Abstract

Good law is law that is in accordance with the law that lives in society (the living law) and is in accordance with the reflection of the values that apply in that society. On progress, the main regulations of criminal law in the future which have been formulated in theRKUHP hasaccommodate the living law as part of positive law as stated in Article 2 paragraph (1) RKUHP. This research analyzes thethe conception of the rule of law that lives in society as regulated in Article 2 Paragraph (1) of the RKUHP in the context of the formation of national law. The results of the study showthat dthe implication of the principle of material legality in the RKUHP is wrong. If the formulation of the principle of material legality in Article 2 paragraph (1) of this RKUHP is not abolished and is still maintained, then the Indonesian legal system will experience a setback. Therefore, the enactment of the living law in society (the living law) in the national legal system is sufficient only to serve as the basis for the formation of national law.

Abstract

This study aims to gain an in-depth understanding and knowledge of the role of social media in shaping and preparing the compliant and law-aware millennial generation in an era of all-digital technology. The author believes that the existence of social media is phenomenal and that it has benefited many parties, including the millennial generation, to learn legal lessons and habits. For this reason, we searched data from several literature sources; then, we entered the stage of analyzing the data to understand and answer the issues and problems of this study with high validity. The review process involves a coding system and a comprehensive data evaluation to obtain relevant findings to answer the problem. Based on our in-depth study and discussion, we have found that social media plays a vital role in providing information, educational inspiration, and motivation for the millennial generation to become aware, obedient, and law-abiding people in Indonesia. Therefore, the government or any party committed to making the law aware should make social media one of the most innovative means of shaping and transforming the millennial generation to become a generation consisting mainly of law-conscious people. It is hoped that the results of this study will serve as a guide for future studies.

The methodology used in this research is a survey with sampling withproportionate stratified random sampling technique. Meanwhile, the formulation of the development model was analyzed using the Structural Equation Model (SEM) with PLS analysis tools. The results showed that most of thefishermen are dominated by fishermen of productive age with the status of fishermen who own boats and fishing gear with more than 30 years of experience as fishermen, andformal education level at the elementary level, but always attends counseling, and has a number of family dependents as many as 2-3 people.
