Abstract

The grant agreement is a unilateral agreement voluntarily made by the donor to the recipient. However, in practice, the grant agreement may be revoked due to a breach or the failure of the recipient to meet specific conditions. This article explores the legal basis for revoking a grant agreement due to breach, from both normative and sociological perspectives. The study finds that under certain conditions, such revocation is legally justified based on principles of justice, good faith, and propriety in civil law.

Abstract

 The enhancement of halal product assurance for Micro, Small, and Medium Enterprises (MSMEs) has become one of the strategic national agendas in realizing consumer protection for Muslims, as stipulated in Law Number 33 of 2014 concerning Halal Product Assurance. This study aims to analyze the role of the Halal Inspection Agency (LPH) of UIN Sunan Gunung Djati Bandung in facilitating halal certification for MSMEs in Cileunyi Subdistrict, as well as to examine its implementation from the perspective of Siyasah Dusturiyah. This research employs a juridical-empirical approach using a descriptive-analytical method, supported by primary data obtained through observation and interviews, and secondary data from literature studies and official documents. The results of the study show that the LPH plays an active role in providing education, technical assistance, and conducting halal audits, which have a positive impact on increasing the number of certified MSMEs, enhancing the sharia awareness of business actors, and improving product competitiveness. The challenges encountered include low halal literacy and a limited number of auditors. From the Siyasah Dusturiyah perspective, the implementation of halal inspections reflects the state's role in ensuring public welfare through synergy between religious institutions, the government, and society. This activity also serves as a concrete form of integration of the functions of Islamic higher education in socio-economic development based on sharia values.

Abstract

Abstract The transfer of fiduciary collateral objects without the creditor's approval is still often carried out by debtors, which according to the provisions cannot be done without the creditor's approval but is still carried out by the debtor, where when the debtor has difficulty paying off his receivables, there is no longer a collateral object that can be executed by the creditor in lieu of paying off the receivables. debtor. The formulation in this research is how to apply the law to perpetrators of criminal acts of transferring objects that are the object of fiduciary collateral without the written consent of the fiduciary recipient and what the judge's legal considerations are in handing down decisions regarding the transfer of objects that are the object of fiduciary collateral without the written consent of the fiduciary recipient in decision number 244/Pid.Sus/2021/PN Grt. The research method used in this research is a normative juridical research method. The normative juridical approach isan approach based on the main legal material by examining theories, concepts, legal principles and statutory regulations related to this research. Furthermore, based on the provisions in Article 36 of the Fiduciary Law, a Fiduciary Giver who transfers, pawns or rents out objects that are the object of Fiduciary Guarantee as intended in Article 23 paragraph (2) without prior written approval from the Fiduciary Recipient, will be punished with a crime. maximum imprisonment of 2 (two) years and a maximum fine of IDR 50,000,000 (fifty million rupiah). And the judge's legal considerations in handing downthe verdict in Decision Number 244/Pid.Sus/2021/PN Grt refer to the article charged by the public prosecutor against the defendant under Article 36 Jo. Article 23 paragraph (2) Law No. 42 of 1999 concerning Fiduciary Guarantees. Based on the facts revealed during the trial, the Judge concluded that all the elements of the article were fulfilled so that the defendant was legally and convincingly proven guilty of committing the crimi al act of transferring objects that were the object of fiduciary collateral without the written consent of th e Fiduciary Recipient.

Abstract

The Constitutional Court Decision Number 176/PUU-XXII/2024 is a judicial response to the normative vacuum regarding the right of elected legislative candidates to resign, as previously unregulated in Law Number 7 of 2017 concerning General Elections. The right to resign, which was previously not strictly limited, has created a loophole for abuse of power that negatively impacts the integrity of elections and the sovereignty of the people. This study aims to analyze the limitation of this right through three main approaches: constitutional-legal analysis, legal implications, and the perspective of siyasah dusturiyah. The research method used is a normative and conceptual legal approach, strengthened by analysis of Constitutional Court decisions, scholarly articles, and Qur'anic interpretation. The findings indicate that restricting the right to resign aligns not only with the principles of constitutional democracy and legal justice but also with the principles of trust (amanah) and justice in Islamic political jurisprudence. The verse QS Al-Ahzab [33]:72 provides a normative basis affirming the importance of exercising entrusted power with justice. Therefore, the state is obligated to formulate technical regulations as an implementation of the decision to ensure the protection of the people's votes and to prevent the manipulation of legislative power by political actors.

Abstract

This study explores the role of women in strengthening participatory monitoring in the 2024 Regional Head Election (Pilkada) in Metro City. Using a juridical-empirical approach, the research reveals that women play a strategic role in safeguarding electoral integrity, promoting inclusive political participation, and ensuring a transparent democratic process. Findings indicate that women's involvement remains limited, from village-level election monitors to Bawaslu commissioners. Therefore, affirmative support, political education, and equal participatory space are essential to enhance women's roles in sustainable election monitoring.

Abstract

Restorative justice is recognized in the criminal law system. Its primary goal is to resolve cases while respecting the values of justice for all parties involved. Restorative justice can be applied to minor to moderate crimes, such as embezzlement and fraud. Embezzlement and fraud are common crimes that frequently occur, causing grief in society. The results of this study are the implementation of settlement mechanisms and standard operating procedures for the implementation of restorative justice. Barriers to the implementation of restorative justice include a lack of police personnel, difficulty for the parties to reach an agreement, and not all cases qualifying for restorative justice.

Abstract

Articles 70 and 71 of the Notary Law regulate the authority and obligations of the Regional Supervisory Board (MPD) as the supervisory body for Notaries in Regencies/Cities. This descriptive analytical research using a normative legal approach examines the reporter's rights regarding MPD examination results, legal consequences of non-disclosure of examination results, and legal considerations in Decision No 161/PDT/2018/PT.Mdn. Reporters have the right to know the progress and final results of their report examination. The MPD's failure to communicate examination results constitutes maladministration that violates legal obligations and results in reporters losing their rights. In this decision, the Panel of Judges determined that the report did not meet administrative requirements, thus the MPD had the right not to proceed with material examination.

Abstract

Color protection as trademark faces harmonization challenges between international and national legal standards. The TRIPS Agreement recognizes color combinations with requirements of distinctiveness through secondary meaning and non-functionality, where developed countries like the United States and Australia even protect single colors as demonstrated in cases like Louboutin v. YSL. However, Indonesia through Law No. 20 of 2016 only recognizes "color arrangements" interpreted as combinations, hindering single color registration. Main obstacles include absence of technical guidelines for proving secondary meaning, imprecise color representation standards, high examiner discretion, and minimal jurisprudence. This creates legal vacuum and uncertainty for businesses, necessitating regulatory reform to recognize both single and combination color registration to provide legal certainty while aligning with international best practices.

Abstract

Defamation is an act that is prohibited by law because it can harm a person's good name and honor as regulated in Article 27 paragraph 3 and 45 paragraph 3 of Law of the Republic of Indonesia number 11 of 2008 concerning electronic transaction information. It is also found in Article 310 paragraphs 1 and 2 of the Criminal Code, Also contained in Article 310 paragraphs 1 and 2 of the Criminal Code, the aim of this research is to examine and understand the application of defamation law to Acehnese as well as the judge's considerations in imposing criminal sanctions on perpetrators of defamation. This type of research uses normative juridical using qualitative methods. From the results of this research, firstly, posts or images of writing were found that were intentionally caused by annoyance and hurt feelings, secondly, in the judge's consideration in making a decision based on the facts revealed.

Abstract

This research discusses the existence of embezzlement crimes against fiduciary collateral objects based on Law Number 42 of 1999 and its comparison with Article 372 of the Criminal Code. In practice, the transfer of fiduciary collateral objects often occurs due to economic pressures, a lack of legal understanding, and the assumption that fiduciary is only a civil matter. In fact, the Fiduciary Law contains criminal provisions in Article 36. This study highlights the dualism of legal regulation that creates legal uncertainty. This research aims to analyze the clarity of norms and legal protection for creditors through a normative legal approach based on Indonesian positive law.
