan kesulitan menuntut haknya dan kesulitan pula melepaskan statusnya. Kajian ini berusaha membedah kepentingan perempuan poligami siri dengan mempertimbangkan aspek kemaslahatannya. Fokus kajian guna menjawab bagaimana kedudukan isbat nikah poligami jika disandingkan kepada kepentingan perempuan apakah tetap dilaranga atau diperbolehkan. Telaah yang dilakukan bersifat kajian normatif dengan maslahah mursalah Al-Shatiby sebagai pisau analisisnya. Hipotesa akhir menggambarkan bahwa justru pelarangan isbat nikah berdampak mudlarat kepada perempuan. Sebab maslahah pelarangan isbat nikah bersifat asumtif sedang kemudlaratan perempuan yang diabaikan suaminya bersifat faktual. Oleh karena itu pelarangan SEMA nomor 3 tahun 2018 harus dibaca ulang serta dikaji lebih dalam demi kepentingan perempuan yang dipoligami siri.

Abstract

My academic concern is that so far, some studies tend to look at economic recovery, during the COVID-19 period, focusing on planning, economic and social, economic and health, economic and political, economic and distribution, economic and monetary transmission. No researcher focused on the problems: how is the performance of the individual approach used by the government in solving economic problems? What constraints are experienced in problem-solving? and how is the community approach of the Quran as a solution to the economic recovery model? By using participatory action qualitative research and content analysis of the Quranic text, the result shows that community-based, using the qur’anic paradigm, can be a monetary recovery system based on religious, social spirit. This, at the same time, confirms the significance of the community-based development approach, combined with the values of the Qur'an, in solving community economic problems, due to the COVID-19 pandemic. The findings of the study term the pattern of economic recovery with the community approach have advantages, compared to the individual approach used by the government. The study also finds that the community's policy in economic recovery opens up more opportunities for the financial independence of the community. By using the community Passing-Loos Management System (CP-LMS), the concept of the Qur'an charity values, as the basis of the religious majority of Indonesian society, the community-based approach can be the foundation of Pancasila's economic development. Thus, the results of this study indicate that the pattern of integration, between the values of the Qur'an and the Pancasila economic system, as the SDGs authorized, can present an independent community economic system.

Abstract

TujuanPenelitian ini bertujuan (1) Untuk memahami, mendeskripsikan, dan menganalisis bagaimana Ponpes Sidogiri mengelola unsur-unsur modal sosial kaitannya dalam mengembangkan KJKS. (2) Untuk memahami, mendeskripsikan dan menganalisis peran modal sosial Ponpes Sidogiri dalam mengembangkan KJKS.Desain/metodologi/pendekatanMetode penelitian atau pendekatan yang digunakan adalah Pendekatan kualitatif dengan paradigma penelitian dramaturgi,  yakni fokus pada bagaimana peran modal sosial dalam pengembangan kjks bmt Maslahah dan BMT UGT Sidogiri.  Langkah penelitian diawali dengan pengumpulan data dari dokumentasi,  observasi dan wawancara mendalam. Selanjutnya dilakukan reduksi data dan dilanjut dengan pengecekan keabsahan data. Setelah itu dianalisis dengan mengintegrasikan data dengan teori untuk kemudian sampai pada kesimpulan.Hasil temuanHasil penelitian menunjukkan bahwa pertama,  dalam upaya optimalisasi pengelolaan modal sosial yang dimiliki,  Ponpes Sidogiri melalui beberapa cara mengolah unsur-unsur modal sosial.  Kedua,  modal sosial ponpes Sidogiri berperan mengembangkan BMT melalui unsur jaringan,  kepercayaan, nilai dan norma.Keterbatasan penelitianPertama,  pengumpulan data terkait Ponpes Sidogiri belum seluruhnya.  Peneliti belum bisa mengumpulkan data terkait santri putri karena peraturan yang berlaku di Ponpes Sidogiri. Kedua, penelitian ini hanya fokus pada bagaimana peran modal sosial Ponpes Sidogiri dalam mengembangkan Kjks padahal masih banyak hal yang bisa dieksplor. Namun hal ini berkaitan dengan keterbatasan waktu dan metode penelitian.Implikasi praktisMenjadi stimulan bagi pihak pengambil kebijakan pondok pesantren dan pemerintah untuk menunbuhkembangkan ekonomi syariah.  Tidak menutup kemungkinan pula hasil penelitian ini dijadikan blueprint untuk diadopsi oleh semua pondok pesantren berpartisipasi dalam mengembangkan ekonomi syariah.  Selain itu,  implikasi praktisnya dapat memperluas potensi perkembangan ekonomi syariah di Indonesia melalui pesantren.Implikasi sosialDapat dijadikan bahan refenrensi bagi penelitian selanjutnya yang melakukan penelitian serupa.  Menambah khazanah keilmuan bagi pondok pesantren dan kalangan yang pedului akan ekonomi syariah.Orisinalitas/nilaiDari beberapa penelitian terdahulu dan kajian dengan tema yang serupa, belum ditemukan kajian yang sama, jadi penelitian ini dengan judul Peran Modal Sosial Pondok Pesantren Sidogiri dalam Mengembangkan Koperasi Jasa Keuangan Syariahmerupakan penelitian baru.Kata kunci:Peran, Modal Sosial, Pengembangan, BMT.

Abstract

The practice of dividing pre-death inheritance in Pehserut Village is an inheritance phenomenon that follows Javanese customary law by prioritizing several aspects of mutual benefit, but the inheritance distribution model that occurs in the Pehserut Village community does not get legality in classical Fiqh or Indonesian positive law. Moreover, the Islamic community in Pehserut Village which incidentally is oriented to the opinion of Sunni scholars on fiqh issues, which distinguishes between the terms grant, will, and inheritance. This article aims to describe the aspects that become the background of the Pehserut village community in carrying out the distribution of the pre-death inheritance of the heirs, as well as understanding the distribution of pre-death inheritance in the Pehserut Village community from the perspective of progressive legal theory. The method used in this paper is a field study, data obtained by interviewing several relevant sources and supplemented with supporting documentation. The results of the study concluded that the distribution process used a method similar to grants and wills, but the Javanese people of Pehserut Village did not call it that but called it the term 'inheritance'.Distribution of Pre-Death Inheritance, Javanese Islamic Community Inheritance, Progressive Law.

Abstract

Feminist discourse is always actual, inexhaustible and not tired of being discussed. When we are saturated with the problem of emancipation, then we speak feminism and gender equality, even now being warmly discussed the issue of violence against women. This paper discusses the truth of the Qur'anic concept of the potential of female violence supported by various social facts. Nowadays women's violence is much faster than men do. The crime of women is not only murder, robbery, mistreatment, demolition and theft, mugging, pickling and burning of houses, but also rape with violence. Therefore, it is necessary to reconstruct the concept of women's empowerment that can eliminate, or at least minimize the possibility of polarization of women violence. This is because clearly in Indonesia the phenomenon of women's violence, both in the family and the public, the more transparent. In the view of the Qur'an, violence to anyone, any gender, and to any group, is not justified and contrary to humanitarian values Diskursus keperempuanan memang selalu aktual, tak habis- habisnya dan tak bosan-bosannya dididiskusikan. Ketika kita jenuh dengan masalah emansipasi, kemudian kita berbicara feminisme dan kesataraan jender, sekarangpun sedang hangat didiskusikan masalah kekerasan terhadap perempuan. Tulisan ini membahas kebenaran konsep al-Qur’an tentang potensi kekerasan perempuan yang didukung fakta sosial yang beragam. Dewasa ini kekerasan yang dilakukan oleh perempuan jauh lebih cepat meningkat dibandingkan yang dilakukan oleh laki-laki. Kriminalitas perempuan tersebut tidak hanya pembunuhan, perampokan, penganiayaan, pembongkaran dan pencurian, penjambretan, pencopetan dan pembakaran rumah, tapi juga perkosaan disertai kekerasan. Untuk itu perlu rekonstruksi konsep pemberdayaan perempuan yang dapat menghilangkan, atau setidaknya meminimalisir kemungkinan terjadinya polarisasi kekerasan perempuan. Hal ini karena jelas di Indonesia fenomena kekerasan perempuan, baik dalam keluarga maupun publik, semakin transparan. Dalam pandangan al-Qur’an, kekerasan pada siapapun, jenis kelamin apapun, dan pada kelompok manapun, tidak dibenarkan dan bertentangan dengan nilai-nilai kemanusiaan

Abstract

Indonesian Muslims when faced with social problems, especially those related to law and justice, always involve the dualism of thought, Islam and kindonesiaan. When human rights issues arise, the unification of Indonesian Islam seeks to justify the problem into its shari'ah. This is normal, because Islam is believed not only mngatur spirituality of his people, but also related to social rules. This paper tries to explain what Muslims can do as the majority of their beloved country's people in dealing with human rights issues. Besides, the effort to enforce the law for internal Islamic and national interests. This paper also discusses how the Islamic perspective is about this. Discussing human rights issues can not be separated from how the principle as stipulated in Islam. The substance that need to be put forward is the fulfillment of the right of life security and the right of freedom to choose religion or belief. Similarly, the right of equality and justice before the law. Therefore, it is necessary to implement the strategy of human rights by considering three priorities. First, that Islamic law is universal. Secondly, Islamic law is never retroactive. Third, that Islamic law does not impose burden except on the perpetrators. Umat Islam Indonesia apabila dihadapkan pada permasalahan-permasalahan sosial, terutama yang berkaitan dengan hukum dan peradilan, selalu melibatkan dualisme pemikiran, keislaman dan kindonesiaan. Ketika permasalahan Hak Asasi Manusia (HAM) muncul, uniat Islam Indonesia berusaha mencarikan justifikasi permasalahan tersebut ke dalam syari’atnya. Hal ini wajar-wajar saja, sebab Islam diyakini tidak sekedar mngatur spiritualitas umatnya, tetapi juga menyangkut aturan-aturan sosial. Tulisan ini mencoba menjelaskan apa yang bisa diperbuat umat Islam sebagai mayoritas masyarakat negerinya tercinta dalam menghadapi permasalahan hak asasi manusia. Selain itu dibahas upaya menegakkan hukum untuk kepentingan internal Islam dan nasional. Tulisan ini juga membahas bagaimana perspektif Islam mengenai hal ini. Membahas permasalahan HAM tidak lepas dari bagaimana prinsipnya sebagaimana diatur dalam Islam. Secara substansif yang perlu dikedepankan yaitu pemenuhan hak keamanan jiwa dan  hak kebebasan memilih agama atau keyakinan. Demikian pula hak kesamaan dan keadilan di depan hukum. Untuk itu diperlukan strategi implementasi hak asasi manusia dengan mempertimbangkan tiga prioritas. Pertama, bahwa hukum Islam bersifat universal. Kedua, bahwa hukum Islam tidak pernah berlaku  surut. Ketiga, bahwa hukum Islam tidak memberikan beban kecuali pada pelakunya.

Abstract

Not a few campus communities, either within the Ministry of Religious Affairs or the Ministry of National Education, who have not or deliberately failed to understand the necessity of Islamization of science. In fact, in the world of global science, many scholars believe that since the last half of the twentieth century it is a revival of Islam (the renaissance of Islam) which is at least characterized by the rise of the Islamization of science, economics, social, politics and so on. Methods of thinking and research methods are the foundation of the development of science, then both are actually an applicative form of the whole paradigm and the world view of the flow of knowledge. Islamization of thinking methods has duality characteristics, Mutawassith characteristics, and formulative characteristics. The research methods developed in both classical and modern Islamic times need to be reconstructed to give birth to the methods expected in Islam. For that reason, it takes dialogue simultaneously to contribute greatly to the creation of an Islamic civilization. Tidak sedikit masyarakat kampus, baik di lingkungan Departemen Agama atau Departemen Pendidikan Nasional, yang belum atau sengaja tidak memahami perlunya Islamisasi ilmu pengetahuan. Padahal, di dunia ilmu pengetahuan global, banyak pakar meyakini bahwa sejak paruh terakhir abad ke- 20 merupakan kebangkitan kembali Islam (the renaissance of Islam) yang setidaknya ditandai dengan timbulnya semangat Islamisasi ilmu pengetahuan, ekonomi, sosial, politik dan sebagainya. Metode  berfikir dan metode penelitian merupakan tumpuan dari pengembangan ilmu pengetahuan, maka keduanya  sesungguhnya merupakan bentuk aplikatif dari seluruh paradigma dan  world view aliran ilmu pengetahuan. Islamisasi metode berfikir memiliki karakteristik dualitas, karakteristik Mutawassith, dan karakteristik formulatif. Baik metode penelitian yang dikembangkan dalam Islam era klasik maupun modern perlu direkontruksi untuk melahirkan metode yang diharapkan dalam Islam. Untuk itu diperlukan dialog secara simultan untuk memberikan kontribusi yang besar terhadap terciptanya peradaban yang Islami.

Abstract

This study aims to examine the main arguments presented by Amina Wadud on inheritance in her book "Quran and Women" and evaluate the validity of her arguments. The scope of this research will include an analysis of Wadud's method of interpreting the Quran as outlined in the book Quran and Women which influenced her thoughts on Islamic inheritance and a critical study of her thoughts. This research is a type of qualitative research with a critical study approach. The results of the study show that a critical study of Wadud's thinking shows that she generalizes the 2:1 provision on the shares of men and women which actually only applies in certain cases. In addition, Wadud's demands for reinterpretation cannot be done without adequate interpretive science tools. Science explains that justice need not be interpreted as equality. There are two categories of justice, according to Aristotle: commutative justice and distributive justice. So that there can be no justification for questioning the Quran's just inheritance allocation. Furthermore, the provisions in the inheritance verse in the Quran are qath'i provisions so there is no justification for doing ijtihad which is presumptive (dzanny) in a reassuring text (qath'i). In addition, Wadud's thoughts are also considered less specific and do not provide a real format for how the redistribution she proposes. Therefore, Wadud's rereading in terms of inheritance is considered incomplete or incomprehensive of the Qur'an.

Abstract

This study aims to analyze the addition of the minimum age limit for marriage in law No. 16 of 2019 and its relevance to efforts to suppress requests for marital dispensation. This study used the library research method with a statutory and conceptual approach. The results of the study show that the formulation of changes to the minimum age limit for marriage in Law Number 16 of 2019 has implemented efforts to prevent early marriage. If viewed from the perspective of hikmatut tasyri', it contains an affirmation that the change represents the maintenance of maqashid sharia. Efforts to increase the minimum age limit for marriage are closely related to the impact of the surge in marriage dispensations received by the religious courts. The marriage dispensation actually applies to legal subjects who do not meet the minimum age criteria and if this minimum age limit is changed to a higher one, the relevance of the dispensation application will also increase. It can be seen that efforts to prevent early marriage are realized in the implementation of the minimum age limit, but the agenda of minimizing dispensation is the responsibility of justice enforcers, namely the panel of judges. Considerations given in the marriage dispensation judicial process are expected to prioritize physical, mental, sociological, and economic conditions.
