Abstract

AbstrakSatuan Lalu Lintas kepolisian resor Karangasem sebagai bagian dari anggota Kepolisian Negara Republik Indonesia memiliki peran penting dalam menanggulangai kecelakaan lalu lintas baik secara preventif maupun represif. Penelitian ini merupakan penelitian yuridis normative dengan dengan data sekunder yang tertdiri dari bahan hukum primer, sekunder dan tertier. Bahan-bahan hukum yang sudah terkumpul selanjutnya dianalisa secara yuridis kualitatif. Penelitian ini bertujuan untuk mengetahui upaya unit keamanan dan keselamatan satuan lalu lintas dalam mencegah tindak pidana kecelakaan lalu lintas di kepolisian resor Karangasem, dan factor penghambatnya. Hasil penelitian menunjukkan faktor-faktor yang menghambat Unit Keamanan dan Keselamatan Satuan lalu lintas dalam mencegah tindak pidana kecelakaan lalu lintas di Polres Karangasem, yaitu (1) Hambatan dalam Tindakan Preemtif berupa Kesadaran Tertib Berlalu Lintas sebagian Masyarakat Masih Rendah, dan Kompetensi Sebagian Guru Pendidikan Kewarganegaraan belum Memadai; (2) Hambatan dalam Tindakan Preventif berupa Personil Polisi Belum Memadai, dan Sarana Transportasi yang Belum Memadai;(3) Hambatan tindakan represif berupa, pengendara memiliki kekerabatan dengan polisi, dan apabila terjadi pelanggaran, pelanggar melarikan diri masuk desa.  Kata kunci: Lalu Lintas, Kecelakaan, dan Kepolisian.

Abstract

The use of electronic signatures for the parties in the notarial deed is still a matter of debate as to whether its validity is recognized or not. In practice, there are still many notaries who in signing a deed by the parties do not use electronic signatures because there is no clear arrangement regarding electronic signatures in notarial deeds. Therefore, the article will focus on the problem of the concept of electronic signatures that are in accordance with the laws and regulations and the validity of the use of electronic signatures in the partij akta. The research method is normative juridical with a statute approach and a conceptual approach. The results of this research are that basically electronic signatures have legal force and legal consequences as long as they meet the requirements regulated in the Electronic Information Electronic Law 2008 (Amendment 2016). However notarial deeds are not allowed to use electronic signatures according to Article 5 of the EIT Law 2008 (Amendment 2016). Notary as state officials must also create efficient public services by following existing technological developments by using electronic signatures to support e-government to create efficient public services. Therefore, the Government must also provide clear legal protection related to electronic signing for the parties in the notarial deed, mainly in the Notary Law and EIT Law.

Abstract

Trademarks as a form of protection for Intellectual Property Rights (IPR) have been used for a long time and have an important role, because the brand is one of the strategic efforts to promote business to the wider community. The number of creations causes the need to protect goods or services which in the production process use Intellectual Property Rights, to avoid the possibility of counterfeiting or unfair competition. Mark ownership rights based on laws and regulations are obtained through a constitutive registration system with the First to File principle, which means that trademark rights are acquired only for those who register for the first time. The reality is that there are still many cases of brand abuse committed by parties with bad intentions. The main issues discussed in this paper are the application of the First to File system in terms of ownership rights to the Samgong brand and the judge's considerations in deciding cases on the Supreme Court's decision Number 640 K/Pdt.Sus-HKI/2020. The type of research method used in this paper is a type of juridical-normative legal research method consisting of a statutory approach, a case approach and a conceptual approach. The results of the study on the decision of the Supreme Court Number 640 K/Pdt.Sus-HKI/2020 on the dispute over the Samgong brand, it can be said that the first to file system in the dispute has not been implemented. The judge also did not include international provisions as a consideration in deciding the dispute over the Samgong trademark. Keywords: Brand, First to File System, Bad Faith

Abstract

Simultaneous General Elections which are held every 5 (five) years create a momentum that cannot be underestimated. To achieve honest elections, election organizers with integrity are needed, election organizers consist of the KPU (General Election Commission), Bawaslu (Election Supervisory Body), and DKPP (Election Organizer Honorary Council). Bawaslu is a body formed by the government to supervise elections. The purpose of this research is to determine "The role of the Bekasi Regency General Election Supervisory Agency in General Election Criminal Violations in the Implementation of the 2024 General Election". The author identifies the problem, namely what is the role of the Election Supervisory Body in enforcing election crimes in 2024 in Bekasi Regency and what obstacles are faced by the Election Supervisory Body in carrying out its role in enforcing election crimes in 2024 in Bekasi Regency. This research method uses empirical research methods with techniques using primary data through interviews with members of the Bekasi Regency Bawaslu and secondary in the form of laws, regulations, and other literature. The results of the research show that Bawaslu Bekasi Regency has an important role, namely supervising election crimes in the form of prevention and prosecution. Bawaslu Bekasi Regency has obstacles in carrying out its role, internal obstacles namely the number of human resources which are limited by law, and external obstacles such as the general public who tend to be apathetic. The Bekasi Regency Bawaslu has been effective in handling election crimes, this is based on the completion of all reports received by the Bekasi Regency Bawaslu.

Abstract

AbstractLaw Number 11 of 2012 concerning the Juvenile Criminal Justice System regulates criminal sanctions and sanctions for actions against children. The Purbalingga District Court is one of the courts that applies sanctions in deciding cases of children in conflict with the law. In 2020 there was a court decision number 8/Pid.SusAnak/2020/PN.Pbg in the form of sanctions for the obligation to attend education at the Al Mujahadah Pagerandong Orphanage, Mrebet District, Purbalingga Regency for one year. The study's goal was to examine the effectiveness of imposing sanctions on perpetrators. criminal acts in the Purbalingga District Court's jurisdiction and impediments to enforcing sanctions against perpetrators of criminal acts in the Purbalingga District Court's jurisdiction. This research uses a sociological juridical approach with descriptive research specifications at the Purbalingga District Court and Purwokerto Bapas. The data sources in this research are primary data obtained through interviews and secondary data obtained through literature study which is presented in the form of descriptions and analyzed qualitatively. According to research findings, the effectiveness of imposing sanctions on criminal perpetrators in the juvenile criminal justice system under the jurisdiction of the Purbalingga district court has been effective because there has been no repetition of criminal acts. Legal substance, specifically the absence of relevant implementing regulations in the form of Government Regulations regarding actions that can be imposed on children, and legal structures, specifically a lack of coordination and human resources in terms of the number of community counselors, are impediments.Keywords: Effectivitness, Children, Action Sanctions, Juvenile Criminal Justice System. AbstrakUndang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak di dalamnya mengatur mengenai sanksi pidana dan sanksi tindakan terhadap anak. Pengadilan Negeri Purbalingga termasuk salah satu pengadilan yang menerapkan sanksi tindakan dalam memutus perkara anak yang berkonflik dengan hukum. Pada tahun 2020 terdapat putusan pengadilan nomor 8/Pid.SusAnak/2020/PN.Pbg berupa sanksi tindakan kewajiban mengikuti pendidikan di Panti Asuhan Al Mujahadah Pagerandong, Kecamatan Mrebet, Kabupaten Purbalingga selama satu tahun.Tujuan penelitian untuk menganalisis efektivitas penerapan sanksi tindakan terhadap pelaku tindak pidana dalam sistem peradilan pidana anak di wilayah hukum Pengadilan Negeri Purbalingga dan faktor penghambat dalam penerapan sanksi tindakan terhadap pelaku tindak pidana dalam sistem peradilan pidana anak di wilayah hukum Pengadilan Negeri Purbalingga. Penelitian ini menggunakan metode pendekatan yuridis sosiologis dengan spesifikasi penelitian deskriptif di Pengadilan Negeri Purbalingga dan Bapas Purwokerto. Sumber data dalam penelitian ini adalah data primer dan data sekunder. Pengumpulan data  primer dilakukan  dengan wawancara, data sekunder diperoleh dari studi pustaka. Data disajikan dalam bentuk uraian dan dianalisis secara kualitatif. Berdasarkan hasil penelitian efektivitas penerapan sanksi tindakan terhadap pelaku tindak pidana dalam sistem peradilan pidana anak di wilayah hukum pengadilan negeri Purbalingga sudah efektif karena belum ada pengulangan tindak pidana. Faktor penghambat meliputi substansi hukum yaitu belum ada peraturan pelaksanaan terkait berupa Peraturan Pemerintah tentang tindakan yang dapat dikenakan kepada anak dan struktur hukum yaitu kurangnya koordinasi serta kurangnya sumber daya manusia terkait jumlah pembimbing kemasyarakatan.Kata Kunci: Efektivitas, Anak, Sanksi Tindakan, Sistem Peradilan Pidana Anak.

Abstract

Village Council (BPD) plays an important role in the formation of village regulation (Perdes). Strengthening the role of BPD in legislation is an effort to improve the quality of village regulation products. This is outlined in Article 61 Village Law, BPD is an institution that embodies democracy in the administration of village governance that functions to accommodate and channel community aspirations, carry out the task of supervising the performance of the Village Head, and together with the Village Head, discuss and agree on the draft village regulation in Dawuhan Kulon Village during 2020-2023 was 24 Perdes’s. One person was purely an initiative for BPD. This research shows that the Dawuhan Kulon BPD, in its role in the initiative to create village regulations, has not been optimal, as seen from the number of Perdes produced. BPD's position in carrying out aspirations is carried out through community activities. BPD places itself as an extension of the village community. Activities are carried out to socialize information on village development, accommodate community aspirations for village regulations, and agree with the Village Head. Recommendations from this research are formulated such that the community is aware that village regulation is a legal product for the benefit of the community; therefore, the community also needs to be involved. The BPD should socialize with its citizens through Rukun Tetangga meetings if there will be discussions and the creation of Perdes.

Abstract

This research focuses on analyzing the implementation of mergers and acquisitions from the perspective of competition law through a comparison between Indonesian and Japanese laws. By conducting legal comparisons, it is hoped that points of improvement can be obtained for competition law in Indonesia in supervising the implementation of mergers and acquisitions. The research method used is doctrinal legal research (dogmatic legal research), with a legis-positivist approach that places the law synonymous with written rules compiled and promulgated by the authorities and sees the law as a normative system that stands alone, closed, and detached from society. Through this research, the author finds that the regulation of mergers and acquisitions in Indonesia from the perspective of competition law, when compared to Japan, is much slower in development. While countries like Japan have long embraced the pre-merger notification regime, Indonesia only adopted it in 2009, and it is regulated through the KPPU Regulation on Pre-Notification of Mergers, Consolidations, and Acquisitions (2009). This certainly creates a misalignment between the Unfair Competition Prohibition Law (1999), which adopts the post-merger notification regime, and the KPPU Regulation on Pre-Notification of Mergers, Consolidations, and Acquisitions (2009). Through this research, the author suggests that harmonization and synchronization between the post-merger notification approach adopted by the Unfair Competition Prohibition Law (1999) and the pre-merger notification approach adopted by the KPPU Regulation on Pre-Notification of Mergers, Consolidations, and Acquisitions (2009) are necessary. This is to avoid confusion among business actors and legal uncertainty that may distort the market.

Abstract

AbstractA crime that has recently occurred is the crime of falsifying a certificate of SWAB antigen results. Based on Decision Number 283/Pid.B/2022/PN Tjk, the Defendant Devi Susanti Binti Dirwan was legally and convincingly proven to have committed the crime of making a fake letter as regulated and punishable in Article 263 Paragraph (1) of the Criminal Code in the First Indictment.  The problem of this research is how the application of criminal sanctions against the perpetrators of the crime of falsification of antigen SWAB result certificate based on Decision Number 283/Pid.B/2022/PN Tjk? and How is the judge's consideration in deciding the case against the perpetrators of the crime of falsification of antigen SWAB result certificate based on Decision Number 283/Pid.B/2022/PN Tjk?. The research method uses normative and empirical juridical approaches. The types of data used are secondary data and primary data. Data collection through library research and field research. The data analysis used is qualitative juridical. The results showed that law enforcement against the perpetrator of the crime of falsifying the certificate of SWAB antigen results based on Decision Number 283/Pid.B/2022/PN Tjk the defendant was sentenced to imprisonment for 4 (four) years because he had violated the provisions of Article 263 Paragraph (1) of the Criminal Code.Keywords: Criminal Sanctions; Criminal act; Counterfeiting; Antigen SWAB. AbstrakTindak pidana yang baru-baru ini terjadi adalah tindak pidana pemalsuan surat keterangan hasil SWAB antigen. Berdasarkan Putusan Nomor 283/Pid.B/2022/PN Tjk menyatakan Terdakwa Devi Susanti Binti Dirwan, telah terbukti secara sah dan meyakinkan melakukan tindak pidana telah membuat surat palsu sebagaimana diatur dan diancam pidana dalam Pasal 263 Ayat (1) KUHPidana dalam dakwaan Kesatu.  Permasalahan penelitian ini adalah bagaimana penerapan sanksi pidana terhadap pelaku tindak pidana pemalsuan surat keterangan hasil SWAB antigen berdasarkan Putusan Nomor 283/Pid.B/2022/PN Tjk? dan Bagaimana pertimbangan hakim dalam memutuskan perkara terhadap pelaku tindak pidana pemalsuan surat keterangan hasil SWAB antigen berdasarkan Putusan Nomor 283/Pid.B/2022/PN Tjk?. Metode penelitian menggunakan pendekatan yuridis normatif dan empiris. Jenis data yang digunakan adalah data sekunder dan data primer. Pengumpulan data melalui penelitian kepustakaan (library research) dan penelitian lapangan (field research). Analisis data yang digunakan adalah yuridis kualitatif. Hasil penelitian menunjukkan penegakan hukum terhadap pelaku tindak pidana pemalsuan surat keterangan hasil SWAB antigen berdasarkan Putusan Nomor 283/Pid.B/2022/PN Tjk terdakwa dikenakan pidana penjara selama 4 (empat) tahun karena telah melanggar ketentuan Pasal 263 Ayat (1) KUHPidana.Kata Kunci: Pemalsuan, SWAB Antigen, Sanksi Pidana, Tindak Pidana.

Abstract

Women and children are the most vulnerable groups in society who tend to become victims of prostitution. Prostitution is a form of criminal act of human trafficking. Trafficking in persons is a violation of human rights and is an extraordinary, organized, and transnational crime. This research aims to determine the prevention of prostitution as a criminal act of trafficking in persons through penal measures and to determine the formulation of criminal sanctions against perpetrators of criminal acts of trafficking in persons for sexual exploitation. This research is normative juridical research with statutory and conceptual approach methods as well as descriptiveanalytical research specifications. The findings in this article are that the change in the regulation of prostitution from the Criminal Code to the Trafficking Law (2007) occurred because of a change in the paradigm of prostitution from an ordinary criminal act to a violation of human rights, this increased criminal sanctions from the aspects of staff (type) and strafmaat (weight). The formulation of acts regulated in the Criminal Code and the Trafficking Law (2007) are similar in terms of the substance of the criminal act, namely that they both ensnare perpetrators who act as intermediaries or pimps in human exploitation. However, there are differences in the construction of the weight of the criminal sanctions. The Criminal Code provides criminal threats with an alternative system, which allows judges to choose between imprisonment or a fine. Meanwhile, the Trafficking Law (2007) applies the danger of cumulative sanctions, where perpetrators can be charged with imprisonment and a fine at the same time. The formulation of criminal sanctions against perpetrators of criminal acts of human trafficking in the Trafficking Law (2007) is formulated with the pattern of increasing the severity of criminal threats (staff at). The increase in the severity of the threat of criminal sanctions aims to provide a more optimal deterrent to perpetrators of criminal acts of human trafficking.

Abstract

Every development impacts environmental changes, especially the exploitation of forest resources in managing and utilizing forest products, which affects these changes. In other words, exploitation of forest resources is a form of forest destruction. The Awyu Tribe indigenous community, accompanied by the Coalition to Save Papua Traditional Forests, is suing for an environmental permit for PT Indo Asiana Lestari (PT IAL) oil palm plantations. The indigenous people of West Papua firmly reject the plan to clear 36 thousand hectares of forest. If the project is implemented, the traditional forest, their livelihood source, will be lost, and their lives will be threatened. This research method uses a normative legal research approach. Who will search for, collect, and analyze qualitative, primary, and secondary legal materials with the aim of legal practice in the context of legal problem-solving? This approach has prescriptive characteristics, which assess what is right or wrong, appropriate or inappropriate. For the results of this research, a structured and careful framework is needed to handle this conflict. Therefore, the steps taken in conflict resolution must be wise and fair. In addition, conflict resolution policies must be able to take into account the aspirations and interests of local indigenous communities.Keywords: Customary forests; Environmental Permits; Indigenous communities
